6月19日下午,湖北國資委召開(kai)了(le)所屬出(chu)資企業總(zong)(zong)法律顧問(wen)履(lv)(lv)職評議現場述職會議。湖北能(neng)源、三環(huan)集(ji)團、大(da)治(zhi)有(you)色(se)等15家省出(chu)資企業的總(zong)(zong)法律顧問(wen)公開(kai)進行了(le)述職,全面(mian)報告了(le)履(lv)(lv)職情況。
進(jin)行現場評(ping)(ping)議(yi)是湖北(bei)國(guo)(guo)資委對(dui)省出(chu)資企(qi)業(ye)(ye)總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)開(kai)展履(lv)職(zhi)評(ping)(ping)議(yi)工(gong)作最(zui)重(zhong)要的(de)(de)一(yi)個(ge)環節。根據(ju)湖北(bei)國(guo)(guo)資委2011年(nian)(nian)底出(chu)臺的(de)(de)《湖北(bei)國(guo)(guo)資委出(chu)資企(qi)業(ye)(ye)總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)履(lv)職(zhi)評(ping)(ping)議(yi)辦法(fa)(fa)(試行)》(鄂(e)國(guo)(guo)資規〔2011〕7號)要求,企(qi)業(ye)(ye)總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)年(nian)(nian)度履(lv)職(zhi)評(ping)(ping)議(yi)工(gong)作,采取總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)述職(zhi)、所在企(qi)業(ye)(ye)法(fa)(fa)人代表評(ping)(ping)議(yi)、湖北(bei)國(guo)(guo)資委綜合評(ping)(ping)定的(de)(de)方(fang)式(shi)進(jin)行。湖北(bei)國(guo)(guo)資委開(kai)展企(qi)業(ye)(ye)總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)年(nian)(nian)度履(lv)職(zhi)評(ping)(ping)議(yi)工(gong)作是深入推(tui)進(jin)企(qi)業(ye)(ye)總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)度建(jian)設的(de)(de)又一(yi)個(ge)重(zhong)大的(de)(de)制(zhi)度創新,對(dui)于加強總(zong)法(fa)(fa)律(lv)(lv)顧(gu)問(wen)制(zhi)度建(jian)設具(ju)有重(zhong)要的(de)(de)意義。
湖(hu)北(bei)(bei)國資(zi)(zi)(zi)委(wei)對(dui)出(chu)(chu)(chu)(chu)資(zi)(zi)(zi)企業(ye)(ye)(ye)總(zong)法(fa)(fa)律(lv)顧(gu)問進(jin)(jin)行(xing)履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)有四(si)個方面的(de)(de)特(te)色:一是專家評(ping)(ping)(ping)(ping)(ping)(ping)審。在(zai)現場履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)評(ping)(ping)(ping)(ping)(ping)(ping)委(wei)的(de)(de)選聘(pin)上(shang)突出(chu)(chu)(chu)(chu)以(yi)法(fa)(fa)律(lv)專家為主導(dao)、職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)能處(chu)室為輔(fu)助的(de)(de)原則。除了由湖(hu)北(bei)(bei)國資(zi)(zi)(zi)委(wei)分(fen)管法(fa)(fa)制工(gong)(gong)作(zuo)副主任(ren)、政策法(fa)(fa)規處(chu)、企業(ye)(ye)(ye)領導(dao)管理處(chu)、監(jian)事會工(gong)(gong)作(zuo)處(chu)的(de)(de)負責(ze)人擔任(ren)外,還(huan)特(te)邀了武漢鋼(gang)鐵(集(ji)團)公(gong)司、江(jiang)漢石油管理局、中(zhong)建三局、中(zhong)鐵大橋局等在(zai)鄂中(zhong)央(yang)企業(ye)(ye)(ye)的(de)(de)總(zong)法(fa)(fa)律(lv)顧(gu)問(領導(dao))以(yi)及(ji)湖(hu)北(bei)(bei)省法(fa)(fa)律(lv)界知名(ming)人士擔任(ren)專家評(ping)(ping)(ping)(ping)(ping)(ping)委(wei)。二(er)是現場打分(fen)。現場述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)重(zhong)(zhong)(zhong)在(zai)突出(chu)(chu)(chu)(chu)業(ye)(ye)(ye)績(ji)導(dao)向。突出(chu)(chu)(chu)(chu)工(gong)(gong)作(zuo)業(ye)(ye)(ye)績(ji),突出(chu)(chu)(chu)(chu)工(gong)(gong)作(zuo)特(te)色,突出(chu)(chu)(chu)(chu)工(gong)(gong)作(zuo)責(ze)任(ren),突出(chu)(chu)(chu)(chu)工(gong)(gong)作(zuo)措(cuo)施。總(zong)法(fa)(fa)律(lv)顧(gu)問述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)后(hou),評(ping)(ping)(ping)(ping)(ping)(ping)委(wei)從(cong)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)業(ye)(ye)(ye)操守、勤勉敬(jing)業(ye)(ye)(ye)、履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)能力、廉潔(jie)從(cong)業(ye)(ye)(ye)、工(gong)(gong)作(zuo)業(ye)(ye)(ye)績(ji)五個方面進(jin)(jin)行(xing)量(liang)化現場打分(fen)。所有企業(ye)(ye)(ye)總(zong)法(fa)(fa)律(lv)顧(gu)問述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)結(jie)(jie)(jie)束后(hou),由主持(chi)人現場公(gong)布評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)分(fen)值,做(zuo)到了公(gong)平(ping)、公(gong)正、公(gong)開。三是結(jie)(jie)(jie)果(guo)公(gong)開。在(zai)確定(ding)(ding)總(zong)法(fa)(fa)律(lv)顧(gu)問評(ping)(ping)(ping)(ping)(ping)(ping)定(ding)(ding)結(jie)(jie)(jie)果(guo)時,根據現場述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)和(he)專家評(ping)(ping)(ping)(ping)(ping)(ping)審意(yi)見,結(jie)(jie)(jie)合企業(ye)(ye)(ye)法(fa)(fa)人代(dai)(dai)表評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)意(yi)見對(dui)企業(ye)(ye)(ye)總(zong)法(fa)(fa)律(lv)顧(gu)問年度(du)履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)情況進(jin)(jin)行(xing)綜合評(ping)(ping)(ping)(ping)(ping)(ping)定(ding)(ding),提出(chu)(chu)(chu)(chu)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)意(yi)見并確定(ding)(ding)其(qi)年度(du)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)結(jie)(jie)(jie)果(guo)。其(qi)中(zhong)總(zong)法(fa)(fa)律(lv)顧(gu)問現場述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)權(quan)(quan)重(zhong)(zhong)(zhong)為70%,所在(zai)企業(ye)(ye)(ye)法(fa)(fa)人代(dai)(dai)表評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)權(quan)(quan)重(zhong)(zhong)(zhong)為20%,湖(hu)北(bei)(bei)國資(zi)(zi)(zi)委(wei)綜合評(ping)(ping)(ping)(ping)(ping)(ping)定(ding)(ding)權(quan)(quan)重(zhong)(zhong)(zhong)為10%。企業(ye)(ye)(ye)總(zong)法(fa)(fa)律(lv)顧(gu)問履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)結(jie)(jie)(jie)果(guo)分(fen)為優秀、稱(cheng)(cheng)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、基本稱(cheng)(cheng)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)、不稱(cheng)(cheng)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)四(si)個等次。評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)結(jie)(jie)(jie)果(guo)經湖(hu)北(bei)(bei)國資(zi)(zi)(zi)委(wei)主任(ren)辦公(gong)會審定(ding)(ding)后(hou),上(shang)網公(gong)示,公(gong)示期(qi)間無異議(yi)(yi)后(hou),再書面通知述(shu)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)對(dui)象及(ji)單位。四(si)是獎(jiang)懲掛鉤(gou)。履(lv)(lv)職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)評(ping)(ping)(ping)(ping)(ping)(ping)議(yi)(yi)結(jie)(jie)(jie)果(guo)作(zuo)為對(dui)企業(ye)(ye)(ye)總(zong)法(fa)(fa)律(lv)顧(gu)問年度(du)和(he)任(ren)期(qi)業(ye)(ye)(ye)績(ji)考(kao)(kao)核、任(ren)期(qi)綜合考(kao)(kao)核、獎(jiang)懲、任(ren)免(續(xu)聘(pin)、解聘(pin))和(he)企業(ye)(ye)(ye)法(fa)(fa)律(lv)顧(gu)問職(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)業(ye)(ye)(ye)崗(gang)位等級資(zi)(zi)(zi)格評(ping)(ping)(ping)(ping)(ping)(ping)定(ding)(ding)的(de)(de)重(zhong)(zhong)(zhong)要依據。
通過(guo)湖北省(sheng)出資企(qi)業總法(fa)(fa)律(lv)顧問(wen)(wen)履職評(ping)議工(gong)作,總結了(le)(le)成績(ji),找出了(le)(le)差(cha)距(ju),關鍵的是強化(hua)了(le)(le)企(qi)業總法(fa)(fa)律(lv)顧問(wen)(wen)恪盡職守、愛崗敬業的責任(ren),提高了(le)(le)總法(fa)(fa)律(lv)顧問(wen)(wen)履職能力(li)和水平。
現場履(lv)職評議結(jie)束后,湖北國(guo)資(zi)委(wei)就(jiu)進一步推(tui)進省(sheng)出(chu)資(zi)企(qi)業總法(fa)律(lv)顧(gu)(gu)問(wen)的(de)制度建設提出(chu)了四點要求:一是堅定(ding)不移(yi)(yi)(yi)選好配強企(qi)業總法(fa)律(lv)顧(gu)(gu)問(wen);二是堅定(ding)不移(yi)(yi)(yi)落實企(qi)業總法(fa)律(lv)顧(gu)(gu)問(wen)的(de)職責;三是堅定(ding)不移(yi)(yi)(yi)地(di)(di)發揮總法(fa)律(lv)顧(gu)(gu)問(wen)在防(fang)范(fan)企(qi)業法(fa)律(lv)風(feng)險當中的(de)關鍵(jian)作用;四是堅定(ding)不移(yi)(yi)(yi)地(di)(di)推(tui)進法(fa)律(lv)工(gong)作隊伍建設。
