《國(guo)(guo)務院(yuan)辦(ban)公廳(ting)關于(yu)(yu)建(jian)立(li)國(guo)(guo)有(you)企業(ye)違(wei)規經營投資(zi)(zi)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)(zhi)度的(de)意見》(國(guo)(guo)辦(ban)發(fa)〔2016〕63號(hao)(hao),以下簡稱63號(hao)(hao)文件(jian))要求在(zai)2020年(nian)年(nian)底(di)前,全(quan)面建(jian)立(li)覆蓋(gai)各級(ji)履行出資(zi)(zi)人職責(ze)的(de)機構及國(guo)(guo)有(you)企業(ye)的(de)責(ze)任(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)體(ti)系,形成(cheng)(cheng)職責(ze)明(ming)確(que)、流程清晰(xi)、規范有(you)序的(de)責(ze)任(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)機制(zhi)(zhi)。各地國(guo)(guo)資(zi)(zi)委(wei)高(gao)度重(zhong)視(shi),積(ji)極(ji)推進違(wei)規經營投資(zi)(zi)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)(zhi)度機制(zhi)(zhi)和(he)組織體(ti)系建(jian)設(she),35個地方(含計劃單(dan)列市和(he)新疆生產建(jian)設(she)兵(bing)團)出臺(tai)了(le)(le)(le)違(wei)規經營投資(zi)(zi)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)(zhi)度,設(she)立(li)或明(ming)確(que)了(le)(le)(le)專門部門承擔(dan)責(ze)任(ren)追(zhui)究(jiu)(jiu)職責(ze),實現了(le)(le)(le)責(ze)任(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)有(you)序平穩起步(bu),為(wei)(wei)推動企業(ye)高(gao)質量發(fa)展發(fa)揮了(le)(le)(le)積(ji)極(ji)作(zuo)(zuo)(zuo)(zuo)用。但由于(yu)(yu)責(ze)任(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)政策(ce)性(xing)強、涉及面廣(guang),工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)處于(yu)(yu)探索階段,仍存(cun)在(zai)對違(wei)規責(ze)任(ren)追(zhui)究(jiu)(jiu)重(zhong)要性(xing)認識不到位,體(ti)系建(jian)設(she)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)相對滯后(hou),保(bao)障機制(zhi)(zhi)還比較(jiao)薄弱等問題(ti)。為(wei)(wei)進一步(bu)推動各級(ji)履行出資(zi)(zi)人職責(ze)的(de)機構及國(guo)(guo)有(you)企業(ye)責(ze)任(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)體(ti)系建(jian)設(she),按期(qi)完(wan)成(cheng)(cheng)2020年(nian)年(nian)底(di)工(gong)(gong)作(zuo)(zuo)(zuo)(zuo)目標,現將有(you)關事(shi)項通知(zhi)如下:
一、提高政治站位,深化對責任追究工作重要性的認識。黨中央(yang)、國(guo)(guo)(guo)(guo)(guo)務院(yuan)高(gao)度重視強(qiang)化(hua)國(guo)(guo)(guo)(guo)(guo)有資(zi)產監管、落(luo)實(shi)國(guo)(guo)(guo)(guo)(guo)有企業(ye)經營(ying)投(tou)資(zi)責(ze)(ze)(ze)任(ren),黨的十八屆三中全(quan)(quan)會以及(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)(guo)(guo)企改革系列(lie)文件對強(qiang)化(hua)經營(ying)投(tou)資(zi)責(ze)(ze)(ze)任(ren)追(zhui)究(jiu),建(jian)立(li)健全(quan)(quan)國(guo)(guo)(guo)(guo)(guo)有企業(ye)重大決策失誤和失職、瀆職責(ze)(ze)(ze)任(ren)追(zhui)究(jiu)倒查機制等提(ti)(ti)出(chu)了明確(que)要求(qiu)。各地國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)要站在守(shou)護(hu)好全(quan)(quan)體人(ren)民(min)共同財富的高(gao)度,深刻理(li)解責(ze)(ze)(ze)任(ren)追(zhui)究(jiu)工(gong)作(zuo)在有效(xiao)防(fang)止國(guo)(guo)(guo)(guo)(guo)有資(zi)產流失、落(luo)實(shi)國(guo)(guo)(guo)(guo)(guo)有資(zi)產保值增值責(ze)(ze)(ze)任(ren)方面的重要作(zuo)用,將推進(jin)責(ze)(ze)(ze)任(ren)追(zhui)究(jiu)工(gong)作(zuo)體系建(jian)設作(zuo)為提(ti)(ti)升(sheng)國(guo)(guo)(guo)(guo)(guo)有企業(ye)合(he)規(gui)經營(ying)水(shui)平和防(fang)范(fan)化(hua)解重大風險的重要抓手(shou),通過有效(xiao)開(kai)展責(ze)(ze)(ze)任(ren)追(zhui)究(jiu)工(gong)作(zuo),促(cu)進(jin)各級經營(ying)管理(li)人(ren)員規(gui)范(fan)履(lv)職、勤(qin)勉盡責(ze)(ze)(ze),推動企業(ye)提(ti)(ti)升(sheng)合(he)規(gui)經營(ying)管理(li)水(shui)平。
二、持續完善責任追究制度體系,實現制度全面覆蓋和有效約束。各地國(guo)資(zi)委要加快構建內容協調、流程(cheng)清(qing)晰、配套完備、有(you)(you)效管用的責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)度體系。要根據地區具(ju)體情(qing)況、企(qi)(qi)業(ye)規(gui)(gui)模(mo)體量差異、業(ye)務模(mo)式特點等,制(zhi)定履(lv)行出資(zi)人職責(ze)的機構及國(guo)有(you)(you)企(qi)(qi)業(ye)違規(gui)(gui)經營投資(zi)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)度,細化各類經營投資(zi)責(ze)任(ren)條款和清(qing)單,明(ming)確責(ze)任(ren)追(zhui)究(jiu)(jiu)范圍(wei)、劃分資(zi)產損失標(biao)準,規(gui)(gui)范責(ze)任(ren)追(zhui)究(jiu)(jiu)工作(zuo)流程(cheng),研究(jiu)(jiu)制(zhi)定損失認定、責(ze)任(ren)認定等實施細則,實現(xian)責(ze)任(ren)追(zhui)究(jiu)(jiu)工作(zuo)標(biao)準一致、有(you)(you)章可(ke)循、規(gui)(gui)范有(you)(you)序。2019年(nian)年(nian)底前,要確保(bao)實現(xian)省級違規(gui)(gui)經營投資(zi)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)度全(quan)(quan)覆蓋。2020年(nian)6月底前,要實現(xian)各級國(guo)有(you)(you)資(zi)產監(jian)督(du)管理機構及國(guo)有(you)(you)企(qi)(qi)業(ye)責(ze)任(ren)追(zhui)究(jiu)(jiu)制(zhi)度全(quan)(quan)覆蓋,同時做好制(zhi)度備案工作(zuo)。
三、加快推進組織體系建設,完善追責工作運行機制。各(ge)地(di)(di)(di)國資(zi)委要(yao)健全責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究組織(zhi)體系(xi),嚴格落實(shi)(shi)責(ze)任(ren)(ren)(ren)(ren)(ren),層層傳導壓力,持續深入推進責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)(gong)作。要(yao)根據(ju)地(di)(di)(di)方(fang)機(ji)構改革總體安排,科學設立或明(ming)(ming)確(que)具體部(bu)(bu)門(men)(men)承擔責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)(gong)作。同時結合地(di)(di)(di)方(fang)和企(qi)業(ye)(ye)實(shi)(shi)際、行業(ye)(ye)特點等,推進責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)(gong)作組織(zhi)體系(xi)建設,壓實(shi)(shi)責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究主體責(ze)任(ren)(ren)(ren)(ren)(ren),實(shi)(shi)現監(jian)督追(zhui)(zhui)(zhui)(zhui)責(ze)組織(zhi)體系(xi)全覆(fu)蓋(gai)。各(ge)地(di)(di)(di)國資(zi)委和所監(jian)管國有(you)企(qi)業(ye)(ye)要(yao)配(pei)齊配(pei)強配(pei)優工(gong)(gong)(gong)(gong)(gong)(gong)作隊伍(wu),提(ti)(ti)升工(gong)(gong)(gong)(gong)(gong)(gong)作人(ren)員專業(ye)(ye)能力,提(ti)(ti)供必要(yao)的(de)保障條件,確(que)保工(gong)(gong)(gong)(gong)(gong)(gong)作有(you)效開展。要(yao)完善(shan)聯合實(shi)(shi)施(shi)、協同聯動(dong)的(de)工(gong)(gong)(gong)(gong)(gong)(gong)作機(ji)制(zhi),加(jia)強與紀檢監(jian)察、巡視(shi)、審計、人(ren)力資(zi)源等部(bu)(bu)門(men)(men)的(de)協同配(pei)合。要(yao)努力提(ti)(ti)升工(gong)(gong)(gong)(gong)(gong)(gong)作信(xin)(xin)息化(hua)水(shui)平(ping),推進信(xin)(xin)息系(xi)統建設,力爭實(shi)(shi)現損(sun)失風(feng)險動(dong)態監(jian)測和責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)(gong)作全流程信(xin)(xin)息管理(li)。2020年年底(di)前形成(cheng)職(zhi)責(ze)明(ming)(ming)確(que)、流程清(qing)晰、規范有(you)序(xu)的(de)責(ze)任(ren)(ren)(ren)(ren)(ren)追(zhui)(zhui)(zhui)(zhui)究工(gong)(gong)(gong)(gong)(gong)(gong)作機(ji)制(zhi)。
四、堅持分級組織分類處理,扎實做好違規責任追究工作。各地國資(zi)(zi)委要(yao)按照國有(you)資(zi)(zi)本(ben)出(chu)資(zi)(zi)關(guan)系(xi)和干部管理(li)權(quan)限,界定(ding)(ding)責任(ren)追(zhui)究(jiu)(jiu)(jiu)工(gong)作(zuo)職責,分級(ji)組織開(kai)展責任(ren)追(zhui)究(jiu)(jiu)(jiu)工(gong)作(zuo)。要(yao)堅持違規(gui)必究(jiu)(jiu)(jiu),追(zhui)責必嚴,切實增強國資(zi)(zi)監管法(fa)(fa)規(gui)制度(du)和企業內部管理(li)規(gui)定(ding)(ding)剛性約束(shu)。要(yao)強化對違規(gui)經(jing)營投資(zi)(zi)責任(ren)追(zhui)究(jiu)(jiu)(jiu)定(ding)(ding)性、定(ding)(ding)損、定(ding)(ding)責等關(guan)鍵環(huan)節的指導把關(guan)和監督檢查,積(ji)極(ji)探索有(you)效的工(gong)作(zuo)方(fang)式(shi)方(fang)法(fa)(fa)。要(yao)加強案例通(tong)報,在(zai)適當(dang)范圍總結、通(tong)報及公(gong)開(kai)違規(gui)經(jing)營投資(zi)(zi)責任(ren)追(zhui)究(jiu)(jiu)(jiu)處理(li)情況(kuang),以案為鑒,發揮“追(zhui)責一個、警示一片(pian)”的警示教(jiao)育作(zuo)用。
五、堅持糾建并舉,健全以追責促發展的長效機制。責(ze)任追(zhui)(zhui)究是手段不是目的(de)(de),各地國資(zi)委與所監管國有企(qi)業都要注重(zhong)做好監督(du)追(zhui)(zhui)責(ze)“后(hou)半篇文章”,把(ba)追(zhui)(zhui)責(ze)成果轉化為(wei)促(cu)(cu)進企(qi)業健康發展(zhan)的(de)(de)監管效能。要以追(zhui)(zhui)責(ze)促(cu)(cu)追(zhui)(zhui)損,及時化解資(zi)產損失風險,防止國有資(zi)產流失。要舉一反(fan)三,以點帶面(mian),深入開展(zhan)共性問題(ti)核(he)查(cha),排查(cha)問題(ti)隱患,預警提示經營(ying)風險。要以責(ze)任追(zhui)(zhui)究為(wei)重(zhong)要抓(zhua)手,通過懲治(zhi)教(jiao)育和制(zhi)度建設(she)相結合,強化國有企(qi)業各級(ji)經營(ying)管理人員合規履職的(de)(de)自覺(jue)性和主動性,全面(mian)推進依法治(zhi)企(qi),有效促(cu)(cu)進企(qi)業穩健經營(ying)和可持續發展(zhan)。
各省(sheng)級國資委要(yao)按(an)照(zhao)目標要(yao)求,細化任(ren)務舉(ju)措,扎實推進各項(xiang)工作,請于(yu)2020年(nian)6月(yue)30日前書(shu)面報告階段性進展情況,于(yu)2020年(nian)12月(yue)底前報送63號文件目標任(ren)務完成情況。
