國務院國資委印發《中央企業工資總額管理辦法》

國(guo)務院國(guo)資(zi)委近(jin)日印發《中央企業工(gong)資(zi)總額管理(li)辦(ban)法》(國(guo)資(zi)委令第(di)39號,以下簡(jian)稱《辦(ban)法》)。

《辦法》以習近平新時代中(zhong)國特(te)色(se)社會主義(yi)思想為(wei)指引,以建立健全與勞(lao)動力市場基本(ben)適應(ying)、與企(qi)業(ye)(ye)經(jing)(jing)濟(ji)效益(yi)和(he)勞(lao)動生(sheng)產率掛(gua)鉤的(de)工資決定和(he)正常增長機制,增強企(qi)業(ye)(ye)活(huo)力和(he)動力,促進企(qi)業(ye)(ye)實(shi)現(xian)高質量發(fa)展,推動國有資本(ben)做(zuo)強做(zuo)優做(zuo)大為(wei)目標,以出資人管(guan)資本(ben)為(wei)主強化(hua)激勵約束建設為(wei)遵循,按照(zhao)《國務院關于改(gai)革國有企(qi)業(ye)(ye)工資決定機制的(de)意見》(國發(fa)〔2018〕16號,以下簡(jian)稱《意見》)精(jing)神,在繼承以往有效經(jing)(jing)驗和(he)做(zuo)法的(de)基礎上,對現(xian)行中(zhong)央企(qi)業(ye)(ye)工資總額管(guan)理相關制度辦法進行修改(gai)和(he)完善。

《辦法》明(ming)確對(dui)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)工(gong)(gong)資(zi)(zi)(zi)總額實(shi)行(xing)(xing)分(fen)類(lei)管(guan)理。對(dui)主業(ye)處于(yu)充(chong)分(fen)競爭行(xing)(xing)業(ye)和領(ling)域(yu)的商業(ye)類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)工(gong)(gong)資(zi)(zi)(zi)總額預(yu)(yu)算原(yuan)則上(shang)全(quan)部(bu)實(shi)行(xing)(xing)備(bei)案制管(guan)理,由(you)企(qi)業(ye)董事(shi)(shi)會在依法依規的前提(ti)下,自(zi)主決定年度工(gong)(gong)資(zi)(zi)(zi)總額預(yu)(yu)算,國(guo)(guo)資(zi)(zi)(zi)委由(you)事(shi)(shi)前核(he)準(zhun)轉變為(wei)事(shi)(shi)前引導、事(shi)(shi)中(zhong)(zhong)(zhong)(zhong)監測和事(shi)(shi)后監督;對(dui)主業(ye)處于(yu)關系國(guo)(guo)家安全(quan)、國(guo)(guo)民經濟命脈的重要(yao)行(xing)(xing)業(ye)和關鍵領(ling)域(yu)、主要(yao)承擔重大專項任務(wu)的商業(ye)類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye)和以提(ti)供公共(gong)產品或服(fu)務(wu)為(wei)主的公益(yi)類(lei)中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye),工(gong)(gong)資(zi)(zi)(zi)總額預(yu)(yu)算繼續實(shi)行(xing)(xing)核(he)準(zhun)制管(guan)理;對(dui)開展國(guo)(guo)有(you)資(zi)(zi)(zi)本投資(zi)(zi)(zi)、運營公司或者混合所(suo)有(you)制改革等試點的中(zhong)(zhong)(zhong)(zhong)央(yang)企(qi)業(ye),提(ti)出可以探索實(shi)行(xing)(xing)更加靈活高(gao)效的工(gong)(gong)資(zi)(zi)(zi)總額管(guan)理方式。

《辦(ban)法》明確對中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額實(shi)行(xing)(xing)分級(ji)管(guan)(guan)(guan)(guan)理。按照《中(zhong)(zhong)共(gong)中(zhong)(zhong)央(yang) 國(guo)務院關于(yu)深化(hua)國(guo)有企(qi)業(ye)(ye)改革的指導意見》(中(zhong)(zhong)發(fa)〔2015〕22號(hao)(hao),以下簡稱中(zhong)(zhong)發(fa)22號(hao)(hao)文件)、《國(guo)務院辦(ban)公廳關于(yu)轉發(fa)國(guo)務院國(guo)資(zi)(zi)委以管(guan)(guan)(guan)(guan)資(zi)(zi)本為主(zhu)推進職(zhi)能轉變方案的通知》(國(guo)辦(ban)發(fa)〔2017〕38號(hao)(hao))要(yao)求,結合當前中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額管(guan)(guan)(guan)(guan)理實(shi)際,強調中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)工(gong)資(zi)(zi)總額實(shi)行(xing)(xing)分級(ji)管(guan)(guan)(guan)(guan)理體制(zhi),國(guo)資(zi)(zi)委與中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)權責清晰(xi)、各司其職(zhi),國(guo)資(zi)(zi)委負(fu)責管(guan)(guan)(guan)(guan)制(zhi)度、管(guan)(guan)(guan)(guan)總量、管(guan)(guan)(guan)(guan)監督,中(zhong)(zhong)央(yang)企(qi)業(ye)(ye)負(fu)責管(guan)(guan)(guan)(guan)內部自主(zhu)分配、管(guan)(guan)(guan)(guan)預算分解落實(shi)、管(guan)(guan)(guan)(guan)具體操(cao)作執行(xing)(xing)。

《辦(ban)法(fa)》緊緊圍(wei)繞中(zhong)發(fa)22號文件和(he)《意見》關(guan)于(yu)“建立健全與(yu)(yu)勞(lao)動(dong)力市場基本適應(ying)、與(yu)(yu)企(qi)業(ye)經濟效(xiao)益(yi)和(he)勞(lao)動(dong)生產率(lv)掛鉤的(de)(de)(de)工(gong)資(zi)(zi)(zi)決定(ding)(ding)(ding)(ding)和(he)正常增長(chang)(chang)(chang)(chang)機制(zhi)”的(de)(de)(de)要求,明確(que)規(gui)定(ding)(ding)(ding)(ding)中(zhong)央企(qi)業(ye)工(gong)資(zi)(zi)(zi)總(zong)額(e)預算(suan)主要按照效(xiao)益(yi)決定(ding)(ding)(ding)(ding)、效(xiao)率(lv)調整、水平(ping)調控三(san)個環節(jie)決定(ding)(ding)(ding)(ding)。一(yi)是(shi)中(zhong)央企(qi)業(ye)工(gong)資(zi)(zi)(zi)總(zong)額(e)預算(suan)與(yu)(yu)利潤總(zong)額(e)等經濟效(xiao)益(yi)指標(biao)的(de)(de)(de)業(ye)績(ji)考核(he)目(mu)標(biao)值掛鉤,并且根據目(mu)標(biao)值的(de)(de)(de)先(xian)進程度(du)確(que)定(ding)(ding)(ding)(ding)不(bu)同(tong)的(de)(de)(de)預算(suan)水平(ping),引導中(zhong)央企(qi)業(ye)通過完成(cheng)高(gao)質量發(fa)展目(mu)標(biao),帶(dai)動(dong)職(zhi)工(gong)工(gong)資(zi)(zi)(zi)總(zong)額(e)合(he)理(li)有(you)(you)序增長(chang)(chang)(chang)(chang)。二是(shi)工(gong)資(zi)(zi)(zi)增長(chang)(chang)(chang)(chang)還(huan)應(ying)當(dang)通過人工(gong)成(cheng)本投入產出效(xiao)率(lv)、勞(lao)動(dong)生產率(lv)等指標(biao)對標(biao)進行調整,進一(yi)步協調不(bu)同(tong)效(xiao)率(lv)的(de)(de)(de)企(qi)業(ye)之間工(gong)資(zi)(zi)(zi)分(fen)配(pei)關(guan)系,提高(gao)企(qi)業(ye)工(gong)資(zi)(zi)(zi)總(zong)額(e)決定(ding)(ding)(ding)(ding)機制(zhi)的(de)(de)(de)科學性(xing)與(yu)(yu)有(you)(you)效(xiao)性(xing)。三(san)是(shi)注重收入分(fen)配(pei)公平(ping),國資(zi)(zi)(zi)委將按照國家有(you)(you)關(guan)部(bu)門發(fa)布(bu)的(de)(de)(de)工(gong)資(zi)(zi)(zi)指導線和(he)對非(fei)競爭(zheng)(zheng)類國有(you)(you)企(qi)業(ye)的(de)(de)(de)工(gong)資(zi)(zi)(zi)調控要求,對部(bu)分(fen)工(gong)資(zi)(zi)(zi)水平(ping)偏高(gao)、過高(gao)的(de)(de)(de)行業(ye)與(yu)(yu)企(qi)業(ye),尤(you)其是(shi)主業(ye)不(bu)屬于(yu)充分(fen)競爭(zheng)(zheng)行業(ye)和(he)領域的(de)(de)(de)企(qi)業(ye)工(gong)資(zi)(zi)(zi)增長(chang)(chang)(chang)(chang)過快(kuai)的(de)(de)(de)情況進行適當(dang)約束(shu),確(que)保企(qi)業(ye)職(zhi)工(gong)工(gong)資(zi)(zi)(zi)的(de)(de)(de)水平(ping)與(yu)(yu)增長(chang)(chang)(chang)(chang)幅度(du)更(geng)加(jia)公平(ping)合(he)理(li)、規(gui)范(fan)有(you)(you)序。同(tong)時,對中(zhong)央企(qi)業(ye)承擔重大專(zhuan)項(xiang)任務、重大科技創新(xin)項(xiang)目(mu)等特殊事項(xiang)的(de)(de)(de),《辦(ban)法(fa)》也(ye)明確(que)將予以適度(du)支持。

《辦法》在從宏觀層面完(wan)善國家、企業(ye)和(he)(he)職(zhi)工三者工資(zi)分(fen)(fen)配(pei)關系,加大(da)出資(zi)人(ren)向中央企業(ye)董事會授權(quan)的(de)同時,也同步對(dui)(dui)責(ze)任(ren)落實和(he)(he)制度配(pei)套進(jin)行了規(gui)定。一(yi)是(shi)強調企業(ye)作為內(nei)(nei)部(bu)分(fen)(fen)配(pei)的(de)責(ze)任(ren)主體,應(ying)當持續深化內(nei)(nei)部(bu)三項制度改革,構建企業(ye)內(nei)(nei)部(bu)管理(li)人(ren)員(yuan)能(neng)(neng)(neng)上(shang)能(neng)(neng)(neng)下、員(yuan)工能(neng)(neng)(neng)進(jin)能(neng)(neng)(neng)出、收(shou)入能(neng)(neng)(neng)增(zeng)能(neng)(neng)(neng)減的(de)市場化勞動用工和(he)(he)收(shou)入分(fen)(fen)配(pei)管理(li)機制,切(qie)實承擔起搞好(hao)、搞活企業(ye)內(nei)(nei)部(bu)分(fen)(fen)配(pei)的(de)職(zhi)責(ze)。二是(shi)加強監督檢查,明確(que)界定企業(ye)違規(gui)責(ze)任(ren),并將企業(ye)工資(zi)總額管理(li)情況納入各項監督檢查范圍,與審(shen)計(ji)、巡(xun)視等工作形成合力,確(que)保實現權(quan)責(ze)對(dui)(dui)等,監管到位(wei)。
