王勇:完善各類國有資產管理體制

  黨(dang)的(de)十八大明確提出要(yao)“完善各類(lei)(lei)國有資產管理(li)(li)體(ti)制”,這既(ji)是對黨(dang)的(de)十六大以來國有資產管理(li)(li)體(ti)制改革取得成效的(de)充分肯定(ding),也(ye)是對進一步加(jia)強各類(lei)(lei)國有資產監管作(zuo)出的(de)重要(yao)部署。我們要(yao)深刻領會和認真(zhen)貫徹黨(dang)的(de)十八大精(jing)神(shen)(shen),牢牢把(ba)握正(zheng)確的(de)改革方向,以改革創(chuang)新的(de)精(jing)神(shen)(shen)不斷完善各類(lei)(lei)國有資產管理(li)(li)體(ti)制。


  一、深刻認識完善各類國有資產管理體制的重要意義


  我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)包括經營性(xing)(xing)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)(含(han)國(guo)(guo)(guo)有(you)金融資產(chan)(chan)(chan)(chan))、行(xing)政事業(ye)性(xing)(xing)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)、資源(yuan)性(xing)(xing)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)。隨(sui)著社(she)會(hui)(hui)(hui)主義現(xian)代(dai)化建(jian)設的(de)不斷推進,我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)規(gui)模不斷擴大、質量不斷提(ti)高,在經濟社(she)會(hui)(hui)(hui)發展中發揮(hui)(hui)著不可替代(dai)的(de)作用。完善各(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)管理體制(zhi),就是(shi)要(yao)立足(zu)我(wo)(wo)國(guo)(guo)(guo)國(guo)(guo)(guo)情,針對各(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)的(de)屬性(xing)(xing)和特(te)點,建(jian)立健全適應社(she)會(hui)(hui)(hui)主義市(shi)場經濟要(yao)求(qiu)的(de)管理體制(zhi)和制(zhi)度(du)體系,保護好(hao)、利用好(hao)、經營好(hao)各(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan),最大限(xian)度(du)地發揮(hui)(hui)好(hao)各(ge)類(lei)(lei)國(guo)(guo)(guo)有(you)資產(chan)(chan)(chan)(chan)的(de)作用,創造(zao)更好(hao)的(de)經濟效益(yi)和社(she)會(hui)(hui)(hui)效益(yi),為建(jian)設中國(guo)(guo)(guo)特(te)色社(she)會(hui)(hui)(hui)主義提(ti)供堅(jian)實(shi)的(de)經濟和政治基礎(chu)。


  (一(yi))完善各類國有資產管理(li)體制(zhi)是進一(yi)步完善社(she)會主義市(shi)場(chang)經濟(ji)體制(zhi)的必然選(xuan)擇(ze)


  完(wan)(wan)善(shan)(shan)社會(hui)主義(yi)市(shi)(shi)場(chang)(chang)(chang)經(jing)(jing)(jing)濟體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi),使(shi)公有(you)(you)制(zhi)(zhi)(zhi)(zhi)與(yu)市(shi)(shi)場(chang)(chang)(chang)經(jing)(jing)(jing)濟有(you)(you)機結合(he),一(yi)(yi)(yi)方(fang)面(mian)要求國(guo)(guo)(guo)(guo)(guo)有(you)(you)經(jing)(jing)(jing)濟不(bu)(bu)斷(duan)(duan)增(zeng)強控(kong)制(zhi)(zhi)(zhi)(zhi)力(li)和(he)(he)(he)影響(xiang)力(li),在經(jing)(jing)(jing)濟發(fa)展(zhan)(zhan)中發(fa)揮(hui)主導作用;另(ling)一(yi)(yi)(yi)方(fang)面(mian)要求國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)不(bu)(bu)斷(duan)(duan)增(zeng)強活力(li)和(he)(he)(he)競(jing)爭力(li),真正(zheng)成為市(shi)(shi)場(chang)(chang)(chang)經(jing)(jing)(jing)濟的(de)重要主體(ti)(ti)(ti)(ti)(ti),這(zhe)需(xu)要以完(wan)(wan)善(shan)(shan)的(de)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)為保障。黨的(de)十六大以來,國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)改革取得了積極(ji)的(de)進(jin)展(zhan)(zhan)和(he)(he)(he)成效,國(guo)(guo)(guo)(guo)(guo)務院(yuan)、省(區、市(shi)(shi))、市(shi)(shi)(地(di))三級國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)機構相繼建(jian)立(li),明確了政府(fu)層面(mian)的(de)出(chu)資(zi)人代表(biao),大部分(fen)經(jing)(jing)(jing)營性(xing)非金(jin)融國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)納入監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)(ti)(ti)(ti)(ti)系;基本形成了企(qi)業(ye)(ye)(ye)(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)(fa)律法(fa)(fa)規制(zhi)(zhi)(zhi)(zhi)度(du)體(ti)(ti)(ti)(ti)(ti)系,國(guo)(guo)(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)出(chu)臺的(de)規章和(he)(he)(he)規范性(xing)文(wen)件(jian)(jian)299件(jian)(jian),地(di)方(fang)政府(fu)和(he)(he)(he)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)發(fa)布(bu)的(de)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)法(fa)(fa)規、制(zhi)(zhi)(zhi)(zhi)度(du)2800多(duo)件(jian)(jian);強化了對企(qi)業(ye)(ye)(ye)(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)的(de)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),業(ye)(ye)(ye)(ye)績(ji)考核(he)和(he)(he)(he)激勵約束機制(zhi)(zhi)(zhi)(zhi)建(jian)立(li)并不(bu)(bu)斷(duan)(duan)完(wan)(wan)善(shan)(shan),財務監(jian)(jian)(jian)(jian)(jian)督、審計監(jian)(jian)(jian)(jian)(jian)督、監(jian)(jian)(jian)(jian)(jian)事會(hui)監(jian)(jian)(jian)(jian)(jian)督機制(zhi)(zhi)(zhi)(zhi)不(bu)(bu)斷(duan)(duan)完(wan)(wan)善(shan)(shan),產(chan)權管(guan)(guan)(guan)(guan)理(li)(li)不(bu)(bu)斷(duan)(duan)加強,國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)本預算管(guan)(guan)(guan)(guan)理(li)(li)制(zhi)(zhi)(zhi)(zhi)度(du)和(he)(he)(he)收益管(guan)(guan)(guan)(guan)理(li)(li)機制(zhi)(zhi)(zhi)(zhi)逐(zhu)步建(jian)立(li)。這(zhe)一(yi)(yi)(yi)系列重要舉措,為國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)改革發(fa)展(zhan)(zhan)創造了良(liang)好的(de)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)環境(jing),促進(jin)了社會(hui)主義(yi)市(shi)(shi)場(chang)(chang)(chang)經(jing)(jing)(jing)濟體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)的(de)完(wan)(wan)善(shan)(shan)。但(dan)目前,各(ge)類(lei)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)管(guan)(guan)(guan)(guan)理(li)(li)的(de)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)還(huan)沒(mei)有(you)(you)完(wan)(wan)全理(li)(li)順(shun),機制(zhi)(zhi)(zhi)(zhi)和(he)(he)(he)法(fa)(fa)規制(zhi)(zhi)(zhi)(zhi)度(du)還(huan)不(bu)(bu)完(wan)(wan)善(shan)(shan),存在責任主體(ti)(ti)(ti)(ti)(ti)不(bu)(bu)明確、監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)不(bu)(bu)到位、配置不(bu)(bu)合(he)理(li)(li)等現(xian)象;一(yi)(yi)(yi)些特定行業(ye)(ye)(ye)(ye)的(de)企(qi)業(ye)(ye)(ye)(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)還(huan)沒(mei)有(you)(you)納入新(xin)的(de)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi),出(chu)資(zi)人職能(neng)(neng)還(huan)沒(mei)有(you)(you)完(wan)(wan)全落實,國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)科學(xue)性(xing)有(you)(you)效性(xing)有(you)(you)待(dai)進(jin)一(yi)(yi)(yi)步增(zeng)強。適應完(wan)(wan)善(shan)(shan)社會(hui)主義(yi)市(shi)(shi)場(chang)(chang)(chang)經(jing)(jing)(jing)濟體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi)的(de)要求,必須進(jin)一(yi)(yi)(yi)步完(wan)(wan)善(shan)(shan)各(ge)類(lei)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)管(guan)(guan)(guan)(guan)理(li)(li)體(ti)(ti)(ti)(ti)(ti)制(zhi)(zhi)(zhi)(zhi),使(shi)各(ge)類(lei)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)更好地(di)發(fa)揮(hui)其(qi)經(jing)(jing)(jing)濟社會(hui)功能(neng)(neng),使(shi)國(guo)(guo)(guo)(guo)(guo)有(you)(you)企(qi)業(ye)(ye)(ye)(ye)真正(zheng)成為獨立(li)的(de)市(shi)(shi)場(chang)(chang)(chang)主體(ti)(ti)(ti)(ti)(ti)。


  (二(er))完善(shan)各類國有資(zi)產管(guan)理體(ti)制是深化行(xing)政體(ti)制改革、轉變政府職(zhi)能(neng)的客觀需(xu)要


  黨的(de)(de)(de)十八大指出(chu),要深(shen)入推(tui)進(jin)政(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)分開(kai)、政(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)分開(kai)、政(zheng)(zheng)(zheng)(zheng)事(shi)分開(kai)、政(zheng)(zheng)(zheng)(zheng)社分開(kai)。這是(shi)深(shen)化(hua)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)改(gai)革(ge)、轉(zhuan)(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職能(neng)(neng)的(de)(de)(de)重(zhong)要內容,對完善(shan)各(ge)類國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產管(guan)(guan)理(li)(li)(li)(li)(li)(li)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)提出(chu)了(le)(le)(le)新的(de)(de)(de)要求。改(gai)革(ge)開(kai)放(fang)初期,國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業(ye)實(shi)際(ji)上(shang)是(shi)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)的(de)(de)(de)附屬物與(yu)延伸,政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)很大精力放(fang)在管(guan)(guan)理(li)(li)(li)(li)(li)(li)國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業(ye)上(shang),企(qi)(qi)(qi)業(ye)的(de)(de)(de)生產、經(jing)營(ying)、人(ren)事(shi)都(dou)是(shi)由政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)直(zhi)接管(guan)(guan)理(li)(li)(li)(li)(li)(li)。隨(sui)著國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業(ye)改(gai)革(ge)的(de)(de)(de)推(tui)進(jin),企(qi)(qi)(qi)業(ye)被賦予了(le)(le)(le)更多的(de)(de)(de)經(jing)營(ying)自主權,但仍(reng)然沒有(you)(you)(you)從(cong)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)上(shang)理(li)(li)(li)(li)(li)(li)順政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)與(yu)企(qi)(qi)(qi)業(ye)的(de)(de)(de)關系。2000年(nian)國(guo)(guo)(guo)(guo)家撤銷政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)行(xing)(xing)(xing)業(ye)管(guan)(guan)理(li)(li)(li)(li)(li)(li)部(bu)門(men),減(jian)少了(le)(le)(le)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)對國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業(ye)的(de)(de)(de)直(zhi)接管(guan)(guan)理(li)(li)(li)(li)(li)(li),2003年(nian)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委的(de)(de)(de)成立(li)從(cong)機構(gou)設(she)(she)置(zhi)和制(zhi)(zhi)(zhi)度(du)安排上(shang)解決了(le)(le)(le)政(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)分開(kai)、政(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)分開(kai)的(de)(de)(de)問題,在深(shen)化(hua)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)改(gai)革(ge)、轉(zhuan)(zhuan)變(bian)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職能(neng)(neng)方面取(qu)得(de)了(le)(le)(le)重(zhong)大突破。新的(de)(de)(de)國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產管(guan)(guan)理(li)(li)(li)(li)(li)(li)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)從(cong)機構(gou)設(she)(she)置(zhi)上(shang)把政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)的(de)(de)(de)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)職能(neng)(neng)與(yu)出(chu)資(zi)(zi)(zi)人(ren)職能(neng)(neng)予以分離,明確政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)部(bu)門(men)不(bu)再履(lv)行(xing)(xing)(xing)出(chu)資(zi)(zi)(zi)人(ren)職責(ze)(ze),國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監管(guan)(guan)機構(gou)不(bu)履(lv)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)職責(ze)(ze),有(you)(you)(you)力促進(jin)了(le)(le)(le)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)改(gai)革(ge)和政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職能(neng)(neng)的(de)(de)(de)轉(zhuan)(zhuan)變(bian)。但目前很多改(gai)革(ge)措(cuo)施(shi)還(huan)不(bu)到位,一些政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)部(bu)門(men)仍(reng)然對國(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)(qi)(qi)業(ye)履(lv)行(xing)(xing)(xing)出(chu)資(zi)(zi)(zi)人(ren)職責(ze)(ze),國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監管(guan)(guan)機構(gou)也(ye)還(huan)承(cheng)擔著一些帶有(you)(you)(you)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)性質的(de)(de)(de)職能(neng)(neng),政(zheng)(zheng)(zheng)(zheng)企(qi)(qi)(qi)不(bu)分、政(zheng)(zheng)(zheng)(zheng)資(zi)(zi)(zi)不(bu)分的(de)(de)(de)現象依(yi)然存在。從(cong)根本上(shang)解決這些問題,需要進(jin)一步(bu)(bu)完善(shan)各(ge)類國(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產管(guan)(guan)理(li)(li)(li)(li)(li)(li)體(ti)(ti)(ti)制(zhi)(zhi)(zhi),進(jin)一步(bu)(bu)促進(jin)行(xing)(xing)(xing)政(zheng)(zheng)(zheng)(zheng)體(ti)(ti)(ti)制(zhi)(zhi)(zhi)改(gai)革(ge)和政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)職能(neng)(neng)轉(zhuan)(zhuan)變(bian),推(tui)動(dong)各(ge)級政(zheng)(zheng)(zheng)(zheng)府(fu)(fu)公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)部(bu)門(men)與(yu)所屬企(qi)(qi)(qi)業(ye)脫鉤,把精力集(ji)中到社會公共管(guan)(guan)理(li)(li)(li)(li)(li)(li)上(shang)來。


  (三)完善各類國有資產(chan)管(guan)理體制是進(jin)一步(bu)深(shen)化國有企業(ye)改(gai)革的迫切要(yao)求

  二、完善各類國有資產管理體制的方向和原則


  完(wan)善各類(lei)國(guo)有資(zi)(zi)產管理體制(zhi)(zhi),要(yao)堅(jian)持社(she)(she)會(hui)主(zhu)義(yi)基(ji)(ji)本(ben)經(jing)(jing)濟(ji)(ji)(ji)制(zhi)(zhi)度和市(shi)(shi)場(chang)(chang)經(jing)(jing)濟(ji)(ji)(ji)改(gai)革方(fang)向。黨的(de)(de)十(shi)八大(da)報告明確指出,要(yao)完(wan)善公有制(zhi)(zhi)為主(zhu)體、多種所有制(zhi)(zhi)經(jing)(jing)濟(ji)(ji)(ji)共同發(fa)展(zhan)(zhan)的(de)(de)基(ji)(ji)本(ben)經(jing)(jing)濟(ji)(ji)(ji)制(zhi)(zhi)度。完(wan)善社(she)(she)會(hui)主(zhu)義(yi)基(ji)(ji)本(ben)經(jing)(jing)濟(ji)(ji)(ji)制(zhi)(zhi)度,要(yao)求我們(men)在(zai)完(wan)善各類(lei)國(guo)有資(zi)(zi)產管理體制(zhi)(zhi)中,使(shi)(shi)各類(lei)國(guo)有資(zi)(zi)產實現(xian)最(zui)優化(hua)配(pei)(pei)置、最(zui)充(chong)分使(shi)(shi)用,爭取經(jing)(jing)濟(ji)(ji)(ji)效益和社(she)(she)會(hui)效益的(de)(de)統一;使(shi)(shi)國(guo)有經(jing)(jing)濟(ji)(ji)(ji)在(zai)經(jing)(jing)濟(ji)(ji)(ji)發(fa)展(zhan)(zhan)中的(de)(de)主(zhu)導作(zuo)用更(geng)好地發(fa)揮。堅(jian)持社(she)(she)會(hui)主(zhu)義(yi)市(shi)(shi)場(chang)(chang)經(jing)(jing)濟(ji)(ji)(ji)的(de)(de)改(gai)革方(fang)向,要(yao)求我們(men)在(zai)完(wan)善各類(lei)國(guo)有資(zi)(zi)產管理體制(zhi)(zhi)過程中,充(chong)分發(fa)揮市(shi)(shi)場(chang)(chang)在(zai)資(zi)(zi)源配(pei)(pei)置中的(de)(de)基(ji)(ji)礎性作(zuo)用,遵循市(shi)(shi)場(chang)(chang)經(jing)(jing)濟(ji)(ji)(ji)規律經(jing)(jing)營管理國(guo)有資(zi)(zi)產,推動國(guo)有資(zi)(zi)本(ben)優化(hua)配(pei)(pei)置,實現(xian)國(guo)有資(zi)(zi)產的(de)(de)保(bao)值增值。


  完善各(ge)類國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)管理(li)體(ti)制,要(yao)堅(jian)持國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)所(suo)(suo)有(you)、分級(ji)(ji)代(dai)表的(de)原(yuan)則。國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)所(suo)(suo)有(you)、分級(ji)(ji)代(dai)表,就(jiu)是(shi)(shi)在(zai)堅(jian)持國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)所(suo)(suo)有(you)的(de)前提下,中央政(zheng)(zheng)府(fu)和(he)地(di)(di)(di)方政(zheng)(zheng)府(fu)分別代(dai)表國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)履(lv)行(xing)(xing)出(chu)資(zi)(zi)(zi)人職(zhi)責,享有(you)所(suo)(suo)有(you)者權益。國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)所(suo)(suo)有(you)是(shi)(shi)我國(guo)(guo)(guo)(guo)(guo)現(xian)行(xing)(xing)法律制度所(suo)(suo)規(gui)(gui)定的(de),也(ye)是(shi)(shi)從整(zheng)體(ti)上落(luo)實對國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)的(de)管理(li)、更好(hao)地(di)(di)(di)配置國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)所(suo)(suo)需要(yao)的(de)。分級(ji)(ji)代(dai)表是(shi)(shi)現(xian)實的(de)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)形(xing)成和(he)管理(li)的(de)延續,也(ye)是(shi)(shi)調動(dong)各(ge)級(ji)(ji)政(zheng)(zheng)府(fu)積極性、更好(hao)地(di)(di)(di)落(luo)實國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)管理(li)責任(ren)、推(tui)動(dong)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)保值(zhi)增(zeng)值(zhi)和(he)最大限度發揮國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)使用效(xiao)率的(de)要(yao)求。按照國(guo)(guo)(guo)(guo)(guo)家(jia)(jia)所(suo)(suo)有(you)、分級(ji)(ji)代(dai)表的(de)原(yuan)則,各(ge)級(ji)(ji)政(zheng)(zheng)府(fu)要(yao)執行(xing)(xing)統(tong)一的(de)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監(jian)管法律法規(gui)(gui),建立(li)統(tong)一的(de)基(ji)礎管理(li)工(gong)作體(ti)系,上級(ji)(ji)政(zheng)(zheng)府(fu)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)管機構依法對下級(ji)(ji)政(zheng)(zheng)府(fu)的(de)國(guo)(guo)(guo)(guo)(guo)有(you)資(zi)(zi)(zi)產(chan)(chan)監(jian)督(du)管理(li)工(gong)作進行(xing)(xing)指導和(he)監(jian)督(du)。


  完善各(ge)類國(guo)有(you)(you)資(zi)產(chan)管(guan)理(li)體制,要堅持政(zheng)企(qi)(qi)(qi)分(fen)開(kai)、政(zheng)資(zi)分(fen)開(kai)、所(suo)有(you)(you)權(quan)(quan)和經(jing)(jing)營(ying)權(quan)(quan)相分(fen)離(li)的(de)原(yuan)則(ze)。政(zheng)企(qi)(qi)(qi)分(fen)開(kai)、政(zheng)資(zi)分(fen)開(kai)是理(li)順政(zheng)府與(yu)國(guo)有(you)(you)企(qi)(qi)(qi)業(ye)關系的(de)核心。根(gen)據(ju)社(she)會(hui)(hui)公共管(guan)理(li)職(zhi)(zhi)能和所(suo)有(you)(you)者(zhe)職(zhi)(zhi)能分(fen)開(kai)的(de)原(yuan)則(ze),國(guo)資(zi)監(jian)管(guan)機構(gou)專門承擔國(guo)有(you)(you)資(zi)產(chan)出資(zi)人職(zhi)(zhi)責,不(bu)(bu)承擔社(she)會(hui)(hui)公共管(guan)理(li)職(zhi)(zhi)能,社(she)會(hui)(hui)公共管(guan)理(li)部門從政(zheng)府經(jing)(jing)濟調節和社(she)會(hui)(hui)管(guan)理(li)角(jiao)度對(dui)各(ge)類所(suo)有(you)(you)制企(qi)(qi)(qi)業(ye)進行管(guan)理(li),不(bu)(bu)承擔出資(zi)人職(zhi)(zhi)責。按(an)照政(zheng)企(qi)(qi)(qi)分(fen)開(kai)以及所(suo)有(you)(you)權(quan)(quan)和經(jing)(jing)營(ying)權(quan)(quan)分(fen)離(li)的(de)原(yuan)則(ze),國(guo)資(zi)監(jian)管(guan)機構(gou)依(yi)法對(dui)企(qi)(qi)(qi)業(ye)的(de)國(guo)有(you)(you)資(zi)產(chan)進行監(jian)管(guan),不(bu)(bu)能干預企(qi)(qi)(qi)業(ye)的(de)生(sheng)產(chan)經(jing)(jing)營(ying)活動。企(qi)(qi)(qi)業(ye)必須自(zi)覺接受國(guo)資(zi)監(jian)管(guan)機構(gou)的(de)監(jian)管(guan),不(bu)(bu)得損害所(suo)有(you)(you)者(zhe)權(quan)(quan)益。


  完善各(ge)類(lei)國(guo)(guo)有(you)資(zi)(zi)產(chan)管(guan)(guan)(guan)理體制(zhi),要(yao)堅持權利、義務(wu)和責(ze)任相統(tong)一,管(guan)(guan)(guan)資(zi)(zi)產(chan)和管(guan)(guan)(guan)人(ren)、管(guan)(guan)(guan)事相結合的(de)原則。各(ge)級國(guo)(guo)資(zi)(zi)監(jian)管(guan)(guan)(guan)機構經(jing)(jing)授權代表(biao)本(ben)級人(ren)民政府對國(guo)(guo)有(you)資(zi)(zi)產(chan)履行出(chu)資(zi)(zi)人(ren)職責(ze),享有(you)資(zi)(zi)產(chan)收益權、參與重(zhong)大決策和選擇(ze)管(guan)(guan)(guan)理者等出(chu)資(zi)(zi)人(ren)權利,對出(chu)資(zi)(zi)企業國(guo)(guo)有(you)資(zi)(zi)產(chan)保值增值和發(fa)揮好國(guo)(guo)有(you)資(zi)(zi)產(chan)在經(jing)(jing)濟社會發(fa)展中的(de)作用負責(ze),接受本(ben)級人(ren)民政府的(de)監(jian)督和考核。國(guo)(guo)資(zi)(zi)監(jian)管(guan)(guan)(guan)機構建立(li)以績(ji)效考核、薪酬分(fen)配(pei)、領(ling)導(dao)人(ren)員(yuan)管(guan)(guan)(guan)理和財務(wu)評價、產(chan)權管(guan)(guan)(guan)理、風(feng)險(xian)管(guan)(guan)(guan)控等為主線的(de)工(gong)作閉環體系,實現管(guan)(guan)(guan)人(ren)、管(guan)(guan)(guan)事、管(guan)(guan)(guan)資(zi)(zi)產(chan)的(de)有(you)效結合。


    三、完善各類國有資產管理體制的主要任務


  完善各(ge)(ge)類國有資(zi)產管理體制意義重(zhong)(zhong)大(da),影響深遠(yuan)。我(wo)們要按照黨的十(shi)八大(da)的重(zhong)(zhong)要部署,繼續堅(jian)持(chi)經過(guo)實踐證明行之有效的重(zhong)(zhong)大(da)原(yuan)則,持(chi)續推(tui)進完善各(ge)(ge)類國有資(zi)產管理體制的各(ge)(ge)項任務。


  (一(yi))完善(shan)國資(zi)監(jian)管機構和職能


  進(jin)一步(bu)明確(que)各(ge)類國(guo)(guo)有(you)(you)資(zi)(zi)產責(ze)任(ren)主體,明晰產權關系,建立(li)體制機(ji)制,落實監(jian)(jian)管(guan)責(ze)任(ren)。進(jin)一步(bu)完善中央、省(區、市(shi))、市(shi)(地)三級(ji)(ji)經營性(xing)國(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)(jian)管(guan)機(ji)構(gou),經營性(xing)國(guo)(guo)有(you)(you)資(zi)(zi)產規模較大的(de)縣(xian)(市(shi))可探(tan)索設立(li)獨(du)立(li)的(de)監(jian)(jian)管(guan)機(ji)構(gou)。進(jin)一步(bu)規范各(ge)級(ji)(ji)國(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)機(ji)構(gou)作為政府直(zhi)屬特設機(ji)構(gou)的(de)性(xing)質定位(wei),依(yi)法保障其專門(men)性(xing)和獨(du)立(li)性(xing)。明確(que)政府公共(gong)管(guan)理(li)部門(men)不履(lv)行(xing)國(guo)(guo)有(you)(you)資(zi)(zi)產出(chu)資(zi)(zi)人職責(ze)。進(jin)一步(bu)落實“上級(ji)(ji)政府國(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)(jian)管(guan)機(ji)構(gou)對(dui)下級(ji)(ji)政府的(de)國(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)(jian)督管(guan)理(li)工作進(jin)行(xing)指導和監(jian)(jian)督”的(de)規定,各(ge)級(ji)(ji)國(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)部門(men)在(zai)依(yi)法履(lv)行(xing)出(chu)資(zi)(zi)人職責(ze)的(de)基礎上,深(shen)入開展國(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)(jian)管(guan),防止將國(guo)(guo)有(you)(you)資(zi)(zi)產監(jian)(jian)管(guan)職責(ze)混同(tong)于行(xing)政管(guan)理(li)職能(neng),形成新的(de)國(guo)(guo)有(you)(you)資(zi)(zi)產多頭監(jian)(jian)管(guan)。


  (二)完善(shan)國資監管法規(gui)規(gui)章
