體系建設有關事項的通知

各省、自治區、直轄市及計劃單列市和新疆生產建設兵團國資委:

《國(guo)(guo)務院辦(ban)(ban)公廳關于建(jian)(jian)立國(guo)(guo)有(you)企業(ye)違(wei)(wei)規經營投(tou)資責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)制度的(de)(de)(de)意見》(國(guo)(guo)辦(ban)(ban)發〔2016〕63號,以下簡稱63號文件(jian))要求在(zai)2020年(nian)年(nian)底前,全面(mian)建(jian)(jian)立覆蓋各級履行(xing)(xing)出資人(ren)職責(ze)的(de)(de)(de)機構及國(guo)(guo)有(you)企業(ye)的(de)(de)(de)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)體系(xi),形成職責(ze)明確、流程清晰、規范有(you)序(xu)(xu)的(de)(de)(de)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)機制。各地國(guo)(guo)資委高度重視(shi),積極推(tui)進違(wei)(wei)規經營投(tou)資責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)制度機制和(he)組織體系(xi)建(jian)(jian)設(she),35個地方(含計劃(hua)單列市和(he)新(xin)疆生產建(jian)(jian)設(she)兵團(tuan))出臺了(le)(le)違(wei)(wei)規經營投(tou)資責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)制度,設(she)立或明確了(le)(le)專門部門承擔責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)職責(ze),實現了(le)(le)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)有(you)序(xu)(xu)平穩(wen)起步,為推(tui)動(dong)企業(ye)高質(zhi)量(liang)發展發揮(hui)了(le)(le)積極作(zuo)(zuo)(zuo)用。但由(you)于責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)政策性強、涉及面(mian)廣,工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)處于探(tan)索階段,仍存在(zai)對違(wei)(wei)規責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)重要性認識不到(dao)位,體系(xi)建(jian)(jian)設(she)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)相(xiang)對滯后,保障機制還比較(jiao)薄弱等問題(ti)。為進一步推(tui)動(dong)各級履行(xing)(xing)出資人(ren)職責(ze)的(de)(de)(de)機構及國(guo)(guo)有(you)企業(ye)責(ze)任(ren)(ren)(ren)追(zhui)究(jiu)(jiu)工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)體系(xi)建(jian)(jian)設(she),按期完成2020年(nian)年(nian)底工(gong)(gong)(gong)(gong)作(zuo)(zuo)(zuo)目標,現將有(you)關事項(xiang)通知如(ru)下:

一、提高政治站位,深化對責任追究工作重要性的認識。黨(dang)中央(yang)、國(guo)(guo)(guo)(guo)(guo)務院(yuan)高(gao)(gao)度重視(shi)強化(hua)國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產監管、落(luo)實國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)經(jing)營投(tou)資(zi)(zi)(zi)責(ze)任(ren)(ren),黨(dang)的(de)十八屆三中全會以及國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)企(qi)改革(ge)系(xi)列(lie)文(wen)件對(dui)強化(hua)經(jing)營投(tou)資(zi)(zi)(zi)責(ze)任(ren)(ren)追(zhui)究(jiu),建(jian)立健全國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)重大決策失(shi)誤和失(shi)職、瀆(du)職責(ze)任(ren)(ren)追(zhui)究(jiu)倒(dao)查機制等提出了(le)明確要求。各地國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委要站在(zai)守(shou)護(hu)好(hao)全體人民共同財(cai)富(fu)的(de)高(gao)(gao)度,深刻理解(jie)責(ze)任(ren)(ren)追(zhui)究(jiu)工(gong)(gong)(gong)作(zuo)在(zai)有(you)(you)(you)效防(fang)止國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產流失(shi)、落(luo)實國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)資(zi)(zi)(zi)產保(bao)值增值責(ze)任(ren)(ren)方面的(de)重要作(zuo)用,將推進(jin)責(ze)任(ren)(ren)追(zhui)究(jiu)工(gong)(gong)(gong)作(zuo)體系(xi)建(jian)設作(zuo)為提升(sheng)國(guo)(guo)(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)合(he)規經(jing)營水平(ping)和防(fang)范(fan)化(hua)解(jie)重大風險的(de)重要抓手,通過(guo)有(you)(you)(you)效開(kai)展責(ze)任(ren)(ren)追(zhui)究(jiu)工(gong)(gong)(gong)作(zuo),促(cu)進(jin)各級經(jing)營管理人員規范(fan)履職、勤勉盡(jin)責(ze),推動企(qi)業(ye)(ye)提升(sheng)合(he)規經(jing)營管理水平(ping)。

二、持續完善責任追究制度體系,實現制度全面覆蓋和有效約束。各地(di)國資(zi)(zi)委要(yao)加(jia)快構(gou)建(jian)內容協調(diao)、流(liu)程清(qing)晰、配套完(wan)備、有(you)(you)(you)(you)效管用的責(ze)(ze)任(ren)(ren)(ren)追(zhui)究制(zhi)度體系。要(yao)根(gen)據地(di)區具體情況、企業(ye)規模(mo)(mo)體量(liang)差異(yi)、業(ye)務模(mo)(mo)式(shi)特點等,制(zhi)定(ding)履行出資(zi)(zi)人(ren)職責(ze)(ze)的機(ji)構(gou)及國有(you)(you)(you)(you)企業(ye)違規經營(ying)投資(zi)(zi)責(ze)(ze)任(ren)(ren)(ren)追(zhui)究制(zhi)度,細化各類經營(ying)投資(zi)(zi)責(ze)(ze)任(ren)(ren)(ren)條(tiao)款和(he)清(qing)單,明(ming)確責(ze)(ze)任(ren)(ren)(ren)追(zhui)究范圍、劃分資(zi)(zi)產(chan)損(sun)失標(biao)(biao)準,規范責(ze)(ze)任(ren)(ren)(ren)追(zhui)究工作(zuo)流(liu)程,研究制(zhi)定(ding)損(sun)失認定(ding)、責(ze)(ze)任(ren)(ren)(ren)認定(ding)等實(shi)施(shi)細則,實(shi)現(xian)責(ze)(ze)任(ren)(ren)(ren)追(zhui)究工作(zuo)標(biao)(biao)準一致、有(you)(you)(you)(you)章可循、規范有(you)(you)(you)(you)序。2019年(nian)年(nian)底前,要(yao)確保實(shi)現(xian)省(sheng)級(ji)違規經營(ying)投資(zi)(zi)責(ze)(ze)任(ren)(ren)(ren)追(zhui)究制(zhi)度全(quan)覆(fu)(fu)蓋(gai)。2020年(nian)6月底前,要(yao)實(shi)現(xian)各級(ji)國有(you)(you)(you)(you)資(zi)(zi)產(chan)監督管理(li)機(ji)構(gou)及國有(you)(you)(you)(you)企業(ye)責(ze)(ze)任(ren)(ren)(ren)追(zhui)究制(zhi)度全(quan)覆(fu)(fu)蓋(gai),同時做好制(zhi)度備案工作(zuo)。

三、加快推進組織體系建設,完善追責工作運行機制。各地(di)(di)國資(zi)(zi)委要健全責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)組織(zhi)體(ti)系,嚴格落實(shi)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren),層(ceng)層(ceng)傳導(dao)壓力,持續(xu)深入(ru)推進責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)工(gong)(gong)作(zuo)(zuo)。要根據地(di)(di)方機(ji)(ji)構改(gai)革總體(ti)安(an)排,科學(xue)設立(li)或明確具體(ti)部門承擔(dan)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)工(gong)(gong)作(zuo)(zuo)。同時結合地(di)(di)方和(he)(he)企(qi)業(ye)(ye)實(shi)際、行(xing)業(ye)(ye)特點等,推進責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)工(gong)(gong)作(zuo)(zuo)組織(zhi)體(ti)系建(jian)設,壓實(shi)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)主體(ti)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren),實(shi)現(xian)監督追(zhui)(zhui)責(ze)(ze)(ze)(ze)(ze)組織(zhi)體(ti)系全覆(fu)蓋(gai)。各地(di)(di)國資(zi)(zi)委和(he)(he)所監管國有企(qi)業(ye)(ye)要配(pei)(pei)齊配(pei)(pei)強配(pei)(pei)優工(gong)(gong)作(zuo)(zuo)隊伍(wu),提(ti)升工(gong)(gong)作(zuo)(zuo)人(ren)員專業(ye)(ye)能力,提(ti)供必要的(de)保(bao)障(zhang)條件,確保(bao)工(gong)(gong)作(zuo)(zuo)有效開展(zhan)。要完善聯(lian)(lian)合實(shi)施、協同聯(lian)(lian)動(dong)的(de)工(gong)(gong)作(zuo)(zuo)機(ji)(ji)制,加強與(yu)紀(ji)檢監察、巡視、審計(ji)、人(ren)力資(zi)(zi)源等部門的(de)協同配(pei)(pei)合。要努力提(ti)升工(gong)(gong)作(zuo)(zuo)信(xin)(xin)息化(hua)水平,推進信(xin)(xin)息系統建(jian)設,力爭(zheng)實(shi)現(xian)損失風險動(dong)態監測(ce)和(he)(he)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)工(gong)(gong)作(zuo)(zuo)全流程信(xin)(xin)息管理。2020年年底前(qian)形成職責(ze)(ze)(ze)(ze)(ze)明確、流程清晰(xi)、規范有序的(de)責(ze)(ze)(ze)(ze)(ze)任(ren)(ren)追(zhui)(zhui)究(jiu)工(gong)(gong)作(zuo)(zuo)機(ji)(ji)制。

四、堅持分級組織分類處理,扎實做好違規責任追究工作。各地國(guo)(guo)資(zi)委要(yao)按照國(guo)(guo)有資(zi)本出資(zi)關(guan)系(xi)和干部(bu)管(guan)理權限,界定責任追(zhui)究工(gong)作(zuo)職責,分(fen)級組織開(kai)展責任追(zhui)究工(gong)作(zuo)。要(yao)堅持違(wei)(wei)規(gui)必究,追(zhui)責必嚴,切實增強(qiang)國(guo)(guo)資(zi)監(jian)(jian)管(guan)法(fa)規(gui)制度和企業內(nei)部(bu)管(guan)理規(gui)定剛性約(yue)束。要(yao)強(qiang)化對違(wei)(wei)規(gui)經營投(tou)資(zi)責任追(zhui)究定性、定損、定責等關(guan)鍵環節的(de)指導把關(guan)和監(jian)(jian)督檢查,積極探(tan)索有效(xiao)的(de)工(gong)作(zuo)方式方法(fa)。要(yao)加(jia)強(qiang)案例通(tong)報,在(zai)適當(dang)范圍(wei)總結、通(tong)報及公開(kai)違(wei)(wei)規(gui)經營投(tou)資(zi)責任追(zhui)究處理情況,以(yi)案為鑒,發揮“追(zhui)責一個(ge)、警(jing)示一片”的(de)警(jing)示教育作(zuo)用。

五、堅持糾建并舉,健全以追責促發展的長效機制。責任(ren)追(zhui)(zhui)究是手(shou)段(duan)不是目的(de),各(ge)地(di)國(guo)資(zi)委與(yu)所監(jian)(jian)管國(guo)有企業(ye)都要注(zhu)重(zhong)做好監(jian)(jian)督追(zhui)(zhui)責“后半(ban)篇文章”,把(ba)追(zhui)(zhui)責成果轉化(hua)為促(cu)進(jin)企業(ye)健(jian)康發(fa)(fa)展的(de)監(jian)(jian)管效能。要以追(zhui)(zhui)責促(cu)追(zhui)(zhui)損(sun)(sun),及時化(hua)解資(zi)產(chan)損(sun)(sun)失風險(xian),防(fang)止國(guo)有資(zi)產(chan)流失。要舉(ju)一反三,以點帶(dai)面,深入開(kai)展共性問(wen)(wen)題核查,排查問(wen)(wen)題隱患(huan),預警提示經營風險(xian)。要以責任(ren)追(zhui)(zhui)究為重(zhong)要抓手(shou),通過懲治(zhi)教(jiao)育和(he)制度(du)建設(she)相(xiang)結合,強化(hua)國(guo)有企業(ye)各(ge)級經營管理(li)人員合規履(lv)職(zhi)的(de)自(zi)覺性和(he)主(zhu)動性,全(quan)面推進(jin)依(yi)法治(zhi)企,有效促(cu)進(jin)企業(ye)穩健(jian)經營和(he)可(ke)持續發(fa)(fa)展。

各省(sheng)級(ji)國資委(wei)要(yao)按照目標要(yao)求(qiu),細化任務舉措(cuo),扎實推進(jin)(jin)各項工(gong)作,請(qing)于(yu)2020年6月(yue)30日(ri)前書面報(bao)(bao)告(gao)階(jie)段性進(jin)(jin)展情(qing)況,于(yu)2020年12月(yue)底(di)前報(bao)(bao)送63號文件(jian)目標任務完(wan)成(cheng)情(qing)況。
