貫徹落實黨的十(shi)九(jiu)大和(he)十(shi)九(jiu)屆二(er)中(zhong)(zhong)、三(san)中(zhong)(zhong)全會關于完善國有(you)資(zi)產管(guan)(guan)理體制的決策部(bu)署,各地圍繞(rao)以管(guan)(guan)資(zi)本為主積(ji)極推進(jin)職能轉變,不斷深(shen)化(hua)國有(you)資(zi)本投資(zi)、運營公司試點(dian),持續推進(jin)經營性國有(you)資(zi)產集中(zhong)(zhong)統一監管(guan)(guan),各項重點(dian)工作(zuo)取(qu)得積(ji)極進(jin)展。
一(yi)、國資(zi)(zi)監(jian)管(guan)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)轉(zhuan)(zhuan)變(bian)(bian)取(qu)得階段性成效。一(yi)是(shi)持續向(xiang)以管(guan)資(zi)(zi)本(ben)(ben)為主轉(zhuan)(zhuan)變(bian)(bian)。準確把握出(chu)資(zi)(zi)人(ren)代表職(zhi)(zhi)(zhi)(zhi)責定位,依法厘(li)清(qing)(qing)(qing)出(chu)資(zi)(zi)人(ren)履職(zhi)(zhi)(zhi)(zhi)邊界,以管(guan)資(zi)(zi)本(ben)(ben)為主調整優化(hua)(hua)(hua)監(jian)管(guan)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)和(he)方式(shi)。目前已(yi)有(you)16個(ge)地方出(chu)臺了職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)轉(zhuan)(zhuan)變(bian)(bian)方案。四(si)川對(dui)以管(guan)資(zi)(zi)本(ben)(ben)為主的(de)(de)(de)原則進行了細(xi)(xi)化(hua)(hua)(hua),強化(hua)(hua)(hua)了對(dui)國有(you)資(zi)(zi)本(ben)(ben)運(yun)營質量、企業財務狀況和(he)產權(quan)流轉(zhuan)(zhuan)環節監(jian)管(guan)。二是(shi)調整優化(hua)(hua)(hua)內(nei)設(she)機構(gou)。通過整合(he)、新設(she)等(deng)方式(shi)科(ke)學設(she)置內(nei)設(she)機構(gou)和(he)職(zhi)(zhi)(zhi)(zhi)責,著力優化(hua)(hua)(hua)監(jian)管(guan)流程。深圳先后2次調整機構(gou)設(she)置,強化(hua)(hua)(hua)綜合(he)研(yan)究、資(zi)(zi)本(ben)(ben)運(yun)作(zuo)(zuo)、股(gu)東(dong)事(shi)(shi)務等(deng)出(chu)資(zi)(zi)人(ren)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)。貴州和(he)重(zhong)慶整合(he)董事(shi)(shi)會(hui)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng),成立董事(shi)(shi)會(hui)監(jian)事(shi)(shi)會(hui)工(gong)作(zuo)(zuo)處,履行對(dui)企業董事(shi)(shi)會(hui)、監(jian)事(shi)(shi)會(hui)規范運(yun)作(zuo)(zuo)和(he)履職(zhi)(zhi)(zhi)(zhi)管(guan)理(li)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)。三是(shi)修(xiu)訂(ding)完善(shan)權(quan)責清(qing)(qing)(qing)單(dan)。截至目前,已(yi)有(you)33個(ge)省級國資(zi)(zi)委出(chu)臺了權(quan)責清(qing)(qing)(qing)單(dan),其中福建、西藏等(deng)10個(ge)地方根據實際情況,結合(he)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng)轉(zhuan)(zhuan)變(bian)(bian)要(yao)求,對(dui)已(yi)公布(bu)的(de)(de)(de)權(quan)責清(qing)(qing)(qing)單(dan)進行修(xiu)訂(ding)與完善(shan),進一(yi)步增強了權(quan)力配置的(de)(de)(de)科(ke)學性和(he)規范性。廣東(dong)以現有(you)權(quan)責清(qing)(qing)(qing)單(dan)為基點,編制印發(fa)了權(quan)責清(qing)(qing)(qing)單(dan)服務指南,增強了清(qing)(qing)(qing)單(dan)管(guan)理(li)的(de)(de)(de)可(ke)操(cao)作(zuo)(zuo)性和(he)指引(yin)性。四(si)是(shi)大力推(tui)進簡政放權(quan)。按照“放管(guan)服”要(yao)求,加大簡政放權(quan)力度(du),取(qu)消(xiao)、下(xia)放和(he)授權(quan)一(yi)批與管(guan)資(zi)(zi)本(ben)(ben)要(yao)求不符的(de)(de)(de)職(zhi)(zhi)(zhi)(zhi)能(neng)(neng),把該(gai)放的(de)(de)(de)以及(ji)細(xi)(xi)、小、散(san)工(gong)作(zuo)(zuo)事(shi)(shi)項放下(xia)去、放到位。江蘇(su)堅(jian)持“四(si)個(ge)一(yi)律精(jing)簡”的(de)(de)(de)原則,對(dui)出(chu)資(zi)(zi)人(ren)審(shen)批事(shi)(shi)項開展了4輪清(qing)(qing)(qing)理(li)規范工(gong)作(zuo)(zuo),累計取(qu)消(xiao)、下(xia)放17項,精(jing)簡幅度(du)達(da)到50%。
二(er)(er)、國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)方(fang)(fang)式(shi)(shi)方(fang)(fang)法(fa)(fa)(fa)進一(yi)步(bu)優化(hua)。一(yi)是注重(zhong)分類(lei)監(jian)(jian)(jian)管(guan)和分類(lei)考(kao)核。針(zhen)對(dui)企(qi)(qi)業不(bu)同戰(zhan)略定位和發展目標(biao)(biao),研究制(zhi)定差異化(hua)的(de)監(jian)(jian)(jian)管(guan)目標(biao)(biao)、監(jian)(jian)(jian)管(guan)重(zhong)點和監(jian)(jian)(jian)管(guan)措(cuo)施(shi),實施(shi)更加(jia)精準有效的(de)分類(lei)監(jian)(jian)(jian)管(guan)。甘肅(su)將監(jian)(jian)(jian)管(guan)企(qi)(qi)業考(kao)核結果與薪酬分配聯動掛鉤,省(sheng)屬企(qi)(qi)業負責人(ren)薪酬差距達到4.86倍。二(er)(er)是加(jia)強國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)信息化(hua)建設。創新(xin)監(jian)(jian)(jian)督(du)工(gong)作(zuo)(zuo)方(fang)(fang)式(shi)(shi)方(fang)(fang)法(fa)(fa)(fa),運用信息化(hua)手段提升監(jian)(jian)(jian)管(guan)效率和有效性(xing)(xing)(xing)。河南在已有的(de)“一(yi)個(ge)(ge)專網(wang)、三(san)(san)個(ge)(ge)系(xi)統”國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)平(ping)臺(tai)基礎上,籌建全省(sheng)統一(yi)的(de)智(zhi)能化(hua)國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)平(ping)臺(tai),通過云計算、大數據、人(ren)工(gong)智(zhi)能等技術手段實現(xian)全省(sheng)國(guo)(guo)(guo)(guo)有資(zi)(zi)產(chan)管(guan)理信息系(xi)統互聯、共(gong)享(xiang)、實時監(jian)(jian)(jian)管(guan)。三(san)(san)是提高國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)法(fa)(fa)(fa)治(zhi)化(hua)水平(ping)。結合國(guo)(guo)(guo)(guo)資(zi)(zi)國(guo)(guo)(guo)(guo)企(qi)(qi)改革進程,不(bu)斷加(jia)強國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)立法(fa)(fa)(fa)工(gong)作(zuo)(zuo)。內蒙古制(zhi)定的(de)《內蒙古自治(zhi)區(qu)企(qi)(qi)業國(guo)(guo)(guo)(guo)有資(zi)(zi)產(chan)監(jian)(jian)(jian)督(du)管(guan)理條例》已經(jing)自治(zhi)區(qu)人(ren)大常委會審議(yi)通過,是繼(ji)湖北、山東(dong)后出臺(tai)的(de)第3個(ge)(ge)國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)(jian)管(guan)地方(fang)(fang)性(xing)(xing)(xing)法(fa)(fa)(fa)規。重(zhong)慶(qing)全年(nian)對(dui)14件(jian)規范性(xing)(xing)(xing)文件(jian)和121項涉法(fa)(fa)(fa)議(yi)題進行合法(fa)(fa)(fa)性(xing)(xing)(xing)審查(cha)(cha),審查(cha)(cha)率達100%。把合法(fa)(fa)(fa)性(xing)(xing)(xing)審查(cha)(cha)作(zuo)(zuo)為重(zhong)大決策前置程序,做到“決策先(xian)問法(fa)(fa)(fa)、違法(fa)(fa)(fa)不(bu)決策”,法(fa)(fa)(fa)律審核機制(zhi)更加(jia)完(wan)善。
三(san)、國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)試點效果逐步顯(xian)現(xian)。一是探索完善國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)授(shou)權經(jing)營(ying)(ying)(ying)體制。將改(gai)建(jian)(jian)組(zu)建(jian)(jian)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)作(zuo)(zuo)為(wei)改(gai)革國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)授(shou)權經(jing)營(ying)(ying)(ying)體制,構建(jian)(jian)“以(yi)管資(zi)(zi)(zi)本(ben)(ben)(ben)為(wei)主(zhu)”國(guo)(guo)(guo)資(zi)(zi)(zi)監管模式的(de)關鍵措施。截至目(mu)前,各地完成改(gai)組(zu)組(zu)建(jian)(jian)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)104家(jia),在體制設(she)計上(shang)均明(ming)確國(guo)(guo)(guo)資(zi)(zi)(zi)委作(zuo)(zuo)為(wei)出資(zi)(zi)(zi)人,對國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)履行出資(zi)(zi)(zi)人職責。二是促進(jin)(jin)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)源優化配置(zhi)。推動(dong)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)向(xiang)關系國(guo)(guo)(guo)家(jia)安全、國(guo)(guo)(guo)民(min)經(jing)濟(ji)命(ming)脈和國(guo)(guo)(guo)計民(min)生(sheng)的(de)重(zhong)要行業(ye)(ye)(ye)(ye)(ye)和關鍵領域、重(zhong)點基礎設(she)施集(ji)中,向(xiang)前瞻(zhan)性(xing)戰略性(xing)產(chan)(chan)業(ye)(ye)(ye)(ye)(ye)集(ji)中,向(xiang)具有(you)(you)核心競(jing)爭力(li)的(de)優勢企(qi)業(ye)(ye)(ye)(ye)(ye)集(ji)中。引導投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)立足(zu)功能定位,通過市場(chang)化手段盤(pan)活(huo)(huo)存量資(zi)(zi)(zi)本(ben)(ben)(ben)、優化增(zeng)量資(zi)(zi)(zi)本(ben)(ben)(ben)。陜(shan)西積極推動(dong)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)通過投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)設(she)立、股權收(shou)購等方式,進(jin)(jin)入航(hang)空、新材料和半導體激光芯片產(chan)(chan)業(ye)(ye)(ye)(ye)(ye)。貴州(zhou)指導投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)規范發行企(qi)業(ye)(ye)(ye)(ye)(ye)債(zhai)券,盤(pan)活(huo)(huo)存量資(zi)(zi)(zi)本(ben)(ben)(ben),推進(jin)(jin)資(zi)(zi)(zi)產(chan)(chan)證券化。三(san)是助力(li)企(qi)業(ye)(ye)(ye)(ye)(ye)“處(chu)僵(jiang)治(zhi)困(kun)”。通過國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)推進(jin)(jin)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)源整(zheng)合和“僵(jiang)尸(shi)企(qi)業(ye)(ye)(ye)(ye)(ye)”處(chu)置(zhi),推動(dong)困(kun)難企(qi)業(ye)(ye)(ye)(ye)(ye)實(shi)現(xian)扭虧為(wei)盈。天(tian)津將國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)作(zuo)(zuo)為(wei)供給(gei)側結(jie)構性(xing)改(gai)革平(ping)臺,為(wei)企(qi)業(ye)(ye)(ye)(ye)(ye)債(zhai)務提(ti)供增(zeng)信支(zhi)持(chi),推動(dong)市管企(qi)業(ye)(ye)(ye)(ye)(ye)化解債(zhai)務風(feng)險(xian)。重(zhong)慶(qing)組(zu)建(jian)(jian)渝(yu)康資(zi)(zi)(zi)產(chan)(chan)管理公(gong)(gong)司(si)(si)(si)作(zuo)(zuo)為(wei)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本(ben)(ben)(ben)投(tou)(tou)(tou)(tou)資(zi)(zi)(zi)、運(yun)(yun)營(ying)(ying)(ying)公(gong)(gong)司(si)(si)(si)中專司(si)(si)(si)不(bu)良(liang)資(zi)(zi)(zi)產(chan)(chan)處(chu)置(zhi)的(de)專業(ye)(ye)(ye)(ye)(ye)公(gong)(gong)司(si)(si)(si)。
四、經營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)一(yi)(yi)監(jian)(jian)(jian)管(guan)(guan)成效明(ming)顯。一(yi)(yi)是(shi)加強頂層(ceng)設(she)計(ji)和組織推(tui)動。將(jiang)推(tui)進經營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)一(yi)(yi)監(jian)(jian)(jian)管(guan)(guan)作為本地區國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)國(guo)(guo)(guo)(guo)(guo)企(qi)改(gai)革(ge)文件的(de)重要內容,進一(yi)(yi)步明(ming)確(que)政企(qi)分開、政資(zi)(zi)(zi)(zi)分開原則。安徽、江蘇等19個(ge)地方出(chu)臺了(le)關于推(tui)進經營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)集(ji)中(zhong)統(tong)(tong)一(yi)(yi)監(jian)(jian)(jian)管(guan)(guan)的(de)實(shi)施意見(jian)或專門文件。二是(shi)積極擴大監(jian)(jian)(jian)管(guan)(guan)范(fan)圍。截至2017年底,全國(guo)(guo)(guo)(guo)(guo)省(sheng)(sheng)級國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)經營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)管(guan)(guan)覆蓋面已經達到90%左右,較2012年提高(gao)了(le)20個(ge)百分點。其中(zhong)天津、山東、上海(hai)、陜西、福建、新疆兵團、大連、青島(dao)、深圳已基(ji)本實(shi)現省(sheng)(sheng)級經營(ying)(ying)性(xing)國(guo)(guo)(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)全部納(na)(na)入(ru)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)監(jian)(jian)(jian)管(guan)(guan),23個(ge)省(sheng)(sheng)市(shi)將(jiang)金融類企(qi)業納(na)(na)入(ru)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)監(jian)(jian)(jian)管(guan)(guan)范(fan)圍。三是(shi)發揮國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)專業化監(jian)(jian)(jian)管(guan)(guan)優勢。在推(tui)進集(ji)中(zhong)統(tong)(tong)一(yi)(yi)監(jian)(jian)(jian)管(guan)(guan)過程中(zhong),注重制度規(gui)則的(de)統(tong)(tong)一(yi)(yi),國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)(jian)管(guan)(guan)專業化、規(gui)范(fan)化水平不(bu)斷提升(sheng)。北京、海(hai)南等地將(jiang)其他部門管(guan)(guan)理的(de)企(qi)業納(na)(na)入(ru)國(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)統(tong)(tong)一(yi)(yi)的(de)基(ji)礎管(guan)(guan)理體(ti)系,實(shi)現了(le)國(guo)(guo)(guo)(guo)(guo)家出(chu)資(zi)(zi)(zi)(zi)企(qi)業統(tong)(tong)一(yi)(yi)產(chan)權登記、統(tong)(tong)一(yi)(yi)資(zi)(zi)(zi)(zi)產(chan)統(tong)(tong)計(ji)、統(tong)(tong)一(yi)(yi)考核評價。

6月6-7日(ri),國務院國資委(wei)舉辦(ban)機(ji)關法治(zhi)建(jian)設專題培訓班。國務院國資委(wei)機(ji)關廳局、直屬單位和省級國資委(wei)共(gong)80余人參加培訓。

2.“全(quan)(quan)面依法從嚴治企(qi)重在‘全(quan)(quan)面’,關(guan)鍵(jian)是全(quan)(quan)面落實各(ge)級各(ge)部門(men)主(zhu)(zhu)體責任(ren),決不能把法治工作‘一股腦’推給(gei)法務(wu)部門(men)或法務(wu)人員。主(zhu)(zhu)要(yao)負(fu)責人要(yao)切實承擔起(qi)領導責任(ren),推動(dong)法治工作由被動(dong)向(xiang)主(zhu)(zhu)動(dong)轉(zhuan)變(bian),由單兵(bing)作戰向(xiang)全(quan)(quan)員參與、齊(qi)抓(zhua)共管(guan)轉(zhuan)變(bian)。分管(guan)領導要(yao)強化法治意識,抓(zhua)好(hao)(hao)分管(guan)領域規章制度建設(she)和法律風險(xian)防范(fan),及時解決好(hao)(hao)分管(guan)業務(wu)中遇到的各(ge)類法律問題。”

●中央企業(ye)法治工(gong)作硬(ying)措施
1、中林集(ji)團:完(wan)善企(qi)業(ye)領導(dao)班子(zi)知識結(jie)構,在相同條件下,優先提拔使用法(fa)治素養好、依法(fa)辦事(shi)能力(li)強的(de)干部。落實(shi)問責(ze)制度,企(qi)業(ye)重大經營活(huo)動因未(wei)經法(fa)律審核,或者(zhe)雖經審核但未(wei)采(cai)納正確法(fa)律意見而(er)造成重大損(sun)失(shi)的(de),要追究企(qi)業(ye)相關領導(dao)人員責(ze)任(ren)。
