努力(li)開創(chuang)指(zhi)導監(jian)督地(di)方國資工作新局(ju)面(mian)
——在(zai)全國國資委系統指導監督(du)工作座談會上(shang)的(de)講話(hua)

同志們:
這(zhe)次會議(yi)是在“十(shi)(shi)二五”開(kai)局(ju)之年,國資監(jian)管(guan)和(he)國企改(gai)革(ge)進入新(xin)階(jie)(jie)段召開(kai)的(de)(de)(de)(de)一次重要會議(yi)。會議(yi)的(de)(de)(de)(de)主要任(ren)務是:總結杭州會議(yi)以來指(zhi)導(dao)監(jian)督地(di)方國資工(gong)作(zuo)的(de)(de)(de)(de)進展(zhan)和(he)成效,交(jiao)流各地(di)好的(de)(de)(de)(de)做法(fa)和(he)經驗,圍繞“國資監(jian)管(guan)上新(xin)水平、國企發展(zhan)上新(xin)臺(tai)階(jie)(jie)”的(de)(de)(de)(de)“兩新(xin)目標”,研究“十(shi)(shi)二五”時期指(zhi)導(dao)監(jian)督地(di)方國資工(gong)作(zuo)的(de)(de)(de)(de)總體(ti)思路和(he)工(gong)作(zuo)重點(dian)(dian),提(ti)出做好下一步工(gong)作(zuo)的(de)(de)(de)(de)具體(ti)措施。國務院國資委對這(zhe)次會議(yi)高度重視(shi),國資委主任(ren)、黨委書(shu)記王勇同志做出重要批示,對進一步加強指(zhi)導(dao)監(jian)督工(gong)作(zuo)提(ti)出明確要求(qiu)。大家(jia)要認(ren)真學(xue)習領會,全面貫徹落實。下面,我講三點(dian)(dian)意見。
一、指導(dao)監督地方(fang)國資工作取得新(xin)進展新(xin)成(cheng)效
去(qu)年(nian)杭(hang)州(zhou)會議(yi)以來,國(guo)資(zi)(zi)委系(xi)統(tong)緊緊圍繞國(guo)資(zi)(zi)監管和國(guo)企(qi)改(gai)革發展的(de)中心任(ren)務,大力(li)推進(jin)指(zhi)導(dao)監督(du)工作,國(guo)資(zi)(zi)系(xi)統(tong)一盤棋理念進(jin)一步增強,上下級國(guo)資(zi)(zi)委溝通聯系(xi)進(jin)一步密(mi)切,工作合力(li)進(jin)一步形成,指(zhi)導(dao)監督(du)工作取得新的(de)進(jin)展和成效(xiao)。
(一)加(jia)強組織領導,指導監督工作機(ji)制基本形(xing)成。
分(fen)(fen)管(guan)領導和(he)工(gong)(gong)(gong)(gong)(gong)作(zuo)機(ji)構全面(mian)落實(shi)。各省級國(guo)(guo)資委(wei)(wei)將(jiang)(jiang)指導監督工(gong)(gong)(gong)(gong)(gong)作(zuo)擺上重要議(yi)事(shi)日程,普遍成立(li)了指導監督工(gong)(gong)(gong)(gong)(gong)作(zuo)領導小組(zu)(zu),不少地方國(guo)(guo)資委(wei)(wei)由一把手親(qin)自擔任領導小組(zu)(zu)組(zu)(zu)長,同時明確了委(wei)(wei)內牽頭處(chu)室(shi),建(jian)立(li)了各處(chu)室(shi)之間的(de)分(fen)(fen)工(gong)(gong)(gong)(gong)(gong)協調機(ji)制(zhi)。北京市(shi)國(guo)(guo)資委(wei)(wei)將(jiang)(jiang)36項工(gong)(gong)(gong)(gong)(gong)作(zuo)任務分(fen)(fen)解到16個處(chu)室(shi)。山東(dong)省國(guo)(guo)資委(wei)(wei)將(jiang)(jiang)各處(chu)室(shi)指導監督工(gong)(gong)(gong)(gong)(gong)作(zuo)開(kai)展情況列入(ru)年度考核(he)內容。上海(hai)市(shi)國(guo)(guo)資委(wei)(wei)對區縣國(guo)(guo)資監管(guan)工(gong)(gong)(gong)(gong)(gong)作(zuo)中(zhong)遇到的(de)難題,由各業務處(chu)室(shi)實(shi)行對口“一條龍”服務。通過落實(shi)分(fen)(fen)管(guan)領導和(he)工(gong)(gong)(gong)(gong)(gong)作(zuo)機(ji)構,初步形成了職責明確、統籌協調、分(fen)(fen)工(gong)(gong)(gong)(gong)(gong)負(fu)責的(de)指導監督工(gong)(gong)(gong)(gong)(gong)作(zuo)組(zu)(zu)織體系。
指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作制度建(jian)設不(bu)斷(duan)加強(qiang)。國務院國資(zi)(zi)委(wei)修(xiu)訂發布了《地方國有資(zi)(zi)產(chan)監(jian)(jian)管(guan)工(gong)(gong)作指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)辦法》(以下(xia)簡稱《指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)辦法》),按照“指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)、溝(gou)通、交流、服務”的(de)(de)原則,明確(que)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作機制和(he)主要工(gong)(gong)作事(shi)項,進一(yi)步規(gui)范了指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)的(de)(de)主要方式和(he)途徑。上(shang)海市國資(zi)(zi)委(wei)制定了《指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)辦法》的(de)(de)實施細則,將(jiang)區縣貫徹執行國資(zi)(zi)監(jian)(jian)管(guan)政(zheng)策法規(gui)情況作為指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)(gong)作重點。湖南、湖北、四川、重慶、甘肅、內蒙、新疆生產(chan)建(jian)設兵團等省區市國資(zi)(zi)委(wei)出臺(tai)了加強(qiang)市、縣級國資(zi)(zi)監(jian)(jian)管(guan)工(gong)(gong)作的(de)(de)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)辦法,探索建(jian)立(li)政(zheng)策指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)與具體指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)、日(ri)常指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)與專(zhuan)項指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)相結合的(de)(de)工(gong)(gong)作體系。
上下級國(guo)(guo)資(zi)(zi)委(wei)之間的(de)溝通(tong)(tong)交流平臺逐步(bu)形(xing)成。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)委(wei)定期編發簡報,及時傳達指導監(jian)(jian)督(du)工作要求,交流推廣各地國(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)的(de)特色做法(fa)和(he)先進(jin)經驗,同時加快建(jian)立地方國(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)信(xin)息資(zi)(zi)源系(xi)(xi)統,嘗試指導監(jian)(jian)督(du)基(ji)礎數(shu)據(ju)的(de)整(zheng)合與(yu)利(li)用(yong)。福建(jian)、安徽等省(sheng)(sheng)國(guo)(guo)資(zi)(zi)委(wei)健全(quan)監(jian)(jian)管(guan)工作體系(xi)(xi),形(xing)成了覆蓋(gai)全(quan)省(sheng)(sheng)的(de)基(ji)礎數(shu)據(ju)網絡。遼寧省(sheng)(sheng)國(guo)(guo)資(zi)(zi)委(wei)通(tong)(tong)過(guo)與(yu)地市(shi)國(guo)(guo)資(zi)(zi)委(wei)辦公(gong)信(xin)息系(xi)(xi)統聯(lian)網,確保(bao)了重(zhong)要信(xin)息及時上報。國(guo)(guo)資(zi)(zi)委(wei)系(xi)(xi)統運用(yong)溝通(tong)(tong)交流平臺,有力地促進(jin)了相互之間的(de)學習借鑒和(he)信(xin)息共(gong)享。
(二)創新(xin)方式(shi)方法,指導監(jian)督工作全面展開。
精(jing)心(xin)規劃(hua)(hua)部署指(zhi)導(dao)(dao)監督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)。國務(wu)院國資(zi)委印發年(nian)度工(gong)(gong)(gong)作(zuo)(zuo)計(ji)劃(hua)(hua),明確了(le)2011年(nian)指(zhi)導(dao)(dao)監督(du)(du)的(de)40項工(gong)(gong)(gong)作(zuo)(zuo)任務(wu)和責任廳局。湖南、新疆、西藏(zang)、廈門等(deng)許多省(sheng)(sheng)市國資(zi)委也(ye)制定(ding)了(le)指(zhi)導(dao)(dao)監督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)年(nian)度計(ji)劃(hua)(hua)。福(fu)建、江西、陜西等(deng)省(sheng)(sheng)市國資(zi)委專門組織(zhi)召(zhao)開了(le)全(quan)省(sheng)(sheng)指(zhi)導(dao)(dao)監督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)會議(yi)。北京(jing)市國資(zi)委邀請區(qu)(qu)縣(xian)政府主管領導(dao)(dao)參加國資(zi)監管工(gong)(gong)(gong)作(zuo)(zuo)會議(yi),全(quan)面(mian)部署了(le)區(qu)(qu)縣(xian)國資(zi)監管重點(dian)(dian)工(gong)(gong)(gong)作(zuo)(zuo)。四川省(sheng)(sheng)國資(zi)委召(zhao)開研討會,研究部署“十二五”時期(qi)指(zhi)導(dao)(dao)監督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)總體思路、重點(dian)(dian)任務(wu)和工(gong)(gong)(gong)作(zuo)(zuo)措施(shi)。通(tong)過工(gong)(gong)(gong)作(zuo)(zuo)計(ji)劃(hua)(hua)和會議(yi)部署,各地指(zhi)導(dao)(dao)監督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)開始全(quan)面(mian)啟動,并初步打開了(le)工(gong)(gong)(gong)作(zuo)(zuo)局面(mian)。
深入(ru)調(diao)研(yan)(yan)(yan)摸清指導(dao)監(jian)督(du)(du)面上(shang)情況(kuang)。今年上(shang)半(ban)年,國(guo)資(zi)(zi)委(wei)(wei)法規(gui)局赴13個(ge)省市(shi)(shi)(shi)深入(ru)了解地方(fang)國(guo)資(zi)(zi)監(jian)管機(ji)構建(jian)設、全(quan)覆蓋監(jian)管、融資(zi)(zi)平臺(tai)公司經營等(deng)方(fang)面的(de)情況(kuang)和(he)(he)問題,并提交了有關調(diao)研(yan)(yan)(yan)報告和(he)(he)上(shang)報的(de)專題信息。福建(jian)省國(guo)資(zi)(zi)委(wei)(wei)對(dui)市(shi)(shi)(shi)、縣(xian)國(guo)資(zi)(zi)監(jian)管工(gong)(gong)作和(he)(he)指導(dao)監(jian)督(du)(du)工(gong)(gong)作情況(kuang)進(jin)行(xing)全(quan)面調(diao)研(yan)(yan)(yan)。山東省國(guo)資(zi)(zi)委(wei)(wei)針(zhen)對(dui)部分(fen)地市(shi)(shi)(shi)出現的(de)國(guo)資(zi)(zi)委(wei)(wei)監(jian)管企業劃回原主管部門的(de)體制回潮現象,由委(wei)(wei)領(ling)導(dao)分(fen)頭(tou)帶隊進(jin)行(xing)集中調(diao)研(yan)(yan)(yan)督(du)(du)導(dao)。安(an)徽省國(guo)資(zi)(zi)委(wei)(wei)建(jian)立了委(wei)(wei)領(ling)導(dao)班子聯系(xi)點制度,每人分(fen)別聯系(xi)2-3個(ge)地市(shi)(shi)(shi)國(guo)資(zi)(zi)委(wei)(wei),定(ding)期開(kai)(kai)(kai)展調(diao)研(yan)(yan)(yan)指導(dao)。四川、黑龍江等(deng)省國(guo)資(zi)(zi)委(wei)(wei)分(fen)片區開(kai)(kai)(kai)展專題調(diao)研(yan)(yan)(yan),實地協調(diao)解決市(shi)(shi)(shi)縣(xian)國(guo)資(zi)(zi)監(jian)管機(ji)構的(de)困(kun)難和(he)(he)問題。通過開(kai)(kai)(kai)展廣泛深入(ru)的(de)調(diao)查研(yan)(yan)(yan)究,進(jin)一步(bu)增強(qiang)了指導(dao)監(jian)督(du)(du)工(gong)(gong)作的(de)針(zhen)對(dui)性和(he)(he)有效性。
注重發揮先(xian)(xian)進(jin)(jin)典型示(shi)范引(yin)路(lu)作用。河南、云(yun)南、青島等省(sheng)市對下級國(guo)(guo)資監(jian)管工(gong)(gong)作進(jin)(jin)行評優表彰,樹立先(xian)(xian)進(jin)(jin)典型。山東(dong)省(sheng)國(guo)(guo)資委(wei)總結(jie)推廣(guang)濟(ji)寧、聊(liao)城、棗莊等地(di)市國(guo)(guo)資委(wei)在加(jia)強(qiang)職(zhi)能(neng)建設、強(qiang)化考核培(pei)訓等方面的經驗和做法。寧夏自治區國(guo)(guo)資委(wei)指導推動全(quan)區國(guo)(guo)有企(qi)(qi)業(ye)(ye)開展與全(quan)國(guo)(guo)先(xian)(xian)進(jin)(jin)企(qi)(qi)業(ye)(ye)、全(quan)區先(xian)(xian)進(jin)(jin)企(qi)(qi)業(ye)(ye)、本行業(ye)(ye)先(xian)(xian)進(jin)(jin)企(qi)(qi)業(ye)(ye)的“三對標”活動。各(ge)地(di)通過總結(jie)推廣(guang)特(te)色做法和先(xian)(xian)進(jin)(jin)經驗,以點帶面,使(shi)指導監(jian)督工(gong)(gong)作的引(yin)領(ling)示(shi)范效應得到較好體(ti)現。
不斷強化(hua)和(he)豐富指(zhi)導(dao)監(jian)督工(gong)作(zuo)內(nei)涵(han)。國(guo)(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)先后(hou)組織召開國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)系統財務(wu)監(jian)督、產(chan)權(quan)管理、業績考(kao)核、收益(yi)分(fen)配、改革改制、董事(shi)會與監(jian)事(shi)會工(gong)作(zuo)、紀檢監(jian)察等專(zhuan)題會議和(he)培訓班,對各地(di)(di)(di)國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)管工(gong)作(zuo)進(jin)行(xing)專(zhuan)項(xiang)指(zhi)導(dao)。深圳(zhen)、上(shang)海、河北(bei)、大連等部(bu)分(fen)省(sheng)市(shi)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)在本地(di)(di)(di)區積極探索推進(jin)經濟增(zeng)加(jia)(jia)值考(kao)核,引導(dao)國(guo)(guo)(guo)(guo)(guo)有企(qi)業增(zeng)強價值創造能力(li),提高發展質量和(he)效益(yi)。云南、江蘇等省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)組織對地(di)(di)(di)市(shi)國(guo)(guo)(guo)(guo)(guo)有企(qi)業生產(chan)經營狀況進(jin)行(xing)綜(zong)合分(fen)析,全(quan)面掌握地(di)(di)(di)市(shi)國(guo)(guo)(guo)(guo)(guo)有經濟的(de)(de)運行(xing)情況。廣東省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)指(zhi)導(dao)地(di)(di)(di)市(shi)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)建(jian)立健全(quan)國(guo)(guo)(guo)(guo)(guo)有企(qi)業財務(wu)快報制度(du)。江蘇、湖北(bei)等省(sheng)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)統一全(quan)省(sheng)企(qi)業國(guo)(guo)(guo)(guo)(guo)有產(chan)權(quan)交易(yi)信息(xi)發布,實行(xing)產(chan)權(quan)交易(yi)網上(shang)動(dong)態(tai)監(jian)測。加(jia)(jia)強對國(guo)(guo)(guo)(guo)(guo)資(zi)監(jian)管各項(xiang)專(zhuan)題工(gong)作(zuo)的(de)(de)指(zhi)導(dao)推動(dong),已經成為國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)系統加(jia)(jia)強聯系、共同提高的(de)(de)重要紐帶(dai)。
(三)突出工作重點,指導(dao)監督(du)效果初步顯現。

推進經營性國(guo)(guo)有(you)(you)資(zi)產(chan)集中統一監(jian)管(guan)取得新(xin)進展。各地按照(zhao)“政企(qi)(qi)分開、政資(zi)分開”原則,積(ji)極拓展國(guo)(guo)資(zi)委(wei)系(xi)統的(de)(de)監(jian)管(guan)范(fan)圍(wei)。目前,全(quan)(quan)國(guo)(guo)有(you)(you)14個省(sheng)級(ji)國(guo)(guo)資(zi)委(wei)監(jian)管(guan)覆(fu)蓋面達到80%以(yi)上(shang),北京、天(tian)津、上(shang)海、重慶四(si)個直轄市實現了(le)(le)經營性國(guo)(guo)有(you)(you)資(zi)產(chan)的(de)(de)全(quan)(quan)覆(fu)蓋監(jian)管(guan)。湖北省(sheng)國(guo)(guo)資(zi)委(wei)對糧油、水電、文化等領(ling)域的(de)(de)脫鉤(gou)改(gai)制企(qi)(qi)業(ye)實現了(le)(le)“統一納(na)入、委(wei)托監(jian)管(guan)”。云南選(xuan)擇(ze)昆(kun)明(ming)、曲靖、文山、大理等四(si)個州市進行了(le)(le)國(guo)(guo)有(you)(you)資(zi)產(chan)監(jian)管(guan)全(quan)(quan)覆(fu)蓋試點。此外,全(quan)(quan)國(guo)(guo)有(you)(you)28個省(sheng)級(ji)國(guo)(guo)資(zi)委(wei)和70個地市級(ji)國(guo)(guo)資(zi)委(wei)監(jian)管(guan)范(fan)圍(wei)還涵蓋了(le)(le)金融類國(guo)(guo)有(you)(you)資(zi)產(chan)。
推(tui)(tui)動(dong)落實縣(xian)級國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)(guan)責任取得新成效。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委召開義(yi)烏現場會后,浙江、廣(guang)東等省(sheng)(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委相繼在全省(sheng)(sheng)范圍內大(da)(da)力總(zong)結推(tui)(tui)廣(guang)義(yi)烏、順(shun)德經驗,進一步加強縣(xian)級國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構建設,健全縣(xian)級國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)管(guan)(guan)體制。湖北省(sheng)(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委總(zong)結推(tui)(tui)廣(guang)“大(da)(da)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)、大(da)(da)監(jian)管(guan)(guan)、大(da)(da)資(zi)(zi)(zi)(zi)(zi)源、大(da)(da)配(pei)置(zhi)(zhi)”的“宜都模式”,大(da)(da)冶市對經營性(xing)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)和行政(zheng)事(shi)業性(xing)資(zi)(zi)(zi)(zi)(zi)產(chan)實行產(chan)權、預(yu)算、資(zi)(zi)(zi)(zi)(zi)產(chan)處置(zhi)(zhi)、資(zi)(zi)(zi)(zi)(zi)源配(pei)置(zhi)(zhi)“四統(tong)一”的監(jian)管(guan)(guan)模式。寧波(bo)市國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)委推(tui)(tui)動(dong)明確了區(qu)縣(xian)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)責任主體。據對吉(ji)林、安徽、廣(guang)西(xi)等8省(sheng)(sheng)市所轄883個縣(xian)區(qu)的統(tong)計,單獨(du)設立(li)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構的有(you)167個,占(zhan)總(zong)數(shu)的19%。廣(guang)東、江西(xi)、四川的縣(xian)(區(qu))單獨(du)設立(li)國(guo)(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構的比例分(fen)別(bie)達到36%、30%和28%。
指導(dao)地(di)方(fang)國(guo)(guo)(guo)有(you)(you)經(jing)濟(ji)發揮引領帶動作(zuo)(zuo)(zuo)用(yong)呈現新(xin)格局。各級國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)積極(ji)指導(dao)推(tui)進跨區(qu)(qu)(qu)域(yu)、跨層(ceng)級國(guo)(guo)(guo)有(you)(you)企業(ye)(ye)之(zhi)間的(de)(de)(de)調整重組,引導(dao)地(di)方(fang)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)本更多地(di)投向支柱(zhu)行業(ye)(ye)和(he)特色產(chan)業(ye)(ye)。國(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)推(tui)動中(zhong)央企業(ye)(ye)與許多省(sheng)(sheng)市開展了央地(di)合(he)作(zuo)(zuo)(zuo)。福建(jian)(jian)省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)牽頭(tou)搭(da)建(jian)(jian)本地(di)區(qu)(qu)(qu)對接央企的(de)(de)(de)合(he)作(zuo)(zuo)(zuo)平(ping)(ping)臺(tai)。不少地(di)方(fang)把(ba)國(guo)(guo)(guo)有(you)(you)經(jing)濟(ji)作(zuo)(zuo)(zuo)為推(tui)進城(cheng)市化建(jian)(jian)設(she)(she)的(de)(de)(de)重要平(ping)(ping)臺(tai)。四個直(zhi)轄(xia)市的(de)(de)(de)企業(ye)(ye)國(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)(zi)產(chan)逐(zhu)步向支柱(zhu)產(chan)業(ye)(ye)和(he)關系(xi)民生(sheng)的(de)(de)(de)公(gong)共基礎設(she)(she)施領域(yu)集(ji)中(zhong)。山西省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)以(yi)煤炭資(zi)(zi)(zi)(zi)源整合(he)為推(tui)手(shou),加快推(tui)進省(sheng)(sheng)、市國(guo)(guo)(guo)有(you)(you)企業(ye)(ye)的(de)(de)(de)結構調整和(he)產(chan)業(ye)(ye)升級。海南省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)大力(li)推(tui)動省(sheng)(sheng)屬(shu)國(guo)(guo)(guo)有(you)(you)企業(ye)(ye)與市縣合(he)作(zuo)(zuo)(zuo),共同(tong)組建(jian)(jian)參與新(xin)城(cheng)區(qu)(qu)(qu)和(he)港(gang)區(qu)(qu)(qu)開發的(de)(de)(de)投資(zi)(zi)(zi)(zi)主體。青海省(sheng)(sheng)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)以(yi)循環經(jing)濟(ji)試驗(yan)區(qu)(qu)(qu)和(he)高新(xin)技術產(chan)業(ye)(ye)為依托(tuo),積極(ji)搭(da)建(jian)(jian)省(sheng)(sheng)內國(guo)(guo)(guo)有(you)(you)企業(ye)(ye)合(he)作(zuo)(zuo)(zuo)發展平(ping)(ping)臺(tai)。各地(di)通(tong)過指導(dao)推(tui)動優勢資(zi)(zi)(zi)(zi)源集(ji)中(zhong),使國(guo)(guo)(guo)有(you)(you)經(jing)濟(ji)在地(di)方(fang)經(jing)濟(ji)社會發展中(zhong)的(de)(de)(de)引領帶動作(zuo)(zuo)(zuo)用(yong)得到(dao)進一步發揮。
總體(ti)上看,近一(yi)年來(lai),各(ge)地(di)國(guo)資委認真貫(guan)徹落(luo)實(shi)杭州(zhou)會議(yi)精神,通過建(jian)(jian)立健(jian)全指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)機制(zhi)(zhi)和制(zhi)(zhi)度,不(bu)(bu)斷創(chuang)新(xin)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)方式和方法(fa),抓住(zhu)重點,突(tu)破難點,國(guo)資委系統指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)開始從起(qi)(qi)步(bu)開局向縱深(shen)推進(jin)轉(zhuan)變(bian),從分頭(tou)摸索(suo)向集中借(jie)鑒轉(zhuan)變(bian),從提(ti)出(chu)一(yi)般要(yao)求向深(shen)化體(ti)系建(jian)(jian)設(she)轉(zhuan)變(bian),為推進(jin)完(wan)善地(di)方國(guo)資監(jian)(jian)管體(ti)制(zhi)(zhi)、促進(jin)地(di)方國(guo)有企業科學發(fa)展發(fa)揮了積極(ji)作(zuo)用。在(zai)(zai)肯定成績的(de)同時,我們(men)也要(yao)清醒(xing)地(di)看到,目前指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)尚(shang)處于剛剛起(qi)(qi)步(bu)、逐步(bu)發(fa)展的(de)階段(duan),仍然存(cun)在(zai)(zai)不(bu)(bu)少問題,主(zhu)要(yao)是:對指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)的(de)認識(shi)參差不(bu)(bu)齊,各(ge)地(di)工(gong)作(zuo)進(jin)展不(bu)(bu)平(ping)衡;指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)體(ti)系還不(bu)(bu)夠(gou)完(wan)善,特別是對縣級國(guo)資監(jian)(jian)管工(gong)作(zuo)的(de)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)仍較薄弱;指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)(du)的(de)一(yi)些重點難點還需(xu)要(yao)積極(ji)探索(suo)、尋求突(tu)破。對存(cun)在(zai)(zai)的(de)這(zhe)些問題,我們(men)要(yao)在(zai)(zai)下一(yi)步(bu)工(gong)作(zuo)中采取切實(shi)措施,努力加以解決。
二(er)、“十(shi)二(er)五”時期指(zhi)導監(jian)督地方國資工作的總(zong)體思路和主(zhu)要任務
“十(shi)二(er)五(wu)(wu)”時(shi)期,是(shi)(shi)深(shen)(shen)入推進(jin)國(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管體(ti)(ti)制(zhi)完善(shan)(shan)的(de)(de)關鍵時(shi)期,也是(shi)(shi)深(shen)(shen)化(hua)(hua)國(guo)(guo)有(you)(you)企(qi)業(ye)改革(ge)發展(zhan)的(de)(de)重(zhong)要時(shi)期。按照(zhao)以科學發展(zhan)為(wei)(wei)主題、以加快轉變經(jing)濟發展(zhan)方式為(wei)(wei)主線的(de)(de)要求,“十(shi)二(er)五(wu)(wu)”時(shi)期將(jiang)(jiang)更(geng)加重(zhong)視改革(ge)的(de)(de)頂(ding)層設計和總體(ti)(ti)規劃,在繼續完善(shan)(shan)經(jing)營性國(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管體(ti)(ti)制(zhi)的(de)(de)同時(shi),還將(jiang)(jiang)完善(shan)(shan)國(guo)(guo)有(you)(you)金融資(zi)產(chan)(chan)、行(xing)政事業(ye)單位(wei)資(zi)產(chan)(chan)和自然(ran)資(zi)源資(zi)產(chan)(chan)監(jian)管體(ti)(ti)制(zhi),推動重(zhong)點領域和關鍵環(huan)節(jie)的(de)(de)改革(ge)取得突破性進(jin)展(zhan)。從國(guo)(guo)際看(kan),隨著(zhu)經(jing)濟全球(qiu)化(hua)(hua)進(jin)程(cheng)不斷深(shen)(shen)入,國(guo)(guo)有(you)(you)企(qi)業(ye)“走出去”步伐進(jin)一步加快,美國(guo)(guo)、歐盟(meng)等發達國(guo)(guo)家和地區(qu)對(dui)我(wo)國(guo)(guo)國(guo)(guo)有(you)(you)企(qi)業(ye)的(de)(de)管理(li)體(ti)(ti)制(zhi)和治理(li)模式將(jiang)(jiang)越來(lai)越關注。國(guo)(guo)內外形勢的(de)(de)發展(zhan)變化(hua)(hua),既為(wei)(wei)完善(shan)(shan)國(guo)(guo)有(you)(you)資(zi)產(chan)(chan)監(jian)管體(ti)(ti)制(zhi)、加快國(guo)(guo)有(you)(you)企(qi)業(ye)改革(ge)帶來(lai)新(xin)(xin)的(de)(de)機遇與挑戰,也對(dui)“十(shi)二(er)五(wu)(wu)”時(shi)期深(shen)(shen)入開(kai)展(zhan)指導(dao)監(jian)督(du)地方國(guo)(guo)資(zi)工作提出了新(xin)(xin)任務和新(xin)(xin)要求。
“十二五(wu)”時期指(zhi)導(dao)監(jian)(jian)(jian)督地(di)(di)方(fang)國(guo)資(zi)工(gong)作(zuo)(zuo)的總(zong)體(ti)思路是:以(yi)(yi)鄧小平理論和(he)“三個代表”重要思想為(wei)指(zhi)導(dao),深入貫徹(che)落實科學發(fa)展觀,緊緊圍繞(rao) “兩新目標”,牢固(gu)樹立(li)(li)國(guo)資(zi)系統(tong)一盤棋理念,立(li)(li)足“指(zhi)導(dao)、溝通、交流、服(fu)務”,以(yi)(yi)加(jia)(jia)強(qiang)(qiang)地(di)(di)方(fang)國(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)管機構(gou)建設(she)、推進經營性國(guo)有(you)(you)資(zi)產(chan)集(ji)中統(tong)一監(jian)(jian)(jian)管、促進國(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)管工(gong)作(zuo)(zuo)不斷深化、強(qiang)(qiang)化企業(ye)國(guo)有(you)(you)資(zi)產(chan)基礎管理為(wei)重點(dian),進一步完善指(zhi)導(dao)監(jian)(jian)(jian)督工(gong)作(zuo)(zuo)機制和(he)制度,推動(dong)構(gou)建國(guo)資(zi)工(gong)作(zuo)(zuo)大格局,努力提升地(di)(di)方(fang)國(guo)資(zi)委依法(fa)履行出(chu)資(zi)人職責、加(jia)(jia)強(qiang)(qiang)國(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)管的能力和(he)水平,為(wei)完善企業(ye)國(guo)有(you)(you)資(zi)產(chan)監(jian)(jian)(jian)管體(ti)制、促進國(guo)有(you)(you)企業(ye)改革發(fa)展作(zuo)(zuo)出(chu)新貢獻。
根(gen)據上述總(zong)體(ti)思路,“十二五(wu)”時期指導(dao)監督地(di)方(fang)國資工作要全面落(luo)實以(yi)下四項主要任務(wu):
(一)指導加強地方國有資產監(jian)管機(ji)構(gou)建設(she)。
加強國有(you)(you)資(zi)(zi)產監(jian)管(guan)機(ji)構(gou)建(jian)設(she),是完善國有(you)(you)資(zi)(zi)產監(jian)管(guan)體(ti)制(zhi)(zhi)的(de)(de)(de)(de)組(zu)(zu)織基礎。黨(dang)的(de)(de)(de)(de)十(shi)六大以(yi)來,中央和(he)省(sheng)、地(di)市三級(ji)政(zheng)府(fu)組(zu)(zu)建(jian)國資(zi)(zi)委,作為(wei)(wei)政(zheng)府(fu)直屬特設(she)機(ji)構(gou),在機(ji)構(gou)設(she)置上實現了政(zheng)府(fu)的(de)(de)(de)(de)社會(hui)公共管(guan)理部(bu)門(men)與(yu)政(zheng)府(fu)的(de)(de)(de)(de)國有(you)(you)資(zi)(zi)產監(jian)管(guan)機(ji)構(gou)完全分開。政(zheng)府(fu)對國有(you)(you)企業的(de)(de)(de)(de)管(guan)理,由過(guo)去以(yi)行政(zheng)方式(shi)管(guan)理改為(wei)(wei)以(yi)出(chu)資(zi)(zi)方式(shi)管(guan)理,由過(guo)去各(ge)部(bu)門(men)多頭(tou)管(guan)理改為(wei)(wei)由國資(zi)(zi)委統一(yi)履行出(chu)資(zi)(zi)人職(zhi)責。這一(yi)新(xin)體(ti)制(zhi)(zhi)具有(you)(you)鮮(xian)明的(de)(de)(de)(de)中國特色,既是我國不斷探索(suo)規(gui)范政(zheng)府(fu)與(yu)國有(you)(you)企業之間關(guan)系的(de)(de)(de)(de)重要制(zhi)(zhi)度創新(xin),也是不斷深(shen)化國有(you)(you)企業改革的(de)(de)(de)(de)經驗(yan)結(jie)晶。8年多來的(de)(de)(de)(de)實踐表(biao)明,這一(yi)新(xin)體(ti)制(zhi)(zhi)有(you)(you)利(li)于保障國有(you)(you)企業真正(zheng)成為(wei)(wei)獨(du)立(li)的(de)(de)(de)(de)市場主體(ti)和(he)法人實體(ti),有(you)(you)利(li)于國有(you)(you)企業平等(deng)參與(yu)國內外兩個(ge)市場競(jing)爭,因而更(geng)好(hao)地(di)適應了深(shen)化國有(you)(you)企業改革的(de)(de)(de)(de)客觀需(xu)要,更(geng)好(hao)地(di)適應了發展社會(hui)主義市場經濟的(de)(de)(de)(de)客觀需(xu)要。
目前,省級國(guo)(guo)資(zi)(zi)委(wei)(wei)機(ji)(ji)構(gou)及其(qi)職(zhi)責定位(wei)比較(jiao)穩固,但不少地市(shi)國(guo)(guo)資(zi)(zi)委(wei)(wei)由直屬(shu)特設(she)機(ji)(ji)構(gou)改為了(le)政府部門(men)或者與其(qi)他部門(men)合署(shu)辦公(gong),機(ji)(ji)構(gou)不獨(du)立、行政化趨勢比較(jiao)明顯(xian)。據統計(ji),全國(guo)(guo)356個(ge)地市(shi)中(zhong),盡管(guan)(guan)有(you)331個(ge)設(she)立國(guo)(guo)資(zi)(zi)委(wei)(wei),占93%,但作為獨(du)立機(ji)(ji)構(gou)的只(zhi)有(you)227個(ge),占設(she)立國(guo)(guo)資(zi)(zi)委(wei)(wei)的68.6%;保留直屬(shu)特設(she)機(ji)(ji)構(gou)性(xing)質(zhi)的只(zhi)有(you)107個(ge),占設(she)立國(guo)(guo)資(zi)(zi)委(wei)(wei)的32.3%。從職(zhi)責上看,一些地方國(guo)(guo)資(zi)(zi)委(wei)(wei)出資(zi)(zi)人三項主要(yao)職(zhi)責不統一、不到(dao)位(wei)現象(xiang)仍然比較(jiao)突出,面上監管(guan)(guan)職(zhi)責尤為薄弱(ruo)。個(ge)別地市(shi)國(guo)(guo)資(zi)(zi)委(wei)(wei)的主要(yao)工作集(ji)中(zhong)在(zai)企業改制、處理信訪和(he)維護穩定上,企業國(guo)(guo)有(you)資(zi)(zi)產監管(guan)(guan)職(zhi)責沒有(you)得(de)到(dao)落(luo)實。
針(zhen)對上(shang)(shang)述情況,“十二五”時期要把指導推進國有資(zi)(zi)(zi)(zi)產監(jian)(jian)管(guan)(guan)機(ji)(ji)構(gou)建(jian)設(she)擺在首要位置,核心是堅(jian)持(chi)(chi)國資(zi)(zi)(zi)(zi)委(wei)直屬特(te)設(she)機(ji)(ji)構(gou)性質。具(ju)體來(lai)(lai)說,要把握好(hao)以下三(san)點:一要準確(que)把握特(te)設(she)機(ji)(ji)構(gou)的(de)(de)(de)(de)實質要求。注(zhu)意區別于(yu)政府(fu)公共管(guan)(guan)理(li)部門和機(ji)(ji)構(gou),堅(jian)持(chi)(chi)國資(zi)(zi)(zi)(zi)委(wei)在政府(fu)層(ceng)面依法履行出(chu)(chu)資(zi)(zi)(zi)(zi)人職(zhi)責(ze)、專司國有資(zi)(zi)(zi)(zi)產監(jian)(jian)管(guan)(guan)、不(bu)(bu)承擔公共管(guan)(guan)理(li)職(zhi)能(neng)的(de)(de)(de)(de)特(te)殊定位。二要準確(que)把握特(te)設(she)機(ji)(ji)構(gou)的(de)(de)(de)(de)職(zhi)責(ze)邊界。對出(chu)(chu)資(zi)(zi)(zi)(zi)人職(zhi)責(ze)范圍內的(de)(de)(de)(de)工作,盡職(zhi)盡責(ze)不(bu)(bu)缺位;對指導和推動監(jian)(jian)管(guan)(guan)企業的(de)(de)(de)(de)工作,有據有度(du)不(bu)(bu)越位;對協助(zhu)政府(fu)其(qi)他部門的(de)(de)(de)(de)工作,做好(hao)配合不(bu)(bu)錯位。三(san)要準確(que)把握特(te)設(she)機(ji)(ji)構(gou)的(de)(de)(de)(de)職(zhi)能(neng)配置。堅(jian)持(chi)(chi)將出(chu)(chu)資(zi)(zi)(zi)(zi)人職(zhi)責(ze)和面上(shang)(shang)監(jian)(jian)管(guan)(guan)職(zhi)責(ze)有機(ji)(ji)結合起來(lai)(lai),在依法履行出(chu)(chu)資(zi)(zi)(zi)(zi)人職(zhi)責(ze)的(de)(de)(de)(de)同時,認真履行好(hao)面上(shang)(shang)監(jian)(jian)管(guan)(guan)職(zhi)責(ze)。
(二(er))指導推動經營(ying)性國(guo)有資產的(de)集中統(tong)一監管。
今年初,張(zhang)德江副總理(li)在全(quan)國(guo)(guo)國(guo)(guo)有(you)(you)(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)(jian)督管(guan)(guan)(guan)(guan)理(li)工(gong)作(zuo)(zuo)會議上(shang)提出,要(yao)“拓寬(kuan)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)范圍(wei),逐步做到全(quan)過(guo)程、全(quan)方(fang)(fang)位監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),不(bu)留(liu)死(si)角(jiao),不(bu)留(liu)遺漏,不(bu)出現重(zhong)大失責”。國(guo)(guo)務院(yuan)領(ling)導的(de)(de)明確要(yao)求,為深入推(tui)(tui)動(dong)經(jing)(jing)營(ying)性國(guo)(guo)有(you)(you)(you)資(zi)產集(ji)中(zhong)(zhong)統一監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)指(zhi)明了方(fang)(fang)向。當前(qian),不(bu)少省(sheng)級(ji)國(guo)(guo)資(zi)委(wei)在省(sheng)委(wei)、省(sheng)政府的(de)(de)重(zhong)視、支持(chi)下(xia),逐步推(tui)(tui)進地(di)方(fang)(fang)經(jing)(jing)營(ying)性國(guo)(guo)有(you)(you)(you)資(zi)產的(de)(de)集(ji)中(zhong)(zhong)統一監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)范圍(wei)不(bu)斷(duan)拓展。但有(you)(you)(you)的(de)(de)地(di)方(fang)(fang)經(jing)(jing)營(ying)性國(guo)(guo)有(you)(you)(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)還較(jiao)為分散,當地(di)國(guo)(guo)資(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)比(bi)例(li)比(bi)較(jiao)低,目前(qian)仍有(you)(you)(you)4個(ge)省(sheng)級(ji)國(guo)(guo)資(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)覆蓋面低于50%。有(you)(you)(you)的(de)(de)地(di)方(fang)(fang)將(jiang)新設立的(de)(de)國(guo)(guo)有(you)(you)(you)企業交由公共(gong)管(guan)(guan)(guan)(guan)理(li)部門監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),還有(you)(you)(you)的(de)(de)地(di)方(fang)(fang)甚至將(jiang)國(guo)(guo)資(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)企業重(zhong)新劃回(hui)原行業主管(guan)(guan)(guan)(guan)部門。因(yin)此,必須把推(tui)(tui)動(dong)地(di)方(fang)(fang)經(jing)(jing)營(ying)性國(guo)(guo)有(you)(you)(you)資(zi)產的(de)(de)集(ji)中(zhong)(zhong)統一監(jian)(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),作(zuo)(zuo)為指(zhi)導監(jian)(jian)(jian)(jian)(jian)(jian)督工(gong)作(zuo)(zuo)的(de)(de)重(zhong)要(yao)任務。
“十二五”時(shi)期(qi),推動(dong)(dong)地(di)方(fang)(fang)經(jing)營性(xing)國(guo)有(you)資(zi)(zi)產的(de)(de)(de)(de)(de)集中(zhong)(zhong)統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan),應當著(zhu)力(li)(li)抓好以下(xia)三點:一(yi)要積極拓(tuo)展國(guo)資(zi)(zi)委監(jian)管(guan)(guan)(guan)(guan)范(fan)圍。各地(di)國(guo)資(zi)(zi)委要主動(dong)(dong)匯報,爭取地(di)方(fang)(fang)黨委、政府支持。要以統(tong)一(yi)履行出(chu)資(zi)(zi)人職責為目標(biao),采取多種方(fang)(fang)式,循序漸進,盡可(ke)能將地(di)方(fang)(fang)國(guo)有(you)企(qi)業(ye)(ye)(ye)納入新的(de)(de)(de)(de)(de)國(guo)資(zi)(zi)監(jian)管(guan)(guan)(guan)(guan)體(ti)(ti)制。完全納入暫時(shi)還(huan)有(you)困難的(de)(de)(de)(de)(de),可(ke)以采取由(you)國(guo)資(zi)(zi)委委托監(jian)管(guan)(guan)(guan)(guan)、行業(ye)(ye)(ye)部門具體(ti)(ti)監(jian)管(guan)(guan)(guan)(guan)等方(fang)(fang)式。二要注意發揮(hui)好統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)(de)體(ti)(ti)制優(you)(you)勢(shi)。嚴格按照(zhao)出(chu)資(zi)(zi)關系,切實加強出(chu)資(zi)(zi)人專業(ye)(ye)(ye)化、系統(tong)化、規(gui)范(fan)化監(jian)管(guan)(guan)(guan)(guan),提高國(guo)有(you)資(zi)(zi)產監(jian)管(guan)(guan)(guan)(guan)效(xiao)率,使出(chu)資(zi)(zi)人監(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)(de)體(ti)(ti)制優(you)(you)勢(shi)得到充分體(ti)(ti)現(xian)(xian)。三要集中(zhong)(zhong)資(zi)(zi)源(yuan)打造(zao)優(you)(you)勢(shi)企(qi)業(ye)(ye)(ye)。通過(guo)(guo)推動(dong)(dong)集中(zhong)(zhong)統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan),加快(kuai)在更(geng)(geng)大范(fan)圍、更(geng)(geng)高層(ceng)次上的(de)(de)(de)(de)(de)企(qi)業(ye)(ye)(ye)重組和資(zi)(zi)源(yuan)整合,著(zhu)力(li)(li)培育一(yi)批地(di)方(fang)(fang)優(you)(you)勢(shi)企(qi)業(ye)(ye)(ye),具備條件的(de)(de)(de)(de)(de)還(huan)要力(li)(li)爭培育成為國(guo)內領先企(qi)業(ye)(ye)(ye)或世界一(yi)流企(qi)業(ye)(ye)(ye)。總之,要通過(guo)(guo)指導(dao)推動(dong)(dong),爭取在新的(de)(de)(de)(de)(de)體(ti)(ti)制框架下(xia)實現(xian)(xian)集中(zhong)(zhong)統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan),在優(you)(you)化資(zi)(zi)源(yuan)配置(zhi)的(de)(de)(de)(de)(de)前提下(xia)實現(xian)(xian)集中(zhong)(zhong)統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan),在打造(zao)優(you)(you)勢(shi)企(qi)業(ye)(ye)(ye)的(de)(de)(de)(de)(de)過(guo)(guo)程中(zhong)(zhong)實現(xian)(xian)集中(zhong)(zhong)統(tong)一(yi)監(jian)管(guan)(guan)(guan)(guan)。
(三)指導促進地方國有(you)資產(chan)監管工作不斷深化。
目前(qian),各地(di)國(guo)(guo)有(you)(you)資產監管(guan)工(gong)作基(ji)本進入規范化(hua)軌道(dao)。但隨(sui)著國(guo)(guo)有(you)(you)企業(ye)(ye)(ye)(ye)改革發展(zhan)的(de)不(bu)斷(duan)加(jia)快,國(guo)(guo)資監管(guan)工(gong)作還不(bu)能(neng)完全適應當(dang)前(qian)形勢發展(zhan)變(bian)化(hua)的(de)需要,監管(guan)不(bu)到(dao)位、監管(guan)資源分散(san)、監管(guan)效率(lv)不(bu)高的(de)問(wen)題還不(bu)同程度地(di)存在(zai),國(guo)(guo)資委內部業(ye)(ye)(ye)(ye)務(wu)流程和組織結構也有(you)(you)待(dai)優(you)化(hua)完善。特別是(shi)在(zai)股權(quan)多元化(hua)條件下,國(guo)(guo)有(you)(you)資產出(chu)資人代表(biao)如(ru)何在(zai)企業(ye)(ye)(ye)(ye)層層落實到(dao)位,如(ru)何加(jia)強境外國(guo)(guo)有(you)(you)資產和重要子企業(ye)(ye)(ye)(ye)監管(guan)等,都需要進一步探索(suo)和規范。
“十二(er)五”時(shi)期要(yao)通過加(jia)(jia)強(qiang)指(zhi)導監(jian)(jian)(jian)(jian)(jian)督,大(da)力(li)推進國(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作的(de)(de)不斷深化。一要(yao)著力(li)拓(tuo)寬監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)思路,提(ti)高(gao)(gao)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作的(de)(de)前(qian)瞻性(xing)。注意(yi)指(zhi)導下級國(guo)(guo)(guo)資(zi)委(wei)妥(tuo)善應對(dui)(dui)日趨復雜的(de)(de)宏(hong)觀經濟環境,準確把(ba)握國(guo)(guo)(guo)有(you)(you)(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)和國(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)改革發展(zhan)(zhan)中的(de)(de)方(fang)向性(xing)、趨勢性(xing)問(wen)題(ti)。二(er)要(yao)著力(li)突出監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)重點,提(ti)高(gao)(gao)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作的(de)(de)針對(dui)(dui)性(xing)。根據監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)企(qi)業(ye)(ye)不同的(de)(de)股權(quan)(quan)結構(gou)和組(zu)織形(xing)式,積極(ji)探索分(fen)類監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)。切(qie)實加(jia)(jia)強(qiang)混合所有(you)(you)(you)制下國(guo)(guo)(guo)有(you)(you)(you)產權(quan)(quan)的(de)(de)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)理(li),繼(ji)續完善有(you)(you)(you)利于推動企(qi)業(ye)(ye)自主(zhu)創新(xin)、提(ti)高(gao)(gao)發展(zhan)(zhan)質量的(de)(de)考核指(zhi)標體系(xi)。適(shi)應國(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)“走出去(qu)”要(yao)求(qiu),進一步加(jia)(jia)強(qiang)對(dui)(dui)境外國(guo)(guo)(guo)有(you)(you)(you)資(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)。針對(dui)(dui)國(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)大(da)部(bu)(bu)分(fen)資(zi)產集中在二(er)、三級企(qi)業(ye)(ye)的(de)(de)情況,完善對(dui)(dui)重要(yao)子企(qi)業(ye)(ye)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)的(de)(de)制度機制。三要(yao)著力(li)整合監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)資(zi)源(yuan),提(ti)高(gao)(gao)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)工(gong)作的(de)(de)有(you)(you)(you)效性(xing)。適(shi)時(shi)調整優化國(guo)(guo)(guo)資(zi)委(wei)內部(bu)(bu)機構(gou)設置(zhi)和職能配置(zhi),加(jia)(jia)強(qiang)投(tou)資(zi)規劃、產權(quan)(quan)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)理(li)、財(cai)務監(jian)(jian)(jian)(jian)(jian)督、業(ye)(ye)績考核、薪酬分(fen)配、干部(bu)(bu)任免、外派監(jian)(jian)(jian)(jian)(jian)事(shi)會(hui)、紀檢監(jian)(jian)(jian)(jian)(jian)察等各(ge)個環節(jie)的(de)(de)銜接(jie)協調,形(xing)成(cheng)國(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)的(de)(de)閉(bi)環鏈條。探索國(guo)(guo)(guo)有(you)(you)(you)企(qi)業(ye)(ye)財(cai)務信息(xi)公開(kai)制度,注重利用現代信息(xi)技術實施監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan),不斷創新(xin)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)方(fang)式,不斷提(ti)高(gao)(gao)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)(guan)(guan)(guan)(guan)效率。
這里(li),我還(huan)要(yao)(yao)特(te)別強調國(guo)(guo)資(zi)(zi)委(wei)系(xi)統融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)風(feng)險(xian)防范問題(ti)。這是當(dang)(dang)前(qian)和今后一個(ge)時期(qi),指(zhi)導監督工(gong)作(zuo)應當(dang)(dang)給(gei)予(yu)高度關注的(de)問題(ti)。融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)大多以國(guo)(guo)有(you)(you)土地(di)使用權(quan)、國(guo)(guo)有(you)(you)企業股權(quan)等作(zuo)為(wei)融(rong)(rong)(rong)資(zi)(zi)擔保,貸款期(qi)限長,潛在風(feng)險(xian)大。要(yao)(yao)注意指(zhi)導地(di)方(fang)融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)按照企業規律運營,既要(yao)(yao)服務于當(dang)(dang)地(di)經濟(ji)(ji)社會發(fa)展大局(ju),為(wei)地(di)方(fang)基礎設施建(jian)設提供資(zi)(zi)金支持;又要(yao)(yao)量入(ru)為(wei)出,合(he)理確定(ding)融(rong)(rong)(rong)資(zi)(zi)規模,不(bu)能以犧牲國(guo)(guo)有(you)(you)資(zi)(zi)產安(an)全解(jie)決暫時的(de)資(zi)(zi)金需求,不(bu)能給(gei)國(guo)(guo)有(you)(you)經濟(ji)(ji)發(fa)展帶(dai)來長期(qi)隱患(huan)。各地(di)國(guo)(guo)資(zi)(zi)委(wei)要(yao)(yao)對(dui)所監管的(de)融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)依法(fa)履行好出資(zi)(zi)人職(zhi)責,嚴格按照法(fa)定(ding)程序參與重(zhong)(zhong)大事(shi)項決策,重(zhong)(zhong)視(shi)指(zhi)導融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)完善治理結構(gou),提高科(ke)學決策水(shui)平。要(yao)(yao)抓緊摸(mo)清所監管的(de)融(rong)(rong)(rong)資(zi)(zi)平臺公(gong)(gong)司(si)資(zi)(zi)產負債、擔保等基本情況,全面評估(gu)潛在風(feng)險(xian),認真研(yan)究制定(ding)切(qie)實可行的(de)風(feng)險(xian)防范預(yu)案。
(四)指導健全企(qi)業國有資(zi)產基(ji)礎管(guan)理工作體系。
健全企(qi)業國(guo)有資(zi)(zi)產基(ji)(ji)礎(chu)管理(li)工作體(ti)系(xi),既是開展指導監督(du)工作的(de)(de)(de)重(zhong)要抓手(shou),也(ye)是上下(xia)級國(guo)資(zi)(zi)委之(zhi)間加強聯(lian)系(xi)的(de)(de)(de)重(zhong)要紐帶。認真做好這項工作,有利(li)于全面(mian)掌握國(guo)有資(zi)(zi)產整體(ti)狀(zhuang)況,有利(li)于全程監管國(guo)有資(zi)(zi)產流轉環(huan)節,有利(li)于適(shi)時實現國(guo)有資(zi)(zi)產運營質量(liang)監測。目前,國(guo)資(zi)(zi)委系(xi)統(tong)基(ji)(ji)礎(chu)管理(li)工作體(ti)系(xi)初步(bu)形(xing)成,管理(li)規則(ze)逐步(bu)健全。但(dan)有關(guan)制度(du)位階較低,系(xi)統(tong)內(nei)外規則(ze)不(bu)統(tong)一,部門(men)職能(neng)交叉、多頭管理(li)、責任不(bu)清的(de)(de)(de)現象仍然(ran)存在(zai),縣級企(qi)業國(guo)有資(zi)(zi)產基(ji)(ji)礎(chu)管理(li)缺位還比較嚴重(zhong)。同時,隨(sui)著這幾(ji)年(nian)國(guo)有資(zi)(zi)產管理(li)體(ti)制改革和國(guo)有企(qi)業改革重(zhong)組的(de)(de)(de)不(bu)斷(duan)深(shen)入,國(guo)有經濟在(zai)我國(guo)經濟社會發展中的(de)(de)(de)主(zhu)(zhu)體(ti)地位和主(zhu)(zhu)導作用進一步(bu)突(tu)出,有關(guan)基(ji)(ji)礎(chu)數據對國(guo)家宏觀經濟決策的(de)(de)(de)參考價值日益凸顯,因而對我們加強企(qi)業國(guo)有資(zi)(zi)產基(ji)(ji)礎(chu)管理(li)提出了更為重(zhong)要和緊迫的(de)(de)(de)要求。
“十二五”時(shi)期,指導健(jian)全(quan)企(qi)(qi)業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理工(gong)作體系,應(ying)當著(zhu)力抓好以(yi)下三點:一(yi)(yi)要(yao)加快(kuai)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理制(zhi)度(du)建設。2010年(nian)(nian)、2011年(nian)(nian),國(guo)(guo)(guo)(guo)(guo)務院兩次將《企(qi)(qi)業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理條例(li)》列為“條件成(cheng)熟時(shi)出臺”的立法項目(mu)。各地(di)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)一(yi)(yi)方(fang)面(mian)要(yao)積(ji)(ji)極配(pei)合起草(cao)好這個條例(li),另(ling)一(yi)(yi)方(fang)面(mian),要(yao)重視(shi)加強地(di)方(fang)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理制(zhi)度(du)建設,積(ji)(ji)極創(chuang)造條件,爭取實現本(ben)地(di)區(qu)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理規(gui)則和制(zhi)度(du)的統一(yi)(yi)。二要(yao)完善(shan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理工(gong)作機制(zhi)。要(yao)加強與有(you)(you)關部門的溝通協調,明(ming)確部門分工(gong),依法落實省、地(di)市(shi)兩級(ji)(ji)國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)企(qi)(qi)業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理職(zhi)責,盡快(kuai)明(ming)確縣級(ji)(ji)企(qi)(qi)業(ye)國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理主體,建立全(quan)面(mian)覆蓋、層(ceng)級(ji)(ji)完整的基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理工(gong)作機制(zhi)。三要(yao)利用好基(ji)礎(chu)(chu)(chu)管(guan)(guan)(guan)(guan)理數據成(cheng)果。比如(ru),通過全(quan)面(mian)掌握總量與分布情況,為國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)布局(ju)結構調整提(ti)供依據;通過及時(shi)跟蹤國(guo)(guo)(guo)(guo)(guo)有(you)(you)產(chan)(chan)(chan)權變(bian)動情況,有(you)(you)效維護國(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)產(chan)(chan)(chan)安全(quan);通過分析國(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟(ji)運行(xing)動態(tai),為政府實施宏觀經濟(ji)管(guan)(guan)(guan)(guan)理和國(guo)(guo)(guo)(guo)(guo)資(zi)委(wei)實施有(you)(you)效監管(guan)(guan)(guan)(guan)提(ti)供決策參考(kao)。
以上(shang)四(si)項(xiang)主要任務,是針對國資委系(xi)統指(zhi)導監督工(gong)作(zuo)需要重(zhong)(zhong)點(dian)(dian)突破(po)的(de)共性問(wen)題(ti)提(ti)出(chu)來的(de)。各地情(qing)況(kuang)不(bu)同,在開展指(zhi)導監督工(gong)作(zuo)時,還可以明(ming)確其(qi)他一些重(zhong)(zhong)點(dian)(dian)工(gong)作(zuo)任務。要分析本地區的(de)突出(chu)矛盾(dun)和問(wen)題(ti),分清輕(qing)重(zhong)(zhong)緩(huan)急(ji),在指(zhi)導監督工(gong)作(zuo)中始終(zhong)堅持(chi)抓重(zhong)(zhong)點(dian)(dian),破(po)難(nan)點(dian)(dian),出(chu)亮點(dian)(dian),做精品。
三、深入做好指導(dao)監(jian)督地方國資工作的幾(ji)點要(yao)求
今年是(shi)指(zhi)導監(jian)督地(di)(di)方(fang)國(guo)資工(gong)作(zuo)深入推進的一(yi)年。按(an)照“十二(er)五”時期指(zhi)導監(jian)督工(gong)作(zuo)總體(ti)思路(lu)和(he)主要(yao)任務,各地(di)(di)國(guo)資委(wei)要(yao)著(zhu)力(li)在“提高認(ren)識、完善(shan)制(zhi)度、突出重點、提升能力(li)”上下功夫,扎(zha)扎(zha)實實地(di)(di)做好(hao)各項工(gong)作(zuo)。

指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作涉及國(guo)資監(jian)(jian)(jian)管(guan)(guan)和國(guo)企改(gai)革發展的(de)方(fang)(fang)方(fang)(fang)面(mian)面(mian),政策要求高,探索性很強,推進難度大,必須不斷提(ti)升指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作的(de)能力(li)和水(shui)平。要深入(ru)學(xue)(xue)習(xi)領會(hui)黨(dang)的(de)十(shi)六大、十(shi)七大關于(yu)國(guo)有資產監(jian)(jian)(jian)管(guan)(guan)體制改(gai)革和完善的(de)一(yi)系列方(fang)(fang)針政策,不斷探索解決指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作涉及的(de)方(fang)(fang)向(xiang)性、全(quan)局性、戰(zhan)略性問(wen)題(ti)。要適(shi)應(ying)指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作面(mian)臨的(de)新形勢新任務,進一(yi)步加(jia)強指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作隊伍(wu)建設。堅持(chi)“學(xue)(xue)用(yong)結合”,經(jing)常組織國(guo)資委系統深入(ru)交流學(xue)(xue)習(xi),及時(shi)研討重點(dian)問(wen)題(ti),加(jia)快提(ti)高指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作隊伍(wu)的(de)政治業務素質和綜合工(gong)作能力(li),努力(li)培養一(yi)支懂政策法規、精國(guo)資監(jian)(jian)(jian)管(guan)(guan)、善協調服(fu)務的(de)指(zhi)導(dao)監(jian)(jian)(jian)督(du)工(gong)作隊伍(wu)。
根據委里會(hui)(hui)議(yi)計劃,今年不再專門召開(kai)國資委系統政策法規工作會(hui)(hui)議(yi),借此機會(hui)(hui),我(wo)想重點強(qiang)調兩個(ge)問題。
(一)關(guan)于依法行(xing)權履(lv)責、進一步(bu)加強法治機(ji)構建設(she)。
近幾年來,國務院高度重視法(fa)治(zhi)政府建設,專(zhuan)門(men)印(yin)發了(le)《國務院全面(mian)推進依(yi)法(fa)行(xing)政實(shi)施(shi)綱要》和《國務院關于加(jia)強法(fa)治(zhi)政府建設的(de)意見》,并且召開了(le)全國依(yi)法(fa)行(xing)政工(gong)作會議,明確要求各級政府部門(men)從立法(fa)、決策(ce)、執行(xing)、監督等方面(mian),采取切(qie)實(shi)措(cuo)施(shi),全面(mian)推進依(yi)法(fa)行(xing)政工(gong)作。國資委雖然不是政府行(xing)政部門(men),但作為(wei)直(zhi)屬特設機構在依(yi)法(fa)行(xing)權履(lv)責過程中,同樣必須貫徹落實(shi)好(hao)這些部署和要求。
國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)去(qu)年12月印(yin)發了《關于依(yi)法(fa)(fa)(fa)(fa)(fa)行權履責(ze)進一(yi)(yi)步加強(qiang)(qiang)法(fa)(fa)(fa)(fa)(fa)治機構建(jian)設(she)的(de)(de)(de)實(shi)施意(yi)見(jian)》,明確提(ti)出加強(qiang)(qiang)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)法(fa)(fa)(fa)(fa)(fa)治機構建(jian)設(she)的(de)(de)(de)總體(ti)要(yao)求和(he)(he)具體(ti)任(ren)務(wu)。希望各(ge)地(di)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)高度(du)重視這項工作(zuo)(zuo)。一(yi)(yi)要(yao)繼(ji)續(xu)做好國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監管立法(fa)(fa)(fa)(fa)(fa)工作(zuo)(zuo)。國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)于近日制定(ding)出臺了《中(zhong)(zhong)(zhong)央企業(ye)境(jing)外國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監督管理(li)(li)暫行辦(ban)(ban)法(fa)(fa)(fa)(fa)(fa)》和(he)(he)《中(zhong)(zhong)(zhong)央企業(ye)境(jing)外國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)產權管理(li)(li)暫行辦(ban)(ban)法(fa)(fa)(fa)(fa)(fa)》,目前正在抓緊(jin)起草(cao)《企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產基礎管理(li)(li)條(tiao)例(li)》,同時配合財政部起草(cao)《國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)本經(jing)(jing)營預(yu)算條(tiao)例(li)》。各(ge)地(di)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)也要(yao)結合本地(di)區國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)監管工作(zuo)(zuo)實(shi)際和(he)(he)突出問題,切實(shi)加強(qiang)(qiang)相關制度(du)建(jian)設(she),努力實(shi)現國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)履行職(zhi)責(ze)的(de)(de)(de)各(ge)項行為都有(you)(you)法(fa)(fa)(fa)(fa)(fa)可依(yi)。二要(yao)堅(jian)持(chi)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系統(tong)(tong)依(yi)法(fa)(fa)(fa)(fa)(fa)科(ke)學民主決策。加強(qiang)(qiang)對重大決策事(shi)項的(de)(de)(de)合法(fa)(fa)(fa)(fa)(fa)性審查(cha)(cha),未經(jing)(jing)合法(fa)(fa)(fa)(fa)(fa)性審查(cha)(cha)或者經(jing)(jing)審查(cha)(cha)不合法(fa)(fa)(fa)(fa)(fa)的(de)(de)(de),不能提(ti)交(jiao)委(wei)(wei)(wei)主任(ren)辦(ban)(ban)公(gong)會議討論決定(ding)。三要(yao)牢固樹立程(cheng)(cheng)序(xu)意(yi)識。在履行出資(zi)(zi)(zi)人職(zhi)責(ze)過(guo)程(cheng)(cheng)中(zhong)(zhong)(zhong),自(zi)覺按程(cheng)(cheng)序(xu)辦(ban)(ban)事(shi),嚴格遵守公(gong)司(si)法(fa)(fa)(fa)(fa)(fa)、企業(ye)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)(zi)產法(fa)(fa)(fa)(fa)(fa)和(he)(he)公(gong)司(si)章程(cheng)(cheng)有(you)(you)關公(gong)司(si)治理(li)(li)結構和(he)(he)議事(shi)規則的(de)(de)(de)各(ge)項規定(ding),認(ren)真執行國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)工作(zuo)(zuo)規程(cheng)(cheng)。四要(yao)深入開(kai)展(zhan)“六(liu)五”普(pu)法(fa)(fa)(fa)(fa)(fa)工作(zuo)(zuo)。根據全國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)普(pu)法(fa)(fa)(fa)(fa)(fa)辦(ban)(ban)“六(liu)五”普(pu)法(fa)(fa)(fa)(fa)(fa)規劃和(he)(he)即將印(yin)發的(de)(de)(de)《國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)關于在國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系統(tong)(tong)開(kai)展(zhan)法(fa)(fa)(fa)(fa)(fa)制宣傳(chuan)教(jiao)育(yu)的(de)(de)(de)第六(liu)個五年規劃》,進一(yi)(yi)步提(ti)高國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)系統(tong)(tong)廣大干部職(zhi)工特別是領導干部的(de)(de)(de)法(fa)(fa)(fa)(fa)(fa)律(lv)意(yi)識,大力推(tui)進機關合規文化建(jian)設(she),自(zi)覺防范好各(ge)級國(guo)(guo)(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)委(wei)(wei)(wei)行權履責(ze)中(zhong)(zhong)(zhong)的(de)(de)(de)法(fa)(fa)(fa)(fa)(fa)律(lv)風險。
(二(er))關于加(jia)快(kuai)落實地(di)方國有重點企業法制(zhi)工作三(san)年目標(biao)。
按(an)照地方國有重(zhong)點(dian)企業(ye)法(fa)制工作(zuo)第二個(ge)三年(nian)目標要求,在今(jin)年(nian)年(nian)底前(qian),省屬國有重(zhong)點(dian)企業(ye)要全部設立(li)(li)法(fa)律事務(wu)機構(gou),70%以上的(de)(de)企業(ye)要建立(li)(li)總法(fa)律顧問(wen)制度。據初步統計,截止到今(jin)年(nian)5月(yue)底,928戶(hu)省屬國有重(zhong)點(dian)企業(ye)中,有782戶(hu)建立(li)(li)了法(fa)律事務(wu)機構(gou),占(zhan)84%;419戶(hu)建立(li)(li)了總法(fa)律顧問(wen)制度,占(zhan)45%。總體上看,這(zhe)一(yi)進展與目標要求相比還有不小差距(ju),特別是有6個(ge)省國資委所監管(guan)企業(ye),至今(jin)未有一(yi)戶(hu)設立(li)(li)總法(fa)律顧問(wen),應當引(yin)起我們(men)的(de)(de)高度重(zhong)視。
目(mu)前,距離三(san)年(nian)(nian)目(mu)標結束僅(jin)剩半年(nian)(nian)時間,各(ge)地(di)(di)國資(zi)(zi)委(wei)要(yao)(yao)進(jin)(jin)一(yi)步增強緊迫(po)感,采取有(you)力措施盡快完成任務(wu)。一(yi)要(yao)(yao)切(qie)實(shi)落實(shi)工作責任,加大推進(jin)(jin)力度。尤其是進(jin)(jin)展較(jiao)慢的(de)(de)(de)省市,國資(zi)(zi)委(wei)領(ling)(ling)導(dao)(dao)(dao)要(yao)(yao)親自抓(zhua),法(fa)(fa)(fa)規處(chu)室要(yao)(yao)切(qie)實(shi)履(lv)行職責,要(yao)(yao)會(hui)同干部管理處(chu)室在(zai)摸清具體(ti)(ti)情況(kuang)和(he)原因的(de)(de)(de)基礎上(shang),抓(zhua)緊進(jin)(jin)行專(zhuan)題研(yan)究(jiu),制(zhi)定符合實(shi)際的(de)(de)(de)整改推進(jin)(jin)計劃(hua)。二(er)要(yao)(yao)及時開(kai)展專(zhuan)項督(du)導(dao)(dao)(dao),有(you)效解決推進(jin)(jin)三(san)年(nian)(nian)目(mu)標的(de)(de)(de)短板。要(yao)(yao)針對所監(jian)管企業(ye)(ye)落實(shi)三(san)年(nian)(nian)目(mu)標的(de)(de)(de)薄弱環節,擬(ni)定督(du)導(dao)(dao)(dao)名單,由國資(zi)(zi)委(wei)領(ling)(ling)導(dao)(dao)(dao)帶隊,通過與企業(ye)(ye)領(ling)(ling)導(dao)(dao)(dao)當(dang)面(mian)交換意見(jian)、幫助總結分析典(dian)型(xing)案例等(deng)形(xing)式(shi),對重點(dian)企業(ye)(ye)逐戶開(kai)展專(zhuan)項督(du)導(dao)(dao)(dao)。三(san)要(yao)(yao)注(zhu)意抓(zhua)好總法(fa)(fa)(fa)律顧(gu)問的(de)(de)(de)上(shang)崗到位,突出推進(jin)(jin)三(san)年(nian)(nian)目(mu)標實(shi)現的(de)(de)(de)重點(dian)環節。對于暫(zan)時沒有(you)合適(shi)專(zhuan)職人選的(de)(de)(de)企業(ye)(ye),可(ke)以(yi)由企業(ye)(ye)領(ling)(ling)導(dao)(dao)(dao)班子成員兼任,也可(ke)以(yi)面(mian)向(xiang)(xiang)社會(hui)公開(kai)招聘。各(ge)地(di)(di)還(huan)可(ke)以(yi)借(jie)鑒江(jiang)西、河(he)南(nan)、湖(hu)北等(deng)地(di)(di)國資(zi)(zi)委(wei)的(de)(de)(de)做法(fa)(fa)(fa),向(xiang)(xiang)監(jian)管企業(ye)(ye)直接委(wei)派總法(fa)(fa)(fa)律顧(gu)問。四要(yao)(yao)認真組織(zhi)檢(jian)查(cha)(cha)驗(yan)(yan)收,確保三(san)年(nian)(nian)目(mu)標的(de)(de)(de)實(shi)現不走過場。各(ge)地(di)(di)要(yao)(yao)按(an)照目(mu)標要(yao)(yao)求的(de)(de)(de)基本(ben)內容,借(jie)鑒國務(wu)院(yuan)國資(zi)(zi)委(wei)檢(jian)查(cha)(cha)驗(yan)(yan)收中(zhong)央企業(ye)(ye)的(de)(de)(de)做法(fa)(fa)(fa),具體(ti)(ti)細化檢(jian)查(cha)(cha)驗(yan)(yan)收標準,在(zai)今年(nian)(nian)年(nian)(nian)底前后,通過自查(cha)(cha)、互查(cha)(cha)、抽查(cha)(cha)相(xiang)結合的(de)(de)(de)方式(shi),全面(mian)檢(jian)查(cha)(cha)本(ben)地(di)(di)區(qu)國有(you)重點(dian)企業(ye)(ye)三(san)年(nian)(nian)目(mu)標的(de)(de)(de)完成情況(kuang),注(zhu)意總結先進(jin)(jin)典(dian)型(xing),著力解決突出困難和(he)問題,檢(jian)查(cha)(cha)結果(guo)要(yao)(yao)以(yi)適(shi)當(dang)形(xing)式(shi)進(jin)(jin)行通報。
