王勇:完善各類國有資產管理體制

  黨(dang)(dang)的(de)(de)十(shi)八(ba)大(da)(da)明確提出(chu)要“完善(shan)各(ge)類國(guo)有資(zi)產(chan)管(guan)理(li)(li)體(ti)制(zhi)”,這既是(shi)對黨(dang)(dang)的(de)(de)十(shi)六大(da)(da)以來國(guo)有資(zi)產(chan)管(guan)理(li)(li)體(ti)制(zhi)改(gai)革取得成效(xiao)的(de)(de)充分(fen)肯定(ding),也是(shi)對進一步加(jia)強各(ge)類國(guo)有資(zi)產(chan)監管(guan)作出(chu)的(de)(de)重要部署。我(wo)們要深(shen)刻領會和(he)認(ren)真貫徹黨(dang)(dang)的(de)(de)十(shi)八(ba)大(da)(da)精(jing)神,牢牢把(ba)握(wo)正確的(de)(de)改(gai)革方(fang)向(xiang),以改(gai)革創新的(de)(de)精(jing)神不斷完善(shan)各(ge)類國(guo)有資(zi)產(chan)管(guan)理(li)(li)體(ti)制(zhi)。


  一、深刻認識完善各類國有資產管理體制的重要意義


  我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)包括(kuo)經(jing)(jing)(jing)(jing)營(ying)性(xing)(xing)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)(含國(guo)(guo)(guo)有(you)(you)(you)(you)(you)金融資產(chan)(chan))、行政事業性(xing)(xing)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)、資源(yuan)性(xing)(xing)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)。隨著(zhu)社(she)(she)會(hui)主義(yi)現(xian)代(dai)化建(jian)設(she)的不(bu)(bu)斷推進(jin),我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)規(gui)模不(bu)(bu)斷擴大(da)、質(zhi)量不(bu)(bu)斷提高,在經(jing)(jing)(jing)(jing)濟社(she)(she)會(hui)發展中(zhong)發揮著(zhu)不(bu)(bu)可替代(dai)的作用(yong)。完善各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)管(guan)理體制(zhi),就是(shi)要立足我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)情,針對各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)的屬(shu)性(xing)(xing)和特點,建(jian)立健全(quan)適應社(she)(she)會(hui)主義(yi)市場經(jing)(jing)(jing)(jing)濟要求的管(guan)理體制(zhi)和制(zhi)度體系,保(bao)護好、利用(yong)好、經(jing)(jing)(jing)(jing)營(ying)好各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan),最(zui)大(da)限度地發揮好各(ge)(ge)類國(guo)(guo)(guo)有(you)(you)(you)(you)(you)資產(chan)(chan)的作用(yong),創造更好的經(jing)(jing)(jing)(jing)濟效(xiao)益和社(she)(she)會(hui)效(xiao)益,為建(jian)設(she)中(zhong)國(guo)(guo)(guo)特色社(she)(she)會(hui)主義(yi)提供堅實的經(jing)(jing)(jing)(jing)濟和政治(zhi)基礎。


  (一)完善各類(lei)國有資產管(guan)理體制是進一步完善社會主義(yi)市場經濟(ji)體制的必然選(xuan)擇


  完(wan)(wan)善(shan)(shan)社(she)(she)會(hui)主(zhu)義市(shi)場(chang)(chang)(chang)(chang)經(jing)濟(ji)(ji)(ji)體制(zhi)(zhi)(zhi)(zhi)(zhi),使公有(you)(you)(you)(you)(you)(you)制(zhi)(zhi)(zhi)(zhi)(zhi)與市(shi)場(chang)(chang)(chang)(chang)經(jing)濟(ji)(ji)(ji)有(you)(you)(you)(you)(you)(you)機(ji)結合(he),一(yi)方面(mian)要(yao)(yao)求國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)經(jing)濟(ji)(ji)(ji)不(bu)(bu)斷(duan)(duan)增(zeng)(zeng)強控制(zhi)(zhi)(zhi)(zhi)(zhi)力和(he)(he)影響力,在(zai)經(jing)濟(ji)(ji)(ji)發(fa)展(zhan)中發(fa)揮(hui)主(zhu)導(dao)作用(yong);另一(yi)方面(mian)要(yao)(yao)求國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)不(bu)(bu)斷(duan)(duan)增(zeng)(zeng)強活(huo)力和(he)(he)競(jing)爭力,真正成為市(shi)場(chang)(chang)(chang)(chang)經(jing)濟(ji)(ji)(ji)的(de)(de)重要(yao)(yao)主(zhu)體,這(zhe)需要(yao)(yao)以(yi)(yi)完(wan)(wan)善(shan)(shan)的(de)(de)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)理(li)(li)(li)體制(zhi)(zhi)(zhi)(zhi)(zhi)為保障。黨(dang)的(de)(de)十(shi)六大以(yi)(yi)來,國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)理(li)(li)(li)體制(zhi)(zhi)(zhi)(zhi)(zhi)改革取得了(le)(le)(le)積極的(de)(de)進(jin)展(zhan)和(he)(he)成效,國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務院(yuan)(yuan)、省(區、市(shi))、市(shi)(地(di)(di)(di))三級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構相繼(ji)建立(li),明確(que)了(le)(le)(le)政(zheng)府層面(mian)的(de)(de)出資(zi)(zi)(zi)(zi)(zi)(zi)人代表,大部分經(jing)營(ying)性(xing)非(fei)金融國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)納入(ru)監(jian)管(guan)(guan)體系;基本形成了(le)(le)(le)企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)法(fa)(fa)律法(fa)(fa)規制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)體系,國(guo)(guo)(guo)(guo)(guo)(guo)(guo)務院(yuan)(yuan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)委出臺的(de)(de)規章和(he)(he)規范(fan)性(xing)文(wen)件(jian)299件(jian),地(di)(di)(di)方政(zheng)府和(he)(he)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)委發(fa)布的(de)(de)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)監(jian)管(guan)(guan)法(fa)(fa)規、制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)2800多件(jian);強化了(le)(le)(le)對企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)的(de)(de)監(jian)管(guan)(guan),業(ye)績(ji)考核和(he)(he)激勵約束機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)建立(li)并不(bu)(bu)斷(duan)(duan)完(wan)(wan)善(shan)(shan),財務監(jian)督、審(shen)計監(jian)督、監(jian)事會(hui)監(jian)督機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)不(bu)(bu)斷(duan)(duan)完(wan)(wan)善(shan)(shan),產(chan)(chan)(chan)權管(guan)(guan)理(li)(li)(li)不(bu)(bu)斷(duan)(duan)加(jia)強,國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)本預算管(guan)(guan)理(li)(li)(li)制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)和(he)(he)收益(yi)管(guan)(guan)理(li)(li)(li)機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)逐步(bu)建立(li)。這(zhe)一(yi)系列重要(yao)(yao)舉(ju)措,為國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)改革發(fa)展(zhan)創造了(le)(le)(le)良好的(de)(de)體制(zhi)(zhi)(zhi)(zhi)(zhi)環境,促進(jin)了(le)(le)(le)社(she)(she)會(hui)主(zhu)義市(shi)場(chang)(chang)(chang)(chang)經(jing)濟(ji)(ji)(ji)體制(zhi)(zhi)(zhi)(zhi)(zhi)的(de)(de)完(wan)(wan)善(shan)(shan)。但目(mu)前,各類(lei)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)理(li)(li)(li)的(de)(de)體制(zhi)(zhi)(zhi)(zhi)(zhi)還(huan)(huan)沒有(you)(you)(you)(you)(you)(you)完(wan)(wan)全(quan)理(li)(li)(li)順(shun),機(ji)制(zhi)(zhi)(zhi)(zhi)(zhi)和(he)(he)法(fa)(fa)規制(zhi)(zhi)(zhi)(zhi)(zhi)度(du)(du)還(huan)(huan)不(bu)(bu)完(wan)(wan)善(shan)(shan),存在(zai)責(ze)任主(zhu)體不(bu)(bu)明確(que)、監(jian)管(guan)(guan)不(bu)(bu)到位、配置不(bu)(bu)合(he)理(li)(li)(li)等(deng)現象;一(yi)些特定行業(ye)的(de)(de)企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)還(huan)(huan)沒有(you)(you)(you)(you)(you)(you)納入(ru)新的(de)(de)監(jian)管(guan)(guan)體制(zhi)(zhi)(zhi)(zhi)(zhi),出資(zi)(zi)(zi)(zi)(zi)(zi)人職能(neng)還(huan)(huan)沒有(you)(you)(you)(you)(you)(you)完(wan)(wan)全(quan)落實,國(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)的(de)(de)科學(xue)性(xing)有(you)(you)(you)(you)(you)(you)效性(xing)有(you)(you)(you)(you)(you)(you)待(dai)進(jin)一(yi)步(bu)增(zeng)(zeng)強。適應(ying)完(wan)(wan)善(shan)(shan)社(she)(she)會(hui)主(zhu)義市(shi)場(chang)(chang)(chang)(chang)經(jing)濟(ji)(ji)(ji)體制(zhi)(zhi)(zhi)(zhi)(zhi)的(de)(de)要(yao)(yao)求,必(bi)須進(jin)一(yi)步(bu)完(wan)(wan)善(shan)(shan)各類(lei)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)管(guan)(guan)理(li)(li)(li)體制(zhi)(zhi)(zhi)(zhi)(zhi),使各類(lei)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)資(zi)(zi)(zi)(zi)(zi)(zi)產(chan)(chan)(chan)更好地(di)(di)(di)發(fa)揮(hui)其經(jing)濟(ji)(ji)(ji)社(she)(she)會(hui)功能(neng),使國(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)(you)(you)(you)企業(ye)真正成為獨立(li)的(de)(de)市(shi)場(chang)(chang)(chang)(chang)主(zhu)體。


  (二)完善各類(lei)國有資(zi)產管理(li)體(ti)制是(shi)深化行政(zheng)體(ti)制改革、轉變政(zheng)府職能的客觀(guan)需(xu)要(yao)


  黨的十八大指出(chu),要(yao)深入推(tui)(tui)進(jin)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)(qi)分(fen)(fen)開(kai)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)分(fen)(fen)開(kai)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)事分(fen)(fen)開(kai)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)社分(fen)(fen)開(kai)。這是深化行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)制(zhi)(zhi)改(gai)(gai)革、轉(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)的重要(yao)內(nei)容,對(dui)完(wan)善(shan)各(ge)類(lei)國(guo)有(you)資(zi)產管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)提出(chu)了(le)新的要(yao)求。改(gai)(gai)革開(kai)放初期,國(guo)有(you)企(qi)(qi)(qi)(qi)業實際(ji)上(shang)(shang)(shang)是政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)的附屬物與(yu)(yu)延伸,政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)很大精(jing)力放在(zai)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)國(guo)有(you)企(qi)(qi)(qi)(qi)業上(shang)(shang)(shang),企(qi)(qi)(qi)(qi)業的生(sheng)產、經(jing)營、人(ren)事都是由(you)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)直接管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)。隨著(zhu)國(guo)有(you)企(qi)(qi)(qi)(qi)業改(gai)(gai)革的推(tui)(tui)進(jin),企(qi)(qi)(qi)(qi)業被賦予了(le)更多的經(jing)營自(zi)主權,但(dan)仍(reng)(reng)然(ran)沒有(you)從(cong)體(ti)(ti)制(zhi)(zhi)上(shang)(shang)(shang)理(li)(li)(li)(li)(li)順政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)與(yu)(yu)企(qi)(qi)(qi)(qi)業的關系。2000年(nian)國(guo)家(jia)撤銷政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)行(xing)(xing)業管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)部(bu)門(men),減少了(le)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)對(dui)國(guo)有(you)企(qi)(qi)(qi)(qi)業的直接管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li),2003年(nian)國(guo)資(zi)委(wei)的成立從(cong)機構(gou)設置和制(zhi)(zhi)度安排上(shang)(shang)(shang)解決了(le)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)(qi)分(fen)(fen)開(kai)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)分(fen)(fen)開(kai)的問(wen)題,在(zai)深化行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)制(zhi)(zhi)改(gai)(gai)革、轉(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)方面取得了(le)重大突破。新的國(guo)有(you)資(zi)產管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi)從(cong)機構(gou)設置上(shang)(shang)(shang)把政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)的公(gong)(gong)(gong)共(gong)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)職(zhi)(zhi)(zhi)能(neng)(neng)與(yu)(yu)出(chu)資(zi)人(ren)職(zhi)(zhi)(zhi)能(neng)(neng)予以分(fen)(fen)離(li),明確政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)公(gong)(gong)(gong)共(gong)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)部(bu)門(men)不(bu)(bu)再履行(xing)(xing)出(chu)資(zi)人(ren)職(zhi)(zhi)(zhi)責(ze),國(guo)資(zi)監(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)不(bu)(bu)履行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)公(gong)(gong)(gong)共(gong)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)職(zhi)(zhi)(zhi)責(ze),有(you)力促(cu)進(jin)了(le)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)制(zhi)(zhi)改(gai)(gai)革和政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)的轉(zhuan)變(bian)。但(dan)目前很多改(gai)(gai)革措(cuo)施還(huan)不(bu)(bu)到位,一些(xie)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)公(gong)(gong)(gong)共(gong)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)部(bu)門(men)仍(reng)(reng)然(ran)對(dui)國(guo)有(you)企(qi)(qi)(qi)(qi)業履行(xing)(xing)出(chu)資(zi)人(ren)職(zhi)(zhi)(zhi)責(ze),國(guo)資(zi)監(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)也還(huan)承(cheng)擔(dan)著(zhu)一些(xie)帶有(you)公(gong)(gong)(gong)共(gong)管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)性質的職(zhi)(zhi)(zhi)能(neng)(neng),政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)(qi)不(bu)(bu)分(fen)(fen)、政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)資(zi)不(bu)(bu)分(fen)(fen)的現象(xiang)依然(ran)存在(zai)。從(cong)根(gen)本(ben)上(shang)(shang)(shang)解決這些(xie)問(wen)題,需要(yao)進(jin)一步完(wan)善(shan)各(ge)類(lei)國(guo)有(you)資(zi)產管(guan)(guan)(guan)(guan)(guan)理(li)(li)(li)(li)(li)體(ti)(ti)制(zhi)(zhi),進(jin)一步促(cu)進(jin)行(xing)(xing)政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)體(ti)(ti)制(zhi)(zhi)改(gai)(gai)革和政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)職(zhi)(zhi)(zhi)能(neng)(neng)轉(zhuan)變(bian),推(tui)(tui)動(dong)各(ge)級政(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)(fu)(fu)公(gong)(gong)(   二、完善各類國有資產管理體制的方向和原則


  完善(shan)各(ge)類國有(you)(you)(you)資(zi)產(chan)管理(li)體(ti)(ti)制(zhi),要(yao)堅(jian)持社會主義(yi)基本經(jing)(jing)(jing)濟(ji)(ji)制(zhi)度和市場(chang)(chang)經(jing)(jing)(jing)濟(ji)(ji)改(gai)革方(fang)向。黨的(de)十八大報告明確指(zhi)出,要(yao)完善(shan)公有(you)(you)(you)制(zhi)為(wei)主體(ti)(ti)、多種所有(you)(you)(you)制(zhi)經(jing)(jing)(jing)濟(ji)(ji)共(gong)同發(fa)(fa)展的(de)基本經(jing)(jing)(jing)濟(ji)(ji)制(zhi)度。完善(shan)社會主義(yi)基本經(jing)(jing)(jing)濟(ji)(ji)制(zhi)度,要(yao)求我(wo)們在(zai)完善(shan)各(ge)類國有(you)(you)(you)資(zi)產(chan)管理(li)體(ti)(ti)制(zhi)中,使各(ge)類國有(you)(you)(you)資(zi)產(chan)實(shi)現最優化配置(zhi)(zhi)、最充分使用(yong)(yong),爭取經(jing)(jing)(jing)濟(ji)(ji)效益和社會效益的(de)統一;使國有(you)(you)(you)經(jing)(jing)(jing)濟(ji)(ji)在(zai)經(jing)(jing)(jing)濟(ji)(ji)發(fa)(fa)展中的(de)主導作(zuo)用(yong)(yong)更好地發(fa)(fa)揮。堅(jian)持社會主義(yi)市場(chang)(chang)經(jing)(jing)(jing)濟(ji)(ji)的(de)改(gai)革方(fang)向,要(yao)求我(wo)們在(zai)完善(shan)各(ge)類國有(you)(you)(you)資(zi)產(chan)管理(li)體(ti)(ti)制(zhi)過(guo)程中,充分發(fa)(fa)揮市場(chang)(chang)在(zai)資(zi)源(yuan)配置(zhi)(zhi)中的(de)基礎性作(zuo)用(yong)(yong),遵循市場(chang)(chang)經(jing)(jing)(jing)濟(ji)(ji)規律經(jing)(jing)(jing)營管理(li)國有(you)(you)(you)資(zi)產(chan),推動國有(you)(you)(you)資(zi)本優化配置(zhi)(zhi),實(shi)現國有(you)(you)(you)資(zi)產(chan)的(de)保值(zhi)增值(zhi)。


  完善各類國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產管(guan)理(li)體制,要堅持(chi)國(guo)(guo)(guo)家(jia)所(suo)有(you)(you)、分(fen)級代(dai)表的原(yuan)則。國(guo)(guo)(guo)家(jia)所(suo)有(you)(you)、分(fen)級代(dai)表,就是在堅持(chi)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產國(guo)(guo)(guo)家(jia)所(suo)有(you)(you)的前提下,中央政(zheng)(zheng)府和地方政(zheng)(zheng)府分(fen)別(bie)代(dai)表國(guo)(guo)(guo)家(jia)履(lv)行(xing)出資(zi)(zi)人職責(ze),享有(you)(you)所(suo)有(you)(you)者權益。國(guo)(guo)(guo)家(jia)所(suo)有(you)(you)是我(wo)國(guo)(guo)(guo)現(xian)行(xing)法律制度(du)所(suo)規(gui)定的,也(ye)是從整(zheng)體上(shang)落實(shi)對(dui)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產的管(guan)理(li)、更好地配置國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產所(suo)需要的。分(fen)級代(dai)表是現(xian)實(shi)的國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產形成和管(guan)理(li)的延續,也(ye)是調動各級政(zheng)(zheng)府積極性(xing)、更好地落實(shi)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產管(guan)理(li)責(ze)任、推(tui)動國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產保值增(zeng)值和最(zui)大限度(du)發揮國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產使用(yong)效率的要求。按照(zhao)國(guo)(guo)(guo)家(jia)所(suo)有(you)(you)、分(fen)級代(dai)表的原(yuan)則,各級政(zheng)(zheng)府要執(zhi)行(xing)統(tong)(tong)一(yi)的國(guo)(guo)(guo)資(zi)(zi)監管(guan)法律法規(gui),建立統(tong)(tong)一(yi)的基礎管(guan)理(li)工(gong)作(zuo)體系,上(shang)級政(zheng)(zheng)府國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監管(guan)機構依法對(dui)下級政(zheng)(zheng)府的國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監督管(guan)理(li)工(gong)作(zuo)進行(xing)指導和監督。


  完善(shan)各類(lei)國(guo)有(you)(you)資(zi)(zi)產(chan)管(guan)(guan)理體制,要(yao)堅持(chi)政(zheng)(zheng)企(qi)分(fen)(fen)開(kai)(kai)、政(zheng)(zheng)資(zi)(zi)分(fen)(fen)開(kai)(kai)、所有(you)(you)權和(he)(he)經(jing)營權相分(fen)(fen)離的(de)(de)原(yuan)(yuan)則(ze)。政(zheng)(zheng)企(qi)分(fen)(fen)開(kai)(kai)、政(zheng)(zheng)資(zi)(zi)分(fen)(fen)開(kai)(kai)是理順(shun)政(zheng)(zheng)府與國(guo)有(you)(you)企(qi)業(ye)(ye)關系的(de)(de)核心。根據社會公(gong)(gong)共(gong)(gong)管(guan)(guan)理職(zhi)(zhi)(zhi)(zhi)能(neng)和(he)(he)所有(you)(you)者職(zhi)(zhi)(zhi)(zhi)能(neng)分(fen)(fen)開(kai)(kai)的(de)(de)原(yuan)(yuan)則(ze),國(guo)資(zi)(zi)監管(guan)(guan)機構專門承擔(dan)(dan)國(guo)有(you)(you)資(zi)(zi)產(chan)出資(zi)(zi)人職(zhi)(zhi)(zhi)(zhi)責(ze),不承擔(dan)(dan)社會公(gong)(gong)共(gong)(gong)管(guan)(guan)理職(zhi)(zhi)(zhi)(zhi)能(neng),社會公(gong)(gong)共(gong)(gong)管(guan)(guan)理部門從(cong)政(zheng)(zheng)府經(jing)濟調節和(he)(he)社會管(guan)(guan)理角度對(dui)各類(lei)所有(you)(you)制企(qi)業(ye)(ye)進行(xing)管(guan)(guan)理,不承擔(dan)(dan)出資(zi)(zi)人職(zhi)(zhi)(zhi)(zhi)責(ze)。按照政(zheng)(zheng)企(qi)分(fen)(fen)開(kai)(kai)以及(ji)所有(you)(you)權和(he)(he)經(jing)營權分(fen)(fen)離的(de)(de)原(yuan)(yuan)則(ze),國(guo)資(zi)(zi)監管(guan)(guan)機構依(yi)法對(dui)企(qi)業(ye)(ye)的(de)(de)國(guo)有(you)(you)資(zi)(zi)產(chan)進行(xing)監管(guan)(guan),不能(neng)干(gan)預企(qi)業(ye)(ye)的(de)(de)生產(chan)經(jing)營活動。企(qi)業(ye)(ye)必須(xu)自(zi)覺接受國(guo)資(zi)(zi)監管(guan)(guan)機構的(de)(de)監管(guan)(guan),不得損害所有(you)(you)者權益(yi)。


  完善各類國(guo)有(you)資(zi)(zi)產管(guan)(guan)理體制(zhi),要(yao)堅持權(quan)利、義務和(he)責任相(xiang)統一,管(guan)(guan)資(zi)(zi)產和(he)管(guan)(guan)人(ren)(ren)、管(guan)(guan)事(shi)相(xiang)結(jie)合的(de)原則。各級(ji)國(guo)資(zi)(zi)監管(guan)(guan)機構經授權(quan)代(dai)表本級(ji)人(ren)(ren)民(min)(min)政府(fu)對(dui)國(guo)有(you)資(zi)(zi)產履行出資(zi)(zi)人(ren)(ren)職責,享(xiang)有(you)資(zi)(zi)產收益權(quan)、參與重(zhong)大(da)決策和(he)選擇管(guan)(guan)理者等(deng)出資(zi)(zi)人(ren)(ren)權(quan)利,對(dui)出資(zi)(zi)企(qi)業國(guo)有(you)資(zi)(zi)產保(bao)值(zhi)增值(zhi)和(he)發揮好國(guo)有(you)資(zi)(zi)產在經濟社會發展中的(de)作用(yong)負責,接受(shou)本級(ji)人(ren)(ren)民(min)(min)政府(fu)的(de)監督和(he)考核(he)。國(guo)資(zi)(zi)監管(guan)(guan)機構建立以績(ji)效考核(he)、薪酬分(fen)配、領導人(ren)(ren)員管(guan)(guan)理和(he)財(cai)務評價(jia)、產權(quan)管(guan)(guan)理、風險管(guan)(guan)控(kong)等(deng)為主線的(de)工作閉環(huan)體系,實現管(guan)(guan)人(ren)(ren)、管(guan)(guan)事(shi)、管(guan)(guan)資(zi)(zi)產的(de)有(you)效結(jie)合。


    三、完善各類國有資產管理體制的主要任務


  完善(shan)各類國有(you)資(zi)產管理體制(zhi)意義重大(da),影(ying)響深遠。我們要按照黨的(de)(de)十八大(da)的(de)(de)重要部(bu)署,繼(ji)續(xu)堅持經過實踐(jian)證明行(xing)之有(you)效的(de)(de)重大(da)原則,持續(xu)推進完善(shan)各類國有(you)資(zi)產管理體制(zhi)的(de)(de)各項任(ren)務。


  (一)完善國資監管機構和職能(neng)


  進(jin)一(yi)(yi)步明(ming)確各(ge)類(lei)國(guo)(guo)有(you)資(zi)產(chan)(chan)責任主(zhu)體(ti),明(ming)晰產(chan)(chan)權關系,建(jian)立(li)(li)體(ti)制機制,落實監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)責任。進(jin)一(yi)(yi)步完善(shan)中央、省(區、市)、市(地)三級經營(ying)性(xing)國(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou),經營(ying)性(xing)國(guo)(guo)有(you)資(zi)產(chan)(chan)規模較大(da)的(de)(de)縣(市)可探索(suo)設(she)立(li)(li)獨(du)立(li)(li)的(de)(de)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)。進(jin)一(yi)(yi)步規范各(ge)級國(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)作(zuo)為政府直屬特設(she)機構(gou)的(de)(de)性(xing)質定(ding)位,依法保障(zhang)其專門性(xing)和獨(du)立(li)(li)性(xing)。明(ming)確政府公共管(guan)(guan)(guan)(guan)(guan)理部(bu)門不履(lv)(lv)行(xing)(xing)國(guo)(guo)有(you)資(zi)產(chan)(chan)出資(zi)人職(zhi)責。進(jin)一(yi)(yi)步落實“上級政府國(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)機構(gou)對下(xia)級政府的(de)(de)國(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)(jian)(jian)(jian)督(du)管(guan)(guan)(guan)(guan)(guan)理工作(zuo)進(jin)行(xing)(xing)指導(dao)和監(jian)(jian)(jian)(jian)督(du)”的(de)(de)規定(ding),各(ge)級國(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)部(bu)門在依法履(lv)(lv)行(xing)(xing)出資(zi)人職(zhi)責的(de)(de)基(ji)礎上,深(shen)入開展(zhan)國(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan),防止將(jiang)國(guo)(guo)有(you)資(zi)產(chan)(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)職(zhi)責混同于行(xing)(xing)政管(guan)(guan)(guan)(guan)(guan)理職(zhi)能,形成新的(de)(de)國(guo)(guo)有(you)資(zi)產(chan)(chan)多頭監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)。

  (三)推進經營性國有(you)資產集(ji)中統一監管


  明(ming)確(que)(que)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管政策制度的(de)(de)(de)(de)統一性(xing)。經營性(xing)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管要堅持已形成并在實踐中證明(ming)行之有(you)(you)(you)效的(de)(de)(de)(de)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管法(fa)律法(fa)規(gui)制度的(de)(de)(de)(de)基本原則(ze),要有(you)(you)(you)明(ming)確(que)(que)的(de)(de)(de)(de)出資(zi)主體(ti),要落(luo)實保值增值責任,要建立考核(he)與(yu)薪酬掛鉤的(de)(de)(de)(de)激勵約束機制,提高國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)的(de)(de)(de)(de)監(jian)(jian)(jian)(jian)管效能。總(zong)結推廣部分地方(fang)開展集中統一監(jian)(jian)(jian)(jian)管的(de)(de)(de)(de)經驗(yan),充分發揮各級國(guo)資(zi)委的(de)(de)(de)(de)專業(ye)化監(jian)(jian)(jian)(jian)管優勢,探索實現國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管的(de)(de)(de)(de)全覆蓋,防止經營性(xing)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管條塊分割,為在更大范圍優化配置資(zi)源(yuan)、提高國(guo)有(you)(you)(you)資(zi)本運行效率、加快資(zi)源(yuan)整合和(he)企(qi)業(ye)重組、培(pei)育具有(you)(you)(you)核(he)心(xin)競爭力的(de)(de)(de)(de)企(qi)業(ye)集團(tuan)創造(zao)有(you)(you)(you)利條件。行政事業(ye)性(xing)和(he)資(zi)源(yuan)性(xing)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)轉為經營性(xing)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)的(de)(de)(de)(de),都要納入經營性(xing)國(guo)有(you)(you)(you)資(zi)產(chan)(chan)(chan)監(jian)(jian)(jian)(jian)管體(ti)制。

  科學把握各(ge)(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產管(guan)理的(de)(de)特(te)(te)殊性(xing),針(zhen)(zhen)對(dui)(dui)具有(you)(you)不(bu)同(tong)屬性(xing)和(he)特(te)(te)點的(de)(de)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產,探索有(you)(you)針(zhen)(zhen)對(dui)(dui)性(xing)的(de)(de)監管(guan)模式和(he)方式方法。根據國(guo)(guo)(guo)家經濟(ji)社會發展的(de)(de)不(bu)同(tong)階段和(he)面臨的(de)(de)新形勢(shi)新任務新要求,及時調整(zheng)監管(guan)措施(shi)和(he)重點。完善績效(xiao)考核體系,加大分類(lei)(lei)考核力(li)(li)度(du),探索不(bu)同(tong)性(xing)質、不(bu)同(tong)類(lei)(lei)別(bie)、不(bu)同(tong)行業的(de)(de)績效(xiao)考核模式,提高(gao)考核指(zhi)標的(de)(de)導向性(xing)和(he)針(zhen)(zhen)對(dui)(dui)性(xing),切實(shi)(shi)落實(shi)(shi)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產保(bao)值(zhi)增值(zhi)、有(you)(you)效(xiao)使用和(he)管(guan)理責任。加強(qiang)對(dui)(dui)各(ge)(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產經營管(guan)理和(he)使用重點環節的(de)(de)監管(guan),形成依靠政(zheng)府、聯合部門(men)、協調各(ge)(ge)界的(de)(de)國(guo)(guo)(guo)資(zi)(zi)監管(guan)大格局,使各(ge)(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產監管(guan)的(de)(de)工作合力(li)(li)進一(yi)步(bu)增強(qiang),國(guo)(guo)(guo)有(you)(you)資(zi)(zi)產配置效(xiao)率進一(yi)步(bu)提高(gao)。
