——在全國國資委系統指(zhi)導監督工作座談會上的講話

同志們:
這次會(hui)(hui)(hui)議(yi)是(shi)在“十二五”開局之年,國(guo)資(zi)監(jian)(jian)管和(he)國(guo)企改革進入(ru)新階段召開的(de)一次重要(yao)會(hui)(hui)(hui)議(yi)。會(hui)(hui)(hui)議(yi)的(de)主(zhu)要(yao)任務(wu)是(shi):總結(jie)杭州會(hui)(hui)(hui)議(yi)以來(lai)指導監(jian)(jian)督(du)地(di)方國(guo)資(zi)工(gong)作的(de)進展和(he)成效,交(jiao)流各地(di)好的(de)做(zuo)法和(he)經驗,圍繞“國(guo)資(zi)監(jian)(jian)管上新水平(ping)、國(guo)企發(fa)展上新臺階”的(de)“兩新目標(biao)”,研究“十二五”時(shi)期指導監(jian)(jian)督(du)地(di)方國(guo)資(zi)工(gong)作的(de)總體思路(lu)和(he)工(gong)作重點,提(ti)出做(zuo)好下一步(bu)工(gong)作的(de)具體措施。國(guo)務(wu)院國(guo)資(zi)委對這次會(hui)(hui)(hui)議(yi)高度重視,國(guo)資(zi)委主(zhu)任、黨委書記(ji)王勇(yong)同(tong)志做(zuo)出重要(yao)批(pi)示(shi),對進一步(bu)加強指導監(jian)(jian)督(du)工(gong)作提(ti)出明確要(yao)求。大家要(yao)認(ren)真學習領會(hui)(hui)(hui),全面貫徹落實。下面,我講三點意見。
一(yi)、指導監督(du)地方國資工(gong)作取得新進展新成效
去年杭州會議(yi)以來(lai),國(guo)資(zi)委系統緊緊圍繞國(guo)資(zi)監(jian)管和(he)(he)國(guo)企(qi)改革(ge)發展的(de)中(zhong)心任(ren)務,大力推進(jin)指(zhi)導監(jian)督(du)工(gong)作(zuo),國(guo)資(zi)系統一盤(pan)棋理念進(jin)一步增強,上下級國(guo)資(zi)委溝通(tong)聯系進(jin)一步密切(qie),工(gong)作(zuo)合力進(jin)一步形(xing)成,指(zhi)導監(jian)督(du)工(gong)作(zuo)取得(de)新的(de)進(jin)展和(he)(he)成效。
(一)加強(qiang)組織領導,指導監督工作(zuo)機制基本形成(cheng)。
分管(guan)領(ling)導(dao)和工(gong)(gong)作(zuo)機(ji)構全面落實(shi)。各(ge)(ge)省(sheng)級國(guo)資委(wei)將指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)擺上(shang)重要議事(shi)日(ri)程(cheng),普遍成(cheng)立(li)了指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)領(ling)導(dao)小組(zu),不(bu)少地方國(guo)資委(wei)由(you)一(yi)把(ba)手親自擔(dan)任(ren)領(ling)導(dao)小組(zu)組(zu)長,同時明確(que)了委(wei)內(nei)牽頭(tou)處(chu)室(shi),建立(li)了各(ge)(ge)處(chu)室(shi)之間的分工(gong)(gong)協(xie)調(diao)機(ji)制。北(bei)京(jing)市(shi)國(guo)資委(wei)將36項(xiang)工(gong)(gong)作(zuo)任(ren)務分解到(dao)16個(ge)處(chu)室(shi)。山(shan)東省(sheng)國(guo)資委(wei)將各(ge)(ge)處(chu)室(shi)指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)開展情況列入年度(du)考核(he)內(nei)容。上(shang)海(hai)市(shi)國(guo)資委(wei)對區(qu)縣國(guo)資監(jian)管(guan)工(gong)(gong)作(zuo)中遇到(dao)的難題(ti),由(you)各(ge)(ge)業務處(chu)室(shi)實(shi)行對口“一(yi)條(tiao)龍(long)”服(fu)務。通過落實(shi)分管(guan)領(ling)導(dao)和工(gong)(gong)作(zuo)機(ji)構,初步(bu)形成(cheng)了職責明確(que)、統籌協(xie)調(diao)、分工(gong)(gong)負責的指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)(du)工(gong)(gong)作(zuo)組(zu)織體系。
指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)制(zhi)度建設不斷加強。國(guo)務院國(guo)資(zi)委修訂發布了《地方(fang)國(guo)有資(zi)產監(jian)(jian)管(guan)工(gong)作(zuo)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)辦法》(以下簡(jian)稱《指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)辦法》),按照“指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)、溝通、交流、服務”的(de)(de)原則,明(ming)確指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)機制(zhi)和主要(yao)工(gong)作(zuo)事項(xiang),進一(yi)步規(gui)范了指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)的(de)(de)主要(yao)方(fang)式(shi)和途(tu)徑。上(shang)海市(shi)(shi)國(guo)資(zi)委制(zhi)定(ding)了《指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)辦法》的(de)(de)實施(shi)細則,將區縣貫徹執行(xing)國(guo)資(zi)監(jian)(jian)管(guan)政策法規(gui)情(qing)況(kuang)作(zuo)為指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)工(gong)作(zuo)重點。湖南(nan)、湖北、四(si)川、重慶、甘肅、內蒙、新疆生產建設兵(bing)團等省(sheng)區市(shi)(shi)國(guo)資(zi)委出臺了加強市(shi)(shi)、縣級國(guo)資(zi)監(jian)(jian)管(guan)工(gong)作(zuo)的(de)(de)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)監(jian)(jian)督(du)(du)辦法,探(tan)索建立(li)政策指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)與(yu)具體(ti)(ti)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)、日常指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)與(yu)專項(xiang)指(zhi)(zhi)(zhi)(zhi)導(dao)(dao)(dao)(dao)相(xiang)結(jie)合的(de)(de)工(gong)作(zuo)體(ti)(ti)系。
上下級國(guo)(guo)資(zi)(zi)(zi)委(wei)之(zhi)間(jian)(jian)的(de)(de)(de)溝通(tong)交(jiao)流(liu)平臺逐(zhu)步(bu)形(xing)成。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)委(wei)定(ding)期編發簡報(bao),及(ji)時(shi)(shi)傳達(da)指導(dao)監(jian)督(du)工(gong)作要求,交(jiao)流(liu)推廣(guang)各地(di)國(guo)(guo)資(zi)(zi)(zi)監(jian)管的(de)(de)(de)特色做法和先(xian)進經驗,同時(shi)(shi)加快建(jian)立地(di)方國(guo)(guo)資(zi)(zi)(zi)監(jian)管信息資(zi)(zi)(zi)源(yuan)系(xi)統,嘗試指導(dao)監(jian)督(du)基(ji)礎數據(ju)的(de)(de)(de)整(zheng)合(he)與(yu)利用。福(fu)建(jian)、安(an)徽等省國(guo)(guo)資(zi)(zi)(zi)委(wei)健(jian)全監(jian)管工(gong)作體系(xi),形(xing)成了覆蓋全省的(de)(de)(de)基(ji)礎數據(ju)網(wang)絡。遼(liao)寧省國(guo)(guo)資(zi)(zi)(zi)委(wei)通(tong)過(guo)與(yu)地(di)市(shi)國(guo)(guo)資(zi)(zi)(zi)委(wei)辦公信息系(xi)統聯網(wang),確保了重(zhong)要信息及(ji)時(shi)(shi)上報(bao)。國(guo)(guo)資(zi)(zi)(zi)委(wei)系(xi)統運用溝通(tong)交(jiao)流(liu)平臺,有(you)力地(di)促進了相(xiang)互之(zhi)間(jian)(jian)的(de)(de)(de)學習借(jie)鑒和信息共享。
(二)創(chuang)新方(fang)式方(fang)法,指導監督工作(zuo)全面展開。
精心規劃(hua)(hua)部(bu)署指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)工(gong)(gong)作(zuo)。國(guo)務(wu)院國(guo)資委(wei)(wei)印發(fa)年度工(gong)(gong)作(zuo)計(ji)劃(hua)(hua),明(ming)確了2011年指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)的40項工(gong)(gong)作(zuo)任務(wu)和責任廳局(ju)。湖南、新(xin)疆、西藏、廈門(men)等許多省市(shi)國(guo)資委(wei)(wei)也制定(ding)了指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)工(gong)(gong)作(zuo)年度計(ji)劃(hua)(hua)。福建、江西、陜西等省市(shi)國(guo)資委(wei)(wei)專門(men)組織召開了全省指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)工(gong)(gong)作(zuo)會(hui)議。北京市(shi)國(guo)資委(wei)(wei)邀(yao)請區縣(xian)政府主管領(ling)導(dao)參加國(guo)資監(jian)管工(gong)(gong)作(zuo)會(hui)議,全面部(bu)署了區縣(xian)國(guo)資監(jian)管重點工(gong)(gong)作(zuo)。四川省國(guo)資委(wei)(wei)召開研討(tao)會(hui),研究部(bu)署“十二(er)五”時期指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)工(gong)(gong)作(zuo)的總(zong)體思路、重點任務(wu)和工(gong)(gong)作(zuo)措施。通過工(gong)(gong)作(zuo)計(ji)劃(hua)(hua)和會(hui)議部(bu)署,各地指(zhi)(zhi)(zhi)導(dao)監(jian)督(du)工(gong)(gong)作(zuo)開始(shi)全面啟動,并初步打(da)開了工(gong)(gong)作(zuo)局(ju)面。
深入調(diao)研(yan)摸清指(zhi)(zhi)導(dao)監(jian)(jian)督面上(shang)(shang)情(qing)況(kuang)。今(jin)年上(shang)(shang)半年,國(guo)資(zi)(zi)(zi)委(wei)(wei)法(fa)規局赴13個省市(shi)深入了解地方國(guo)資(zi)(zi)(zi)監(jian)(jian)管機(ji)構(gou)建設(she)、全(quan)覆(fu)蓋監(jian)(jian)管、融資(zi)(zi)(zi)平臺(tai)公司經營等(deng)方面的(de)(de)情(qing)況(kuang)和(he)問題,并提交了有關調(diao)研(yan)報(bao)(bao)告和(he)上(shang)(shang)報(bao)(bao)的(de)(de)專題信(xin)息。福建省國(guo)資(zi)(zi)(zi)委(wei)(wei)對市(shi)、縣國(guo)資(zi)(zi)(zi)監(jian)(jian)管工作(zuo)和(he)指(zhi)(zhi)導(dao)監(jian)(jian)督工作(zuo)情(qing)況(kuang)進(jin)行全(quan)面調(diao)研(yan)。山東省國(guo)資(zi)(zi)(zi)委(wei)(wei)針對部分(fen)地市(shi)出現的(de)(de)國(guo)資(zi)(zi)(zi)委(wei)(wei)監(jian)(jian)管企(qi)業劃(hua)回原(yuan)主(zhu)管部門的(de)(de)體制(zhi)回潮現象,由委(wei)(wei)領導(dao)分(fen)頭帶隊進(jin)行集中調(diao)研(yan)督導(dao)。安徽省國(guo)資(zi)(zi)(zi)委(wei)(wei)建立了委(wei)(wei)領導(dao)班(ban)子聯系點制(zhi)度,每人分(fen)別聯系2-3個地市(shi)國(guo)資(zi)(zi)(zi)委(wei)(wei),定期開展(zhan)調(diao)研(yan)指(zhi)(zhi)導(dao)。四川、黑龍江等(deng)省國(guo)資(zi)(zi)(zi)委(wei)(wei)分(fen)片區開展(zhan)專題調(diao)研(yan),實地協調(diao)解決市(shi)縣國(guo)資(zi)(zi)(zi)監(jian)(jian)管機(ji)構(gou)的(de)(de)困(kun)難和(he)問題。通(tong)過開展(zhan)廣泛(fan)深入的(de)(de)調(diao)查(cha)研(yan)究(jiu),進(jin)一步增強(qiang)了指(zhi)(zhi)導(dao)監(jian)(jian)督工作(zuo)的(de)(de)針對性(xing)和(he)有效性(xing)。
注重發揮(hui)先(xian)進(jin)典(dian)型(xing)(xing)示范引路作(zuo)(zuo)用。河南(nan)、云(yun)南(nan)、青島(dao)等(deng)省(sheng)市對(dui)下級國(guo)資監管工作(zuo)(zuo)進(jin)行評優表(biao)彰,樹立先(xian)進(jin)典(dian)型(xing)(xing)。山東省(sheng)國(guo)資委(wei)總(zong)結(jie)推廣(guang)濟寧、聊城、棗莊等(deng)地市國(guo)資委(wei)在(zai)加強職能建設、強化考核(he)培訓等(deng)方面的(de)經(jing)驗(yan)和做法。寧夏自治區(qu)(qu)國(guo)資委(wei)指導(dao)推動全區(qu)(qu)國(guo)有(you)企(qi)(qi)業開展(zhan)與全國(guo)先(xian)進(jin)企(qi)(qi)業、全區(qu)(qu)先(xian)進(jin)企(qi)(qi)業、本行業先(xian)進(jin)企(qi)(qi)業的(de)“三對(dui)標”活動。各地通過總(zong)結(jie)推廣(guang)特色(se)做法和先(xian)進(jin)經(jing)驗(yan),以點帶面,使指導(dao)監督工作(zuo)(zuo)的(de)引領示范效應得到較好(hao)體現。
不斷強化和豐富指導(dao)監(jian)(jian)督工(gong)作(zuo)內涵。國(guo)(guo)(guo)(guo)(guo)(guo)務院國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)先(xian)后組織召開(kai)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)系統(tong)財務監(jian)(jian)督、產(chan)權(quan)管理、業(ye)(ye)績(ji)考(kao)核(he)、收益分配、改革改制、董事會與監(jian)(jian)事會工(gong)作(zuo)、紀檢(jian)監(jian)(jian)察等(deng)專題會議和培訓班,對各地(di)(di)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)管工(gong)作(zuo)進(jin)行專項指導(dao)。深(shen)圳、上(shang)海、河北(bei)(bei)、大連等(deng)部分省(sheng)市(shi)(shi)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)在本地(di)(di)區積極探索推進(jin)經濟增(zeng)加(jia)值考(kao)核(he),引(yin)導(dao)國(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企業(ye)(ye)增(zeng)強價值創(chuang)造能力(li),提高發展質量(liang)和效益。云南、江蘇(su)等(deng)省(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)組織對地(di)(di)市(shi)(shi)國(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企業(ye)(ye)生產(chan)經營狀況(kuang)進(jin)行綜合分析(xi),全面掌握地(di)(di)市(shi)(shi)國(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)經濟的運行情況(kuang)。廣東省(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)指導(dao)地(di)(di)市(shi)(shi)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)建(jian)立健(jian)全國(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)企業(ye)(ye)財務快報制度。江蘇(su)、湖北(bei)(bei)等(deng)省(sheng)國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)統(tong)一全省(sheng)企業(ye)(ye)國(guo)(guo)(guo)(guo)(guo)(guo)有(you)(you)產(chan)權(quan)交易信息(xi)發布,實行產(chan)權(quan)交易網上(shang)動態監(jian)(jian)測。加(jia)強對國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)(jian)管各項專題工(gong)作(zuo)的指導(dao)推動,已經成為國(guo)(guo)(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)系統(tong)加(jia)強聯系、共同提高的重要紐帶。
(三)突出工作(zuo)重(zhong)點,指導監督效果初步顯(xian)現。
指(zhi)導(dao)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管(guan)(guan)體制(zhi)和(he)(he)制(zhi)度建(jian)設邁出(chu)(chu)新步(bu)伐。各地(di)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)以保(bao)持(chi)機(ji)(ji)構(gou)(gou)(gou)的(de)(de)(de)(de)獨立性(xing)(xing)(xing)、專業性(xing)(xing)(xing)和(he)(he)落實出(chu)(chu)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)人三項主要職(zhi)責(ze)(ze)為重(zhong)點,通(tong)過(guo)立法(fa)和(he)(he)政(zheng)(zheng)策引導(dao)等多(duo)種(zhong)途(tu)徑,深入推進本地(di)區國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管(guan)(guan)體制(zhi)和(he)(he)制(zhi)度的(de)(de)(de)(de)完(wan)(wan)善(shan)(shan)。湖北省(sheng)(sheng)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)主要領(ling)導(dao)親自掛帥,主動地(di)向省(sheng)(sheng)委(wei)(wei)、省(sheng)(sheng)政(zheng)(zheng)府(fu)(fu)(fu)匯(hui)報,積極加強與(yu)省(sheng)(sheng)政(zheng)(zheng)府(fu)(fu)(fu)各部門(men)和(he)(he)省(sheng)(sheng)人大(da)法(fa)律委(wei)(wei)的(de)(de)(de)(de)協(xie)調配合,組織起草(cao)并推動出(chu)(chu)臺了《湖北省(sheng)(sheng)企業國(guo)有資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)產監督(du)管(guan)(guan)理條例(li)》,首次(ci)以地(di)方性(xing)(xing)(xing)法(fa)規的(de)(de)(de)(de)形式,明確了全省(sheng)(sheng)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)的(de)(de)(de)(de)直屬特設機(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質(zhi)和(he)(he)全覆蓋監管(guan)(guan)職(zhi)責(ze)(ze),健全完(wan)(wan)善(shan)(shan)了地(di)方國(guo)有資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)本經營預算制(zhi)度。山東、貴州等省(sheng)(sheng)市(shi)(shi)(shi)也先后出(chu)(chu)臺了指(zhi)導(dao)本地(di)區國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管(guan)(guan)體制(zhi)完(wan)(wan)善(shan)(shan)的(de)(de)(de)(de)專門(men)文件(jian),對國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)職(zhi)責(ze)(ze)定(ding)(ding)位、監管(guan)(guan)范圍(wei)以及市(shi)(shi)(shi)縣(xian)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)監管(guan)(guan)責(ze)(ze)任主體等做(zuo)出(chu)(chu)了明確規定(ding)(ding)。福(fu)建(jian)省(sheng)(sheng)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)針對部分地(di)市(shi)(shi)(shi)擬撤并國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)的(de)(de)(de)(de)動向,及時(shi)與(yu)各地(di)市(shi)(shi)(shi)黨委(wei)(wei)、政(zheng)(zheng)府(fu)(fu)(fu)溝(gou)通(tong),并將情況上報省(sheng)(sheng)政(zheng)(zheng)府(fu)(fu)(fu)取(qu)得支持(chi),保(bao)持(chi)了地(di)市(shi)(shi)(shi)級國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)機(ji)(ji)構(gou)(gou)(gou)的(de)(de)(de)(de)穩定(ding)(ding)。重(zhong)慶、陜西等省(sheng)(sheng)市(shi)(shi)(shi)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)主要領(ling)導(dao)與(yu)地(di)市(shi)(shi)(shi)政(zheng)(zheng)府(fu)(fu)(fu)主要負責(ze)(ze)同(tong)志深入協(xie)商溝(gou)通(tong),推動地(di)市(shi)(shi)(shi)級國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei)的(de)(de)(de)(de)單獨設立和(he)(he)職(zhi)責(ze)(ze)到位。最近,深圳市(shi)(shi)(shi)委(wei)(wei)和(he)(he)市(shi)(shi)(shi)政(zheng)(zheng)府(fu)(fu)(fu)對市(shi)(shi)(shi)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)局的(de)(de)(de)(de)機(ji)(ji)構(gou)(gou)(gou)名稱和(he)(he)機(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質(zhi)專門(men)作了研究(jiu),正式決定(ding)(ding)將市(shi)(shi)(shi)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)局更(geng)名為市(shi)(shi)(shi)國(guo)資(zi)(zi)(zi)(zi)(zi)(zi)(zi)(zi)委(wei)(wei),機(ji)(ji)構(gou)(gou)(gou)性(xing)(xing)(xing)質(zhi)由(you)市(shi)(shi)(shi)政(zheng)(zheng)府(fu)(fu)(fu)工作部門(men)變更(geng)為市(shi)(shi)(shi)政(zheng)(zheng)府(fu)(fu)(fu)直屬特設機(ji)(ji)構(gou)(gou)(gou)。
推(tui)進經營性國(guo)(guo)有(you)(you)資產集中統(tong)一(yi)監管(guan)(guan)取得新進展。各(ge)地按照(zhao)“政(zheng)企(qi)分開、政(zheng)資分開”原(yuan)則(ze),積極(ji)拓(tuo)展國(guo)(guo)資委(wei)系統(tong)的監管(guan)(guan)范圍。目(mu)前,全國(guo)(guo)有(you)(you)14個(ge)(ge)省級(ji)國(guo)(guo)資委(wei)監管(guan)(guan)覆(fu)蓋面達到(dao)80%以(yi)上(shang),北(bei)京、天津、上(shang)海、重(zhong)慶(qing)四個(ge)(ge)直(zhi)轄市(shi)實現(xian)了(le)(le)經營性國(guo)(guo)有(you)(you)資產的全覆(fu)蓋監管(guan)(guan)。湖北(bei)省國(guo)(guo)資委(wei)對糧油、水電(dian)、文化等領域的脫鉤(gou)改制企(qi)業實現(xian)了(le)(le)“統(tong)一(yi)納(na)入(ru)、委(wei)托監管(guan)(guan)”。云南(nan)選(xuan)擇昆明、曲靖、文山、大(da)理等四個(ge)(ge)州市(shi)進行(xing)了(le)(le)國(guo)(guo)有(you)(you)資產監管(guan)(guan)全覆(fu)蓋試點。此外(wai),全國(guo)(guo)有(you)(you)28個(ge)(ge)省級(ji)國(guo)(guo)資委(wei)和70個(ge)(ge)地市(shi)級(ji)國(guo)(guo)資委(wei)監管(guan)(guan)范圍還涵(han)蓋了(le)(le)金融(rong)類國(guo)(guo)有(you)(you)資產。
推動落(luo)實(shi)縣(xian)(xian)(xian)級國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產監(jian)管(guan)(guan)責(ze)任取得新(xin)成效(xiao)。國(guo)(guo)務院國(guo)(guo)資(zi)(zi)(zi)(zi)委召開(kai)義烏現場會后,浙江、廣(guang)(guang)東等省(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)委相繼在(zai)全省(sheng)范圍內(nei)大(da)(da)力總(zong)結(jie)推廣(guang)(guang)義烏、順德經驗,進一(yi)步加強(qiang)縣(xian)(xian)(xian)級國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構建設(she),健全縣(xian)(xian)(xian)級國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產監(jian)管(guan)(guan)體(ti)制。湖北省(sheng)國(guo)(guo)資(zi)(zi)(zi)(zi)委總(zong)結(jie)推廣(guang)(guang)“大(da)(da)國(guo)(guo)資(zi)(zi)(zi)(zi)、大(da)(da)監(jian)管(guan)(guan)、大(da)(da)資(zi)(zi)(zi)(zi)源、大(da)(da)配(pei)置”的(de)(de)(de)“宜(yi)都模式(shi)”,大(da)(da)冶市對經營性(xing)國(guo)(guo)有(you)資(zi)(zi)(zi)(zi)產和行(xing)政(zheng)事業性(xing)資(zi)(zi)(zi)(zi)產實(shi)行(xing)產權、預(yu)算、資(zi)(zi)(zi)(zi)產處置、資(zi)(zi)(zi)(zi)源配(pei)置“四統一(yi)”的(de)(de)(de)監(jian)管(guan)(guan)模式(shi)。寧波市國(guo)(guo)資(zi)(zi)(zi)(zi)委推動明確了區(qu)(qu)縣(xian)(xian)(xian)國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)責(ze)任主體(ti)。據(ju)對吉林、安徽、廣(guang)(guang)西等8省(sheng)市所轄883個縣(xian)(xian)(xian)區(qu)(qu)的(de)(de)(de)統計(ji),單獨設(she)立(li)國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構的(de)(de)(de)有(you)167個,占總(zong)數的(de)(de)(de)19%。廣(guang)(guang)東、江西、四川的(de)(de)(de)縣(xian)(xian)(xian)(區(qu)(qu))單獨設(she)立(li)國(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)(guan)機(ji)構的(de)(de)(de)比例分(fen)別達到36%、30%和28%。
指導(dao)地(di)(di)(di)(di)方(fang)國(guo)(guo)(guo)有經(jing)濟(ji)(ji)發揮引(yin)領(ling)帶動作(zuo)用呈現新(xin)格局。各級國(guo)(guo)(guo)資(zi)委(wei)積極指導(dao)推進(jin)(jin)跨(kua)區(qu)域(yu)、跨(kua)層(ceng)級國(guo)(guo)(guo)有企(qi)業(ye)(ye)之間(jian)的(de)調(diao)整重(zhong)組(zu),引(yin)導(dao)地(di)(di)(di)(di)方(fang)國(guo)(guo)(guo)有資(zi)本(ben)(ben)更多地(di)(di)(di)(di)投向(xiang)(xiang)支柱行業(ye)(ye)和(he)特色產業(ye)(ye)。國(guo)(guo)(guo)務院國(guo)(guo)(guo)資(zi)委(wei)推動中(zhong)(zhong)央企(qi)業(ye)(ye)與(yu)許(xu)多省(sheng)市(shi)開展(zhan)了央地(di)(di)(di)(di)合(he)作(zuo)。福建(jian)(jian)(jian)(jian)省(sheng)國(guo)(guo)(guo)資(zi)委(wei)牽頭搭建(jian)(jian)(jian)(jian)本(ben)(ben)地(di)(di)(di)(di)區(qu)對接央企(qi)的(de)合(he)作(zuo)平(ping)臺。不少地(di)(di)(di)(di)方(fang)把(ba)國(guo)(guo)(guo)有經(jing)濟(ji)(ji)作(zuo)為推進(jin)(jin)城(cheng)市(shi)化(hua)建(jian)(jian)(jian)(jian)設的(de)重(zhong)要平(ping)臺。四(si)個直轄(xia)市(shi)的(de)企(qi)業(ye)(ye)國(guo)(guo)(guo)有資(zi)產逐步向(xiang)(xiang)支柱產業(ye)(ye)和(he)關系民生的(de)公共基礎設施領(ling)域(yu)集中(zhong)(zhong)。山西省(sheng)國(guo)(guo)(guo)資(zi)委(wei)以(yi)煤炭(tan)資(zi)源整合(he)為推手,加(jia)快推進(jin)(jin)省(sheng)、市(shi)國(guo)(guo)(guo)有企(qi)業(ye)(ye)的(de)結構(gou)調(diao)整和(he)產業(ye)(ye)升級。海南(nan)省(sheng)國(guo)(guo)(guo)資(zi)委(wei)大力推動省(sheng)屬國(guo)(guo)(guo)有企(qi)業(ye)(ye)與(yu)市(shi)縣合(he)作(zuo),共同組(zu)建(jian)(jian)(jian)(jian)參與(yu)新(xin)城(cheng)區(qu)和(he)港區(qu)開發的(de)投資(zi)主體。青(qing)海省(sheng)國(guo)(guo)(guo)資(zi)委(wei)以(yi)循環經(jing)濟(ji)(ji)試驗區(qu)和(he)高新(xin)技術產業(ye)(ye)為依托,積極搭建(jian)(jian)(jian)(jian)省(sheng)內(nei)國(guo)(guo)(guo)有企(qi)業(ye)(ye)合(he)作(zuo)發展(zhan)平(ping)臺。各地(di)(di)(di)(di)通過指導(dao)推動優(you)勢資(zi)源集中(zhong)(zhong),使國(guo)(guo)(guo)有經(jing)濟(ji)(ji)在地(di)(di)(di)(di)方(fang)經(jing)濟(ji)(ji)社會發展(zhan)中(zhong)(zhong)的(de)引(yin)領(ling)帶動作(zuo)用得到進(jin)(jin)一(yi)步發揮。
總體上看,近一年(nian)來,各地(di)國(guo)資委認(ren)真貫徹落實杭(hang)州會議精神,通過建立(li)健全(quan)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)工(gong)作(zuo)(zuo)機制和(he)制度,不斷創新指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)方(fang)式和(he)方(fang)法,抓住重(zhong)點,突破難點,國(guo)資委系(xi)統(tong)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)工(gong)作(zuo)(zuo)開始(shi)從(cong)起步(bu)開局向(xiang)縱深推(tui)進轉(zhuan)變,從(cong)分頭摸索向(xiang)集中借鑒轉(zhuan)變,從(cong)提出一般要(yao)求向(xiang)深化體系(xi)建設轉(zhuan)變,為推(tui)進完善地(di)方(fang)國(guo)資監(jian)管(guan)體制、促進地(di)方(fang)國(guo)有企業科學(xue)發(fa)展(zhan)發(fa)揮了積極作(zuo)(zuo)用。在肯定成績的(de)(de)同(tong)時,我們也要(yao)清醒地(di)看到,目前(qian)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)工(gong)作(zuo)(zuo)尚處(chu)于剛剛起步(bu)、逐步(bu)發(fa)展(zhan)的(de)(de)階段,仍然存在不少問(wen)題,主要(yao)是:對指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)工(gong)作(zuo)(zuo)的(de)(de)認(ren)識參(can)差不齊,各地(di)工(gong)作(zuo)(zuo)進展(zhan)不平(ping)衡;指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)工(gong)作(zuo)(zuo)體系(xi)還不夠完善,特別是對縣級國(guo)資監(jian)管(guan)工(gong)作(zuo)(zuo)的(de)(de)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)仍較薄弱;指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)監(jian)督(du)(du)(du)的(de)(de)一些(xie)重(zhong)點難點還需要(yao)積極探(tan)索、尋求突破。對存在的(de)(de)這些(xie)問(wen)題,我們要(yao)在下一步(bu)工(gong)作(zuo)(zuo)中采取(qu)切實措施,努(nu)力(li)加以解決。
二、“十(shi)二五”時期(qi)指導監督地方國資工(gong)作的總(zong)體思路和主要任務(wu)
“十二五”時(shi)(shi)期(qi)(qi),是(shi)深(shen)入推進國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)管(guan)體(ti)(ti)(ti)制完善的關鍵時(shi)(shi)期(qi)(qi),也是(shi)深(shen)化國(guo)(guo)(guo)有(you)企(qi)業(ye)(ye)(ye)改(gai)(gai)革發(fa)展的重(zhong)(zhong)要時(shi)(shi)期(qi)(qi)。按(an)照以科學發(fa)展為主題(ti)、以加(jia)快轉變經濟發(fa)展方式(shi)(shi)為主線的要求,“十二五”時(shi)(shi)期(qi)(qi)將(jiang)更加(jia)重(zhong)(zhong)視改(gai)(gai)革的頂層(ceng)設計(ji)和(he)總體(ti)(ti)(ti)規劃,在繼(ji)續完善經營性國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)管(guan)體(ti)(ti)(ti)制的同時(shi)(shi),還將(jiang)完善國(guo)(guo)(guo)有(you)金融(rong)資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)、行政(zheng)事業(ye)(ye)(ye)單(dan)位資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)和(he)自(zi)然資(zi)(zi)(zi)(zi)(zi)源資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)管(guan)體(ti)(ti)(ti)制,推動重(zhong)(zhong)點領域(yu)和(he)關鍵環(huan)節的改(gai)(gai)革取得突(tu)破性進展。從國(guo)(guo)(guo)際看,隨(sui)著(zhu)經濟全球化進程不斷深(shen)入,國(guo)(guo)(guo)有(you)企(qi)業(ye)(ye)(ye)“走出(chu)去”步(bu)伐進一步(bu)加(jia)快,美國(guo)(guo)(guo)、歐盟等發(fa)達國(guo)(guo)(guo)家和(he)地(di)區對(dui)我國(guo)(guo)(guo)國(guo)(guo)(guo)有(you)企(qi)業(ye)(ye)(ye)的管(guan)理體(ti)(ti)(ti)制和(he)治理模式(shi)(shi)將(jiang)越(yue)來(lai)越(yue)關注。國(guo)(guo)(guo)內(nei)外形勢(shi)的發(fa)展變化,既為完善國(guo)(guo)(guo)有(you)資(zi)(zi)(zi)(zi)(zi)產(chan)(chan)監(jian)管(guan)體(ti)(ti)(ti)制、加(jia)快國(guo)(guo)(guo)有(you)企(qi)業(ye)(ye)(ye)改(gai)(gai)革帶來(lai)新的機遇與挑戰,也對(dui)“十二五”時(shi)(shi)期(qi)(qi)深(shen)入開展指導監(jian)督地(di)方國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)(zi)工作提出(chu)了新任(ren)務和(he)新要求。
“十二五(wu)”時期指(zhi)(zhi)導監(jian)(jian)(jian)(jian)督(du)地方國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)工(gong)作的總體(ti)思(si)路是:以鄧小平理(li)(li)論和(he)“三個代(dai)表”重要思(si)想(xiang)為(wei)(wei)指(zhi)(zhi)導,深入貫徹落(luo)實科學發展(zhan)觀,緊緊圍繞(rao) “兩新目標”,牢固樹立國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)系(xi)統(tong)一盤棋理(li)(li)念,立足“指(zhi)(zhi)導、溝通(tong)、交流、服務”,以加強(qiang)地方國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)機構(gou)建(jian)設、推進經營性國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)集中統(tong)一監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)、促進國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)工(gong)作不斷深化(hua)、強(qiang)化(hua)企業國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)基(ji)礎管(guan)(guan)(guan)理(li)(li)為(wei)(wei)重點,進一步完善(shan)指(zhi)(zhi)導監(jian)(jian)(jian)(jian)督(du)工(gong)作機制和(he)制度(du),推動構(gou)建(jian)國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)工(gong)作大格局,努力(li)提升地方國(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委依法履行出(chu)資(zi)(zi)(zi)(zi)人職責、加強(qiang)國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)的能力(li)和(he)水平,為(wei)(wei)完善(shan)企業國(guo)(guo)(guo)有資(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)(jian)(jian)管(guan)(guan)(guan)體(ti)制、促進國(guo)(guo)(guo)有企業改革發展(zhan)作出(chu)新貢獻。
根據上述(shu)總體思路,“十(shi)二五”時(shi)期指導監督地方(fang)國資工作要全(quan)面落實(shi)以下四項主要任(ren)務(wu):
(一(yi))指導加強(qiang)地方國(guo)有資產監管機(ji)構建設。
加強國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)機構(gou)建設,是(shi)(shi)完(wan)善國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)體制(zhi)的(de)(de)組織基礎。黨的(de)(de)十(shi)六大以來,中央和省(sheng)、地市三級政(zheng)府(fu)(fu)(fu)組建國(guo)(guo)(guo)(guo)資(zi)(zi)委,作為(wei)政(zheng)府(fu)(fu)(fu)直(zhi)屬特(te)設機構(gou),在(zai)機構(gou)設置(zhi)上實(shi)現了政(zheng)府(fu)(fu)(fu)的(de)(de)社(she)會公共管(guan)(guan)(guan)理部門與(yu)政(zheng)府(fu)(fu)(fu)的(de)(de)國(guo)(guo)(guo)(guo)有(you)(you)資(zi)(zi)產(chan)(chan)監管(guan)(guan)(guan)機構(gou)完(wan)全分(fen)開。政(zheng)府(fu)(fu)(fu)對國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)的(de)(de)管(guan)(guan)(guan)理,由(you)過去(qu)以行(xing)政(zheng)方式(shi)管(guan)(guan)(guan)理改(gai)為(wei)以出(chu)資(zi)(zi)方式(shi)管(guan)(guan)(guan)理,由(you)過去(qu)各部門多頭管(guan)(guan)(guan)理改(gai)為(wei)由(you)國(guo)(guo)(guo)(guo)資(zi)(zi)委統(tong)一履(lv)行(xing)出(chu)資(zi)(zi)人職責。這一新(xin)體制(zhi)具有(you)(you)鮮明的(de)(de)中國(guo)(guo)(guo)(guo)特(te)色(se),既是(shi)(shi)我國(guo)(guo)(guo)(guo)不斷(duan)探索(suo)規(gui)范政(zheng)府(fu)(fu)(fu)與(yu)國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)之(zhi)間關系的(de)(de)重要制(zhi)度(du)創新(xin),也是(shi)(shi)不斷(duan)深化國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)改(gai)革(ge)的(de)(de)經驗結晶。8年多來的(de)(de)實(shi)踐表明,這一新(xin)體制(zhi)有(you)(you)利于(yu)保障國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)真正成為(wei)獨(du)立的(de)(de)市場主體和法人實(shi)體,有(you)(you)利于(yu)國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)平等參與(yu)國(guo)(guo)(guo)(guo)內外(wai)兩個市場競(jing)爭,因而更好地適應了深化國(guo)(guo)(guo)(guo)有(you)(you)企業(ye)改(gai)革(ge)的(de)(de)客(ke)觀需要,更好地適應了發展社(she)會主義市場經濟的(de)(de)客(ke)觀需要。
目前,省(sheng)級國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)機(ji)構(gou)及其(qi)職(zhi)責(ze)(ze)(ze)定位(wei)比(bi)較(jiao)穩(wen)固(gu),但不(bu)少地市(shi)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)由(you)直屬特設(she)機(ji)構(gou)改為了政(zheng)府部門或者與其(qi)他(ta)部門合署辦公(gong),機(ji)構(gou)不(bu)獨立(li)(li)、行政(zheng)化趨勢比(bi)較(jiao)明顯。據統(tong)計(ji),全國(guo)(guo)356個(ge)(ge)地市(shi)中,盡管(guan)有(you)331個(ge)(ge)設(she)立(li)(li)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei),占93%,但作(zuo)為獨立(li)(li)機(ji)構(gou)的(de)只(zhi)有(you)227個(ge)(ge),占設(she)立(li)(li)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)的(de)68.6%;保留直屬特設(she)機(ji)構(gou)性質的(de)只(zhi)有(you)107個(ge)(ge),占設(she)立(li)(li)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)的(de)32.3%。從(cong)職(zhi)責(ze)(ze)(ze)上(shang)看,一些(xie)地方國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)出資(zi)(zi)人(ren)三項主要職(zhi)責(ze)(ze)(ze)不(bu)統(tong)一、不(bu)到位(wei)現象仍然比(bi)較(jiao)突出,面(mian)上(shang)監管(guan)職(zhi)責(ze)(ze)(ze)尤為薄弱。個(ge)(ge)別地市(shi)國(guo)(guo)資(zi)(zi)委(wei)(wei)(wei)的(de)主要工(gong)作(zuo)集中在企業(ye)改制、處理(li)信訪和(he)維護(hu)穩(wen)定上(shang),企業(ye)國(guo)(guo)有(you)資(zi)(zi)產監管(guan)職(zhi)責(ze)(ze)(ze)沒有(you)得到落(luo)實。
針對上(shang)述情(qing)況(kuang),“十二五”時(shi)期要(yao)(yao)(yao)把(ba)(ba)指(zhi)導推(tui)(tui)進國(guo)有(you)資(zi)產監(jian)(jian)管(guan)機(ji)(ji)構(gou)(gou)建設(she)擺在(zai)(zai)首要(yao)(yao)(yao)位置(zhi),核心是(shi)堅(jian)持(chi)(chi)國(guo)資(zi)委直屬特(te)(te)設(she)機(ji)(ji)構(gou)(gou)性質(zhi)。具體來(lai)說(shuo),要(yao)(yao)(yao)把(ba)(ba)握(wo)好(hao)以下三點:一(yi)要(yao)(yao)(yao)準確(que)把(ba)(ba)握(wo)特(te)(te)設(she)機(ji)(ji)構(gou)(gou)的(de)實質(zhi)要(yao)(yao)(yao)求。注意區別于政府公(gong)共管(guan)理部門和機(ji)(ji)構(gou)(gou),堅(jian)持(chi)(chi)國(guo)資(zi)委在(zai)(zai)政府層面依法履(lv)行出(chu)資(zi)人(ren)職(zhi)責(ze)(ze)、專司國(guo)有(you)資(zi)產監(jian)(jian)管(guan)、不(bu)(bu)承擔公(gong)共管(guan)理職(zhi)能(neng)的(de)特(te)(te)殊定(ding)位。二要(yao)(yao)(yao)準確(que)把(ba)(ba)握(wo)特(te)(te)設(she)機(ji)(ji)構(gou)(gou)的(de)職(zhi)責(ze)(ze)邊界。對出(chu)資(zi)人(ren)職(zhi)責(ze)(ze)范圍內的(de)工(gong)作,盡職(zhi)盡責(ze)(ze)不(bu)(bu)缺位;對指(zhi)導和推(tui)(tui)動監(jian)(jian)管(guan)企業的(de)工(gong)作,有(you)據有(you)度(du)不(bu)(bu)越位;對協助政府其他部門的(de)工(gong)作,做好(hao)配(pei)合不(bu)(bu)錯位。三要(yao)(yao)(yao)準確(que)把(ba)(ba)握(wo)特(te)(te)設(she)機(ji)(ji)構(gou)(gou)的(de)職(zhi)能(neng)配(pei)置(zhi)。堅(jian)持(chi)(chi)將出(chu)資(zi)人(ren)職(zhi)責(ze)(ze)和面上(shang)監(jian)(jian)管(guan)職(zhi)責(ze)(ze)有(you)機(ji)(ji)結(jie)合起來(lai),在(zai)(zai)依法履(lv)行出(chu)資(zi)人(ren)職(zhi)責(ze)(ze)的(de)同(tong)時(shi),認真履(lv)行好(hao)面上(shang)監(jian)(jian)管(guan)職(zhi)責(ze)(ze)。
(二(er))指導推動經營(ying)性國有資產的(de)集中統一監(jian)管。
今年初,張德江(jiang)副總理在(zai)全國(guo)(guo)國(guo)(guo)有(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)(jian)督管(guan)(guan)(guan)(guan)理工(gong)作(zuo)會議上提(ti)出,要(yao)(yao)“拓寬監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)范圍,逐步(bu)做到全過程、全方(fang)位監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),不(bu)留(liu)死角,不(bu)留(liu)遺漏,不(bu)出現(xian)重大失責”。國(guo)(guo)務院領(ling)導的(de)(de)(de)明確要(yao)(yao)求,為深入推(tui)動(dong)經(jing)(jing)營性(xing)國(guo)(guo)有(you)資(zi)(zi)產集(ji)中(zhong)統一(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)指明了方(fang)向。當前(qian),不(bu)少省(sheng)級國(guo)(guo)資(zi)(zi)委(wei)在(zai)省(sheng)委(wei)、省(sheng)政府(fu)的(de)(de)(de)重視(shi)、支持下,逐步(bu)推(tui)進(jin)地(di)方(fang)經(jing)(jing)營性(xing)國(guo)(guo)有(you)資(zi)(zi)產的(de)(de)(de)集(ji)中(zhong)統一(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)范圍不(bu)斷拓展。但有(you)的(de)(de)(de)地(di)方(fang)經(jing)(jing)營性(xing)國(guo)(guo)有(you)資(zi)(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)還較為分散,當地(di)國(guo)(guo)資(zi)(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)比例比較低(di),目前(qian)仍有(you)4個省(sheng)級國(guo)(guo)資(zi)(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)覆蓋面低(di)于50%。有(you)的(de)(de)(de)地(di)方(fang)將(jiang)(jiang)新設立(li)的(de)(de)(de)國(guo)(guo)有(you)企(qi)業(ye)(ye)交由(you)公共(gong)管(guan)(guan)(guan)(guan)理部門(men)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),還有(you)的(de)(de)(de)地(di)方(fang)甚至將(jiang)(jiang)國(guo)(guo)資(zi)(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)企(qi)業(ye)(ye)重新劃回(hui)原行業(ye)(ye)主(zhu)管(guan)(guan)(guan)(guan)部門(men)。因此,必須把推(tui)動(dong)地(di)方(fang)經(jing)(jing)營性(xing)國(guo)(guo)有(you)資(zi)(zi)產的(de)(de)(de)集(ji)中(zhong)統一(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),作(zuo)為指導監(jian)(jian)(jian)(jian)(jian)督工(gong)作(zuo)的(de)(de)(de)重要(yao)(yao)任務。
“十二五(wu)”時(shi)期,推動(dong)地(di)方(fang)(fang)(fang)經營(ying)性國(guo)(guo)有資(zi)(zi)(zi)產的(de)集中(zhong)(zhong)統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),應當著(zhu)力(li)抓好以下三(san)點:一(yi)(yi)要積極拓展(zhan)國(guo)(guo)資(zi)(zi)(zi)委(wei)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)范(fan)圍。各地(di)國(guo)(guo)資(zi)(zi)(zi)委(wei)要主動(dong)匯報,爭(zheng)取(qu)(qu)地(di)方(fang)(fang)(fang)黨委(wei)、政府支持(chi)。要以統(tong)一(yi)(yi)履行出資(zi)(zi)(zi)人(ren)職責為目標,采(cai)取(qu)(qu)多種方(fang)(fang)(fang)式,循序漸進,盡可(ke)(ke)能將地(di)方(fang)(fang)(fang)國(guo)(guo)有企(qi)業(ye)(ye)(ye)(ye)納入新的(de)國(guo)(guo)資(zi)(zi)(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)體制。完(wan)全納入暫時(shi)還有困難的(de),可(ke)(ke)以采(cai)取(qu)(qu)由國(guo)(guo)資(zi)(zi)(zi)委(wei)委(wei)托監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)、行業(ye)(ye)(ye)(ye)部門具(ju)體監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)等(deng)方(fang)(fang)(fang)式。二要注意發揮好統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)體制優勢(shi)。嚴(yan)格(ge)按照出資(zi)(zi)(zi)關系,切(qie)實加(jia)強出資(zi)(zi)(zi)人(ren)專業(ye)(ye)(ye)(ye)化(hua)、系統(tong)化(hua)、規范(fan)化(hua)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),提高國(guo)(guo)有資(zi)(zi)(zi)產監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)效率,使出資(zi)(zi)(zi)人(ren)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)的(de)體制優勢(shi)得到充分體現(xian)。三(san)要集中(zhong)(zhong)資(zi)(zi)(zi)源(yuan)打造優勢(shi)企(qi)業(ye)(ye)(ye)(ye)。通(tong)過推動(dong)集中(zhong)(zhong)統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),加(jia)快在更大范(fan)圍、更高層(ceng)次上的(de)企(qi)業(ye)(ye)(ye)(ye)重組和資(zi)(zi)(zi)源(yuan)整合,著(zhu)力(li)培育(yu)一(yi)(yi)批地(di)方(fang)(fang)(fang)優勢(shi)企(qi)業(ye)(ye)(ye)(ye),具(ju)備條件的(de)還要力(li)爭(zheng)培育(yu)成為國(guo)(guo)內領先企(qi)業(ye)(ye)(ye)(ye)或世界一(yi)(yi)流企(qi)業(ye)(ye)(ye)(ye)。總之(zhi),要通(tong)過指導推動(dong),爭(zheng)取(qu)(qu)在新的(de)體制框架下實現(xian)集中(zhong)(zhong)統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),在優化(hua)資(zi)(zi)(zi)源(yuan)配置的(de)前提下實現(xian)集中(zhong)(zhong)統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan),在打造優勢(shi)企(qi)業(ye)(ye)(ye)(ye)的(de)過程中(zhong)(zhong)實現(xian)集中(zhong)(zhong)統(tong)一(yi)(yi)監(jian)(jian)(jian)(jian)(jian)管(guan)(guan)(guan)(guan)。
(三)指導促進地方(fang)國有資產監管工作不斷(duan)深(shen)化。
目(mu)前,各地國(guo)(guo)有(you)(you)資產監管(guan)工(gong)作基本進(jin)入規范化(hua)(hua)軌道(dao)。但隨著國(guo)(guo)有(you)(you)企業改革發展的(de)不(bu)斷加(jia)快(kuai),國(guo)(guo)資監管(guan)工(gong)作還不(bu)能完(wan)全適應當前形(xing)勢發展變化(hua)(hua)的(de)需要,監管(guan)不(bu)到位、監管(guan)資源分散、監管(guan)效率不(bu)高的(de)問題(ti)還不(bu)同程度地存(cun)在(zai),國(guo)(guo)資委內部業務流程和(he)組織(zhi)結構也有(you)(you)待優化(hua)(hua)完(wan)善(shan)。特(te)別(bie)是在(zai)股權(quan)多元(yuan)化(hua)(hua)條件下,國(guo)(guo)有(you)(you)資產出資人(ren)代表如何(he)在(zai)企業層層落實到位,如何(he)加(jia)強境(jing)外國(guo)(guo)有(you)(you)資產和(he)重要子企業監管(guan)等,都需要進(jin)一步探索和(he)規范。
“十二(er)五”時(shi)期要通過加(jia)強指(zhi)(zhi)導(dao)監(jian)(jian)督,大力推進(jin)國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)的(de)(de)(de)(de)不斷深化。一要著(zhu)力拓寬(kuan)監(jian)(jian)管(guan)(guan)(guan)(guan)思路,提高(gao)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)的(de)(de)(de)(de)前瞻性。注意指(zhi)(zhi)導(dao)下級(ji)國(guo)資(zi)(zi)(zi)委妥善應對日趨復雜的(de)(de)(de)(de)宏觀經濟環(huan)境(jing),準確把握國(guo)有資(zi)(zi)(zi)產監(jian)(jian)管(guan)(guan)(guan)(guan)和國(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)改革(ge)發展中(zhong)的(de)(de)(de)(de)方向性、趨勢性問(wen)題。二(er)要著(zhu)力突出(chu)監(jian)(jian)管(guan)(guan)(guan)(guan)重點,提高(gao)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)的(de)(de)(de)(de)針對性。根據監(jian)(jian)管(guan)(guan)(guan)(guan)企(qi)(qi)業(ye)(ye)(ye)(ye)不同的(de)(de)(de)(de)股權(quan)結構和組(zu)織形式(shi),積極(ji)探索分類監(jian)(jian)管(guan)(guan)(guan)(guan)。切實加(jia)強混合(he)所有制(zhi)(zhi)下國(guo)有產權(quan)的(de)(de)(de)(de)管(guan)(guan)(guan)(guan)理(li),繼續完善有利于(yu)推動企(qi)(qi)業(ye)(ye)(ye)(ye)自主創(chuang)新(xin)、提高(gao)發展質量的(de)(de)(de)(de)考核指(zhi)(zhi)標體系(xi)。適(shi)應國(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)“走出(chu)去”要求(qiu),進(jin)一步加(jia)強對境(jing)外(wai)國(guo)有資(zi)(zi)(zi)產監(jian)(jian)管(guan)(guan)(guan)(guan)。針對國(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)大部(bu)(bu)分資(zi)(zi)(zi)產集(ji)中(zhong)在二(er)、三級(ji)企(qi)(qi)業(ye)(ye)(ye)(ye)的(de)(de)(de)(de)情況,完善對重要子企(qi)(qi)業(ye)(ye)(ye)(ye)監(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)制(zhi)(zhi)度機(ji)制(zhi)(zhi)。三要著(zhu)力整合(he)監(jian)(jian)管(guan)(guan)(guan)(guan)資(zi)(zi)(zi)源,提高(gao)監(jian)(jian)管(guan)(guan)(guan)(guan)工作(zuo)的(de)(de)(de)(de)有效性。適(shi)時(shi)調整優化國(guo)資(zi)(zi)(zi)委內部(bu)(bu)機(ji)構設置和職能配置,加(jia)強投資(zi)(zi)(zi)規劃、產權(quan)管(guan)(guan)(guan)(guan)理(li)、財(cai)務監(jian)(jian)督、業(ye)(ye)(ye)(ye)績考核、薪酬分配、干部(bu)(bu)任免、外(wai)派監(jian)(jian)事會、紀(ji)檢監(jian)(jian)察(cha)等(deng)各個環(huan)節的(de)(de)(de)(de)銜(xian)接(jie)協調,形成國(guo)資(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)(de)閉(bi)環(huan)鏈條(tiao)。探索國(guo)有企(qi)(qi)業(ye)(ye)(ye)(ye)財(cai)務信息(xi)公開制(zhi)(zhi)度,注重利用現代(dai)信息(xi)技術實施監(jian)(jian)管(guan)(guan)(guan)(guan),不斷創(chuang)新(xin)監(jian)(jian)管(guan)(guan)(guan)(guan)方式(shi),不斷提高(gao)監(jian)(jian)管(guan)(guan)(guan)(guan)效率。
這里,我還(huan)要(yao)(yao)特別強調國資(zi)(zi)委系統融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司風(feng)(feng)險防(fang)范(fan)問題。這是當(dang)前和今后一(yi)個時(shi)期(qi),指導監(jian)督工作(zuo)應當(dang)給(gei)予(yu)高度關注的(de)問題。融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司大多以國有(you)土(tu)地(di)(di)使用權、國有(you)企業股權等(deng)作(zuo)為(wei)融(rong)資(zi)(zi)擔保(bao),貸款期(qi)限長,潛(qian)在(zai)(zai)風(feng)(feng)險大。要(yao)(yao)注意指導地(di)(di)方(fang)融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司按(an)照企業規律運營,既要(yao)(yao)服務于當(dang)地(di)(di)經(jing)濟(ji)社會發(fa)展大局,為(wei)地(di)(di)方(fang)基(ji)礎設(she)施建設(she)提供資(zi)(zi)金(jin)支持;又要(yao)(yao)量入(ru)為(wei)出,合(he)理確定(ding)融(rong)資(zi)(zi)規模(mo),不能以犧牲國有(you)資(zi)(zi)產(chan)安(an)全解決(jue)暫時(shi)的(de)資(zi)(zi)金(jin)需求,不能給(gei)國有(you)經(jing)濟(ji)發(fa)展帶來長期(qi)隱(yin)患。各(ge)地(di)(di)國資(zi)(zi)委要(yao)(yao)對所監(jian)管(guan)的(de)融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司依法履行好出資(zi)(zi)人職責,嚴格(ge)按(an)照法定(ding)程序參與重大事(shi)項(xiang)決(jue)策(ce),重視(shi)指導融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司完善治理結構(gou),提高科(ke)學決(jue)策(ce)水(shui)平(ping)。要(yao)(yao)抓緊摸清所監(jian)管(guan)的(de)融(rong)資(zi)(zi)平(ping)臺(tai)公(gong)司資(zi)(zi)產(chan)負債(zhai)、擔保(bao)等(deng)基(ji)本情況,全面評估(gu)潛(qian)在(zai)(zai)風(feng)(feng)險,認真(zhen)研究制定(ding)切(qie)實可行的(de)風(feng)(feng)險防(fang)范(fan)預案。
(四)指(zhi)導健全企業國有資(zi)產基礎管理(li)工作體系。
健全(quan)企業國(guo)有資產(chan)基(ji)(ji)礎管(guan)(guan)理(li)工(gong)(gong)(gong)作體系(xi)(xi),既(ji)是開(kai)展指導監督(du)工(gong)(gong)(gong)作的(de)重(zhong)要抓手,也是上(shang)下級(ji)國(guo)資委之間(jian)加強(qiang)(qiang)聯系(xi)(xi)的(de)重(zhong)要紐帶。認(ren)真做好這項工(gong)(gong)(gong)作,有利(li)于(yu)全(quan)面掌握(wo)國(guo)有資產(chan)整體狀況,有利(li)于(yu)全(quan)程監管(guan)(guan)國(guo)有資產(chan)流轉環(huan)節(jie),有利(li)于(yu)適時實現國(guo)有資產(chan)運營(ying)質(zhi)量(liang)監測。目前(qian),國(guo)資委系(xi)(xi)統基(ji)(ji)礎管(guan)(guan)理(li)工(gong)(gong)(gong)作體系(xi)(xi)初步(bu)形成,管(guan)(guan)理(li)規則(ze)逐(zhu)步(bu)健全(quan)。但有關制(zhi)度位階較低,系(xi)(xi)統內外(wai)規則(ze)不統一,部門職(zhi)能交(jiao)叉、多頭管(guan)(guan)理(li)、責任(ren)不清的(de)現象仍然存在,縣級(ji)企業國(guo)有資產(chan)基(ji)(ji)礎管(guan)(guan)理(li)缺位還比較嚴重(zhong)。同時,隨著這幾年(nian)國(guo)有資產(chan)管(guan)(guan)理(li)體制(zhi)改(gai)革和(he)國(guo)有企業改(gai)革重(zhong)組的(de)不斷(duan)深(shen)入(ru),國(guo)有經濟在我國(guo)經濟社會發展中的(de)主體地位和(he)主導作用(yong)進一步(bu)突(tu)出(chu),有關基(ji)(ji)礎數據對國(guo)家宏觀(guan)經濟決策的(de)參(can)考(kao)價值日益凸顯,因而對我們加強(qiang)(qiang)企業國(guo)有資產(chan)基(ji)(ji)礎管(guan)(guan)理(li)提出(chu)了更為重(zhong)要和(he)緊迫的(de)要求。
“十二五(wu)”時(shi)期(qi),指導健(jian)全(quan)(quan)企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)工(gong)作(zuo)體系,應當著力抓好以下(xia)三點:一要(yao)(yao)加快基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)制(zhi)(zhi)(zhi)(zhi)度(du)建(jian)設。2010年、2011年,國(guo)(guo)(guo)(guo)務院兩次將(jiang)《企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)條例》列為“條件成(cheng)熟時(shi)出臺”的立法項目。各(ge)地國(guo)(guo)(guo)(guo)資(zi)委(wei)一方面要(yao)(yao)積(ji)極配合起草好這(zhe)個條例,另一方面,要(yao)(yao)重(zhong)視加強地方國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)制(zhi)(zhi)(zhi)(zhi)度(du)建(jian)設,積(ji)極創造(zao)條件,爭(zheng)取實(shi)(shi)現本地區基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)規則(ze)和制(zhi)(zhi)(zhi)(zhi)度(du)的統一。二要(yao)(yao)完善(shan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)工(gong)作(zuo)機(ji)制(zhi)(zhi)(zhi)(zhi)。要(yao)(yao)加強與有(you)關部門的溝通協調(diao),明(ming)確部門分工(gong),依法落實(shi)(shi)省、地市兩級國(guo)(guo)(guo)(guo)資(zi)委(wei)企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)職責,盡(jin)快明(ming)確縣級企業(ye)國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)主體,建(jian)立全(quan)(quan)面覆蓋、層(ceng)級完整的基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)工(gong)作(zuo)機(ji)制(zhi)(zhi)(zhi)(zhi)。三要(yao)(yao)利用好基(ji)(ji)礎(chu)(chu)管(guan)(guan)(guan)理(li)(li)(li)(li)數據成(cheng)果(guo)。比如,通過全(quan)(quan)面掌握(wo)總量與分布情況(kuang),為國(guo)(guo)(guo)(guo)有(you)經濟(ji)布局(ju)結構調(diao)整提供依據;通過及時(shi)跟蹤國(guo)(guo)(guo)(guo)有(you)產(chan)(chan)(chan)權(quan)變(bian)動(dong)情況(kuang),有(you)效維護國(guo)(guo)(guo)(guo)有(you)資(zi)產(chan)(chan)(chan)安全(quan)(quan);通過分析國(guo)(guo)(guo)(guo)有(you)經濟(ji)運行動(dong)態(tai),為政(zheng)府實(shi)(shi)施宏(hong)觀經濟(ji)管(guan)(guan)(guan)理(li)(li)(li)(li)和國(guo)(guo)(guo)(guo)資(zi)委(wei)實(shi)(shi)施有(you)效監(jian)管(guan)(guan)(guan)提供決(jue)策參考。
以上四項主要任(ren)務,是針對(dui)國(guo)資委系統指(zhi)導監督(du)工作(zuo)需要重點(dian)突破的(de)共(gong)性問題提出(chu)來(lai)的(de)。各地情況不同(tong),在開展指(zhi)導監督(du)工作(zuo)時,還可(ke)以明確其他一些重點(dian)工作(zuo)任(ren)務。要分析本地區的(de)突出(chu)矛盾和問題,分清輕重緩急,在指(zhi)導監督(du)工作(zuo)中始終堅持抓重點(dian),破難點(dian),出(chu)亮(liang)點(dian),做精(jing)品。
三、深入做好指導監(jian)督地(di)方國資工作(zuo)的幾點要求
今年是(shi)指(zhi)導(dao)監督地(di)方國資工作(zuo)深(shen)入推(tui)進的一(yi)年。按照“十二五”時期指(zhi)導(dao)監督工作(zuo)總體思路和(he)主(zhu)要(yao)(yao)任務,各地(di)國資委(wei)要(yao)(yao)著力在(zai)“提(ti)高認(ren)識、完善(shan)制度、突(tu)出重點、提(ti)升能(neng)力”上下功夫,扎扎實實地(di)做好各項工作(zuo)。
(一)要(yao)始終(zhong)把(ba)指(zhi)導(dao)監督工(gong)作擺(bai)上重要(yao)議(yi)事(shi)日程(cheng)。
上級國(guo)資委(wei)(wei)(wei)依(yi)法對(dui)下級政府國(guo)有(you)資產(chan)監(jian)(jian)(jian)管(guan)工(gong)(gong)(gong)(gong)作(zuo)(zuo)進行(xing)指(zhi)(zhi)(zhi)(zhi)導(dao)和(he)(he)監(jian)(jian)(jian)督(du)(du)(du)(du),是法律賦予各(ge)(ge)(ge)級國(guo)資委(wei)(wei)(wei)的(de)(de)(de)一項(xiang)重要(yao)職責。各(ge)(ge)(ge)地國(guo)資委(wei)(wei)(wei)要(yao)從加快完善地方(fang)國(guo)有(you)資產(chan)監(jian)(jian)(jian)管(guan)體制和(he)(he)制度(du)、提升國(guo)有(you)資產(chan)監(jian)(jian)(jian)管(guan)工(gong)(gong)(gong)(gong)作(zuo)(zuo)能力(li)和(he)(he)水平的(de)(de)(de)高度(du),深(shen)(shen)(shen)刻認識和(he)(he)把握加強(qiang)指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)重要(yao)性和(he)(he)緊迫性。要(yao)牢(lao)固樹立國(guo)資系統一盤棋的(de)(de)(de)理念(nian),加快形成(cheng)國(guo)資監(jian)(jian)(jian)管(guan)的(de)(de)(de)“大(da)合力(li)”。要(yao)切實糾正指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)可(ke)有(you)可(ke)無的(de)(de)(de)模糊(hu)認識,克服各(ge)(ge)(ge)種畏難情緒,切實把指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)有(you)效(xiao)開(kai)展起來。各(ge)(ge)(ge)地國(guo)資委(wei)(wei)(wei)主要(yao)負責同志(zhi),要(yao)親(qin)(qin)自統籌謀劃,層(ceng)層(ceng)落實指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)責任(ren);親(qin)(qin)自過問協(xie)調(diao),及(ji)時(shi)解決指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)涉及(ji)的(de)(de)(de)重大(da)問題;親(qin)(qin)自溝通協(xie)商,切實加強(qiang)對(dui)下級政府國(guo)有(you)資產(chan)監(jian)(jian)(jian)管(guan)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)指(zhi)(zhi)(zhi)(zhi)導(dao)服務。分管(guan)指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)負責同志(zhi),更要(yao)盡職盡責,深(shen)(shen)(shen)入分析(xi)把握本(ben)地區(qu)指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)重點、難點,認真(zhen)組織、協(xie)調(diao)和(he)(he)落實指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)各(ge)(ge)(ge)項(xiang)工(gong)(gong)(gong)(gong)作(zuo)(zuo)要(yao)求,努力(li)將指(zhi)(zhi)(zhi)(zhi)導(dao)監(jian)(jian)(jian)督(du)(du)(du)(du)工(gong)(gong)(gong)(gong)作(zuo)(zuo)引向深(shen)(shen)(shen)入。
(二)要繼續(xu)健全(quan)指(zhi)導監督工作機制和制度。
健全完善(shan)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)機(ji)(ji)(ji)(ji)制和(he)(he)(he)制度(du)(du),是做(zuo)好(hao)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)重要(yao)(yao)(yao)基(ji)礎。各地國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)要(yao)(yao)(yao)依(yi)(yi)據《指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)辦法(fa)》的(de)(de)(de)規(gui)定(ding),結合本地實(shi)際,進(jin)一步加(jia)強指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)機(ji)(ji)(ji)(ji)制和(he)(he)(he)制度(du)(du)建設。要(yao)(yao)(yao)加(jia)快形(xing)成委(wei)(wei)內(nei)各專業(ye)機(ji)(ji)(ji)(ji)構(gou)之間、上(shang)下級國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)之間指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)“兩個合力”。在明確委(wei)(wei)內(nei)分(fen)管(guan)領導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)和(he)(he)(he)工(gong)(gong)(gong)作(zuo)(zuo)機(ji)(ji)(ji)(ji)構(gou)的(de)(de)(de)基(ji)礎上(shang),既(ji)要(yao)(yao)(yao)發揮工(gong)(gong)(gong)作(zuo)(zuo)機(ji)(ji)(ji)(ji)構(gou)的(de)(de)(de)信息溝通、交流(liu)服務(wu)和(he)(he)(he)綜合協(xie)調作(zuo)(zuo)用(yong),又要(yao)(yao)(yao)調動委(wei)(wei)內(nei)專業(ye)機(ji)(ji)(ji)(ji)構(gou)開展指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)積極性。要(yao)(yao)(yao)按照指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)總體部署,通過會議(yi)、簡(jian)報、調研交流(liu)和(he)(he)(he)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)檢查等多(duo)種(zhong)形(xing)式(shi),加(jia)快健全國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)系統(tong)上(shang)下聯動、運轉有力的(de)(de)(de)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)機(ji)(ji)(ji)(ji)制。要(yao)(yao)(yao)及時(shi)總結推廣指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)中(zhong)的(de)(de)(de)特色做(zuo)法(fa)和(he)(he)(he)先進(jin)經(jing)驗,及時(shi)反饋工(gong)(gong)(gong)作(zuo)(zuo)中(zhong)遇(yu)到的(de)(de)(de)難點(dian)(dian)和(he)(he)(he)問題。要(yao)(yao)(yao)認真落(luo)實(shi)《指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)監(jian)(jian)(jian)(jian)(jian)督(du)(du)辦法(fa)》確立的(de)(de)(de)立法(fa)備案、法(fa)規(gui)政策實(shi)施(shi)督(du)(du)查和(he)(he)(he)重大事(shi)項報告(gao)等“三(san)項制度(du)(du)”。堅持寓指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)于服務(wu)之中(zhong),發揮好(hao)指(zhi)(zhi)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)引(yin)導(dao)(dao)(dao)(dao)(dao)(dao)(dao)(dao)、規(gui)范、提高(gao)和(he)(he)(he)促進(jin)作(zuo)(zuo)用(yong),同時(shi)防止越權干預下級國(guo)(guo)(guo)(guo)資(zi)委(wei)(wei)依(yi)(yi)法(fa)行(xing)權履(lv)責。堅持監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)“少而精(jing)”的(de)(de)(de)原則(ze),注意(yi)把監(jian)(jian)(jian)(jian)(jian)督(du)(du)工(gong)(gong)(gong)作(zuo)(zuo)的(de)(de)(de)著(zhu)力點(dian)(dian)放在確保國(guo)(guo)(guo)(guo)資(zi)監(jian)(jian)(jian)(jian)(jian)管(guan)法(fa)律(lv)法(fa)規(gui)和(he)(he)(he)國(guo)(guo)(guo)(guo)家政策的(de)(de)(de)貫徹實(shi)施(shi)上(shang),放在國(guo)(guo)(guo)(guo)企改制、產權轉讓等可能出現(xian)違法(fa)違規(gui)行(xing)為(wei)的(de)(de)(de)重點(dian)(dian)環節上(shang),放在防范國(guo)(guo)(guo)(guo)有資(zi)產重大損失和(he)(he)(he)重大不良社會影響的(de)(de)(de)潛(qian)在風(feng)險上(shang)。
(三(san))要(yao)進一步突出指導監督工作重點(dian)。
各地(di)(di)國(guo)資(zi)委(wei)要根據(ju)“十二五(wu)”時(shi)期(qi)指(zhi)導監(jian)督(du)工作總體部署(shu),注(zhu)意(yi)從本地(di)(di)區實(shi)際情況和(he)工作需要出發,明確(que)工作重(zhong)點(dian),抓好重(zhong)點(dian)突破。要立足(zu)于進一(yi)步發揮國(guo)有(you)經(jing)濟(ji)在地(di)(di)方(fang)經(jing)濟(ji)發展中的(de)(de)引領(ling)帶動(dong)作用,積極參與當地(di)(di)企(qi)(qi)業(ye)脫(tuo)鉤改(gai)制(zhi)和(he)調整(zheng)重(zhong)組工作,加快推進地(di)(di)方(fang)經(jing)營性(xing)國(guo)有(you)資(zi)產(chan)(chan)的(de)(de)集(ji)中統一(yi)監(jian)管。要立足(zu)于國(guo)有(you)資(zi)產(chan)(chan)監(jian)管體制(zhi)改(gai)革的(de)(de)正確(que)方(fang)向,堅持政(zheng)企(qi)(qi)分(fen)開、政(zheng)資(zi)分(fen)開、所(suo)有(you)權與經(jing)營權相分(fen)離,確(que)保國(guo)資(zi)委(wei)直(zhi)屬特設(she)機(ji)構定位,切實(shi)扭轉(zhuan)部分(fen)地(di)(di)市(shi)級(ji)國(guo)資(zi)委(wei)回歸行政(zheng)化的(de)(de)趨(qu)勢。要立足(zu)于新的(de)(de)國(guo)有(you)資(zi)產(chan)(chan)監(jian)管體制(zhi)的(de)(de)特點(dian)和(he)優勢,繼續探(tan)索(suo)加強(qiang)縣級(ji)經(jing)營性(xing)國(guo)有(you)資(zi)產(chan)(chan)監(jian)管工作,鼓(gu)勵(li)國(guo)有(you)企(qi)(qi)業(ye)數量較(jiao)多(duo)、企(qi)(qi)業(ye)國(guo)有(you)資(zi)產(chan)(chan)規(gui)模較(jiao)大的(de)(de)縣單獨設(she)立國(guo)資(zi)委(wei),指(zhi)導暫不具備條件的(de)(de)縣抓緊明確(que)國(guo)有(you)資(zi)產(chan)(chan)監(jian)管責任主體。
(四)要不斷提升指(zhi)導監督工作(zuo)能力(li)和(he)水平。
指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作涉(she)及(ji)國(guo)資(zi)監(jian)(jian)管和(he)(he)國(guo)企改革發展的(de)方(fang)方(fang)面面,政策(ce)(ce)要求(qiu)高,探索性很(hen)強,推(tui)進(jin)難度大,必須不斷(duan)提(ti)(ti)升指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作的(de)能力(li)和(he)(he)水平。要深入學(xue)習(xi)領會黨的(de)十六大、十七大關于國(guo)有資(zi)產監(jian)(jian)管體制改革和(he)(he)完(wan)善的(de)一系(xi)列方(fang)針政策(ce)(ce),不斷(duan)探索解決指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作涉(she)及(ji)的(de)方(fang)向性、全局性、戰略性問題。要適應指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作面臨的(de)新形勢新任務(wu),進(jin)一步加強指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作隊(dui)伍建(jian)設。堅持“學(xue)用結合”,經(jing)常組織國(guo)資(zi)委系(xi)統(tong)深入交流(liu)學(xue)習(xi),及(ji)時研討重點問題,加快提(ti)(ti)高指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作隊(dui)伍的(de)政治(zhi)業(ye)務(wu)素(su)質和(he)(he)綜合工(gong)作能力(li),努力(li)培養一支懂政策(ce)(ce)法(fa)規(gui)、精國(guo)資(zi)監(jian)(jian)管、善協調服務(wu)的(de)指(zhi)(zhi)導(dao)(dao)監(jian)(jian)督(du)工(gong)作隊(dui)伍。
根據委(wei)里(li)會議計劃,今年不再專門召(zhao)開國資(zi)委(wei)系統(tong)政策法規工作會議,借(jie)此機會,我想重點強調兩(liang)個問題(ti)。
(一(yi))關于依(yi)法(fa)(fa)行權履(lv)責(ze)、進一(yi)步加強法(fa)(fa)治機(ji)構建設。
近幾年來(lai),國(guo)務(wu)院(yuan)高度重視(shi)法(fa)(fa)治政(zheng)(zheng)府(fu)建設(she)(she),專門印發了(le)《國(guo)務(wu)院(yuan)全(quan)面(mian)推(tui)進依法(fa)(fa)行政(zheng)(zheng)實(shi)施綱(gang)要(yao)(yao)》和《國(guo)務(wu)院(yuan)關于(yu)加強法(fa)(fa)治政(zheng)(zheng)府(fu)建設(she)(she)的意見》,并且召開(kai)了(le)全(quan)國(guo)依法(fa)(fa)行政(zheng)(zheng)工作會議,明確要(yao)(yao)求(qiu)各級政(zheng)(zheng)府(fu)部(bu)門從立(li)法(fa)(fa)、決策、執(zhi)行、監督(du)等方面(mian),采取切實(shi)措施,全(quan)面(mian)推(tui)進依法(fa)(fa)行政(zheng)(zheng)工作。國(guo)資委雖然不是政(zheng)(zheng)府(fu)行政(zheng)(zheng)部(bu)門,但作為直(zhi)屬特設(she)(she)機構在依法(fa)(fa)行權履責過程中(zhong),同樣必(bi)須貫(guan)徹落實(shi)好這些部(bu)署和要(yao)(yao)求(qiu)。
國(guo)(guo)務(wu)院(yuan)國(guo)(guo)資(zi)(zi)(zi)委(wei)去年12月印(yin)發(fa)了(le)《關(guan)于(yu)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)行(xing)權履(lv)責進一步加強法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治機構(gou)建設的(de)實(shi)(shi)施意見》,明確提(ti)(ti)出加強國(guo)(guo)資(zi)(zi)(zi)委(wei)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)治機構(gou)建設的(de)總體要求(qiu)和(he)具體任務(wu)。希望各(ge)地國(guo)(guo)資(zi)(zi)(zi)委(wei)高(gao)度重視這項(xiang)工作(zuo)。一要繼續(xu)做好國(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)立(li)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工作(zuo)。國(guo)(guo)務(wu)院(yuan)國(guo)(guo)資(zi)(zi)(zi)委(wei)于(yu)近日制定(ding)(ding)出臺了(le)《中(zhong)央(yang)企(qi)(qi)業境外國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產監(jian)督管(guan)(guan)理(li)(li)(li)暫(zan)行(xing)辦(ban)(ban)(ban)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)》和(he)《中(zhong)央(yang)企(qi)(qi)業境外國(guo)(guo)有(you)(you)產權管(guan)(guan)理(li)(li)(li)暫(zan)行(xing)辦(ban)(ban)(ban)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)》,目前正(zheng)在抓(zhua)緊起(qi)草《企(qi)(qi)業國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產基礎管(guan)(guan)理(li)(li)(li)條例》,同時(shi)配合(he)(he)(he)財政部(bu)起(qi)草《國(guo)(guo)有(you)(you)資(zi)(zi)(zi)本經營(ying)預(yu)算(suan)條例》。各(ge)地國(guo)(guo)資(zi)(zi)(zi)委(wei)也要結合(he)(he)(he)本地區(qu)國(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)工作(zuo)實(shi)(shi)際和(he)突出問題(ti),切(qie)實(shi)(shi)加強相關(guan)制度建設,努力(li)實(shi)(shi)現國(guo)(guo)資(zi)(zi)(zi)委(wei)履(lv)行(xing)職責的(de)各(ge)項(xiang)行(xing)為都有(you)(you)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)可依(yi)。二要堅持國(guo)(guo)資(zi)(zi)(zi)委(wei)系統(tong)依(yi)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)科學民(min)主(zhu)決(jue)策(ce)。加強對重大(da)決(jue)策(ce)事(shi)(shi)項(xiang)的(de)合(he)(he)(he)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)性(xing)審查(cha),未經合(he)(he)(he)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)性(xing)審查(cha)或(huo)者經審查(cha)不(bu)合(he)(he)(he)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)的(de),不(bu)能提(ti)(ti)交委(wei)主(zhu)任辦(ban)(ban)(ban)公會議討論(lun)決(jue)定(ding)(ding)。三(san)要牢(lao)固樹(shu)立(li)程(cheng)(cheng)序意識。在履(lv)行(xing)出資(zi)(zi)(zi)人職責過(guo)程(cheng)(cheng)中(zhong),自覺按程(cheng)(cheng)序辦(ban)(ban)(ban)事(shi)(shi),嚴格遵守公司(si)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)、企(qi)(qi)業國(guo)(guo)有(you)(you)資(zi)(zi)(zi)產法(fa)(fa)(fa)(fa)(fa)(fa)(fa)和(he)公司(si)章程(cheng)(cheng)有(you)(you)關(guan)公司(si)治理(li)(li)(li)結構(gou)和(he)議事(shi)(shi)規(gui)則的(de)各(ge)項(xiang)規(gui)定(ding)(ding),認真執行(xing)國(guo)(guo)資(zi)(zi)(zi)委(wei)工作(zuo)規(gui)程(cheng)(cheng)。四要深入開展“六五(wu)(wu)(wu)”普(pu)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)工作(zuo)。根據全(quan)國(guo)(guo)普(pu)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)辦(ban)(ban)(ban)“六五(wu)(wu)(wu)”普(pu)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)規(gui)劃(hua)和(he)即(ji)將(jiang)印(yin)發(fa)的(de)《國(guo)(guo)務(wu)院(yuan)國(guo)(guo)資(zi)(zi)(zi)委(wei)關(guan)于(yu)在國(guo)(guo)資(zi)(zi)(zi)委(wei)系統(tong)開展法(fa)(fa)(fa)(fa)(fa)(fa)(fa)制宣(xuan)傳教育的(de)第(di)六個五(wu)(wu)(wu)年規(gui)劃(hua)》,進一步提(ti)(ti)高(gao)國(guo)(guo)資(zi)(zi)(zi)委(wei)系統(tong)廣大(da)干部(bu)職工特別是領導干部(bu)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)意識,大(da)力(li)推(tui)進機關(guan)合(he)(he)(he)規(gui)文化建設,自覺防范(fan)好各(ge)級國(guo)(guo)資(zi)(zi)(zi)委(wei)行(xing)權履(lv)責中(zhong)的(de)法(fa)(fa)(fa)(fa)(fa)(fa)(fa)律(lv)風險。
(二)關于加(jia)快(kuai)落實地方國有重點企業法(fa)制(zhi)工作(zuo)三(san)年目(mu)標。
按(an)照地方國(guo)有(you)重(zhong)點企(qi)業法(fa)(fa)(fa)制(zhi)工作第二個(ge)三年(nian)目(mu)標(biao)要(yao)求,在今年(nian)年(nian)底前,省屬(shu)國(guo)有(you)重(zhong)點企(qi)業要(yao)全部設(she)立法(fa)(fa)(fa)律事務機(ji)構(gou),70%以上的(de)企(qi)業要(yao)建立總(zong)法(fa)(fa)(fa)律顧問(wen)(wen)制(zhi)度。據初步統計,截(jie)止到今年(nian)5月底,928戶(hu)(hu)省屬(shu)國(guo)有(you)重(zhong)點企(qi)業中(zhong),有(you)782戶(hu)(hu)建立了法(fa)(fa)(fa)律事務機(ji)構(gou),占84%;419戶(hu)(hu)建立了總(zong)法(fa)(fa)(fa)律顧問(wen)(wen)制(zhi)度,占45%。總(zong)體上看(kan),這(zhe)一(yi)進展與(yu)目(mu)標(biao)要(yao)求相比還(huan)有(you)不小差距,特別是有(you)6個(ge)省國(guo)資(zi)委所監管企(qi)業,至今未(wei)有(you)一(yi)戶(hu)(hu)設(she)立總(zong)法(fa)(fa)(fa)律顧問(wen)(wen),應當引起我們(men)的(de)高(gao)度重(zhong)視。
目(mu)前(qian),距離(li)三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)結(jie)束(shu)僅剩半年(nian)(nian)(nian)(nian)時(shi)間,各地(di)國資(zi)委(wei)要(yao)進(jin)(jin)(jin)一(yi)步增強緊(jin)(jin)迫感,采取有(you)力措施(shi)盡快完成任(ren)務。一(yi)要(yao)切實(shi)(shi)(shi)落實(shi)(shi)(shi)工作責任(ren),加大推(tui)(tui)進(jin)(jin)(jin)力度(du)。尤其是進(jin)(jin)(jin)展較慢的(de)(de)(de)(de)(de)(de)省市,國資(zi)委(wei)領導(dao)(dao)(dao)要(yao)親(qin)自抓(zhua),法規處(chu)室(shi)要(yao)切實(shi)(shi)(shi)履(lv)行(xing)職責,要(yao)會同干部管理處(chu)室(shi)在摸清具體情況和原因(yin)的(de)(de)(de)(de)(de)(de)基礎(chu)上,抓(zhua)緊(jin)(jin)進(jin)(jin)(jin)行(xing)專(zhuan)題研(yan)究,制(zhi)定符合實(shi)(shi)(shi)際的(de)(de)(de)(de)(de)(de)整改推(tui)(tui)進(jin)(jin)(jin)計(ji)劃。二(er)要(yao)及時(shi)開(kai)展專(zhuan)項督(du)導(dao)(dao)(dao),有(you)效解(jie)決(jue)推(tui)(tui)進(jin)(jin)(jin)三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)的(de)(de)(de)(de)(de)(de)短板。要(yao)針對所監(jian)管企(qi)(qi)業(ye)落實(shi)(shi)(shi)三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)的(de)(de)(de)(de)(de)(de)薄弱(ruo)環節,擬定督(du)導(dao)(dao)(dao)名單,由(you)國資(zi)委(wei)領導(dao)(dao)(dao)帶隊,通(tong)過(guo)與企(qi)(qi)業(ye)領導(dao)(dao)(dao)當(dang)面交換意(yi)(yi)見(jian)、幫助總結(jie)分析典型(xing)案(an)例等形式,對重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)逐戶(hu)開(kai)展專(zhuan)項督(du)導(dao)(dao)(dao)。三(san)要(yao)注意(yi)(yi)抓(zhua)好總法律(lv)顧問的(de)(de)(de)(de)(de)(de)上崗到(dao)位,突出推(tui)(tui)進(jin)(jin)(jin)三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)實(shi)(shi)(shi)現(xian)(xian)的(de)(de)(de)(de)(de)(de)重(zhong)(zhong)點(dian)環節。對于暫時(shi)沒有(you)合適(shi)專(zhuan)職人(ren)選的(de)(de)(de)(de)(de)(de)企(qi)(qi)業(ye),可以由(you)企(qi)(qi)業(ye)領導(dao)(dao)(dao)班子成員兼任(ren),也(ye)可以面向社會公開(kai)招聘。各地(di)還可以借鑒江西、河南、湖北(bei)等地(di)國資(zi)委(wei)的(de)(de)(de)(de)(de)(de)做(zuo)法,向監(jian)管企(qi)(qi)業(ye)直接委(wei)派總法律(lv)顧問。四(si)要(yao)認真組織(zhi)檢查(cha)(cha)驗(yan)(yan)收(shou),確(que)保三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)的(de)(de)(de)(de)(de)(de)實(shi)(shi)(shi)現(xian)(xian)不走過(guo)場。各地(di)要(yao)按照目(mu)標(biao)(biao)要(yao)求的(de)(de)(de)(de)(de)(de)基本內容,借鑒國務院國資(zi)委(wei)檢查(cha)(cha)驗(yan)(yan)收(shou)中央企(qi)(qi)業(ye)的(de)(de)(de)(de)(de)(de)做(zuo)法,具體細化檢查(cha)(cha)驗(yan)(yan)收(shou)標(biao)(biao)準,在今年(nian)(nian)(nian)(nian)年(nian)(nian)(nian)(nian)底前(qian)后,通(tong)過(guo)自查(cha)(cha)、互(hu)查(cha)(cha)、抽查(cha)(cha)相(xiang)結(jie)合的(de)(de)(de)(de)(de)(de)方式,全面檢查(cha)(cha)本地(di)區國有(you)重(zhong)(zhong)點(dian)企(qi)(qi)業(ye)三(san)年(nian)(nian)(nian)(nian)目(mu)標(biao)(biao)的(de)(de)(de)(de)(de)(de)完成情況,注意(yi)(yi)總結(jie)先進(jin)(jin)(jin)典型(xing),著力解(jie)決(jue)突出困難和問題,檢查(cha)(cha)結(jie)果要(yao)以適(shi)當(dang)形式進(jin)(jin)(jin)行(xing)通(tong)報(bao)。
