近日,國(guo)務院(yuan)(yuan)國(guo)資委發布了《中(zhong)央(yang)企業工(gong)資總額管理辦(ban)法(fa)》(國(guo)資委令第39號,以下(xia)簡稱《辦(ban)法(fa)》)。《辦(ban)法(fa)》出臺后,國(guo)務院(yuan)(yuan)國(guo)資委有關負責同志接受了記者采訪。
問:請介紹《辦法》的起草背(bei)景(jing)。
答:中央企(qi)業(ye)(ye)(ye)(ye)工(gong)資總(zong)額(e)管理是調(diao)節國家(jia)、企(qi)業(ye)(ye)(ye)(ye)、職(zhi)工(gong)三(san)者利(li)益關系的(de)重要(yao)(yao)方式(shi),也是國資委(wei)依法履(lv)行出資人(ren)職(zhi)責的(de)重要(yao)(yao)手(shou)段,一直以(yi)來,在(zai)推動中央企(qi)業(ye)(ye)(ye)(ye)改革(ge)發展、確保(bao)國有資產保(bao)值(zhi)增值(zhi)方面發揮(hui)了重要(yao)(yao)作(zuo)用,同(tong)時,工(gong)資總(zong)額(e)管理又是關乎民生(sheng)福祉的(de)重要(yao)(yao)內容(rong),涉及中央企(qi)業(ye)(ye)(ye)(ye)廣大干部職(zhi)工(gong)的(de)切身利(li)益,歷來受到(dao)各方面的(de)高度關注。
國(guo)(guo)資(zi)委(wei)成立(li)以(yi)來,對(dui)完(wan)善工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)管(guan)(guan)理(li)(li)制(zhi)度(du)(du)做了(le)大量積極有效探索,總(zong)(zong)(zong)(zong)(zong)體上分為三個階段。第一(yi)(yi)階段為承接(jie)起(qi)步(bu)期(qi)(qi),從2003年(nian)(nian)至2007年(nian)(nian),國(guo)(guo)資(zi)委(wei)在(zai)依法承接(jie)原勞動(dong)保障(zhang)部門對(dui)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)監(jian)管(guan)(guan)職(zhi)能(neng)的(de)基礎上,從出(chu)資(zi)人(ren)的(de)角度(du)(du),持續(xu)對(dui)工(gong)(gong)(gong)(gong)效掛鉤管(guan)(guan)理(li)(li)辦(ban)法進(jin)(jin)行改(gai)(gai)革(ge)(ge)和(he)完(wan)善,初(chu)步(bu)構建(jian)了(le)出(chu)資(zi)人(ren)對(dui)企業(ye)(ye)(ye)(ye)的(de)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)調控(kong)(kong)體系,在(zai)促(cu)進(jin)(jin)企業(ye)(ye)(ye)(ye)經(jing)濟(ji)效益高速(su)增長的(de)同時(shi),保障(zhang)了(le)職(zhi)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)較快提高。第二(er)階段是改(gai)(gai)革(ge)(ge)突(tu)破(po)(po)期(qi)(qi),重點(dian)是探索和(he)建(jian)立(li)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)的(de)體制(zhi)機(ji)制(zhi)。2008年(nian)(nian)國(guo)(guo)資(zi)委(wei)在(zai)部分重點(dian)行業(ye)(ye)(ye)(ye)啟動(dong)了(le)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)試點(dian),著手(shou)建(jian)立(li)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)制(zhi)度(du)(du)體系,2010年(nian)(nian)、2012年(nian)(nian)先后印(yin)發了(le)《中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)暫行辦(ban)法》和(he)《中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)暫行辦(ban)法實(shi)施細則(ze)》,2014年(nian)(nian)實(shi)現(xian)了(le)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)全覆蓋。這個時(shi)期(qi)(qi)的(de)改(gai)(gai)革(ge)(ge)突(tu)破(po)(po),在(zai)中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)構建(jian)起(qi)了(le)既符合現(xian)代企業(ye)(ye)(ye)(ye)制(zhi)度(du)(du),又與中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)實(shi)際相結合的(de)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)制(zhi)度(du)(du)體系,也為全國(guo)(guo)國(guo)(guo)有企業(ye)(ye)(ye)(ye)全面(mian)實(shi)行工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)管(guan)(guan)理(li)(li)提供了(le)可復制(zhi)、可推廣(guang)的(de)經(jing)驗和(he)改(gai)(gai)革(ge)(ge)藍本。2014年(nian)(nian)以(yi)后,在(zai)深(shen)(shen)化國(guo)(guo)企改(gai)(gai)革(ge)(ge)的(de)大背景下(xia),工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)管(guan)(guan)理(li)(li)進(jin)(jin)入(ru)第三階段,即持續(xu)深(shen)(shen)化期(qi)(qi),重點(dian)以(yi)分類管(guan)(guan)理(li)(li)為手(shou)段,制(zhi)定(ding)了(le)工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)預算(suan)備案制(zhi)周期(qi)(qi)制(zhi)管(guan)(guan)理(li)(li)、工(gong)(gong)(gong)(gong)資(zi)總(zong)(zong)(zong)(zong)(zong)額(e)(e)特別獎勵(li)等一(yi)(yi)系列(lie)政策措施,進(jin)(jin)一(yi)(yi)步(bu)增強了(le)職(zhi)工(gong)(gong)(gong)(gong)收入(ru)分配調控(kong)(kong)的(de)針對(dui)性(xing)(xing)(xing)和(he)有效性(xing)(xing)(xing),在(zai)經(jing)濟(ji)發展(zhan)新常態下(xia),發揮了(le)助力中(zhong)央(yang)(yang)(yang)企業(ye)(ye)(ye)(ye)穩增長、激發和(he)調動(dong)企業(ye)(ye)(ye)(ye)干(gan)部職(zhi)工(gong)(gong)(gong)(gong)積極性(xing)(xing)(xing)的(de)重要作用。
黨(dang)的(de)十(shi)九大站在(zai)新(xin)的(de)歷史起(qi)點上(shang),明確我國(guo)(guo)經(jing)(jing)濟已經(jing)(jing)由(you)高(gao)速增長階(jie)段轉向高(gao)質(zhi)量發(fa)(fa)展階(jie)段,作出了(le)貫徹(che)新(xin)發(fa)(fa)展理念、實現高(gao)質(zhi)量發(fa)(fa)展的(de)部(bu)署,提(ti)出了(le)培育具(ju)有全球(qiu)競爭力(li)的(de)世界一(yi)流(liu)企(qi)(qi)業(ye)(ye)(ye)(ye)目標(biao)。按照黨(dang)中央(yang)(yang)(yang)、國(guo)(guo)務院(yuan)的(de)決策部(bu)署,以(yi)及《中共中央(yang)(yang)(yang) 國(guo)(guo)務院(yuan)關于(yu)深化(hua)國(guo)(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)改(gai)革的(de)指導意見》(中發(fa)(fa)〔2015〕22號,以(yi)下(xia)(xia)簡(jian)稱中發(fa)(fa)22號文件(jian))提(ti)出的(de)“建(jian)立健全與(yu)(yu)勞動力(li)市場基本適應、與(yu)(yu)企(qi)(qi)業(ye)(ye)(ye)(ye)經(jing)(jing)濟效益和勞動生產率(lv)掛(gua)鉤(gou)的(de)工(gong)資(zi)決定(ding)和正常增長機制”,即“一(yi)適應、兩掛(gua)鉤(gou)”的(de)總要求(qiu),人力(li)資(zi)源社(she)會保障部(bu)、財政部(bu)、國(guo)(guo)資(zi)委共同研究起(qi)草《關于(yu)改(gai)革國(guo)(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)決定(ding)機制的(de)意見》(以(yi)下(xia)(xia)簡(jian)稱《意見》),2018年5月,《意見》經(jing)(jing)由(you)中央(yang)(yang)(yang)全面(mian)深化(hua)改(gai)革委員(yuan)會第一(yi)次會議審議通過,國(guo)(guo)務院(yuan)正式印(yin)發(fa)(fa)。國(guo)(guo)資(zi)委作為共同牽(qian)頭(tou)單位(wei),在(zai)積極(ji)參與(yu)(yu)《意見》制定(ding)工(gong)作的(de)同時,根據(ju)《意見》精神,結合中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)(ye)(ye)改(gai)革發(fa)(fa)展的(de)實際情況(kuang),對中央(yang)(yang)(yang)企(qi)(qi)業(ye)(ye)(ye)(ye)工(gong)資(zi)總額管理制度體系進行全面(mian)修訂完善(shan),同步制定(ding)了(le)《辦法》。
作為《意(yi)見》在中央企業落地(di)落實的(de)配套文件(jian)制度,在近兩年的(de)起草制定過程中,國資(zi)(zi)委廣泛征求(qiu)了各有關部門、地(di)方國資(zi)(zi)委以及全部中央企業意(yi)見,期間數易(yi)其稿,最終由(you)國務院(yuan)國資(zi)(zi)委黨委會和(he)主任辦公(gong)會審議通過,以國務院(yuan)國資(zi)(zi)委令的(de)形式(shi)正式(shi)公(gong)布。
問:制定(ding)《辦法》的主要(yao)目的和意義(yi)是什么(me)。
答:《辦法(fa)》是國(guo)資委首(shou)次以委令形式公開發(fa)布的中央(yang)企(qi)業(ye)工資總(zong)額管理制度文(wen)件,充分體現了國(guo)資委對這(zhe)項(xiang)工作的高度重視。制定《辦法(fa)》的根本目的,是貫(guan)徹落(luo)實習近(jin)平新時代中國(guo)特色社會(hui)主(zhu)義思(si)想,增強(qiang)中央(yang)企(qi)業(ye)活力和競爭(zheng)力,促進中央(yang)企(qi)業(ye)實現高質量發(fa)展(zhan)。
中央企(qi)(qi)業(ye)(ye)(ye)工(gong)資總(zong)(zong)額管(guan)理,既(ji)要(yao)與國有(you)企(qi)(qi)業(ye)(ye)(ye)工(gong)資決(jue)定機(ji)制(zhi)改革的(de)(de)總(zong)(zong)體方向保持一致(zhi),又要(yao)充(chong)分(fen)體現中央企(qi)(qi)業(ye)(ye)(ye)自身的(de)(de)經營發展特點。此次出臺的(de)(de)《辦法》,緊扣《意見》的(de)(de)精神實質,切(qie)實做到了將出資人依法調(diao)控和(he)企(qi)(qi)業(ye)(ye)(ye)自主分(fen)配有(you)機(ji)結合。
一(yi)是明確(que)提出(chu)按中(zhong)央(yang)企(qi)業(ye)(ye)功能(neng)定位(wei)對工資(zi)總(zong)額(e)實行分類管(guan)理。此次(ci)改革的(de)重要創(chuang)新點之一(yi)就是分類管(guan)理,將工資(zi)總(zong)額(e)預(yu)算備案制管(guan)理的(de)實施范圍,擴大到全部主業(ye)(ye)處于(yu)充分競(jing)爭行業(ye)(ye)和領域(yu)的(de)商(shang)業(ye)(ye)類中(zhong)央(yang)企(qi)業(ye)(ye),由(you)企(qi)業(ye)(ye)董事會(hui)依(yi)法依(yi)規自主決定年度工資(zi)總(zong)額(e)預(yu)算,國資(zi)委由(you)事前(qian)核準轉變為事前(qian)引導、事中(zhong)監測和事后監督。
二(er)是明確提(ti)出了對中央(yang)企(qi)業工(gong)資總額實行分(fen)級管理。國(guo)資委負責管制度、管總量、管監督,中央(yang)企(qi)業負責管內部自主分(fen)配、管預算分(fen)解落實、管具體操作執行,國(guo)資委與中央(yang)企(qi)業權責清晰、各司其職(zhi)。
三是進一(yi)(yi)(yi)(yi)步完善中央企(qi)業(ye)(ye)工(gong)(gong)資總(zong)額(e)與經濟效(xiao)益(yi)掛鉤決定(ding)(ding)(ding)機(ji)制。《辦法(fa)》圍(wei)繞建立(li)健全(quan)“一(yi)(yi)(yi)(yi)適應、兩掛鉤”工(gong)(gong)資決定(ding)(ding)(ding)機(ji)制的(de)目標要求,進行了(le)(le)一(yi)(yi)(yi)(yi)系(xi)列重大(da)創(chuang)新。如(ru)明確了(le)(le)中央企(qi)業(ye)(ye)工(gong)(gong)資總(zong)額(e)根(gen)據效(xiao)益(yi)決定(ding)(ding)(ding),并按照效(xiao)率(lv)調整,進一(yi)(yi)(yi)(yi)步豐(feng)富了(le)(le)工(gong)(gong)資與效(xiao)益(yi)掛鉤的(de)內涵,全(quan)面樹(shu)立(li)“工(gong)(gong)資是掙出來”的(de)核心理(li)念。再比如(ru)《辦法(fa)》進一(yi)(yi)(yi)(yi)步簡化了(le)(le)出資人(ren)根(gen)據國(guo)家要求調控(kong)企(qi)業(ye)(ye)工(gong)(gong)資水平的(de)規定(ding)(ding)(ding),突出了(le)(le)出資人(ren)以管資本為主加強監管、簡政放(fang)權的(de)管理(li)導向,釋放(fang)了(le)(le)積極的(de)改革信(xin)號。同時,《辦法(fa)》還(huan)明確了(le)(le)企(qi)業(ye)(ye)同口徑增人(ren)不(bu)增工(gong)(gong)資總(zong)額(e)、減(jian)(jian)人(ren)不(bu)減(jian)(jian)工(gong)(gong)資總(zong)額(e)的(de)有關規定(ding)(ding)(ding),鼓勵中央企(qi)業(ye)(ye)提高用人(ren)效(xiao)率(lv)。
四是進(jin)一(yi)步強調深化企業(ye)內部(bu)分配制(zhi)(zhi)度改革(ge)。《辦法》在(zai)宏觀層面完善國家、企業(ye)和職工(gong)(gong)三(san)者工(gong)(gong)資分配關系的(de)同時,強調企業(ye)作(zuo)為(wei)內部(bu)分配的(de)責(ze)任主(zhu)體,應當持續深化內部(bu)三(san)項制(zhi)(zhi)度改革(ge),構(gou)建形(xing)成(cheng)企業(ye)內部(bu)管理人員能(neng)上能(neng)下、員工(gong)(gong)能(neng)進(jin)能(neng)出、收入(ru)能(neng)增能(neng)減的(de)市場(chang)化勞動(dong)用工(gong)(gong)和收入(ru)分配管理機制(zhi)(zhi),切實承擔起(qi)搞好、搞活企業(ye)內部(bu)分配的(de)職責(ze)。
五(wu)是進一步(bu)強(qiang)調工資總(zong)(zong)額(e)管(guan)理的(de)監督檢查(cha)(cha),明(ming)確(que)界定(ding)企(qi)業的(de)違規責任。如明(ming)確(que)對(dui)于實施備案(an)制(zhi)管(guan)理的(de)企(qi)業,出(chu)現嚴重違反(fan)國家(jia)和國資委(wei)關(guan)于收入(ru)分配有(you)關(guan)規定(ding)的(de),將其工資總(zong)(zong)額(e)預(yu)算管(guan)理方(fang)式由備案(an)制(zhi)調整(zheng)為核(he)準制(zhi),確(que)保做到權責對(dui)等。同時,《辦(ban)法》明(ming)確(que)將企(qi)業工資總(zong)(zong)額(e)管(guan)理情況(kuang)納入(ru)各項監督檢查(cha)(cha)范圍,與審(shen)計、巡視等工作形成(cheng)合力,切實保證監管(guan)到位。
總(zong)的(de)來說,《辦(ban)法(fa)》較好地(di)體(ti)現(xian)了(le)中發(fa)22號文件的(de)改革(ge)(ge)要(yao)(yao)求,體(ti)現(xian)了(le)黨的(de)十九大提(ti)出(chu)(chu)的(de)堅持質量(liang)第一(yi)、效益優先的(de)發(fa)展理念,符(fu)(fu)合此前國有企(qi)業改革(ge)(ge)座談會提(ti)出(chu)(chu)強(qiang)化正向激勵的(de)有關精神,符(fu)(fu)合中央關于簡政放權、“放管服”的(de)改革(ge)(ge)要(yao)(yao)求,對促(cu)進(jin)中央企(qi)業實現(xian)高質量(liang)發(fa)展、推(tui)動國有資本做強(qiang)做優做大,加快(kuai)培育具(ju)有全(quan)球競爭力的(de)世界一(yi)流企(qi)業具(ju)有重要(yao)(yao)意義(yi)。
問:根據新(xin)的(de)《辦法(fa)》,中央企(qi)業職工(gong)工(gong)資總額(e)具體如何決定?

答:《辦法》于(yu)2019年在中央(yang)企(qi)業(ye)全面施(shi)行,此(ci)次對中央(yang)企(qi)業(ye)工(gong)(gong)(gong)資總額決定機制(zhi)和管理制(zhi)度體(ti)系(xi)進(jin)行全面改革(ge),事(shi)關(guan)(guan)中央(yang)企(qi)業(ye)改革(ge)發展,事(shi)關(guan)(guan)廣大企(qi)業(ye)職工(gong)(gong)(gong)切身(shen)利益,事(shi)關(guan)(guan)收入分配和諧有(you)序,涉及面廣、政策(ce)性強、影響力大。國(guo)資委將在今后一個時期,采(cai)取積極措(cuo)施(shi),統籌推(tui)進(jin)工(gong)(gong)(gong)作,確保《辦法》全面貫徹落(luo)實。
一是國資委將(jiang)按照《辦法》,全(quan)面部署2019年中央企業工資總額預算管理(li)相關工作。
二是加(jia)快相關配套文件(jian)的(de)正式出(chu)臺(tai)。包括《辦法》中工(gong)資(zi)(zi)決定(ding)機制(zhi)的(de)具體(ti)實(shi)施規程、備(bei)案制(zhi)管(guan)理實(shi)施方案、周期制(zhi)管(guan)理實(shi)施方案以及工(gong)資(zi)(zi)管(guan)理特(te)殊事項清單等,將盡(jin)快研(yan)究出(chu)臺(tai)完整的(de)工(gong)資(zi)(zi)管(guan)理政(zheng)策體(ti)系,以利企業執(zhi)行。
三(san)是(shi)加大政策(ce)(ce)宣貫和(he)培訓(xun)力度(du)。國資委將組織系列(lie)面向(xiang)中央(yang)企(qi)(qi)業(ye)的政策(ce)(ce)培訓(xun),通(tong)過(guo)政策(ce)(ce)宣講、專(zhuan)家解讀、專(zhuan)題培訓(xun)等多種(zhong)形式,確保各中央(yang)企(qi)(qi)業(ye)準確把握《辦(ban)法》精神實質(zhi),并推動(dong)中央(yang)企(qi)(qi)業(ye)制定和(he)完善本企(qi)(qi)業(ye)的工資總額管理制度(du)體(ti)系。
四是協同(tong)推(tui)進工(gong)資分(fen)配(pei)相(xiang)關配(pei)套改(gai)革(ge)(ge)。2019年(nian),國資委將進一(yi)步深入推(tui)進中(zhong)央企業內部三項制度改(gai)革(ge)(ge)工(gong)作,加快推(tui)進企業建立健全市場化(hua)勞(lao)動用工(gong)和收(shou)入分(fen)配(pei)管理機制,持(chi)續(xu)增(zeng)強企業活力與競爭力。同(tong)時(shi),在加大出資人(ren)授權改(gai)革(ge)(ge)的(de)同(tong)時(shi),加強對中(zhong)央企業工(gong)資分(fen)配(pei)合規性(xing)的(de)監督檢(jian)查,強化(hua)事中(zhong)監測和事后監督,確保權力放得下(xia)、接得住。
