一、主要負責人切實履行推進法治建設第一責任人職責
(一)深入學習貫徹習近平法治思想。國(guo)(guo)(guo)(guo)(guo)(guo)資委(wei)(wei)黨(dang)委(wei)(wei)書記(ji)、主任(ren)郝鵬嚴格(ge)貫(guan)徹(che)落(luo)實(shi)《中(zhong)(zhong)共中(zhong)(zhong)央辦(ban)公廳 國(guo)(guo)(guo)(guo)(guo)(guo)務院辦(ban)公廳關于(yu)印發〈黨(dang)政主要(yao)(yao)(yao)(yao)負責(ze)人(ren)(ren)履(lv)行(xing)推進(jin)法(fa)治(zhi)建(jian)設(she)第一責(ze)任(ren)人(ren)(ren)職責(ze)規定〉的通知》要(yao)(yao)(yao)(yao)求,始終把習(xi)(xi)近(jin)平法(fa)治(zhi)思(si)想作(zuo)為(wei)國(guo)(guo)(guo)(guo)(guo)(guo)資委(wei)(wei)系統法(fa)治(zhi)建(jian)設(she)的根本遵循,認真貫(guan)徹(che)落(luo)實(shi)黨(dang)中(zhong)(zhong)央關于(yu)法(fa)治(zhi)建(jian)設(she)的重大決策部署(shu),切實(shi)履(lv)行(xing)國(guo)(guo)(guo)(guo)(guo)(guo)資國(guo)(guo)(guo)(guo)(guo)(guo)企(qi)法(fa)治(zhi)建(jian)設(she)組織者、推動(dong)者和實(shi)踐(jian)者的職責(ze)。召開黨(dang)委(wei)(wei)會議(yi)(yi)傳(chuan)達學(xue)(xue)(xue)習(xi)(xi)習(xi)(xi)近(jin)平總(zong)書記(ji)在中(zhong)(zhong)央全面依法(fa)治(zhi)國(guo)(guo)(guo)(guo)(guo)(guo)委(wei)(wei)員(yuan)會第三次會議(yi)(yi)上的重要(yao)(yao)(yao)(yao)講話精(jing)神,部署(shu)依法(fa)防控疫(yi)情工(gong)作(zuo)。國(guo)(guo)(guo)(guo)(guo)(guo)資委(wei)(wei)黨(dang)委(wei)(wei)理論學(xue)(xue)(xue)習(xi)(xi)中(zhong)(zhong)心組集體深(shen)入學(xue)(xue)(xue)習(xi)(xi)習(xi)(xi)近(jin)平總(zong)書記(ji)在中(zhong)(zhong)央政治(zhi)局(ju)第二十次集體學(xue)(xue)(xue)習(xi)(xi)時的重要(yao)(yao)(yao)(yao)講話精(jing)神,邀請全國(guo)(guo)(guo)(guo)(guo)(guo)人(ren)(ren)大常委(wei)(wei)會法(fa)制工(gong)作(zuo)委(wei)(wei)員(yuan)會負責(ze)同(tong)志作(zuo)《中(zhong)(zhong)華人(ren)(ren)民共和國(guo)(guo)(guo)(guo)(guo)(guo)民法(fa)典》(以下(xia)簡稱(cheng)《民法(fa)典》)專題講座,結(jie)合國(guo)(guo)(guo)(guo)(guo)(guo)資國(guo)(guo)(guo)(guo)(guo)(guo)企(qi)實(shi)際(ji)研究推動(dong)落(luo)實(shi)措(cuo)施。黨(dang)委(wei)(wei)會議(yi)(yi)專題傳(chuan)達學(xue)(xue)(xue)習(xi)(xi)中(zhong)(zhong)央全面依法(fa)治(zhi)國(guo)(guo)(guo)(guo)(guo)(guo)工(gong)作(zuo)會議(yi)(yi)精(jing)神,要(yao)(yao)(yao)(yao)求全面準確(que)學(xue)(xue)(xue)習(xi)(xi)領會習(xi)(xi)近(jin)平法(fa)治(zhi)思(si)想,深(shen)入開展學(xue)(xue)(xue)習(xi)(xi)宣傳(chuan)教育(yu)活動(dong),并就推進(jin)國(guo)(guo)(guo)(guo)(guo)(guo)資委(wei)(wei)系統法(fa)治(zhi)建(jian)設(she)作(zuo)出部署(shu)安排。
(二)加強國資國企法治建設的組織領導。深入研(yan)究謀劃(hua)國資國企(qi)法(fa)(fa)治(zhi)建設年度工(gong)作,確保法(fa)(fa)治(zhi)建設與其(qi)他重(zhong)點工(gong)作同(tong)步(bu)(bu)部(bu)署、同(tong)步(bu)(bu)推進(jin)、同(tong)步(bu)(bu)督(du)促。黨(dang)(dang)委會議(yi)專(zhuan)題(ti)(ti)傳達(da)學(xue)習中央政法(fa)(fa)工(gong)作會議(yi)精(jing)神,研(yan)究制(zhi)定貫徹落實措施。嚴格依法(fa)(fa)依規(gui)決策,健全重(zhong)大(da)決策法(fa)(fa)律(lv)審(shen)核機(ji)制(zhi),加強對規(gui)章規(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)和黨(dang)(dang)委規(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)的審(shen)核把關(guan)。及時研(yan)究解(jie)決法(fa)(fa)治(zhi)建設重(zhong)大(da)問題(ti)(ti),國資委黨(dang)(dang)委會議(yi)、委務會議(yi)專(zhuan)題(ti)(ti)審(shen)議(yi)立法(fa)(fa)工(gong)作計劃(hua)、黨(dang)(dang)委規(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)制(zhi)定計劃(hua)、重(zhong)要(yao)制(zhi)度文(wen)(wen)件(jian)(jian)(jian)以及法(fa)(fa)治(zhi)建設年度情況(kuang)報告等。統(tong)籌(chou)部(bu)署黨(dang)(dang)內(nei)法(fa)(fa)規(gui)制(zhi)度建設,組織研(yan)究制(zhi)定黨(dang)(dang)委規(gui)范(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian),確保黨(dang)(dang)內(nei)法(fa)(fa)規(gui)各項要(yao)求(qiu)在國資委系統(tong)落實落地(di)。
(三)強化對法治建設具體措施的指導督促。受(shou)國務(wu)院委托,向全國人(ren)大(da)常委會報告國資(zi)委系統監(jian)管(guan)企業國有(you)資(zi)產管(guan)理情況,認真接受(shou)人(ren)大(da)監(jian)督。部署推動(dong)重要法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規研究制(zhi)定工(gong)作,多次(ci)對(dui)配(pei)合做好《中華人(ren)民共(gong)和(he)國公司法(fa)(fa)(fa)》(以(yi)(yi)下簡(jian)稱(cheng)《公司法(fa)(fa)(fa)》)修訂等作出批(pi)示,組織研究起草(cao)《中華人(ren)民共(gong)和(he)國公職人(ren)員(yuan)政務(wu)處分(fen)法(fa)(fa)(fa)》(以(yi)(yi)下簡(jian)稱(cheng)《政務(wu)處分(fen)法(fa)(fa)(fa)》)有(you)關配(pei)套規定。專門就中央(yang)企業法(fa)(fa)(fa)治工(gong)作會議作出批(pi)示,對(dui)“十四五”時期法(fa)(fa)(fa)治央(yang)企建設工(gong)作提出明確要求。堅持重視法(fa)(fa)(fa)治素養和(he)法(fa)(fa)(fa)治能力的用(yong)人(ren)導向,推動(dong)將(jiang)“依法(fa)(fa)(fa)依規辦事(shi)、制(zhi)度執(zhi)行能力”等納入(ru)干部年度考核(he)指標。
二、2020年法治建設主要舉措和成效
(一)依法全面行權履職。一是(shi)(shi)持(chi)續推進(jin)(jin)職(zhi)能轉(zhuan)變(bian)重(zhong)點任務(wu)。加(jia)強組織推動(dong)(dong),建(jian)(jian)立健全(quan)(quan)職(zhi)能轉(zhuan)變(bian)工(gong)作(zuo)(zuo)季報機制(zhi)(zhi),定期(qi)梳理匯總(zong)工(gong)作(zuo)(zuo)進(jin)(jin)展。全(quan)(quan)面(mian)開(kai)展權責(ze)(ze)(ze)清單運(yun)行評估(gu),梳理調整權責(ze)(ze)(ze)事項(xiang),推進(jin)(jin)新版清單編制(zhi)(zhi)工(gong)作(zuo)(zuo)。加(jia)大(da)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)本(ben)投資(zi)(zi)(zi)、運(yun)營公司授權放權工(gong)作(zuo)(zuo)力(li)度,推動(dong)(dong)優化(hua)運(yun)營模式和經(jing)(jing)(jing)營機制(zhi)(zhi),更好(hao)服務(wu)實體經(jing)(jing)(jing)濟和科技創新。二是(shi)(shi)進(jin)(jin)一步(bu)加(jia)大(da)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)工(gong)作(zuo)(zuo)力(li)度。完善業務(wu)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)、綜(zong)合(he)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)、責(ze)(ze)(ze)任追究三位一體的(de)(de)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)工(gong)作(zuo)(zuo)格(ge)(ge)局(ju),指導(dao)推動(dong)(dong)中央企(qi)(qi)(qi)業不斷完善內(nei)控體系(xi)(xi)、內(nei)部審計等(deng)制(zhi)(zhi)度。深(shen)入開(kai)展國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產重(zhong)大(da)損失(shi)調查及違規經(jing)(jing)(jing)營投資(zi)(zi)(zi)責(ze)(ze)(ze)任追究,嚴(yan)防國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產流失(shi)。三是(shi)(shi)推動(dong)(dong)構(gou)建(jian)(jian)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)大(da)格(ge)(ge)局(ju)。組織召開(kai)構(gou)建(jian)(jian)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)大(da)格(ge)(ge)局(ju)工(gong)作(zuo)(zuo)推進(jin)(jin)會(hui),印發(fa)年(nian)度指導(dao)監(jian)(jian)(jian)(jian)(jian)(jian)督(du)地(di)方國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)工(gong)作(zuo)(zuo)計劃,全(quan)(quan)面(mian)部署年(nian)度重(zhong)點工(gong)作(zuo)(zuo)。經(jing)(jing)(jing)營性國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產集中統(tong)一監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)有(you)序(xu)推進(jin)(jin),省級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)比例(li)超過(guo)91%,全(quan)(quan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)24個地(di)方監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)比例(li)超過(guo)95%。四是(shi)(shi)加(jia)快建(jian)(jian)設國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)(qi)在線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)(xi)統(tong)。國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)(qi)在線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)(xi)統(tong)建(jian)(jian)設取得實質性進(jin)(jin)展,基(ji)本(ben)建(jian)(jian)成涉企(qi)(qi)(qi)事項(xiang)網上(shang)服務(wu)大(da)廳,35項(xiang)常規業務(wu)實現(xian)網上(shang)辦(ban)理,推動(dong)(dong)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)向(xiang)數(shu)字(zi)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)、智慧(hui)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)轉(zhuan)變(bian)。統(tong)籌推進(jin)(jin)全(quan)(quan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)企(qi)(qi)(qi)在線監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)系(xi)(xi)統(tong)建(jian)(jian)設,促(cu)進(jin)(jin)形(xing)成上(shang)下聯動(dong)(dong)的(de)(de)信息化(hua)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)格(ge)(ge)局(ju)。
(二)在法治軌道上扎實做好疫情防控和復工復產相關工作。一是加(jia)強(qiang)(qiang)組(zu)織領導(dao)(dao),健全(quan)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)機(ji)(ji)制。第(di)一時間(jian)成(cheng)立應對(dui)疫(yi)(yi)情(qing)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)領導(dao)(dao)小(xiao)組(zu),作(zuo)(zuo)(zuo)出(chu)全(quan)面(mian)部署,加(jia)強(qiang)(qiang)對(dui)國資委(wei)和(he)(he)中(zhong)央企業(ye)疫(yi)(yi)情(qing)防(fang)(fang)(fang)(fang)控工(gong)(gong)(gong)作(zuo)(zuo)(zuo)的領導(dao)(dao)。多措并(bing)舉(ju)(ju)確保(bao)國資委(wei)機(ji)(ji)關(guan)(guan)(guan)和(he)(he)直屬單位零感染(ran),主動(dong)(dong)(dong)作(zuo)(zuo)(zuo)為,及早成(cheng)立醫療物資保(bao)障(zhang)專(zhuan)項工(gong)(gong)(gong)作(zuo)(zuo)(zuo)組(zu)和(he)(he)境外(wai)疫(yi)(yi)情(qing)防(fang)(fang)(fang)(fang)控指(zhi)導(dao)(dao)組(zu),指(zhi)導(dao)(dao)企業(ye)依(yi)(yi)法(fa)(fa)(fa)做(zuo)好(hao)醫療物資保(bao)障(zhang)和(he)(he)境外(wai)疫(yi)(yi)情(qing)風險(xian)排查(cha)防(fang)(fang)(fang)(fang)控等(deng)(deng)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)。舉(ju)(ju)國資央企之力,盡銳(rui)出(chu)戰,奮力奪取疫(yi)(yi)情(qing)防(fang)(fang)(fang)(fang)控和(he)(he)經營發(fa)展雙勝利。二是強(qiang)(qiang)化疫(yi)(yi)情(qing)防(fang)(fang)(fang)(fang)控復(fu)工(gong)(gong)(gong)復(fu)產(chan)法(fa)(fa)(fa)治保(bao)障(zhang)。召開(kai)專(zhuan)題會議,對(dui)新冠病(bing)(bing)毒(du)(du)疫(yi)(yi)苗研(yan)(yan)發(fa)、使(shi)用(yong)(yong)(yong)、接種有關(guan)(guan)(guan)法(fa)(fa)(fa)律問題進行研(yan)(yan)究分(fen)析,指(zhi)導(dao)(dao)監督相關(guan)(guan)(guan)企業(ye)依(yi)(yi)法(fa)(fa)(fa)合(he)規開(kai)展新冠病(bing)(bing)毒(du)(du)疫(yi)(yi)苗研(yan)(yan)發(fa)生產(chan)和(he)(he)使(shi)用(yong)(yong)(yong)等(deng)(deng)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)。督促(cu)企業(ye)在做(zuo)好(hao)全(quan)面(mian)防(fang)(fang)(fang)(fang)控和(he)(he)確保(bao)依(yi)(yi)法(fa)(fa)(fa)合(he)規的前提下有序(xu)安排復(fu)工(gong)(gong)(gong)復(fu)產(chan)。配合(he)有關(guan)(guan)(guan)部門做(zuo)好(hao)動(dong)(dong)(dong)物防(fang)(fang)(fang)(fang)疫(yi)(yi)法(fa)(fa)(fa)、傳染(ran)病(bing)(bing)防(fang)(fang)(fang)(fang)治法(fa)(fa)(fa)修訂工(gong)(gong)(gong)作(zuo)(zuo)(zuo),開(kai)展野生動(dong)(dong)(dong)物保(bao)護領域法(fa)(fa)(fa)規、規章(zhang)、規范(fan)性文(wen)件(jian)(jian)清理。三(san)是指(zhi)導(dao)(dao)中(zhong)央企業(ye)依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)范(fan)涉(she)疫(yi)(yi)風險(xian)。印發(fa)《關(guan)(guan)(guan)于依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)控疫(yi)(yi)情(qing)切實防(fang)(fang)(fang)(fang)范(fan)法(fa)(fa)(fa)律合(he)規風險(xian)的通知》等(deng)(deng)制度(du)文(wen)件(jian)(jian),指(zhi)導(dao)(dao)企業(ye)加(jia)強(qiang)(qiang)研(yan)(yan)判(pan),切實防(fang)(fang)(fang)(fang)范(fan)防(fang)(fang)(fang)(fang)疫(yi)(yi)物資出(chu)口、境外(wai)施工(gong)(gong)(gong)等(deng)(deng)法(fa)(fa)(fa)律合(he)規風險(xian)。加(jia)強(qiang)(qiang)對(dui)境外(wai)項目(mu)較多的能源、建筑類(lei)企業(ye)依(yi)(yi)法(fa)(fa)(fa)防(fang)(fang)(fang)(fang)控境外(wai)疫(yi)(yi)情(qing)工(gong)(gong)(gong)作(zuo)(zuo)(zuo)的調研(yan)(yan)指(zhi)導(dao)(dao)。邀請有關(guan)(guan)(guan)專(zhuan)家就(jiu)疫(yi)(yi)情(qing)期間(jian)不可抗力原則適用(yong)(yong)(yong)和(he)(he)實務(wu)應對(dui)等(deng)(deng)問題作(zuo)(zuo)(zuo)專(zhuan)題培(pei)訓(xun)。

(四)完善國資監管法規制度體系。一(yi)是積極(ji)參與國(guo)(guo)家立法(fa)工作。深(shen)入開展《公司法(fa)》修改(gai)有(you)(you)關問題研究,組織(zhi)起(qi)草配套辦法(fa),推動《政務處分法(fa)》規定落(luo)實(shi)落(luo)地(di)。二是深(shen)入開展立改(gai)廢釋(shi)工作。編(bian)制2020年度(du)立法(fa)工作計劃,加大(da)計劃執行督促落(luo)實(shi)力度(du),圍繞業績考核(he)、章(zhang)(zhang)程管(guan)(guan)理、風險防范、產權管(guan)(guan)理等重(zhong)點出臺規范性(xing)文件(jian)16件(jian)。深(shen)入開展規章(zhang)(zhang)規范性(xing)文件(jian)清理。截至2020年底,國(guo)(guo)資(zi)委現行有(you)(you)效規章(zhang)(zhang)27件(jian),規范性(xing)文件(jian)221件(jian)。三是加強重(zhong)大(da)立法(fa)課題研究。完成完善國(guo)(guo)資(zi)監管(guan)(guan)法(fa)規制度(du)體系(xi)課題研究項目(mu),明(ming)確(que)“十四五”時期健全國(guo)(guo)資(zi)監管(guan)(guan)法(fa)規制度(du)體系(xi)的(de)目(mu)標(biao)任務。
(五)深入推進法治央企建設。一(yi)(yi)是(shi)開(kai)展(zhan)(zhan)法治(zhi)央(yang)企建(jian)設(she)總(zong)結驗收。全面總(zong)結5年來(lai)法治(zhi)央(yang)企建(jian)設(she)成效,深入查找短板和不足,及時推動整改提(ti)升。組(zu)織開(kai)展(zhan)(zhan)中(zhong)央(yang)企業優(you)秀總(zong)法律(lv)(lv)(lv)顧問、優(you)秀企業法律(lv)(lv)(lv)顧問和企業法律(lv)(lv)(lv)事務(wu)先進工(gong)作(zuo)者評比(bi)表彰,進一(yi)(yi)步激發企業法務(wu)人員工(gong)作(zuo)榮譽感和積極性。二是(shi)強化重點(dian)領(ling)域合(he)規(gui)(gui)管理。編印中(zhong)央(yang)企業合(he)規(gui)(gui)管理指南,指導(dao)企業切實防范(fan)合(he)規(gui)(gui)風(feng)險(xian)。三是(shi)夯(hang)實糾紛(fen)案(an)件(jian)管理。全面分析(xi)2019年中(zhong)央(yang)企業法律(lv)(lv)(lv)糾紛(fen)案(an)件(jian)特點(dian)及原因,針對性指導(dao)企業加大(da)案(an)件(jian)處置(zhi)力(li)度。開(kai)展(zhan)(zhan)建(jian)筑行業企業案(an)件(jian)管理“壓(ya)存控增、提(ti)質增效”專(zhuan)項行動。印發重大(da)案(an)件(jian)督(du)辦函,指導(dao)督(du)促企業切實維(wei)護合(he)法權益。
(六)扎實開展法治宣傳教育。一是(shi)突出法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣傳教育(yu)重(zhong)(zhong)(zhong)(zhong)點(dian)內(nei)(nei)容。將(jiang)學(xue)(xue)(xue)習(xi)領會習(xi)近平法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)思(si)想作為重(zhong)(zhong)(zhong)(zhong)大政治(zhi)(zhi)任務,切實(shi)發揮“關(guan)鍵少數”引領作用,國資委(wei)(wei)黨委(wei)(wei)帶(dai)頭認真學(xue)(xue)(xue)習(xi),吃(chi)透基本(ben)精神、把(ba)握核心要(yao)義、扎(zha)實(shi)抓好落實(shi)。將(jiang)《民(min)法(fa)(fa)(fa)(fa)(fa)(fa)典(dian)》等(deng)重(zhong)(zhong)(zhong)(zhong)要(yao)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)(fa)規納入國資委(wei)(wei)黨委(wei)(wei)理論學(xue)(xue)(xue)習(xi)中心組(zu)學(xue)(xue)(xue)習(xi)重(zhong)(zhong)(zhong)(zhong)要(yao)內(nei)(nei)容,有力(li)發揮領學(xue)(xue)(xue)促學(xue)(xue)(xue)作用。將(jiang)國資監管法(fa)(fa)(fa)(fa)(fa)(fa)規制(zhi)度文件作為法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣傳教育(yu)重(zhong)(zhong)(zhong)(zhong)要(yao)內(nei)(nei)容,及時通過(guo)網站、新媒體(ti)平臺對(dui)外公開(kai)(kai),采(cai)取多種(zhong)形式加強(qiang)宣傳解讀。二是(shi)開(kai)(kai)展法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設專(zhuan)題培訓。面(mian)向國資委(wei)(wei)系統機關(guan)干(gan)(gan)(gan)部(bu),舉辦(ban)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設專(zhuan)題培訓班(ban)(ban),提升(sheng)干(gan)(gan)(gan)部(bu)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)意識。面(mian)向中央企業、地(di)方(fang)國資委(wei)(wei)和國有企業,每兩月舉辦(ban)一期(qi)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)講(jiang)堂,邀請專(zhuan)家講(jiang)授《民(min)法(fa)(fa)(fa)(fa)(fa)(fa)典(dian)》等(deng)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)(fa)規,每期(qi)受眾超過(guo)2萬人(ren)。三是(shi)創新普法(fa)(fa)(fa)(fa)(fa)(fa)方(fang)式方(fang)法(fa)(fa)(fa)(fa)(fa)(fa)。持續提升(sheng)“互聯網+法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣傳”工作效能,充分利用門戶官網和微信公眾號等(deng)新媒體(ti)開(kai)(kai)展法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣傳教育(yu)。豐富普法(fa)(fa)(fa)(fa)(fa)(fa)活動,通過(guo)組(zu)織國家憲法(fa)(fa)(fa)(fa)(fa)(fa)日知識競賽、優秀微視頻作品征集、班(ban)(ban)組(zu)學(xue)(xue)(xue)習(xi)等(deng)形式,引導廣大干(gan)(gan)(gan)部(bu)職工不斷增強(qiang)法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)意識和法(fa)(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)能力(li)。
(七)持續加強黨內法規制度建設。一(yi)是(shi)編制(zhi)(zhi)(zhi)2020年黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定計劃,嚴格規(gui)范(fan)(fan)新增計劃外項目(mu)的報批(pi)程序(xu),不斷增強黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定的科學性(xing)(xing)、計劃性(xing)(xing)和嚴肅性(xing)(xing)。全年制(zhi)(zhi)(zhi)定黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)6件(jian)(jian)(jian)(jian)。二是(shi)健(jian)(jian)全黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定機制(zhi)(zhi)(zhi)。落(luo)實中(zhong)央(yang)黨(dang)(dang)內(nei)法規(gui)要求,研究(jiu)起(qi)草(cao)《國資委(wei)(wei)(wei)黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)制(zhi)(zhi)(zhi)定管理辦法》,進一(yi)步明確征求意見、前置審核、審議簽批(pi)等程序(xu)規(gui)定,不斷健(jian)(jian)全黨(dang)(dang)內(nei)法規(gui)工(gong)作(zuo)制(zhi)(zhi)(zhi)度(du)。認(ren)真(zhen)開(kai)展(zhan)黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)審查,按要求做好(hao)文(wen)(wen)件(jian)(jian)(jian)(jian)備案(an)工(gong)作(zuo)。三是(shi)加強對中(zhong)央(yang)企(qi)業(ye)(ye)(ye)黨(dang)(dang)內(nei)法規(gui)制(zhi)(zhi)(zhi)度(du)建設的指導督促。繼續開(kai)展(zhan)部分中(zhong)央(yang)企(qi)業(ye)(ye)(ye)黨(dang)(dang)委(wei)(wei)(wei)規(gui)范(fan)(fan)性(xing)(xing)文(wen)(wen)件(jian)(jian)(jian)(jian)備案(an)試點工(gong)作(zuo),將8家企(qi)業(ye)(ye)(ye)列(lie)入試點,推(tui)動企(qi)業(ye)(ye)(ye)黨(dang)(dang)內(nei)法規(gui)制(zhi)(zhi)(zhi)度(du)建設整(zheng)體水平進一(yi)步提升(sheng)。
三、存在問題和2021年工作打算
2020年(nian),國(guo)(guo)資(zi)委法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)取得了積極成效,但與黨中央、國(guo)(guo)務(wu)院的要(yao)求以(yi)及國(guo)(guo)資(zi)國(guo)(guo)企(qi)(qi)改(gai)革(ge)發展新(xin)形勢新(xin)要(yao)求相(xiang)比,還(huan)(huan)存在著一些問題和(he)(he)不足(zu):一是(shi)學(xue)習(xi)宣傳習(xi)近平(ping)法(fa)(fa)治(zhi)(zhi)思想還(huan)(huan)需要(yao)進一步(bu)深入,廣大干部職(zhi)工(gong)法(fa)(fa)治(zhi)(zhi)意識和(he)(he)法(fa)(fa)律(lv)素養(yang)仍(reng)需持(chi)續提(ti)升,運(yun)用法(fa)(fa)治(zhi)(zhi)思維和(he)(he)法(fa)(fa)治(zhi)(zhi)方式(shi)開展工(gong)作(zuo)的能(neng)力(li)還(huan)(huan)需要(yao)進一步(bu)培養(yang)。二(er)是(shi)國(guo)(guo)資(zi)監管(guan)領域法(fa)(fa)律(lv)制(zhi)度供(gong)給仍(reng)然不足(zu),一些重大改(gai)革(ge)成果尚未及時(shi)制(zhi)度化、法(fa)(fa)律(lv)化,法(fa)(fa)規制(zhi)度體系(xi)還(huan)(huan)不夠系(xi)統(tong)科學(xue)。三(san)是(shi)國(guo)(guo)資(zi)監管(guan)體制(zhi)仍(reng)需進一步(bu)健全,職(zhi)能(neng)轉變重點(dian)任(ren)務(wu)有(you)待持(chi)續落實(shi),差異(yi)化監管(guan)仍(reng)有(you)差距(ju)。四是(shi)企(qi)(qi)業法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)工(gong)作(zuo)總體還(huan)(huan)不平(ping)衡,中央企(qi)(qi)業子企(qi)(qi)業和(he)(he)地方國(guo)(guo)有(you)企(qi)(qi)業的法(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)仍(reng)較薄弱(ruo)。
2021年,國資(zi)委(wei)將以習(xi)近平法(fa)(fa)(fa)(fa)(fa)治思想為指導,持續(xu)落實法(fa)(fa)(fa)(fa)(fa)治政(zheng)府建設(she)各項(xiang)要(yao)求,重點做(zuo)好(hao)以下工(gong)(gong)作(zuo)(zuo):一是(shi)深(shen)入學習(xi)貫徹習(xi)近平法(fa)(fa)(fa)(fa)(fa)治思想。籌備成立(li)“八五(wu)”普(pu)法(fa)(fa)(fa)(fa)(fa)工(gong)(gong)作(zuo)(zuo)領導小組,在國資(zi)委(wei)系(xi)(xi)統深(shen)入學習(xi)宣傳習(xi)近平法(fa)(fa)(fa)(fa)(fa)治思想,加(jia)大普(pu)法(fa)(fa)(fa)(fa)(fa)力(li)度(du)(du),不(bu)斷(duan)增強(qiang)干部職(zhi)工(gong)(gong)依(yi)法(fa)(fa)(fa)(fa)(fa)行(xing)權(quan)履(lv)職(zhi)和(he)依(yi)法(fa)(fa)(fa)(fa)(fa)辦事能力(li)水平。二是(shi)不(bu)斷(duan)完善國資(zi)監管(guan)法(fa)(fa)(fa)(fa)(fa)規(gui)制度(du)(du)體(ti)系(xi)(xi)。加(jia)強(qiang)前瞻性(xing)研究,推動(dong)完善相關法(fa)(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)(fa)規(gui)。認真研究起草《政(zheng)務處分法(fa)(fa)(fa)(fa)(fa)》配套辦法(fa)(fa)(fa)(fa)(fa),深(shen)入開展規(gui)章(zhang)規(gui)范(fan)性(xing)文件(jian)清理(li)(li),適時開展文件(jian)匯編(bian)。三是(shi)持續(xu)深(shen)化(hua)(hua)國資(zi)監管(guan)職(zhi)能轉變。全口徑梳(shu)理(li)(li)面向中(zhong)(zhong)央(yang)(yang)企(qi)業和(he)地方國資(zi)委(wei)的(de)工(gong)(gong)作(zuo)(zuo)事項(xiang),按(an)照中(zhong)(zhong)央(yang)(yang)統一部署,認真做(zuo)好(hao)權(quan)責(ze)清單編(bian)制修訂。加(jia)強(qiang)國資(zi)委(wei)對混(hun)合(he)所有制企(qi)業、股權(quan)多元化(hua)(hua)企(qi)業履(lv)行(xing)股東職(zhi)責(ze)的(de)研究,進(jin)一步規(gui)范(fan)履(lv)職(zhi)程(cheng)序。四(si)是(shi)不(bu)斷(duan)深(shen)化(hua)(hua)中(zhong)(zhong)央(yang)(yang)企(qi)業法(fa)(fa)(fa)(fa)(fa)治建設(she)。制定進(jin)一步加(jia)強(qiang)中(zhong)(zhong)央(yang)(yang)企(qi)業法(fa)(fa)(fa)(fa)(fa)治建設(she)的(de)指導意(yi)見(jian),明確(que)“十(shi)四(si)五(wu)”時期(qi)法(fa)(fa)(fa)(fa)(fa)治央(yang)(yang)企(qi)建設(she)總體(ti)思路、目標(biao)和(he)舉措(cuo)。推動(dong)中(zhong)(zhong)央(yang)(yang)企(qi)業建立(li)健(jian)全合(he)規(gui)管(guan)理(li)(li)體(ti)系(xi)(xi),切實防(fang)范(fan)合(he)規(gui)風(feng)險。五(wu)是(shi)推動(dong)健(jian)全監督追責(ze)體(ti)系(xi)(xi),加(jia)大重大違規(gui)案(an)件(jian)查辦和(he)警(jing)示力(li)度(du)(du),不(bu)斷(duan)提升監督效能。
