貫徹(che)落實中共中央、國務院(yuan)印(yin)發(fa)的《法(fa)治政府建設實施綱要(2015-2020年)》(以下簡稱《綱要》)要求,國資(zi)委2016年法(fa)治建設取得(de)積極進展。
一(yi)、切實加強組織領導(dao)
國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)高度(du)(du)(du)(du)重(zhong)(zhong)(zhong)視(shi)機(ji)關(guan)和(he)(he)中(zhong)(zhong)央(yang)企(qi)業(ye)法(fa)(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she),深(shen)(shen)入推(tui)(tui)(tui)進(jin)(jin)(jin)依(yi)法(fa)(fa)(fa)監(jian)管(guan)、依(yi)法(fa)(fa)(fa)治(zhi)(zhi)企(qi),認(ren)真落(luo)實(shi)(shi)《黨(dang)(dang)政(zheng)主(zhu)要(yao)(yao)負(fu)(fu)責人(ren)履(lv)行推(tui)(tui)(tui)進(jin)(jin)(jin)法(fa)(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)第(di)一(yi)責任人(ren)職責規(gui)(gui)(gui)定(ding)(ding)(ding)》(以下簡稱《規(gui)(gui)(gui)定(ding)(ding)(ding)》),自覺運(yun)用(yong)法(fa)(fa)(fa)治(zhi)(zhi)思(si)維(wei)和(he)(he)法(fa)(fa)(fa)治(zhi)(zhi)方式(shi)深(shen)(shen)化(hua)(hua)改(gai)革、推(tui)(tui)(tui)動(dong)發展、化(hua)(hua)解(jie)矛(mao)盾、維(wei)護穩定(ding)(ding)(ding)。一(yi)是(shi)深(shen)(shen)入學(xue)習(xi)貫徹習(xi)近(jin)平總(zong)書(shu)記系(xi)列(lie)重(zhong)(zhong)(zhong)要(yao)(yao)講(jiang)(jiang)話(hua)精神。黨(dang)(dang)的(de)(de)十(shi)八屆四(si)中(zhong)(zhong)全(quan)會(hui)(hui)(hui)(hui)作(zuo)(zuo)出了全(quan)面推(tui)(tui)(tui)進(jin)(jin)(jin)依(yi)法(fa)(fa)(fa)治(zhi)(zhi)國(guo)(guo)(guo)(guo)的(de)(de)重(zhong)(zhong)(zhong)大(da)戰略部(bu)署。習(xi)近(jin)平總(zong)書(shu)記圍繞推(tui)(tui)(tui)進(jin)(jin)(jin)全(quan)面依(yi)法(fa)(fa)(fa)治(zhi)(zhi)國(guo)(guo)(guo)(guo)提出了一(yi)系(xi)列(lie)新(xin)理念新(xin)思(si)想(xiang)新(xin)戰略,為全(quan)面推(tui)(tui)(tui)進(jin)(jin)(jin)各項工(gong)作(zuo)(zuo)提出了重(zhong)(zhong)(zhong)要(yao)(yao)遵循。國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)黨(dang)(dang)委(wei)(wei)(wei)(wei)堅持(chi)把學(xue)習(xi)總(zong)書(shu)記系(xi)列(lie)重(zhong)(zhong)(zhong)要(yao)(yao)講(jiang)(jiang)話(hua)精神擺(bai)在(zai)重(zhong)(zhong)(zhong)要(yao)(yao)位置,牢固樹立“四(si)個意(yi)識”,通過(guo)黨(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)(hui)(hui)、中(zhong)(zhong)心組學(xue)習(xi)、專(zhuan)題(ti)學(xue)習(xi)研討等方式(shi),集(ji)體學(xue)習(xi)總(zong)書(shu)記系(xi)列(lie)重(zhong)(zhong)(zhong)要(yao)(yao)講(jiang)(jiang)話(hua)精神,特別是(shi)專(zhuan)題(ti)學(xue)習(xi)了習(xi)近(jin)平總(zong)書(shu)記在(zai)中(zhong)(zhong)共中(zhong)(zhong)央(yang)政(zheng)治(zhi)(zhi)局第(di)三十(shi)七次集(ji)體學(xue)習(xi)時的(de)(de)重(zhong)(zhong)(zhong)要(yao)(yao)講(jiang)(jiang)話(hua),深(shen)(shen)刻領(ling)會(hui)(hui)(hui)(hui)堅持(chi)依(yi)法(fa)(fa)(fa)治(zhi)(zhi)國(guo)(guo)(guo)(guo)和(he)(he)以德(de)治(zhi)(zhi)國(guo)(guo)(guo)(guo)相結合(he)(he)的(de)(de)重(zhong)(zhong)(zhong)要(yao)(yao)思(si)想(xiang)。二(er)是(shi)加(jia)強中(zhong)(zhong)央(yang)文(wen)件(jian)和(he)(he)黨(dang)(dang)內法(fa)(fa)(fa)規(gui)(gui)(gui)的(de)(de)學(xue)習(xi)。國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)黨(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)(hui)(hui)傳達(da)學(xue)習(xi)了全(quan)國(guo)(guo)(guo)(guo)黨(dang)(dang)內法(fa)(fa)(fa)規(gui)(gui)(gui)工(gong)作(zuo)(zuo)會(hui)(hui)(hui)(hui)議(yi)精神,并(bing)第(di)一(yi)時間(jian)向中(zhong)(zhong)央(yang)企(qi)業(ye)傳達(da),要(yao)(yao)求(qiu)(qiu)將(jiang)思(si)想(xiang)建(jian)(jian)黨(dang)(dang)和(he)(he)制(zhi)(zhi)度(du)(du)(du)(du)治(zhi)(zhi)黨(dang)(dang)相結合(he)(he)、依(yi)規(gui)(gui)(gui)治(zhi)(zhi)黨(dang)(dang)和(he)(he)以德(de)治(zhi)(zhi)黨(dang)(dang)相統(tong)一(yi),全(quan)面做好黨(dang)(dang)內法(fa)(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)度(du)(du)(du)(du)建(jian)(jian)設(she);專(zhuan)門學(xue)習(xi)《綱要(yao)(yao)》《規(gui)(gui)(gui)定(ding)(ding)(ding)》《關(guan)于推(tui)(tui)(tui)行法(fa)(fa)(fa)律顧問制(zhi)(zhi)度(du)(du)(du)(du)和(he)(he)公職律師公司律師制(zhi)(zhi)度(du)(du)(du)(du)的(de)(de)意(yi)見》等中(zhong)(zhong)央(yang)文(wen)件(jian)精神,并(bing)提出貫徹落(luo)實(shi)(shi)要(yao)(yao)求(qiu)(qiu)。組織委(wei)(wei)(wei)(wei)機(ji)關(guan)和(he)(he)中(zhong)(zhong)央(yang)企(qi)業(ye)黨(dang)(dang)內法(fa)(fa)(fa)規(gui)(gui)(gui)輔(fu)導(dao)報告會(hui)(hui)(hui)(hui),邀請有(you)關(guan)同(tong)(tong)志(zhi)(zhi)講(jiang)(jiang)解(jie)黨(dang)(dang)章、《中(zhong)(zhong)國(guo)(guo)(guo)(guo)共產(chan)黨(dang)(dang)問責條例(li)》等重(zhong)(zhong)(zhong)要(yao)(yao)黨(dang)(dang)內法(fa)(fa)(fa)規(gui)(gui)(gui)。三是(shi)迅(xun)速出臺實(shi)(shi)施方案(an)。《綱要(yao)(yao)》印發后,國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)高度(du)(du)(du)(du)重(zhong)(zhong)(zhong)視(shi),第(di)一(yi)時間(jian)部(bu)署安(an)排(pai)貫徹落(luo)實(shi)(shi)。經黨(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)(hui)(hui)和(he)(he)主(zhu)任辦公會(hui)(hui)(hui)(hui)審(shen)議(yi)通過(guo),印發《國(guo)(guo)(guo)(guo)務(wu)院(yuan)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)推(tui)(tui)(tui)進(jin)(jin)(jin)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)治(zhi)(zhi)機(ji)構建(jian)(jian)設(she)實(shi)(shi)施方案(an)》(以下簡稱《實(shi)(shi)施方案(an)》,將(jiang)《綱要(yao)(yao)》規(gui)(gui)(gui)定(ding)(ding)(ding)和(he)(he)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)工(gong)作(zuo)(zuo)實(shi)(shi)際相結合(he)(he),明確(que)6個方面24項主(zhu)要(yao)(yao)任務(wu),并(bing)逐一(yi)細化(hua)(hua)落(luo)實(shi)(shi)負(fu)(fu)責廳局、時間(jian)進(jin)(jin)(jin)度(du)(du)(du)(du)安(an)排(pai)和(he)(he)可檢驗的(de)(de)成果形式(shi)。四(si)是(shi)強化(hua)(hua)工(gong)作(zuo)(zuo)部(bu)署推(tui)(tui)(tui)動(dong)。黨(dang)(dang)委(wei)(wei)(wei)(wei)會(hui)(hui)(hui)(hui)、主(zhu)任辦公會(hui)(hui)(hui)(hui)多(duo)次研究(jiu)法(fa)(fa)(fa)治(zhi)(zhi)工(gong)作(zuo)(zuo),主(zhu)要(yao)(yao)負(fu)(fu)責同(tong)(tong)志(zhi)(zhi)親自謀劃、親自協調,確(que)保法(fa)(fa)(fa)治(zhi)(zhi)建(jian)(jian)設(she)與年度(du)(du)(du)(du)工(gong)作(zuo)(zuo)要(yao)(yao)點同(tong)(tong)部(bu)署、同(tong)(tong)推(tui)(tui)(tui)進(jin)(jin)(jin)、同(tong)(tong)督(du)促;在(zai)中(zhong)(zhong)央(yang)企(qi)業(ye)、地方國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)負(fu)(fu)責人(ren)會(hui)(hui)(hui)(hui)議(yi)上,主(zhu)要(yao)(yao)負(fu)(fu)責同(tong)(tong)志(zhi)(zhi)明確(que)要(yao)(yao)求(qiu)(qiu)強化(hua)(hua)依(yi)法(fa)(fa)(fa)監(jian)管(guan),嚴格依(yi)據國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)相關(guan)法(fa)(fa)(fa)律法(fa)(fa)(fa)規(gui)(gui)(gui)規(gui)(gui)(gui)定(ding)(ding)(ding)的(de)(de)權限和(he)(he)程序行權履(lv)職,健全(quan)完善國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)度(du)(du)(du)(du)體系(xi);組織召開中(zhong)(zhong)央(yang)企(qi)業(ye)法(fa)(fa)(fa)治(zhi)(zhi)工(gong)作(zuo)(zuo)會(hui)(hui)(hui)(hui)議(yi)和(he)(he)國(guo)(guo)(guo)(guo)資(zi)(zi)(zi)(zi)委(wei)(wei)(wei)(wei)系(xi)統(tong)政(zheng)策法(fa)(fa)(fa)規(gui)(gui)(gui)工(gong)作(zuo)(zuo)研討培訓班,明確(que)2017年推(tui)(tui)(tui)進(jin)(jin)(jin)依(yi)法(fa)(fa)(fa)監(jian)管(guan)、依(yi)法(fa)(fa)(fa)治(zhi)(zhi)企(qi)的(de)(de)具(ju)體工(gong)作(zuo)(zuo)任務(wu)。
二、著力打造國(guo)資監管(guan)法治機構(gou)
認(ren)真落實以管(guan)(guan)資本為(wei)主加強(qiang)國(guo)有資產監管(guan)(guan)的改革要求(qiu),嚴(yan)格依據公司法、企業(ye)國(guo)有資產法全(quan)面(mian)履(lv)行出資人職責,建(jian)立健(jian)全(quan)依法監管(guan)(guan)的機(ji)制制度,法治(zhi)機(ji)構建(jian)設取得明顯進展。
(一)依(yi)法全面履行(xing)國(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan)職(zhi)責(ze)(ze)。一是推進國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)職(zhi)能轉變(bian)。研究(jiu)制(zhi)訂(ding)國(guo)務院國(guo)資(zi)(zi)(zi)(zi)(zi)委以管(guan)(guan)資(zi)(zi)(zi)(zi)(zi)本為主推進職(zhi)能轉變(bian)方案,強(qiang)化管(guan)(guan)資(zi)(zi)(zi)(zi)(zi)本重點職(zhi)能,加(jia)強(qiang)出(chu)資(zi)(zi)(zi)(zi)(zi)人監(jian)(jian)督(du)(du),全面加(jia)強(qiang)黨(dang)的(de)建設,精簡監(jian)(jian)管(guan)(guan)事項,改(gai)(gai)進國(guo)資(zi)(zi)(zi)(zi)(zi)監(jian)(jian)管(guan)(guan)方式和(he)手段。同時,加(jia)快研究(jiu)制(zhi)訂(ding)出(chu)資(zi)(zi)(zi)(zi)(zi)人監(jian)(jian)管(guan)(guan)權力(li)和(he)責(ze)(ze)任(ren)清(qing)單。二是運用法治化方式行(xing)權履責(ze)(ze)。嚴格按照法定(ding)職(zhi)責(ze)(ze)和(he)程序加(jia)強(qiang)國(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)管(guan)(guan),完善(shan)中央(yang)企(qi)業(ye)(ye)章程管(guan)(guan)理(li),推動(dong)中央(yang)企(qi)業(ye)(ye)建立規(gui)范董事會,進一步規(gui)范董事會運作,依(yi)法依(yi)規(gui)選(xuan)派、選(xuan)任(ren)和(he)管(guan)(guan)理(li)股東代表(biao)、董事、監(jian)(jian)事及經營管(guan)(guan)理(li)者,更(geng)多通過公司法人治理(li)結構(gou)(gou)有(you)(you)效體現(xian)出(chu)資(zi)(zi)(zi)(zi)(zi)人意(yi)(yi)志。三是依(yi)法強(qiang)化國(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)產(chan)監(jian)(jian)督(du)(du)。成立監(jian)(jian)督(du)(du)一局、監(jian)(jian)督(du)(du)二局、監(jian)(jian)督(du)(du)三局,負責(ze)(ze)深入(ru)核查、分類處(chu)置(zhi)和(he)整(zheng)改(gai)(gai)督(du)(du)辦(ban)委機(ji)關(guan)、監(jian)(jian)事會及有(you)(you)關(guan)監(jian)(jian)督(du)(du)機(ji)構(gou)(gou)發現(xian)移(yi)交的(de)問題,依(yi)法組織開展國(guo)有(you)(you)資(zi)(zi)(zi)(zi)(zi)產(chan)重大(da)損失調(diao)(diao)查,提出(chu)有(you)(you)關(guan)責(ze)(ze)任(ren)追(zhui)究(jiu)的(de)意(yi)(yi)見建議。落實《關(guan)于建立國(guo)有(you)(you)企(qi)業(ye)(ye)違(wei)規(gui)經營投資(zi)(zi)(zi)(zi)(zi)責(ze)(ze)任(ren)追(zhui)究(jiu)制(zhi)度的(de)意(yi)(yi)見》要求,加(jia)大(da)對中央(yang)企(qi)業(ye)(ye)違(wei)規(gui)經營責(ze)(ze)任(ren)追(zhui)究(jiu)力(li)度,形(xing)成發現(xian)、調(diao)(diao)查、處(chu)理(li)問題的(de)監(jian)(jian)督(du)(du)工作閉環。
(二)完(wan)善國(guo)資(zi)監(jian)管法(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)度體系(xi)。一是加強(qiang)重(zhong)點(dian)領(ling)域(yu)國(guo)資(zi)監(jian)管立(li)法(fa)(fa)。圍繞國(guo)企(qi)(qi)(qi)國(guo)資(zi)改(gai)革(ge)(ge)發展中(zhong)(zhong)(zhong)心任(ren)務,突出以管資(zi)本為主(zhu),編制(zhi)(zhi)我委2016年(nian)度立(li)法(fa)(fa)工作(zuo)(zuo)計劃(hua),保障改(gai)革(ge)(ge)立(li)法(fa)(fa)需求(qiu)。全年(nian)共出臺《企(qi)(qi)(qi)業國(guo)有資(zi)產交易監(jian)督管理(li)辦法(fa)(fa)》《中(zhong)(zhong)(zhong)央企(qi)(qi)(qi)業負(fu)責人經(jing)營業績考核(he)辦法(fa)(fa)》《關于完(wan)善中(zhong)(zhong)(zhong)央企(qi)(qi)(qi)業功能分(fen)類(lei)考核(he)的實(shi)施方案》等27件(jian)規(gui)(gui)(gui)章(zhang)規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)(含黨委規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian))。截(jie)至(zhi)2016年(nian)底,國(guo)資(zi)委現行(xing)有效規(gui)(gui)(gui)章(zhang)28件(jian),規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)294件(jian),國(guo)資(zi)監(jian)管法(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)度體系(xi)進(jin)(jin)一步(bu)完(wan)善。二是加強(qiang)規(gui)(gui)(gui)章(zhang)規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)合(he)(he)法(fa)(fa)性(xing)(xing)(xing)審(shen)查。根據立(li)法(fa)(fa)法(fa)(fa)和《規(gui)(gui)(gui)章(zhang)制(zhi)(zhi)定程序(xu)條例》,嚴格落實(shi)《國(guo)資(zi)委立(li)法(fa)(fa)工作(zuo)(zuo)規(gui)(gui)(gui)則》、《國(guo)資(zi)委規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)制(zhi)(zhi)定暫行(xing)辦法(fa)(fa)》,要求(qiu)規(gui)(gui)(gui)章(zhang)規(gui)(gui)(gui)范(fan)性(xing)(xing)(xing)文(wen)(wen)件(jian)在提請(qing)委主(zhu)任(ren)辦公會議審(shen)議前,須由法(fa)(fa)制(zhi)(zhi)機構進(jin)(jin)行(xing)合(he)(he)法(fa)(fa)性(xing)(xing)(xing)審(shen)查并出具(ju)審(shen)查報告。三是深入(ru)開展國(guo)資(zi)監(jian)管文(wen)(wen)件(jian)清(qing)理(li)。根據國(guo)務院統一部署要求(qiu),對(dui)不(bu)利于穩增長、促改(gai)革(ge)(ge)、調結(jie)構、惠民(min)生(sheng)的政(zheng)策性(xing)(xing)(xing)文(wen)(wen)件(jian)進(jin)(jin)行(xing)清(qing)理(li),共宣布廢止、失效一批政(zheng)策性(xing)(xing)(xing)文(wen)(wen)件(jian)。清(qing)理(li)結(jie)果以國(guo)資(zi)委公告的形式向(xiang)社會公布。此外,積極參與《中(zhong)(zhong)(zhong)華人民(min)共和國(guo)商品(pin)流通法(fa)(fa)》《中(zhong)(zhong)(zhong)華人民(min)共和國(guo)反不(bu)正當競爭法(fa)(fa)》《中(zhong)(zhong)(zhong)華人民(min)共和國(guo)電力法(fa)(fa)》等國(guo)家重(zhong)要立(li)法(fa)(fa)。
(三)推(tui)進決(jue)策(ce)(ce)科學化(hua)、民主(zhu)化(hua)、法(fa)(fa)(fa)(fa)(fa)治化(hua)。一是(shi)完善依法(fa)(fa)(fa)(fa)(fa)決(jue)策(ce)(ce)程序。明確重大(da)(da)決(jue)策(ce)(ce)應當(dang)經(jing)委(wei)黨委(wei)會(hui)、委(wei)主(zhu)任辦公(gong)會(hui)議討論,由(you)主(zhu)要負責同(tong)志(zhi)在集體討論基礎(chu)上作(zuo)出(chu)決(jue)定(ding)。二(er)是(shi)加強(qiang)重大(da)(da)決(jue)策(ce)(ce)合法(fa)(fa)(fa)(fa)(fa)性審(shen)查。除(chu)規章規范(fan)性文件外(wai),明確涉及國企國資改革(ge)發展的重大(da)(da)決(jue)策(ce)(ce),必須(xu)征求法(fa)(fa)(fa)(fa)(fa)制機(ji)(ji)構意見。三是(shi)探(tan)索推(tui)行機(ji)(ji)關法(fa)(fa)(fa)(fa)(fa)律顧(gu)問制度。在國資監管立法(fa)(fa)(fa)(fa)(fa)、重大(da)(da)事項決(jue)策(ce)(ce)、訴訟(song)復議和(he)(he)訴訟(song)案件應對等機(ji)(ji)關法(fa)(fa)(fa)(fa)(fa)律事務中,充分發揮法(fa)(fa)(fa)(fa)(fa)律顧(gu)問的法(fa)(fa)(fa)(fa)(fa)律咨(zi)詢論證、審(shen)核把(ba)關和(he)(he)協調(diao)服務作(zuo)用(yong)。
(四)強化對(dui)(dui)權(quan)力的(de)(de)(de)制(zhi)約和(he)監督(du)。一(yi)是(shi)(shi)健全國(guo)(guo)資(zi)(zi)(zi)監管權(quan)力運行(xing)制(zhi)約和(he)監督(du)體系。注重(zhong)廉政風險防(fang)控建設(she),加(jia)強對(dui)(dui)“關鍵環節”的(de)(de)(de)監督(du),緊(jin)盯(ding)權(quan)力集中(zhong)(zhong)(zhong)、資(zi)(zi)(zi)金密集、經(jing)營(ying)壟斷等(deng)重(zhong)點(dian)領域、重(zhong)點(dian)環節和(he)重(zhong)點(dian)人員。在國(guo)(guo)資(zi)(zi)(zi)委(wei)門(men)戶網(wang)站(zhan)添(tian)加(jia)中(zhong)(zhong)(zhong)央國(guo)(guo)家機關舉(ju)(ju)報網(wang)站(zhan)網(wang)址(zhi),暢通舉(ju)(ju)報監督(du)渠道。二是(shi)(shi)自(zi)覺接(jie)受黨內監督(du)和(he)審計監督(du)。按照“條條要(yao)整(zheng)改(gai)(gai)、件(jian)件(jian)有(you)著落(luo)”的(de)(de)(de)要(yao)求,把巡視(shi)反饋(kui)的(de)(de)(de)突出問(wen)題(ti),提出對(dui)(dui)應整(zheng)改(gai)(gai)措施(shi),一(yi)一(yi)對(dui)(dui)賬(zhang)銷號(hao),切實(shi)發揮(hui)好巡視(shi)發現問(wen)題(ti)、形成震懾、倒逼改(gai)(gai)革、促進(jin)發展(zhan)的(de)(de)(de)作(zuo)用。積極配合審計監督(du),全面提供資(zi)(zi)(zi)料、主(zhu)動說明(ming)(ming)情況(kuang);對(dui)(dui)審計發現的(de)(de)(de)問(wen)題(ti)及時明(ming)(ming)確責(ze)任,落(luo)實(shi)整(zheng)改(gai)(gai)措施(shi),確保監管更加(jia)規范有(you)效。三是(shi)(shi)全面推進(jin)信息(xi)公開(kai)。2016年我委(wei)通過國(guo)(guo)資(zi)(zi)(zi)委(wei)門(men)戶網(wang)站(zhan)主(zhu)動發布各(ge)類信息(xi),涵蓋國(guo)(guo)企(qi)(qi)國(guo)(guo)資(zi)(zi)(zi)深化改(gai)(gai)革、中(zhong)(zhong)(zhong)央企(qi)(qi)業經(jing)營(ying)發展(zhan)、中(zhong)(zhong)(zhong)央企(qi)(qi)業履(lv)行(xing)社(she)會(hui)責(ze)任等(deng)方面情況(kuang),特別是(shi)(shi)向社(she)會(hui)主(zhu)動公開(kai)中(zhong)(zhong)(zhong)央企(qi)(qi)業負(fu)責(ze)同志2015年度薪酬水平(ping)情況(kuang),進(jin)一(yi)步提高了中(zhong)(zhong)(zhong)央企(qi)(qi)業透明(ming)(ming)度。依法依規做好依申請公開(kai)工作(zuo),印發了《關于推進(jin)中(zhong)(zhong)(zhong)央企(qi)(qi)業信息(xi)公開(kai)的(de)(de)(de)指(zhi)導(dao)意見》,推動中(zhong)(zhong)(zhong)央企(qi)(qi)業信息(xi)公開(kai)試點(dian)工作(zuo)有(you)序進(jin)行(xing)。
(五)依(yi)法(fa)有效化(hua)解矛(mao)盾(dun)糾紛。一(yi)(yi)是提高信(xin)息公(gong)(gong)開、授權委托等(deng)法(fa)律審核質量,全面做好涉訴(su)案件和行(xing)政復(fu)議應對工(gong)作,較好地防范(fan)了(le)委機關法(fa)律風險。二是完善信(xin)訪(fang)(fang)工(gong)作制度。建立局(ju)處級干部(bu)定期參加接訪(fang)(fang)、新錄公(gong)(gong)務員信(xin)訪(fang)(fang)鍛煉等(deng)制度,提高全委干部(bu)信(xin)訪(fang)(fang)工(gong)作意識(shi)。進一(yi)(yi)步規范(fan)信(xin)訪(fang)(fang)事項辦理流程,研究(jiu)網上信(xin)訪(fang)(fang)工(gong)作,暢通信(xin)訪(fang)(fang)渠道,推動通過法(fa)定途徑分類處理信(xin)訪(fang)(fang)投訴(su)請求。組織中央(yang)企業深入開展矛(mao)盾(dun)糾紛排(pai)查(cha)化(hua)解工(gong)作,對排(pai)查(cha)出的問(wen)題做到責任、人員、措施“三落(luo)實”,健全中央(yang)企業不穩(wen)定問(wen)題臺賬。
(六)加強機關法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)(xuan)(xuan)傳(chuan)教育(yu)。一(yi)(yi)是(shi)(shi)啟動(dong)(dong)“七(qi)五”普(pu)法(fa)(fa)(fa)(fa)(fa)工(gong)作。制(zhi)定(ding)《國(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)資(zi)(zi)委(wei)關于在(zai)國(guo)(guo)(guo)資(zi)(zi)委(wei)系(xi)(xi)統開展法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)(xuan)(xuan)傳(chuan)教育(yu)的(de)第七(qi)個五年規(gui)劃(2016-2020年)》,正式啟動(dong)(dong)國(guo)(guo)(guo)資(zi)(zi)委(wei)系(xi)(xi)統“七(qi)五”普(pu)法(fa)(fa)(fa)(fa)(fa)工(gong)作。二是(shi)(shi)深入(ru)抓(zhua)好(hao)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)教育(yu)。定(ding)期(qi)組(zu)織(zhi)“法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)講(jiang)堂”,邀請政府機關、高等院(yuan)校的(de)專家(jia)學(xue)者(zhe)以及律師、企(qi)業總法(fa)(fa)(fa)(fa)(fa)律顧問等,在(zai)各中(zhong)(zhong)央企(qi)業和地方國(guo)(guo)(guo)資(zi)(zi)委(wei)設立(li)分會場,以視頻(pin)形式進行專題講(jiang)座,2016年共舉(ju)(ju)辦(ban)6期(qi)。深入(ru)開展“12·4”全(quan)(quan)國(guo)(guo)(guo)憲(xian)法(fa)(fa)(fa)(fa)(fa)日和全(quan)(quan)國(guo)(guo)(guo)法(fa)(fa)(fa)(fa)(fa)制(zhi)宣(xuan)(xuan)(xuan)傳(chuan)日宣(xuan)(xuan)(xuan)傳(chuan)教育(yu)活動(dong)(dong),加強公務員初任(ren)培(pei)(pei)(pei)訓(xun)、干部(bu)(bu)任(ren)職(zhi)培(pei)(pei)(pei)訓(xun)中(zhong)(zhong)的(de)法(fa)(fa)(fa)(fa)(fa)律知識培(pei)(pei)(pei)訓(xun)。組(zu)織(zhi)機關干部(bu)(bu)旁(pang)聽我(wo)委(wei)涉訴(su)案件(jian)庭審并開展座談會,通(tong)過網絡(luo)、微信等不(bu)斷拓(tuo)寬(kuan)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)(xuan)(xuan)傳(chuan)教育(yu)渠道,提升(sheng)機關干部(bu)(bu)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)素(su)養(yang)。三是(shi)(shi)加強對(dui)外法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)宣(xuan)(xuan)(xuan)傳(chuan)。加強國(guo)(guo)(guo)資(zi)(zi)監(jian)管(guan)法(fa)(fa)(fa)(fa)(fa)規(gui)制(zhi)度的(de)普(pu)法(fa)(fa)(fa)(fa)(fa)宣(xuan)(xuan)(xuan)傳(chuan),及時向社會公開國(guo)(guo)(guo)資(zi)(zi)委(wei)規(gui)章規(gui)范性文(wen)件(jian),并通(tong)過網站、公告、新聞(wen)通(tong)氣(qi)會等方式進行政策解(jie)讀。組(zu)織(zhi)編輯出(chu)版(ban)《一(yi)(yi)帶(dai)一(yi)(yi)路沿(yan)線國(guo)(guo)(guo)家(jia)法(fa)(fa)(fa)(fa)(fa)律風險防范指(zhi)引》印尼、沙特、俄羅斯(si)等9個國(guo)(guo)(guo)家(jia)分冊。會同(tong)有關部(bu)(bu)門共同(tong)舉(ju)(ju)辦(ban)2期(qi)反壟(long)斷法(fa)(fa)(fa)(fa)(fa)培(pei)(pei)(pei)訓(xun)班,對(dui)中(zhong)(zhong)央和地方國(guo)(guo)(guo)有大中(zhong)(zhong)型企(qi)業進行法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)教育(yu)培(pei)(pei)(pei)訓(xun)。在(zai)2016年全(quan)(quan)國(guo)(guo)(guo)“六五”普(pu)法(fa)(fa)(fa)(fa)(fa)表彰中(zhong)(zhong),國(guo)(guo)(guo)務院(yuan)國(guo)(guo)(guo)資(zi)(zi)委(wei)普(pu)法(fa)(fa)(fa)(fa)(fa)辦(ban)被評為先進單位。
三、深(shen)入推(tui)進法治央(yang)企建(jian)設
