各地國資委積極推進完善國有資產管理體制

貫徹落(luo)實黨(dang)的(de)十(shi)九大(da)和十(shi)九屆二中、三中全會關于完善國(guo)有資產管理體制的(de)決策部署,各地圍繞以管資本為主積極(ji)推進(jin)職(zhi)能(neng)轉變,不斷深(shen)化國(guo)有資本投資、運營(ying)公司試點,持(chi)續推進(jin)經營(ying)性(xing)國(guo)有資產集(ji)中統一監管,各項(xiang)重點工作取得積極(ji)進(jin)展。

一(yi)(yi)、國(guo)(guo)資(zi)(zi)監管(guan)(guan)職(zhi)(zhi)能(neng)(neng)轉(zhuan)變(bian)(bian)取得階(jie)段(duan)性成(cheng)效。一(yi)(yi)是持(chi)續向以管(guan)(guan)資(zi)(zi)本(ben)為主(zhu)轉(zhuan)變(bian)(bian)。準確(que)把握出(chu)(chu)資(zi)(zi)人代表職(zhi)(zhi)責(ze)(ze)定位,依(yi)法厘清出(chu)(chu)資(zi)(zi)人履職(zhi)(zhi)邊界,以管(guan)(guan)資(zi)(zi)本(ben)為主(zhu)調整(zheng)優化(hua)監管(guan)(guan)職(zhi)(zhi)能(neng)(neng)和(he)方式。目前(qian)已有(you)16個地方出(chu)(chu)臺了(le)(le)職(zhi)(zhi)能(neng)(neng)轉(zhuan)變(bian)(bian)方案。四(si)川(chuan)對(dui)以管(guan)(guan)資(zi)(zi)本(ben)為主(zhu)的(de)原(yuan)則進行了(le)(le)細化(hua),強(qiang)化(hua)了(le)(le)對(dui)國(guo)(guo)有(you)資(zi)(zi)本(ben)運營質量(liang)、企(qi)業財(cai)務(wu)狀況和(he)產權(quan)(quan)流轉(zhuan)環節監管(guan)(guan)。二(er)是調整(zheng)優化(hua)內(nei)設(she)(she)(she)機(ji)構(gou)。通過(guo)整(zheng)合(he)(he)、新設(she)(she)(she)等方式科(ke)學設(she)(she)(she)置內(nei)設(she)(she)(she)機(ji)構(gou)和(he)職(zhi)(zhi)責(ze)(ze),著力(li)(li)優化(hua)監管(guan)(guan)流程(cheng)。深圳先后(hou)2次調整(zheng)機(ji)構(gou)設(she)(she)(she)置,強(qiang)化(hua)綜合(he)(he)研究、資(zi)(zi)本(ben)運作(zuo)、股(gu)東事(shi)(shi)(shi)務(wu)等出(chu)(chu)資(zi)(zi)人職(zhi)(zhi)能(neng)(neng)。貴州和(he)重慶整(zheng)合(he)(he)董事(shi)(shi)(shi)會(hui)(hui)職(zhi)(zhi)能(neng)(neng),成(cheng)立(li)董事(shi)(shi)(shi)會(hui)(hui)監事(shi)(shi)(shi)會(hui)(hui)工作(zuo)處,履行對(dui)企(qi)業董事(shi)(shi)(shi)會(hui)(hui)、監事(shi)(shi)(shi)會(hui)(hui)規(gui)范(fan)運作(zuo)和(he)履職(zhi)(zhi)管(guan)(guan)理職(zhi)(zhi)能(neng)(neng)。三是修訂(ding)完善權(quan)(quan)責(ze)(ze)清單(dan)。截至(zhi)目前(qian),已有(you)33個省(sheng)級國(guo)(guo)資(zi)(zi)委出(chu)(chu)臺了(le)(le)權(quan)(quan)責(ze)(ze)清單(dan),其(qi)中福(fu)建、西藏等10個地方根據實際(ji)情況,結合(he)(he)職(zhi)(zhi)能(neng)(neng)轉(zhuan)變(bian)(bian)要(yao)求(qiu),對(dui)已公(gong)布(bu)的(de)權(quan)(quan)責(ze)(ze)清單(dan)進行修訂(ding)與完善,進一(yi)(yi)步(bu)增(zeng)強(qiang)了(le)(le)權(quan)(quan)力(li)(li)配(pei)置的(de)科(ke)學性和(he)規(gui)范(fan)性。廣(guang)東以現(xian)有(you)權(quan)(quan)責(ze)(ze)清單(dan)為基點,編制印發了(le)(le)權(quan)(quan)責(ze)(ze)清單(dan)服(fu)務(wu)指南(nan),增(zeng)強(qiang)了(le)(le)清單(dan)管(guan)(guan)理的(de)可(ke)操作(zuo)性和(he)指引(yin)性。四(si)是大力(li)(li)推(tui)進簡政(zheng)(zheng)放權(quan)(quan)。按照(zhao)“放管(guan)(guan)服(fu)”要(yao)求(qiu),加(jia)大簡政(zheng)(zheng)放權(quan)(quan)力(li)(li)度,取消(xiao)、下放和(he)授權(quan)(quan)一(yi)(yi)批與管(guan)(guan)資(zi)(zi)本(ben)要(yao)求(qiu)不符的(de)職(zhi)(zhi)能(neng)(neng),把該放的(de)以及細、小(xiao)、散工作(zuo)事(shi)(shi)(shi)項(xiang)放下去、放到(dao)位。江蘇堅(jian)持(chi)“四(si)個一(yi)(yi)律精(jing)簡”的(de)原(yuan)則,對(dui)出(chu)(chu)資(zi)(zi)人審批事(shi)(shi)(shi)項(xiang)開展了(le)(le)4輪清理規(gui)范(fan)工作(zuo),累計取消(xiao)、下放17項(xiang),精(jing)簡幅(fu)度達(da)到(dao)50%。

二、國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)方(fang)(fang)式方(fang)(fang)法(fa)進一(yi)步優(you)化(hua)(hua)(hua)。一(yi)是(shi)注重分類監(jian)(jian)管(guan)(guan)(guan)(guan)和(he)分類考核(he)(he)。針對(dui)企(qi)(qi)業(ye)不同戰略(lve)定位和(he)發展目(mu)標(biao),研究(jiu)制定差異化(hua)(hua)(hua)的(de)(de)監(jian)(jian)管(guan)(guan)(guan)(guan)目(mu)標(biao)、監(jian)(jian)管(guan)(guan)(guan)(guan)重點和(he)監(jian)(jian)管(guan)(guan)(guan)(guan)措施,實施更(geng)加(jia)精準有(you)效(xiao)的(de)(de)分類監(jian)(jian)管(guan)(guan)(guan)(guan)。甘肅將(jiang)監(jian)(jian)管(guan)(guan)(guan)(guan)企(qi)(qi)業(ye)考核(he)(he)結(jie)(jie)果與薪酬分配聯(lian)動掛鉤,省屬(shu)企(qi)(qi)業(ye)負責人(ren)薪酬差距(ju)達到(dao)(dao)4.86倍。二是(shi)加(jia)強國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)信息化(hua)(hua)(hua)建(jian)設。創新監(jian)(jian)督(du)工(gong)作(zuo)方(fang)(fang)式方(fang)(fang)法(fa),運用信息化(hua)(hua)(hua)手(shou)段提(ti)升監(jian)(jian)管(guan)(guan)(guan)(guan)效(xiao)率(lv)和(he)有(you)效(xiao)性(xing)。河南在已有(you)的(de)(de)“一(yi)個(ge)專網(wang)、三(san)個(ge)系統(tong)”國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)平臺基礎上(shang),籌建(jian)全省統(tong)一(yi)的(de)(de)智能化(hua)(hua)(hua)國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)平臺,通(tong)過(guo)(guo)云計算、大數據、人(ren)工(gong)智能等技術(shu)手(shou)段實現全省國(guo)有(you)資(zi)(zi)(zi)產管(guan)(guan)(guan)(guan)理信息系統(tong)互聯(lian)、共(gong)享、實時監(jian)(jian)管(guan)(guan)(guan)(guan)。三(san)是(shi)提(ti)高(gao)國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)治化(hua)(hua)(hua)水平。結(jie)(jie)合國(guo)資(zi)(zi)(zi)國(guo)企(qi)(qi)改(gai)革進程(cheng),不斷加(jia)強國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)立法(fa)工(gong)作(zuo)。內(nei)蒙古(gu)(gu)制定的(de)(de)《內(nei)蒙古(gu)(gu)自治區(qu)企(qi)(qi)業(ye)國(guo)有(you)資(zi)(zi)(zi)產監(jian)(jian)督(du)管(guan)(guan)(guan)(guan)理條例》已經自治區(qu)人(ren)大常(chang)委會審(shen)(shen)議(yi)通(tong)過(guo)(guo),是(shi)繼湖北(bei)、山東(dong)后(hou)出臺的(de)(de)第3個(ge)國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)地方(fang)(fang)性(xing)法(fa)規。重慶(qing)全年對(dui)14件規范(fan)性(xing)文件和(he)121項涉(she)法(fa)議(yi)題進行合法(fa)性(xing)審(shen)(shen)查,審(shen)(shen)查率(lv)達100%。把(ba)合法(fa)性(xing)審(shen)(shen)查作(zuo)為重大決策(ce)前置程(cheng)序(xu),做到(dao)(dao)“決策(ce)先問法(fa)、違法(fa)不決策(ce)”,法(fa)律審(shen)(shen)核(he)(he)機制更(geng)加(jia)完善(shan)。

三(san)、國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司試點效(xiao)果逐步顯(xian)現(xian)。一是(shi)探索完(wan)善國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)授權經營(ying)(ying)(ying)體(ti)制。將改(gai)建(jian)(jian)組(zu)(zu)建(jian)(jian)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司作(zuo)為(wei)改(gai)革國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)授權經營(ying)(ying)(ying)體(ti)制,構建(jian)(jian)“以管(guan)(guan)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)為(wei)主”國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管(guan)(guan)模式(shi)的關(guan)鍵(jian)措施。截至目前,各地完(wan)成改(gai)組(zu)(zu)組(zu)(zu)建(jian)(jian)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司104家,在體(ti)制設(she)計上(shang)均明確國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)作(zuo)為(wei)出資(zi)(zi)(zi)(zi)(zi)(zi)(zi)人,對國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司履行出資(zi)(zi)(zi)(zi)(zi)(zi)(zi)人職責。二是(shi)促進(jin)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)源優化配置(zhi)。推(tui)(tui)(tui)(tui)動(dong)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)向(xiang)關(guan)系國(guo)(guo)(guo)家安全、國(guo)(guo)(guo)民經濟(ji)命脈和(he)國(guo)(guo)(guo)計民生的重(zhong)要行業(ye)和(he)關(guan)鍵(jian)領域、重(zhong)點基礎設(she)施集中(zhong)(zhong),向(xiang)前瞻性戰略(lve)性產業(ye)集中(zhong)(zhong),向(xiang)具有(you)(you)核心競爭力的優勢企(qi)(qi)(qi)(qi)業(ye)集中(zhong)(zhong)。引導投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司立足功能定位,通(tong)(tong)過(guo)市場化手段(duan)盤活(huo)存量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)、優化增(zeng)量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)。陜西積極推(tui)(tui)(tui)(tui)動(dong)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司通(tong)(tong)過(guo)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)設(she)立、股權收購等方式(shi),進(jin)入航空、新(xin)材料和(he)半導體(ti)激光(guang)芯片(pian)產業(ye)。貴州(zhou)指導投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司規范發行企(qi)(qi)(qi)(qi)業(ye)債(zhai)券,盤活(huo)存量資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben),推(tui)(tui)(tui)(tui)進(jin)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)產證券化。三(san)是(shi)助力企(qi)(qi)(qi)(qi)業(ye)“處(chu)僵治困”。通(tong)(tong)過(guo)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司推(tui)(tui)(tui)(tui)進(jin)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)源整合和(he)“僵尸企(qi)(qi)(qi)(qi)業(ye)”處(chu)置(zhi),推(tui)(tui)(tui)(tui)動(dong)困難(nan)企(qi)(qi)(qi)(qi)業(ye)實(shi)現(xian)扭(niu)虧為(wei)盈。天津將國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司作(zuo)為(wei)供給側結構性改(gai)革平(ping)臺(tai),為(wei)企(qi)(qi)(qi)(qi)業(ye)債(zhai)務提供增(zeng)信支持,推(tui)(tui)(tui)(tui)動(dong)市管(guan)(guan)企(qi)(qi)(qi)(qi)業(ye)化解債(zhai)務風(feng)險(xian)。重(zhong)慶組(zu)(zu)建(jian)(jian)渝康資(zi)(zi)(zi)(zi)(zi)(zi)(zi)產管(guan)(guan)理公(gong)(gong)(gong)司作(zuo)為(wei)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)本(ben)(ben)投(tou)(tou)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)(gong)司中(zhong)(zhong)專司不良資(zi)(zi)(zi)(zi)(zi)(zi)(zi)產處(chu)置(zhi)的專業(ye)公(gong)(gong)(gong)司。

四、經(jing)營(ying)(ying)性(xing)(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)集(ji)(ji)中(zhong)(zhong)統(tong)一(yi)(yi)(yi)監(jian)(jian)管(guan)(guan)成(cheng)效(xiao)明顯。一(yi)(yi)(yi)是(shi)加強頂層設計(ji)和組織推(tui)動。將推(tui)進(jin)經(jing)營(ying)(ying)性(xing)(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)集(ji)(ji)中(zhong)(zhong)統(tong)一(yi)(yi)(yi)監(jian)(jian)管(guan)(guan)作為本地(di)區國(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)企(qi)改革文件的(de)重要內(nei)容,進(jin)一(yi)(yi)(yi)步(bu)明確政(zheng)企(qi)分開、政(zheng)資(zi)(zi)(zi)分開原則。安徽(hui)、江(jiang)蘇等19個地(di)方出(chu)臺(tai)了關于推(tui)進(jin)經(jing)營(ying)(ying)性(xing)(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)集(ji)(ji)中(zhong)(zhong)統(tong)一(yi)(yi)(yi)監(jian)(jian)管(guan)(guan)的(de)實施意見或專(zhuan)門文件。二是(shi)積極擴大(da)監(jian)(jian)管(guan)(guan)范(fan)圍(wei)。截至2017年底(di),全(quan)國(guo)(guo)(guo)省(sheng)級國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)經(jing)營(ying)(ying)性(xing)(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)(jian)管(guan)(guan)覆蓋面已經(jing)達到(dao)90%左右,較2012年提(ti)高(gao)了20個百分點。其(qi)中(zhong)(zhong)天津、山東、上海、陜西、福(fu)建、新疆兵團、大(da)連(lian)、青島(dao)、深圳已基(ji)本實現(xian)省(sheng)級經(jing)營(ying)(ying)性(xing)(xing)(xing)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產(chan)(chan)全(quan)部納(na)入國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)監(jian)(jian)管(guan)(guan),23個省(sheng)市將金融(rong)類企(qi)業(ye)納(na)入國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)監(jian)(jian)管(guan)(guan)范(fan)圍(wei)。三(san)是(shi)發揮國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)專(zhuan)業(ye)化監(jian)(jian)管(guan)(guan)優勢。在(zai)推(tui)進(jin)集(ji)(ji)中(zhong)(zhong)統(tong)一(yi)(yi)(yi)監(jian)(jian)管(guan)(guan)過(guo)程中(zhong)(zhong),注(zhu)重制度規則的(de)統(tong)一(yi)(yi)(yi),國(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)專(zhuan)業(ye)化、規范(fan)化水平(ping)不(bu)斷(duan)提(ti)升。北(bei)京、海南等地(di)將其(qi)他部門管(guan)(guan)理的(de)企(qi)業(ye)納(na)入國(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)統(tong)一(yi)(yi)(yi)的(de)基(ji)礎管(guan)(guan)理體系,實現(xian)了國(guo)(guo)(guo)家(jia)出(chu)資(zi)(zi)(zi)企(qi)業(ye)統(tong)一(yi)(yi)(yi)產(chan)(chan)權登記、統(tong)一(yi)(yi)(yi)資(zi)(zi)(zi)產(chan)(chan)統(tong)計(ji)、統(tong)一(yi)(yi)(yi)考核評價。

6月6-7日,國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)(zi)委(wei)舉(ju)辦(ban)機關法(fa)治建設(she)專題培(pei)(pei)訓(xun)班。國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)(zi)委(wei)機關廳局、直屬單(dan)位和(he)省級國(guo)(guo)(guo)資(zi)(zi)委(wei)共80余人參加培(pei)(pei)訓(xun)。

2.“全面依法(fa)(fa)(fa)(fa)從嚴治(zhi)企重在‘全面’,關鍵(jian)是(shi)全面落實(shi)各級各部門(men)主體(ti)責任,決(jue)(jue)不能(neng)把法(fa)(fa)(fa)(fa)治(zhi)工作(zuo)‘一(yi)股腦’推給法(fa)(fa)(fa)(fa)務部門(men)或法(fa)(fa)(fa)(fa)務人員。主要負責人要切(qie)實(shi)承擔起領(ling)導責任,推動法(fa)(fa)(fa)(fa)治(zhi)工作(zuo)由(you)被動向(xiang)(xiang)主動轉(zhuan)(zhuan)變,由(you)單兵(bing)作(zuo)戰(zhan)向(xiang)(xiang)全員參與(yu)、齊抓共管轉(zhuan)(zhuan)變。分管領(ling)導要強化法(fa)(fa)(fa)(fa)治(zhi)意識,抓好分管領(ling)域規(gui)章(zhang)制度(du)建設和法(fa)(fa)(fa)(fa)律風險(xian)防范,及時(shi)解決(jue)(jue)好分管業務中遇到(dao)的各類法(fa)(fa)(fa)(fa)律問題。”

●中央企業法治(zhi)工作硬(ying)措施(shi)

1、中林集團:完善(shan)企業(ye)領導班子(zi)知識結構,在相(xiang)同條件下,優先提拔使用法治素養(yang)好、依法辦事能力強的(de)(de)干部(bu)。落(luo)實問責制(zhi)度,企業(ye)重(zhong)大經(jing)(jing)營活動因未經(jing)(jing)法律(lv)(lv)審核,或(huo)者雖經(jing)(jing)審核但未采納正確(que)法律(lv)(lv)意見而造成(cheng)重(zhong)大損失的(de)(de),要追究企業(ye)相(xiang)關領導人員(yuan)責任。
