國有資產監管大(da)格局(ju)的指導意見
為深入貫徹落實(shi)黨的十八大和十八屆三(san)中全(quan)會精神,進一步(bu)完善全(quan)區國有(you)資(zi)產(chan)(chan)監(jian)管(guan)體制,提高全(quan)區國有(you)資(zi)產(chan)(chan)監(jian)管(guan)水平,根據《中華人民(min)共(gong)和國企業國有(you)資(zi)產(chan)(chan)法(fa)(fa)》、《企業國有(you)資(zi)產(chan)(chan)監(jian)督管(guan)理暫行條例(li)》、《地方(fang)國有(you)資(zi)產(chan)(chan)監(jian)管(guan)工作指導(dao)監(jian)督辦法(fa)(fa)》(國務院國資(zi)委(wei)令第25號)等法(fa)(fa)律法(fa)(fa)規,結合實(shi)際,現就加強市、縣(xian)(市、區,以下簡(jian)稱縣(xian))國有(you)資(zi)產(chan)(chan)監(jian)管(guan)工作、加快構建(jian)全(quan)區國有(you)資(zi)產(chan)(chan)監(jian)管(guan)大格(ge)局,提出如下指導(dao)意見。
一、重要意義
市(shi)、縣(xian)(xian)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)工(gong)作是(shi)全(quan)區(qu)(qu)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)工(gong)作的(de)(de)重要組成部(bu)分。經過(guo)多年的(de)(de)改(gai)革發展,全(quan)區(qu)(qu)市(shi)、縣(xian)(xian)兩級(ji)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)體(ti)制機(ji)制不(bu)(bu)斷(duan)完(wan)(wan)善(shan)(shan),國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟布局結構不(bu)(bu)斷(duan)優(you)化(hua),國(guo)(guo)(guo)(guo)(guo)有(you)(you)企業(ye)規模質量(liang)不(bu)(bu)斷(duan)提升(sheng),市(shi)、縣(xian)(xian)兩級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)企成為推(tui)動本(ben)地區(qu)(qu)經濟社會發展的(de)(de)骨(gu)干力量(liang)。但是(shi),部(bu)分市(shi)、縣(xian)(xian)面臨著國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)體(ti)制不(bu)(bu)夠完(wan)(wan)善(shan)(shan)、履行國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產出資(zi)(zi)(zi)人職責不(bu)(bu)夠到位、國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)工(gong)作進(jin)展不(bu)(bu)夠平衡、企業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產基礎性管(guan)理工(gong)作與(yu)形(xing)勢(shi)任(ren)務(wu)要求(qiu)不(bu)(bu)適(shi)應(ying),以及國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)機(ji)構與(yu)有(you)(you)關部(bu)門的(de)(de)關系尚未完(wan)(wan)全(quan)理順、縣(xian)(xian)級(ji)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產出資(zi)(zi)(zi)人制度尚未完(wan)(wan)全(quan)落實、各級(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)聯(lian)合互動的(de)(de)工(gong)作機(ji)制尚未真(zhen)正建立等亟待解決的(de)(de)問題,影響國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)(jian)管(guan)工(gong)作和(he)國(guo)(guo)(guo)(guo)(guo)有(you)(you)企業(ye)改(gai)革的(de)(de)深(shen)入推(tui)進(jin),需要引起高度重視(shi)。
上級(ji)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管機構(gou)(gou)對(dui)下級(ji)政府國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管工作進(jin)(jin)行指導監(jian)督,是(shi)維(wei)護國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)“國(guo)(guo)家所有(you)(you)、分(fen)級(ji)代(dai)表”的(de)一項重(zhong)要制(zhi)度安排。加強指導監(jian)督工作,是(shi)加快(kuai)完善國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管體制(zhi)和(he)制(zhi)度的(de)內在(zai)要求,也是(shi)進(jin)(jin)一步加強國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管機構(gou)(gou)建(jian)設的(de)重(zhong)要措施,對(dui)于切實解(jie)決好(hao)市、縣國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管工作存在(zai)的(de)不(bu)到位、不(bu)平衡、不(bu)適應等問(wen)題(ti),提(ti)高國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管機構(gou)(gou)履職能(neng)力,加快(kuai)構(gou)(gou)建(jian)整(zheng)合協調(diao)、開放合作的(de)國(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)管大格局,實現(xian)各級(ji)國(guo)(guo)資(zi)(zi)融合發(fa)展(zhan)、聯動發(fa)展(zhan),更好(hao)地營造國(guo)(guo)有(you)(you)企業改革發(fa)展(zhan)的(de)良(liang)好(hao)環(huan)境,做強做優國(guo)(guo)有(you)(you)企業,促進(jin)(jin)全區經(jing)濟社會穩中求進(jin)(jin)、穩中向好(hao)發(fa)展(zhan)具有(you)(you)十分(fen)重(zhong)要的(de)意(yi)義。
二、總體要求
市(shi)(shi)、縣兩級(ji)政府(fu)要加(jia)強(qiang)對國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)工(gong)作(zuo)的(de)(de)(de)(de)領導(dao)(dao),按(an)(an)照國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)分級(ji)管(guan)(guan)理(li)(li)的(de)(de)(de)(de)原(yuan)則,進一步明(ming)確國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)的(de)(de)(de)(de)責任主(zhu)體(ti)。全區各級(ji)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)要在本級(ji)黨委(wei)、政府(fu)的(de)(de)(de)(de)領導(dao)(dao)下,堅持以鄧小平(ping)(ping)理(li)(li)論、“三個代表”重要思想和科(ke)學(xue)發展(zhan)觀(guan)為指(zhi)導(dao)(dao),深入貫徹(che)落實黨的(de)(de)(de)(de)十(shi)(shi)八大(da)、十(shi)(shi)八屆三中全會精(jing)神,緊緊圍繞推(tui)動國(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)上水平(ping)(ping)、國(guo)(guo)(guo)企(qi)(qi)(qi)發展(zhan)上臺(tai)階的(de)(de)(de)(de)“兩新目標”,以加(jia)強(qiang)地方(fang)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)建(jian)設(she)、推(tui)進經營(ying)性國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)集(ji)中統一監(jian)(jian)管(guan)(guan)、強(qiang)化企(qi)(qi)(qi)業國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)基礎管(guan)(guan)理(li)(li)為重點,按(an)(an)照以管(guan)(guan)資(zi)(zi)本為主(zhu)加(jia)強(qiang)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)的(de)(de)(de)(de)要求,充分發揮國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)本運營(ying)平(ping)(ping)臺(tai)作(zuo)用,努力(li)提(ti)高(gao)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)資(zi)(zi)本化、市(shi)(shi)場化、證券化水平(ping)(ping)。牢固樹立(li)各級(ji)國(guo)(guo)(guo)資(zi)(zi)“一盤棋”的(de)(de)(de)(de)理(li)(li)念,立(li)足“指(zhi)導(dao)(dao)、溝通、交流、服務”,加(jia)快健全緊密聯系、深度融合、有(you)(you)(you)效(xiao)整合的(de)(de)(de)(de)工(gong)作(zuo)系統,不斷完善指(zhi)導(dao)(dao)監(jian)(jian)督有(you)(you)(you)效(xiao)、互相(xiang)支(zhi)持有(you)(you)(you)力(li)、溝通協調順暢的(de)(de)(de)(de)工(gong)作(zuo)機制(zhi),推(tui)動構(gou)建(jian)國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)大(da)格局,努力(li)提(ti)升國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機構(gou)依法(fa)履行出資(zi)(zi)人職(zhi)責的(de)(de)(de)(de)能力(li)和水平(ping)(ping),為完善國(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)體(ti)制(zhi)機制(zhi)、促進國(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業改革發展(zhan)作(zuo)出新貢獻。
三、基本原則
(一)堅(jian)持(chi)國有資(zi)產屬于國家所有原則,落實國有資(zi)產監(jian)管(guan)責任,保障國有資(zi)產監(jian)管(guan)政策法規(gui)的貫徹實施。
(二)堅持(chi)各級(ji)(ji)(ji)政府分別代(dai)表國(guo)(guo)家履行(xing)出(chu)(chu)資人職(zhi)(zhi)責(ze)原(yuan)則(ze),各級(ji)(ji)(ji)國(guo)(guo)有資產(chan)監(jian)(jian)管(guan)機(ji)構(gou)(gou)應當根據本(ben)級(ji)(ji)(ji)政府授權(quan),按照法定職(zhi)(zhi)責(ze)和程序指導監(jian)(jian)督下級(ji)(ji)(ji)國(guo)(guo)有資產(chan)監(jian)(jian)管(guan)機(ji)構(gou)(gou)的工作,尊重和維護下級(ji)(ji)(ji)國(guo)(guo)有資產(chan)監(jian)(jian)管(guan)機(ji)構(gou)(gou)的出(chu)(chu)資人權(quan)利,不得代(dai)替或者干預下級(ji)(ji)(ji)國(guo)(guo)有資產(chan)監(jian)(jian)管(guan)機(ji)構(gou)(gou)履行(xing)出(chu)(chu)資人職(zhi)(zhi)責(ze)。
(三)堅持政(zheng)企分(fen)開、政(zheng)資(zi)(zi)(zi)(zi)分(fen)開、所有權(quan)和經營權(quan)分(fen)離(li)、政(zheng)府的(de)(de)社(she)會公共管(guan)理職(zhi)能與國有資(zi)(zi)(zi)(zi)產(chan)出資(zi)(zi)(zi)(zi)人職(zhi)能分(fen)開的(de)(de)原則(ze),完善經營性國有資(zi)(zi)(zi)(zi)產(chan)監管(guan)體制(zhi)機制(zhi),積極探索國有資(zi)(zi)(zi)(zi)產(chan)監管(guan)和運營的(de)(de)有效途徑和方式。
(四)堅持依法合規原則,加強分類(lei)指(zhi)導(dao),突出(chu)監督重(zhong)點,增強地方國(guo)有(you)資產(chan)監管(guan)工作的規范性(xing)和有(you)效性(xing)。
四、重點任務
(一)繼續深(shen)化(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革(ge)。要(yao)認真貫徹(che)落實(shi)黨的十(shi)八(ba)大、十(shi)八(ba)屆三中全(quan)會、自治區黨委十(shi)屆四(si)次全(quan)會精神,全(quan)面深(shen)化(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革(ge),各市、縣要(yao)相應(ying)成立(li)深(shen)化(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革(ge)領(ling)導小組,負責(ze)整體統(tong)籌推進改革(ge)工(gong)作,研(yan)究制定相關方(fang)案(an)措施,協調解決存在的問題,全(quan)力做好本級政府深(shen)化(hua)國(guo)資(zi)(zi)國(guo)企(qi)改革(ge)工(gong)作。
(二)健全(quan)完善國(guo)有(you)資(zi)產(chan)監(jian)管(guan)(guan)(guan)組織(zhi)體系(xi)。市、縣政(zheng)府(fu)要(yao)進一步加(jia)強國(guo)有(you)資(zi)產(chan)監(jian)管(guan)(guan)(guan)機(ji)(ji)構(gou)建(jian)設,堅持市級國(guo)資(zi)委政(zheng)府(fu)直屬特設機(ji)(ji)構(gou)性質(zhi)不變,明(ming)(ming)確(que)縣級國(guo)有(you)資(zi)產(chan)監(jian)管(guan)(guan)(guan)責任主體,積極探索符合(he)改革要(yao)求和(he)本地(di)實際的國(guo)有(you)資(zi)產(chan)監(jian)管(guan)(guan)(guan)有(you)效方式和(he)途徑,努力實現經營性國(guo)有(you)資(zi)產(chan)監(jian)管(guan)(guan)(guan)和(he)明(ming)(ming)確(que)縣級國(guo)資(zi)監(jian)管(guan)(guan)(guan)責任主體的“全(quan)覆蓋(gai)”。
(三)健(jian)全(quan)完善國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)制(zhi)度(du)(du)(du)(du)體(ti)系。市(shi)、縣國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)機構要依(yi)據《中華人民(min)共和國(guo)(guo)(guo)企(qi)業國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)法》和《企(qi)業國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)督(du)(du)管(guan)(guan)理暫(zan)行條(tiao)例》,在(zai)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)出(chu)資(zi)人制(zhi)度(du)(du)(du)(du)、國(guo)(guo)(guo)家(jia)出(chu)資(zi)企(qi)業制(zhi)度(du)(du)(du)(du)和國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)統一監(jian)(jian)管(guan)(guan)制(zhi)度(du)(du)(du)(du)三大制(zhi)度(du)(du)(du)(du)框架下,健(jian)全(quan)完善本地(di)區具(ju)體(ti)規章制(zhi)度(du)(du)(du)(du),形成監(jian)(jian)督(du)(du)有(you)力、管(guan)(guan)理科(ke)學、運作(zuo)高效的(de)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)制(zhi)度(du)(du)(du)(du)體(ti)系。要切實(shi)加(jia)強(qiang)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)法律、行政(zheng)法規和規章的(de)執行力度(du)(du)(du)(du),強(qiang)化(hua)監(jian)(jian)督(du)(du)檢查,確保各項制(zhi)度(du)(du)(du)(du)落實(shi)到(dao)位(wei)。
(四)健全(quan)(quan)完(wan)(wan)善國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)體(ti)系。市、縣國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)機(ji)構要深(shen)入(ru)探(tan)索國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)規(gui)律,進一(yi)(yi)步充實完(wan)(wan)善以發展戰略(lve)制定、主(zhu)業(ye)核定、業(ye)績考核、薪酬分(fen)(fen)(fen)(fen)配、企業(ye)領導人(ren)員任(聘(pin))免、財務(wu)監(jian)(jian)督(du)與評價、產(chan)(chan)(chan)(chan)權管(guan)(guan)(guan)(guan)理、監(jian)(jian)事會監(jian)(jian)督(du)、風險(xian)管(guan)(guan)(guan)(guan)控等為主(zhu)線的(de)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)閉環(huan),加快健全(quan)(quan)全(quan)(quan)區規(gui)則(ze)統(tong)一(yi)(yi)、分(fen)(fen)(fen)(fen)類分(fen)(fen)(fen)(fen)層、權責明確、運轉高效和規(gui)范(fan)透明的(de)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)體(ti)系。建立完(wan)(wan)善經營(ying)性(xing)(xing)國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)集中統(tong)一(yi)(yi)監(jian)(jian)管(guan)(guan)(guan)(guan)制度,推進全(quan)(quan)面實現(xian)政企分(fen)(fen)(fen)(fen)開(kai)、政資(zi)分(fen)(fen)(fen)(fen)開(kai)。根據基礎支撐、戰略(lve)引導、公益產(chan)(chan)(chan)(chan)品和服務(wu)、一(yi)(yi)般競爭性(xing)(xing)領域等不同(tong)功能定位,探(tan)索實行國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)分(fen)(fen)(fen)(fen)類監(jian)(jian)管(guan)(guan)(guan)(guan),提高國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)監(jian)(jian)管(guan)(guan)(guan)(guan)的(de)針對性(xing)(xing)有(you)效性(xing)(xing),全(quan)(quan)面落實國(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)(chan)保(bao)值(zhi)(zhi)增(zeng)值(zhi)(zhi)責任。
(五(wu))健全(quan)(quan)完善指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)工(gong)(gong)作機(ji)制。自治區和(he)市級(ji)國有(you)(you)資(zi)(zi)產監(jian)(jian)(jian)管機(ji)構(gou)要嚴格按照(zhao)《地方(fang)國有(you)(you)資(zi)(zi)產監(jian)(jian)(jian)管工(gong)(gong)作指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)辦法》(國務院國資(zi)(zi)委(wei)令(ling)第25號(hao))的規(gui)定,進(jin)一步明確指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)工(gong)(gong)作的主要職(zhi)責和(he)要求,充(chong)分發(fa)揮好指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)工(gong)(gong)作的引導(dao)(dao)(dao)、規(gui)范、提高(gao)和(he)促進(jin)作用。要加(jia)快(kuai)完善上(shang)下(xia)聯動、規(gui)范有(you)(you)序、全(quan)(quan)面覆蓋的指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)工(gong)(gong)作機(ji)制,始終堅持指導(dao)(dao)(dao)寓于服務之中,把指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)下(xia)級(ji)國有(you)(you)資(zi)(zi)產監(jian)(jian)(jian)管工(gong)(gong)作的重點放(fang)在(zai)加(jia)強監(jian)(jian)(jian)管機(ji)構(gou)建(jian)設與(yu)提高(gao)監(jian)(jian)(jian)管機(ji)構(gou)依法履職(zhi)的能力和(he)水平(ping)、指導(dao)(dao)(dao)地方(fang)國有(you)(you)經濟布局結構(gou)調整、指導(dao)(dao)(dao)和(he)支持國有(you)(you)企業改革發(fa)展(zhan)、加(jia)強國有(you)(you)資(zi)(zi)產基礎管理等重點環節(jie)上(shang),確保指導(dao)(dao)(dao)監(jian)(jian)(jian)督(du)及時有(you)(you)效(xiao)。
五、主要措施
(一)切實(shi)加(jia)強(qiang)(qiang)組織領導。市、縣政府要高度重(zhong)視國(guo)(guo)(guo)有資(zi)產監(jian)管(guan)(guan)工(gong)作(zuo)(zuo),充分認(ren)識在新形勢(shi)下加(jia)強(qiang)(qiang)和完善國(guo)(guo)(guo)有資(zi)產監(jian)管(guan)(guan)工(gong)作(zuo)(zuo)的(de)重(zhong)要意義,為(wei)開展監(jian)管(guan)(guan)工(gong)作(zuo)(zuo)創造(zao)必要條件。市、縣國(guo)(guo)(guo)有資(zi)產監(jian)管(guan)(guan)機構要把加(jia)強(qiang)(qiang)國(guo)(guo)(guo)資(zi)監(jian)管(guan)(guan)工(gong)作(zuo)(zuo)列入重(zhong)要議事日程,研究制(zhi)訂切實(shi)可行的(de)工(gong)作(zuo)(zuo)計(ji)劃和實(shi)施方案,落實(shi)工(gong)作(zuo)(zuo)職(zhi)責,加(jia)強(qiang)(qiang)督促(cu)檢查。條件成熟的(de)市可將(jiang)對(dui)縣級國(guo)(guo)(guo)有資(zi)產監(jian)管(guan)(guan)工(gong)作(zuo)(zuo)列入政府績效考評范圍。
(二)進一步明(ming)確(que)國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)責(ze)(ze)任主體。市、縣(xian)政府要(yao)建立(li)和完善本級(ji)國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)機構,做(zuo)到(dao)機構、人(ren)員、職能、責(ze)(ze)任“四到(dao)位(wei)”。國(guo)(guo)有資(zi)產數量較大、具(ju)備條件的(de)縣(xian)應設(she)立(li)獨立(li)的(de)國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)機構,暫不(bu)(bu)(bu)具(ju)備設(she)立(li)獨立(li)監(jian)管(guan)(guan)機構的(de)縣(xian)應明(ming)確(que)一個履(lv)行國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)職責(ze)(ze)的(de)部門或組(zu)建國(guo)(guo)有資(zi)產經營管(guan)(guan)理(li)公司授權統一監(jian)管(guan)(guan)。要(yao)認真(zhen)落實(shi)以管(guan)(guan)資(zi)本為主加強國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)的(de)要(yao)求,調(diao)整優化國(guo)(guo)有資(zi)產監(jian)管(guan)(guan)職能,突出履(lv)行出資(zi)人(ren)職責(ze)(ze)的(de)重點環節,做(zuo)到(dao)監(jian)管(guan)(guan)不(bu)(bu)(bu)缺位(wei)、不(bu)(bu)(bu)錯位(wei)、不(bu)(bu)(bu)越位(wei)。
(三)推動經營性國(guo)有資(zi)產集(ji)中統一監管。要切(qie)實轉變政府職能,加快(kuai)政企分開步伐,對仍由黨(dang)政機(ji)關管理的(de)企業(ye)和經營性資(zi)產要制定(ding)分離脫鉤(gou)方(fang)案和時(shi)間(jian)表(biao),盡快(kuai)納入國(guo)有資(zi)產監管機(ji)構實行統一監管。支持按照(zhao)出(chu)資(zi)關系(xi)對地(di)方(fang)金融、文化等(deng)領域經營性國(guo)有資(zi)產實行專業(ye)或授(shou)權監管。
(四)執行重大事(shi)項報(bao)(bao)(bao)告(gao)制度。市(shi)、縣國(guo)(guo)資(zi)監(jian)(jian)管(guan)機構(gou)要(yao)(yao)定期向(xiang)本(ben)級(ji)黨委、政府匯(hui)報(bao)(bao)(bao)本(ben)地區(qu)國(guo)(guo)資(zi)國(guo)(guo)企(qi)改革(ge)發展情(qing)(qing)況(kuang)以及(ji)國(guo)(guo)有(you)(you)資(zi)產總量、結構(gou)、變動(dong)、收益等匯(hui)總分析(xi)情(qing)(qing)況(kuang),圍繞當地經濟(ji)社會發展大局(ju)和(he)國(guo)(guo)有(you)(you)經濟(ji)改革(ge)發展狀況(kuang),提出相關意見建(jian)議。下級(ji)國(guo)(guo)有(you)(you)資(zi)產監(jian)(jian)管(guan)機構(gou)要(yao)(yao)將本(ben)地區(qu)國(guo)(guo)有(you)(you)經濟(ji)運行情(qing)(qing)況(kuang)以及(ji)所出資(zi)企(qi)業匯(hui)總月度及(ji)年度財務情(qing)(qing)況(kuang)向(xiang)上一級(ji)國(guo)(guo)有(you)(you)資(zi)產監(jian)(jian)管(guan)機構(gou)報(bao)(bao)(bao)告(gao)。下級(ji)國(guo)(guo)有(you)(you)資(zi)產監(jian)(jian)管(guan)機構(gou)出臺(tai)的規范(fan)性文件要(yao)(yao)向(xiang)上一級(ji)國(guo)(guo)有(you)(you)資(zi)產監(jian)(jian)管(guan)機構(gou)報(bao)(bao)(bao)備。
(五)加強指導(dao)(dao)監(jian)督工作(zuo)。根據逐級(ji)指導(dao)(dao)監(jian)督的(de)原則,上級(ji)國有資產(chan)監(jian)管(guan)(guan)機構應(ying)當加強與下級(ji)政府的(de)溝通(tong)(tong)協調,加強對(dui)下級(ji)國有資產(chan)監(jian)管(guan)(guan)工作(zuo)的(de)調研(yan)指導(dao)(dao),加強業務交(jiao)流和(he)培訓,及時總結推廣(guang)國有資產(chan)監(jian)管(guan)(guan)和(he)國有企業改革發展(zhan)的(de)典型經(jing)驗,通(tong)(tong)報開展(zhan)監(jian)督檢查情(qing)況。
(六)加強合作(zuo)(zuo)交(jiao)流(liu)。要(yao)(yao)進(jin)一步優化(hua)資(zi)(zi)源(yuan)(yuan)配置,按照市場經濟規(gui)律,大力推進(jin)各級(ji)國有(you)(you)資(zi)(zi)產(chan)開放性市場化(hua)有(you)(you)效整合、兼并重組,實現(xian)(xian)優勢互(hu)補、互(hu)利共贏。要(yao)(yao)進(jin)一步拓寬各級(ji)國有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)機(ji)構(gou)信息(xi)(xi)交(jiao)流(liu)渠道,建立健全國有(you)(you)資(zi)(zi)產(chan)基礎管(guan)理信息(xi)(xi)平臺(tai),大力推進(jin)信息(xi)(xi)交(jiao)流(liu)工作(zuo)(zuo)的制(zhi)度化(hua)、規(gui)范化(hua),逐步實現(xian)(xian)信息(xi)(xi)互(hu)通,數據共享。要(yao)(yao)積(ji)極搭建人才隊(dui)伍培養平臺(tai),健全完善(shan)各級(ji)國有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)機(ji)構(gou)之(zhi)間、國有(you)(you)資(zi)(zi)產(chan)監(jian)(jian)管(guan)機(ji)構(gou)與(yu)監(jian)(jian)管(guan)企(qi)業之(zhi)間的人員雙向交(jiao)流(liu)掛職(zhi)制(zhi)度,努力實現(xian)(xian)人才資(zi)(zi)源(yuan)(yuan)共享。
(七)嚴格實(shi)施監(jian)督(du)檢(jian)查(cha)。各級(ji)(ji)國有(you)(you)(you)資(zi)(zi)產監(jian)管機構要依(yi)法加強對下級(ji)(ji)政(zheng)府(fu)國有(you)(you)(you)資(zi)(zi)產監(jian)管工(gong)作的(de)監(jian)督(du)檢(jian)查(cha),上(shang)級(ji)(ji)國有(you)(you)(you)資(zi)(zi)產監(jian)管機構發(fa)現下級(ji)(ji)政(zheng)府(fu)國有(you)(you)(you)資(zi)(zi)產監(jian)管工(gong)作中(zhong)存在與國有(you)(you)(you)資(zi)(zi)產監(jian)管法律、行政(zheng)法規和國家方針政(zheng)策不符情形(xing)的(de),應當依(yi)法提(ti)出糾正意見(jian)或處理建議(yi)。
(八)著力(li)發展(zhan)地(di)方國有優(you)勢(shi)特(te)色企(qi)(qi)業(ye)(ye)。繼續推動(dong)國有企(qi)(qi)業(ye)(ye)加快轉(zhuan)型升級和(he)調整產業(ye)(ye)結構,推進自主(zhu)創新(xin)(xin)、優(you)化(hua)內部資(zi)(zi)源(yuan)配置,大力(li)發展(zhan)新(xin)(xin)型混合所有制企(qi)(qi)業(ye)(ye),推動(dong)國有資(zi)(zi)本(ben)、集體資(zi)(zi)本(ben)、非公有資(zi)(zi)本(ben)相互(hu)融合、優(you)勢(shi)互(hu)補、共同發展(zhan),探索(suo)改組或組建(jian)國有資(zi)(zi)本(ben)投資(zi)(zi)運營公司,加快打造一批具有競爭力(li)和(he)影響(xiang)力(li)的地(di)方優(you)勢(shi)特(te)色企(qi)(qi)業(ye)(ye)。
(九)大(da)力(li)加強自身建設。要大(da)力(li)推(tui)動國有資產(chan)監(jian)管(guan)機構專業化(hua)、規(gui)范(fan)化(hua)、制(zhi)度化(hua)建設,切實改進干部(bu)作風(feng)(feng),強化(hua)大(da)局意(yi)識(shi)(shi)、責(ze)任意(yi)識(shi)(shi)、服務意(yi)識(shi)(shi)、擔當意(yi)識(shi)(shi),提升履職能力(li),提高監(jian)管(guan)水平。要依法(fa)規(gui)范(fan)出(chu)資人(ren)行權履責(ze)的各項活動,重(zhong)視合法(fa)性、合規(gui)性審查,強化(hua)監(jian)督機制(zhi),防范(fan)法(fa)律風(feng)(feng)險,全面(mian)提高國有資產(chan)監(jian)管(guan)工作規(gui)范(fan)化(hua)水平。
