國務院關于大力發展電子商務加快培育經濟新動力的意見

各(ge)省、自治區、直(zhi)(zhi)轄市(shi)人(ren)民政府(fu),國務院各(ge)部委、各(ge)直(zhi)(zhi)屬機(ji)構:

  近年來我國電(dian)(dian)子(zi)商務(wu)發(fa)(fa)(fa)展迅(xun)猛,不(bu)(bu)僅創(chuang)造(zao)了新(xin)(xin)(xin)的(de)(de)消費(fei)需求,引(yin)發(fa)(fa)(fa)了新(xin)(xin)(xin)的(de)(de)投資熱潮,開(kai)辟了就業(ye)(ye)(ye)增(zeng)收新(xin)(xin)(xin)渠道(dao),為(wei)(wei)大眾創(chuang)業(ye)(ye)(ye)、萬(wan)眾創(chuang)新(xin)(xin)(xin)提供了新(xin)(xin)(xin)空間,而且電(dian)(dian)子(zi)商務(wu)正加速與制(zhi)造(zao)業(ye)(ye)(ye)融合,推動(dong)服務(wu)業(ye)(ye)(ye)轉型升級,催生新(xin)(xin)(xin)興業(ye)(ye)(ye)態,成為(wei)(wei)提供公共(gong)(gong)產品、公共(gong)(gong)服務(wu)的(de)(de)新(xin)(xin)(xin)力量,成為(wei)(wei)經濟(ji)發(fa)(fa)(fa)展新(xin)(xin)(xin)的(de)(de)原(yuan)動(dong)力。與此同時,電(dian)(dian)子(zi)商務(wu)發(fa)(fa)(fa)展面(mian)臨管理(li)方(fang)式不(bu)(bu)適應、誠信(xin)體(ti)系不(bu)(bu)健全、市場(chang)秩(zhi)序不(bu)(bu)規范等問題,亟(ji)需采取措(cuo)施(shi)予以(yi)解決(jue)。當前,我國已進入全面(mian)建(jian)成小康社會的(de)(de)決(jue)定性(xing)階段,為(wei)(wei)減少束縛電(dian)(dian)子(zi)商務(wu)發(fa)(fa)(fa)展的(de)(de)機制(zhi)體(ti)制(zhi)障礙,進一(yi)步發(fa)(fa)(fa)揮電(dian)(dian)子(zi)商務(wu)在培(pei)育經濟(ji)新(xin)(xin)(xin)動(dong)力,打(da)造(zao)“雙引(yin)擎”、實現(xian)“雙目標”等方(fang)面(mian)的(de)(de)重要作用,現(xian)提出以(yi)下意(yi)見(jian):

  一(yi)、指導思想、基本原則和(he)主要目標(biao)

  (一)指導思想。全(quan)面貫徹黨的(de)(de)十八大和(he)(he)十八屆二中、三中、四(si)中全(quan)會精神,按照黨中央、國(guo)務(wu)院決策部署,堅持依靠改革(ge)推動(dong)科學發(fa)展,主(zhu)動(dong)適應和(he)(he)引領經濟(ji)發(fa)展新(xin)(xin)(xin)常態,著(zhu)力(li)解(jie)決電(dian)子商(shang)務(wu)發(fa)展中的(de)(de)深層次矛盾和(he)(he)重(zhong)大問題,大力(li)推進政策創(chuang)(chuang)新(xin)(xin)(xin)、管(guan)理(li)創(chuang)(chuang)新(xin)(xin)(xin)和(he)(he)服務(wu)創(chuang)(chuang)新(xin)(xin)(xin),加快建立開(kai)放、規范、誠(cheng)信、安全(quan)的(de)(de)電(dian)子商(shang)務(wu)發(fa)展環(huan)境,進一步激發(fa)電(dian)子商(shang)務(wu)創(chuang)(chuang)新(xin)(xin)(xin)動(dong)力(li)、創(chuang)(chuang)造潛(qian)力(li)、創(chuang)(chuang)業活(huo)力(li),加速推動(dong)經濟(ji)結構戰略(lve)性調整,實現(xian)經濟(ji)提質增效升級。

  (二)基本(ben)原則。一(yi)(yi)是積極(ji)(ji)推(tui)動(dong)。主動(dong)作為(wei)(wei)、支持(chi)發(fa)(fa)(fa)(fa)展。積極(ji)(ji)協調解(jie)決電(dian)子商(shang)(shang)務發(fa)(fa)(fa)(fa)展中的(de)各種矛盾與問題(ti)。在政府資(zi)源(yuan)開放、網絡安全保(bao)障、投(tou)融資(zi)支持(chi)、基礎設施和誠(cheng)信體系建設等方(fang)面加(jia)大服務力度(du)。推(tui)進(jin)電(dian)子商(shang)(shang)務企(qi)(qi)業(ye)(ye)(ye)稅費合理化,減輕企(qi)(qi)業(ye)(ye)(ye)負擔。進(jin)一(yi)(yi)步(bu)釋放電(dian)子商(shang)(shang)務發(fa)(fa)(fa)(fa)展潛力,提升(sheng)電(dian)子商(shang)(shang)務創(chuang)新發(fa)(fa)(fa)(fa)展水(shui)平。二是逐步(bu)規(gui)范。簡政放權(quan)、放管結合。法無禁止的(de)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)主體即可為(wei)(wei),法未授權(quan)的(de)政府部(bu)門不能(neng)為(wei)(wei),最(zui)大限度(du)減少對電(dian)子商(shang)(shang)務市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)的(de)行政干預。在放寬(kuan)市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)準入(ru)的(de)同時(shi),要在發(fa)(fa)(fa)(fa)展中逐步(bu)規(gui)范市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)秩序(xu),營造公平競爭的(de)創(chuang)業(ye)(ye)(ye)發(fa)(fa)(fa)(fa)展環境,進(jin)一(yi)(yi)步(bu)激發(fa)(fa)(fa)(fa)社會創(chuang)業(ye)(ye)(ye)活力,拓(tuo)(tuo)寬(kuan)電(dian)子商(shang)(shang)務創(chuang)新發(fa)(fa)(fa)(fa)展領域。三是加(jia)強(qiang)引(yin)(yin)(yin)導(dao)。把(ba)握趨勢、因勢利導(dao)。加(jia)強(qiang)對電(dian)子商(shang)(shang)務發(fa)(fa)(fa)(fa)展中前(qian)瞻性、苗頭性、傾向性問題(ti)的(de)研(yan)究(jiu),及時(shi)在商(shang)(shang)業(ye)(ye)(ye)模(mo)式創(chuang)新、關鍵技(ji)術研(yan)發(fa)(fa)(fa)(fa)、國際市(shi)(shi)(shi)場(chang)(chang)(chang)(chang)(chang)開拓(tuo)(tuo)等方(fang)面加(jia)大對企(qi)(qi)業(ye)(ye)(ye)的(de)支持(chi)引(yin)(yin)(yin)導(dao)力度(du),引(yin)(yin)(yin)領電(dian)子商(shang)(shang)務向打造“雙(shuang)引(yin)(yin)(yin)擎”、實現“雙(shuang)目標”發(fa)(fa)(fa)(fa)展,進(jin)一(yi)(yi)步(bu)增強(qiang)企(qi)(qi)業(ye)(ye)(ye)的(de)創(chuang)新動(dong)力,加(jia)速電(dian)子商(shang)(shang)務創(chuang)新發(fa)(fa)(fa)(fa)展步(bu)伐。

  (三(san))主要目(mu)標。到2020年,統一開放、競爭(zheng)有序、誠信守(shou)法(fa)、安(an)全可靠(kao)的電子商(shang)務(wu)大市(shi)場基本建成。電子商(shang)務(wu)與其他產業深度融合(he),成為促進(jin)創業、穩(wen)定就業、改善民生(sheng)服務(wu)的重要平臺,對工業化(hua)、信息(xi)化(hua)、城鎮化(hua)、農(nong)業現代化(hua)同步發展起到關鍵性作用。

  二、營造寬松發展(zhan)環境

  (四)降低準(zhun)入門(men)檻。全面清理電子商(shang)務(wu)(wu)領域(yu)(yu)現有(you)前置(zhi)審(shen)(shen)批事(shi)項,無法律法規依據的一(yi)(yi)律取消,嚴禁(jin)違法設定(ding)行(xing)政(zheng)許可、增加行(xing)政(zheng)許可條件和(he)程序(xu)。(國務(wu)(wu)院審(shen)(shen)改(gai)(gai)(gai)辦(ban),有(you)關部(bu)(bu)門(men)按職責(ze)分工(gong)分別(bie)負責(ze))進一(yi)(yi)步簡化(hua)注(zhu)冊(ce)資本登記(ji),深(shen)入推進電子商(shang)務(wu)(wu)領域(yu)(yu)由“先證(zheng)(zheng)后照(zhao)”改(gai)(gai)(gai)為“先照(zhao)后證(zheng)(zheng)”改(gai)(gai)(gai)革。(工(gong)商(shang)總局、中央編辦(ban))落(luo)實(shi)《注(zhu)冊(ce)資本登記(ji)制(zhi)(zhi)度改(gai)(gai)(gai)革方案》,放(fang)寬電子商(shang)務(wu)(wu)市場(chang)(chang)主體住(zhu)所(suo)(經營場(chang)(chang)所(suo))登記(ji)條件,完善相(xiang)關管(guan)理措施(shi)。(省(sheng)級人(ren)民政(zheng)府)推進對快遞企業(ye)設立非法人(ren)快遞末端網點實(shi)施(shi)備案制(zhi)(zhi)管(guan)理。(郵政(zheng)局)簡化(hua)境(jing)內電子商(shang)務(wu)(wu)企業(ye)海(hai)外上市審(shen)(shen)批流程,鼓勵電子商(shang)務(wu)(wu)領域(yu)(yu)的跨境(jing)人(ren)民幣直接(jie)投資。(發(fa)(fa)展改(gai)(gai)(gai)革委(wei)、商(shang)務(wu)(wu)部(bu)(bu)、外匯(hui)局、證(zheng)(zheng)監會、人(ren)民銀(yin)行(xing))放(fang)開外商(shang)投資電子商(shang)務(wu)(wu)業(ye)務(wu)(wu)的外方持股比例限制(zhi)(zhi)。(工(gong)業(ye)和(he)信息化(hua)部(bu)(bu)、發(fa)(fa)展改(gai)(gai)(gai)革委(wei)、商(shang)務(wu)(wu)部(bu)(bu))探(tan)索建立能源、鐵路、公(gong)共事(shi)業(ye)等行(xing)業(ye)電子商(shang)務(wu)(wu)服(fu)務(wu)(wu)的市場(chang)(chang)化(hua)機制(zhi)(zhi)。(有(you)關部(bu)(bu)門(men)按職責(ze)分工(gong)分別(bie)負責(ze))

  (五(wu))合理降稅減(jian)負。從(cong)事電子(zi)商(shang)務(wu)(wu)(wu)活動的(de)企(qi)業(ye),經(jing)認定(ding)為高(gao)新技術企(qi)業(ye)的(de),依法(fa)享受高(gao)新技術企(qi)業(ye)相(xiang)關優(you)惠(hui)政(zheng)(zheng)策,小微企(qi)業(ye)依法(fa)享受稅收優(you)惠(hui)政(zheng)(zheng)策。(科技部(bu)、財政(zheng)(zheng)部(bu)、稅務(wu)(wu)(wu)總局)加(jia)快推進“營(ying)改(gai)增”,逐步(bu)將(jiang)旅(lv)游電子(zi)商(shang)務(wu)(wu)(wu)、生活服務(wu)(wu)(wu)類(lei)電子(zi)商(shang)務(wu)(wu)(wu)等相(xiang)關行業(ye)納入“營(ying)改(gai)增”范圍。(財政(zheng)(zheng)部(bu)、稅務(wu)(wu)(wu)總局)

  (六)加大金(jin)(jin)融服(fu)務(wu)(wu)(wu)(wu)(wu)支持。建(jian)立健全適應電(dian)子(zi)商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)發展的(de)多(duo)元化、多(duo)渠道(dao)投融資(zi)機(ji)制。(有關(guan)部門(men)按職責(ze)分工(gong)分別負(fu)責(ze))研究鼓勵符合(he)條(tiao)件(jian)的(de)互聯網企業(ye)(ye)在境內上市(shi)等(deng)相關(guan)政(zheng)策(ce)。(證監會)支持商(shang)(shang)業(ye)(ye)銀(yin)行、擔(dan)保(bao)存貨管理(li)機(ji)構及電(dian)子(zi)商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)企業(ye)(ye)開展無(wu)形資(zi)產(chan)、動產(chan)質押等(deng)多(duo)種形式的(de)融資(zi)服(fu)務(wu)(wu)(wu)(wu)(wu)。鼓勵商(shang)(shang)業(ye)(ye)銀(yin)行、商(shang)(shang)業(ye)(ye)保(bao)理(li)機(ji)構、電(dian)子(zi)商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)企業(ye)(ye)開展供應鏈金(jin)(jin)融、商(shang)(shang)業(ye)(ye)保(bao)理(li)服(fu)務(wu)(wu)(wu)(wu)(wu),進一步拓(tuo)展電(dian)子(zi)商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)企業(ye)(ye)融資(zi)渠道(dao)。(人民銀(yin)行、商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)部)引導和推動創業(ye)(ye)投資(zi)基金(jin)(jin),加大對電(dian)子(zi)商(shang)(shang)務(wu)(wu)(wu)(wu)(wu)初創企業(ye)(ye)的(de)支持。(發展改革委)

  (七)維(wei)護公(gong)(gong)平競(jing)爭。規范電子(zi)(zi)商(shang)務(wu)(wu)市(shi)(shi)場(chang)(chang)競(jing)爭行(xing)(xing)(xing)為(wei),促(cu)進建(jian)立開放、公(gong)(gong)平、健(jian)康的(de)電子(zi)(zi)商(shang)務(wu)(wu)市(shi)(shi)場(chang)(chang)競(jing)爭秩序。研(yan)究制(zhi)定(ding)電子(zi)(zi)商(shang)務(wu)(wu)產(chan)品質量(liang)監督管(guan)(guan)理辦法(fa)(fa),探(tan)索建(jian)立風險監測、網上抽(chou)查(cha)、源頭追溯、屬地查(cha)處的(de)電子(zi)(zi)商(shang)務(wu)(wu)產(chan)品質量(liang)監督機(ji)制(zhi),完善部(bu)(bu)門(men)間(jian)、區域間(jian)監管(guan)(guan)信息(xi)共(gong)享和(he)職(zhi)能銜(xian)接機(ji)制(zhi)。依法(fa)(fa)打(da)擊網絡虛假(jia)宣(xuan)傳(chuan)、生產(chan)銷售假(jia)冒偽劣產(chan)品、違(wei)(wei)反國家(jia)出(chu)口管(guan)(guan)制(zhi)法(fa)(fa)規政(zheng)策跨境銷售兩(liang)用品和(he)技術(shu)、不正(zheng)當競(jing)爭等違(wei)(wei)法(fa)(fa)行(xing)(xing)(xing)為(wei),組織開展電子(zi)(zi)商(shang)務(wu)(wu)產(chan)品質量(liang)提(ti)升行(xing)(xing)(xing)動,促(cu)進合法(fa)(fa)、誠信經營。(工(gong)商(shang)總(zong)(zong)局(ju)(ju)、質檢總(zong)(zong)局(ju)(ju)、公(gong)(gong)安(an)部(bu)(bu)、商(shang)務(wu)(wu)部(bu)(bu)按(an)(an)職(zhi)責(ze)(ze)(ze)分工(gong)分別負責(ze)(ze)(ze))重點查(cha)處達(da)成壟斷協議和(he)濫(lan)用市(shi)(shi)場(chang)(chang)支配(pei)地位的(de)問(wen)題(ti),通過經營者(zhe)集中反壟斷審查(cha),防止(zhi)排除(chu)、限制(zhi)市(shi)(shi)場(chang)(chang)競(jing)爭的(de)行(xing)(xing)(xing)為(wei)。(發展改革委、工(gong)商(shang)總(zong)(zong)局(ju)(ju)、商(shang)務(wu)(wu)部(bu)(bu))加(jia)強電子(zi)(zi)商(shang)務(wu)(wu)領域知識(shi)產(chan)權保護,研(yan)究進一(yi)步加(jia)大(da)網絡商(shang)業(ye)方(fang)法(fa)(fa)領域發明專(zhuan)利保護力度(du)。(工(gong)業(ye)和(he)信息(xi)化(hua)部(bu)(bu)、商(shang)務(wu)(wu)部(bu)(bu)、海關(guan)總(zong)(zong)署、工(gong)商(shang)總(zong)(zong)局(ju)(ju)、新聞出(chu)版廣電總(zong)(zong)局(ju)(ju)、知識(shi)產(chan)權局(ju)(ju)等部(bu)(bu)門(men)按(an)(an)職(zhi)責(ze)(ze)(ze)分工(gong)分別負責(ze)(ze)(ze))進一(yi)步加(jia)大(da)政(zheng)府利用電子(zi)(zi)商(shang)務(wu)(wu)平臺進行(xing)(xing)(xing)采購的(de)力度(du)。(財政(zheng)部(bu)(bu))各級政(zheng)府部(bu)(bu)門(men)不得通過行(xing)(xing)(xing)政(zheng)命(ming)令指定(ding)為(wei)電子(zi)(zi)商(shang)務(wu)(wu)提(ti)供公(gong)(gong)共(gong)服(fu)務(wu)(wu)的(de)供應(ying)商(shang),不得濫(lan)用行(xing)(xing)(xing)政(zheng)權力排除(chu)、限制(zhi)電子(zi)(zi)商(shang)務(wu)(wu)的(de)競(jing)爭。(有關(guan)部(bu)(bu)門(men)按(an)(an)職(zhi)責(ze)(ze)(ze)分工(gong)分別負責(ze)(ze)(ze))

  三、促進就業(ye)創業(ye)

  (八)鼓勵(li)電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)領域(yu)就業(ye)(ye)(ye)創業(ye)(ye)(ye)。把發展(zhan)電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)促進(jin)就業(ye)(ye)(ye)納(na)入各(ge)地就業(ye)(ye)(ye)發展(zhan)規(gui)劃和電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)發展(zhan)整體規(gui)劃。建立電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)就業(ye)(ye)(ye)和社(she)會保(bao)障(zhang)指(zhi)標統計(ji)制度(du)。經(jing)工(gong)商(shang)(shang)(shang)(shang)(shang)(shang)登記(ji)注(zhu)冊的(de)網(wang)絡商(shang)(shang)(shang)(shang)(shang)(shang)戶從業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan),同(tong)等享受(shou)各(ge)項就業(ye)(ye)(ye)創業(ye)(ye)(ye)扶持(chi)(chi)政(zheng)策(ce)。未(wei)進(jin)行工(gong)商(shang)(shang)(shang)(shang)(shang)(shang)登記(ji)注(zhu)冊的(de)網(wang)絡商(shang)(shang)(shang)(shang)(shang)(shang)戶從業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan),可(ke)認定為(wei)靈(ling)活就業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan),享受(shou)靈(ling)活就業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan)扶持(chi)(chi)政(zheng)策(ce),其中(zhong)在網(wang)絡平臺實(shi)名注(zhu)冊、穩(wen)定經(jing)營且信譽(yu)良好的(de)網(wang)絡商(shang)(shang)(shang)(shang)(shang)(shang)戶創業(ye)(ye)(ye)者,可(ke)按(an)規(gui)定享受(shou)小(xiao)(xiao)額擔(dan)保(bao)貸款及貼(tie)息政(zheng)策(ce)。支持(chi)(chi)中(zhong)小(xiao)(xiao)微企業(ye)(ye)(ye)應(ying)用(yong)電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)、拓展(zhan)業(ye)(ye)(ye)務(wu)(wu)領域(yu),鼓勵(li)有條件的(de)地區(qu)建設電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)創業(ye)(ye)(ye)園區(qu),指(zhi)導(dao)各(ge)類創業(ye)(ye)(ye)孵(fu)化基地為(wei)電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)創業(ye)(ye)(ye)人(ren)(ren)(ren)員(yuan)提(ti)供場地支持(chi)(chi)和創業(ye)(ye)(ye)孵(fu)化服務(wu)(wu)。加強電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)企業(ye)(ye)(ye)用(yong)工(gong)服務(wu)(wu),完善電(dian)(dian)子(zi)(zi)(zi)商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)人(ren)(ren)(ren)才供求(qiu)信息對接機制。(人(ren)(ren)(ren)力資源社(she)會保(bao)障(zhang)部(bu)、工(gong)業(ye)(ye)(ye)和信息化部(bu)、商(shang)(shang)(shang)(shang)(shang)(shang)務(wu)(wu)部(bu)、統計(ji)局,地方各(ge)級人(ren)(ren)(ren)民政(zheng)府)
