國資委關于2017年度法治建設工作情況的報告

貫(guan)徹(che)落實中共(gong)中央、國(guo)務院(yuan)印發的《法治政府建(jian)設(she)實施綱要(2015-2020年(nian))》(以下簡稱(cheng)《綱要》)要求(qiu),國(guo)資(zi)委2017年(nian)法治建(jian)設(she)工作(zuo)取得積極(ji)進展:

2017年(nian),國(guo)(guo)(guo)資(zi)委認真學習貫(guan)徹(che)習近(jin)平新時代中國(guo)(guo)(guo)特色社會主義思想和黨的十九(jiu)大精神,深入貫(guan)徹(che)全面依法(fa)(fa)(fa)(fa)治國(guo)(guo)(guo)戰略(lve)部署,認真落實(shi)《綱要(yao)》,扎實(shi)推進《國(guo)(guo)(guo)務(wu)院國(guo)(guo)(guo)資(zi)委推進國(guo)(guo)(guo)資(zi)監管法(fa)(fa)(fa)(fa)治機構(gou)建(jian)設實(shi)施方(fang)(fang)案》(國(guo)(guo)(guo)資(zi)發法(fa)(fa)(fa)(fa)規〔2016〕134號)各項(xiang)任務(wu)措施,在(zai)依法(fa)(fa)(fa)(fa)全面履(lv)職、完善(shan)法(fa)(fa)(fa)(fa)規體系(xi)、健(jian)全決策(ce)機制、強化權(quan)力(li)監督、有效化解矛盾、提升法(fa)(fa)(fa)(fa)治能力(li)等(deng)方(fang)(fang)面取得明顯成效,國(guo)(guo)(guo)資(zi)國(guo)(guo)(guo)企法(fa)(fa)(fa)(fa)治建(jian)設邁出(chu)新步(bu)伐。

一、切實加(jia)強對法治建設(she)的領(ling)導和頂層制(zhi)度設(she)計(ji)

一(yi)(yi)是深入(ru)(ru)學(xue)習貫(guan)徹習近(jin)平總(zong)(zong)(zong)書(shu)(shu)記(ji)關于(yu)全面(mian)(mian)依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)國(guo)新(xin)(xin)理(li)念新(xin)(xin)思(si)想新(xin)(xin)戰(zhan)略(lve)。黨(dang)(dang)(dang)的(de)十(shi)九大(da)把堅持全面(mian)(mian)依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)國(guo)確立(li)為新(xin)(xin)時代堅持和(he)發(fa)展中(zhong)國(guo)特色社會主(zhu)(zhu)義的(de)十(shi)四(si)條(tiao)基本方略(lve)之一(yi)(yi),對深化(hua)依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)國(guo)實(shi)(shi)(shi)踐作(zuo)(zuo)出(chu)全面(mian)(mian)部(bu)署(shu),為全面(mian)(mian)推(tui)(tui)(tui)(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)各項(xiang)工(gong)作(zuo)(zuo)提供了根本遵循。國(guo)資(zi)委(wei)(wei)(wei)(wei)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)牢固樹立(li)“四(si)個(ge)意識”,通(tong)過(guo)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)會和(he)中(zhong)心(xin)組(zu)學(xue)習、專題(ti)學(xue)習研討等方式,多次(ci)(ci)學(xue)習貫(guan)徹習近(jin)平總(zong)(zong)(zong)書(shu)(shu)記(ji)關于(yu)全面(mian)(mian)依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)國(guo)新(xin)(xin)理(li)念新(xin)(xin)思(si)想新(xin)(xin)戰(zhan)略(lve),深刻(ke)領會總(zong)(zong)(zong)書(shu)(shu)記(ji)依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)國(guo)、依(yi)(yi)(yi)(yi)規(gui)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)黨(dang)(dang)(dang)重要(yao)論述(shu)和(he)中(zhong)央政(zheng)法(fa)(fa)(fa)(fa)工(gong)作(zuo)(zuo)會議(yi)精神(shen),并提出(chu)貫(guan)徹落(luo)實(shi)(shi)(shi)要(yao)求(qiu)(qiu)。二是切(qie)實(shi)(shi)(shi)落(luo)實(shi)(shi)(shi)第(di)一(yi)(yi)責(ze)(ze)任人職(zhi)責(ze)(ze)。貫(guan)徹《黨(dang)(dang)(dang)政(zheng)主(zhu)(zhu)要(yao)負責(ze)(ze)人履(lv)行推(tui)(tui)(tui)(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)第(di)一(yi)(yi)責(ze)(ze)任人職(zhi)責(ze)(ze)規(gui)定》(中(zhong)辦(ban)(ban)發(fa)〔2016〕71號)要(yao)求(qiu)(qiu),黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)書(shu)(shu)記(ji)直接分(fen)管(guan)政(zheng)策(ce)法(fa)(fa)(fa)(fa)規(gui)工(gong)作(zuo)(zuo),黨(dang)(dang)(dang)政(zheng)主(zhu)(zhu)要(yao)負責(ze)(ze)同(tong)志(zhi)專門研究(jiu)、認真(zhen)謀劃(hua)國(guo)資(zi)國(guo)企(qi)(qi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)年(nian)度工(gong)作(zuo)(zuo)任務,并納入(ru)(ru)《國(guo)資(zi)委(wei)(wei)(wei)(wei)2017年(nian)工(gong)作(zuo)(zuo)要(yao)點》,確保法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)與(yu)其(qi)他(ta)重點工(gong)作(zuo)(zuo)同(tong)部(bu)署(shu)、同(tong)推(tui)(tui)(tui)(tui)進(jin)、同(tong)督(du)促。推(tui)(tui)(tui)(tui)動建(jian)(jian)(jian)(jian)立(li)并帶(dai)頭落(luo)實(shi)(shi)(shi)規(gui)章、規(gui)范性(xing)文件(jian)和(he)重大(da)決策(ce)法(fa)(fa)(fa)(fa)律審核制(zhi)度,依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)依(yi)(yi)(yi)(yi)規(gui)決策(ce)重大(da)事項(xiang)。在中(zhong)央企(qi)(qi)業(ye)(ye)、地(di)方國(guo)資(zi)委(wei)(wei)(wei)(wei)負責(ze)(ze)人會議(yi)上對依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)監管(guan)、依(yi)(yi)(yi)(yi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)企(qi)(qi)作(zuo)(zuo)出(chu)部(bu)署(shu),明確要(yao)求(qiu)(qiu)中(zhong)央企(qi)(qi)業(ye)(ye)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)(黨(dang)(dang)(dang)組(zu))書(shu)(shu)記(ji)、董事長、總(zong)(zong)(zong)經理(li)切(qie)實(shi)(shi)(shi)履(lv)行推(tui)(tui)(tui)(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)第(di)一(yi)(yi)責(ze)(ze)任人職(zhi)責(ze)(ze),層(ceng)層(ceng)壓實(shi)(shi)(shi)主(zhu)(zhu)體責(ze)(ze)任。三是強化(hua)制(zhi)度設(she)(she)計。委(wei)(wei)(wei)(wei)黨(dang)(dang)(dang)委(wei)(wei)(wei)(wei)會、委(wei)(wei)(wei)(wei)主(zhu)(zhu)任辦(ban)(ban)公(gong)會多次(ci)(ci)研究(jiu)討論法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)工(gong)作(zuo)(zuo),先(xian)后制(zhi)定《中(zhong)央企(qi)(qi)業(ye)(ye)主(zhu)(zhu)要(yao)負責(ze)(ze)人履(lv)行推(tui)(tui)(tui)(tui)進(jin)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)第(di)一(yi)(yi)責(ze)(ze)任人職(zhi)責(ze)(ze)規(gui)定》《中(zhong)央企(qi)(qi)業(ye)(ye)境(jing)外投(tou)資(zi)監督(du)管(guan)理(li)辦(ban)(ban)法(fa)(fa)(fa)(fa)》《國(guo)資(zi)委(wei)(wei)(wei)(wei)關于(yu)加強和(he)改進(jin)行政(zheng)應(ying)訴工(gong)作(zuo)(zuo)的(de)實(shi)(shi)(shi)施意見》等文件(jian),為國(guo)資(zi)國(guo)企(qi)(qi)法(fa)(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)(zhi)(zhi)建(jian)(jian)(jian)(jian)設(she)(she)提供制(zhi)度支撐和(he)保障(zhang)。

二、依(yi)法全面履行國有資產監管職責(ze)

一(yi)是研(yan)究(jiu)制訂(ding)國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)以(yi)(yi)管(guan)(guan)(guan)(guan)資(zi)(zi)本為(wei)主推進(jin)(jin)職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an)。認真貫徹(che)國(guo)(guo)(guo)(guo)務(wu)(wu)院關于(yu)深化(hua)(hua)“放管(guan)(guan)(guan)(guan)服(fu)”改(gai)革工作部署,研(yan)究(jiu)起草國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an),經中(zhong)(zhong)央(yang)(yang)全(quan)面(mian)深化(hua)(hua)改(gai)革領(ling)導(dao)小組第三十(shi)次會(hui)議審議通過。2017年4月27日,國(guo)(guo)(guo)(guo)務(wu)(wu)院辦公廳轉(zhuan)(zhuan)(zhuan)(zhuan)發了(le)《國(guo)(guo)(guo)(guo)務(wu)(wu)院國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)以(yi)(yi)管(guan)(guan)(guan)(guan)資(zi)(zi)本為(wei)主推進(jin)(jin)職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an)》(以(yi)(yi)下簡稱《職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an)》),提出(chu)(chu)強化(hua)(hua)3項管(guan)(guan)(guan)(guan)資(zi)(zi)本職(zhi)(zhi)(zhi)能,精(jing)簡43項監(jian)(jian)管(guan)(guan)(guan)(guan)事(shi)項,整(zheng)合三方(fang)面(mian)相關職(zhi)(zhi)(zhi)能。國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)黨委(wei)(wei)第一(yi)時間組織(zhi)中(zhong)(zhong)心組專題學習,研(yan)究(jiu)制定了(le)《貫徹(che)落(luo)(luo)實(shi)〈國(guo)(guo)(guo)(guo)務(wu)(wu)院國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)以(yi)(yi)管(guan)(guan)(guan)(guan)資(zi)(zi)本為(wei)主推進(jin)(jin)職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an)〉重點任(ren)務(wu)(wu)分工方(fang)案(an)(an)(an)(an)》(國(guo)(guo)(guo)(guo)資(zi)(zi)廳法(fa)規〔2017〕586號(hao)),確保(bao)(bao)各項任(ren)務(wu)(wu)措施落(luo)(luo)實(shi)落(luo)(luo)細。二是制定出(chu)(chu)資(zi)(zi)人(ren)(ren)(ren)監(jian)(jian)管(guan)(guan)(guan)(guan)權(quan)力(li)(li)和(he)(he)責(ze)任(ren)清(qing)單。結合國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)《職(zhi)(zhi)(zhi)能轉(zhuan)(zhuan)(zhuan)(zhuan)變(bian)(bian)(bian)方(fang)案(an)(an)(an)(an)》和(he)(he)簡政放權(quan)要求(qiu),研(yan)究(jiu)制定國(guo)(guo)(guo)(guo)務(wu)(wu)院國(guo)(guo)(guo)(guo)資(zi)(zi)委(wei)(wei)出(chu)(chu)資(zi)(zi)人(ren)(ren)(ren)監(jian)(jian)管(guan)(guan)(guan)(guan)權(quan)力(li)(li)和(he)(he)責(ze)任(ren)清(qing)單,依法(fa)厘(li)清(qing)國(guo)(guo)(guo)(guo)資(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)職(zhi)(zhi)(zhi)責(ze)邊界,明確權(quan)責(ze)事(shi)項,規范履職(zhi)(zhi)(zhi)方(fang)式和(he)(he)流程,細化(hua)(hua)追責(ze)情形。三是依法(fa)加(jia)(jia)強國(guo)(guo)(guo)(guo)有資(zi)(zi)產監(jian)(jian)督(du)。健全(quan)完善中(zhong)(zhong)央(yang)(yang)企業境(jing)外(wai)投資(zi)(zi)監(jian)(jian)管(guan)(guan)(guan)(guan)制度,強化(hua)(hua)境(jing)外(wai)重大投資(zi)(zi)項目審核把關,指導(dao)中(zhong)(zhong)央(yang)(yang)企業定期排查(cha)并妥善處置(zhi)境(jing)外(wai)法(fa)律(lv)風險,健全(quan)長效(xiao)工作機制,確保(bao)(bao)境(jing)外(wai)國(guo)(guo)(guo)(guo)有資(zi)(zi)產安全(quan)運(yun)營(ying)和(he)(he)保(bao)(bao)值增值。進(jin)(jin)一(yi)步(bu)(bu)完善財(cai)務(wu)(wu)監(jian)(jian)管(guan)(guan)(guan)(guan),向部分中(zhong)(zhong)央(yang)(yang)企業委(wei)(wei)派總會(hui)計(ji)師,加(jia)(jia)強出(chu)(chu)資(zi)(zi)人(ren)(ren)(ren)對(dui)企業審計(ji)監(jian)(jian)督(du),指導(dao)企業開(kai)展內審工作,督(du)促整(zheng)改(gai)審計(ji)問(wen)題。強化(hua)(hua)監(jian)(jian)事(shi)會(hui)監(jian)(jian)督(du),進(jin)(jin)一(yi)步(bu)(bu)突出(chu)(chu)監(jian)(jian)督(du)重點、深入核查(cha)問(wen)題、強化(hua)(hua)督(du)促整(zheng)改(gai),監(jian)(jian)督(du)的權(quan)威性(xing)、及時性(xing)和(he)(he)有效(xiao)性(xing)明顯增強。

三、完善國資(zi)監管法規(gui)制度體(ti)系

一(yi)(yi)(yi)是做好國(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)(guan)立(li)法(fa)(fa)(fa)(fa)工(gong)作(zuo)(zuo)(zuo)。編(bian)制(zhi)(zhi)(zhi)國(guo)(guo)資(zi)(zi)(zi)委(wei)2017年(nian)立(li)法(fa)(fa)(fa)(fa)工(gong)作(zuo)(zuo)(zuo)計劃,列入立(li)法(fa)(fa)(fa)(fa)項目(mu)23項,優(you)先保(bao)障國(guo)(guo)資(zi)(zi)(zi)國(guo)(guo)企改(gai)革發展急需項目(mu),切實(shi)(shi)提(ti)高計劃的科學(xue)(xue)性(xing)針對(dui)性(xing)。共出臺規(gui)(gui)(gui)章2件(jian)(jian)、規(gui)(gui)(gui)范(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)23件(jian)(jian),包括(kuo)《中(zhong)(zhong)央(yang)企業(ye)功能(neng)界定(ding)分類方案》《關于中(zhong)(zhong)央(yang)企業(ye)降杠桿減(jian)負債的指(zhi)導意(yi)見(jian)》等。加強立(li)法(fa)(fa)(fa)(fa)調研,在文(wen)(wen)件(jian)(jian)起草過程中(zhong)(zhong)充分聽取(qu)中(zhong)(zhong)央(yang)企業(ye)、地方國(guo)(guo)資(zi)(zi)(zi)委(wei)意(yi)見(jian),切實(shi)(shi)提(ti)高文(wen)(wen)件(jian)(jian)質量。截至(zhi)2017年(nian)底,國(guo)(guo)資(zi)(zi)(zi)委(wei)現(xian)行有效規(gui)(gui)(gui)章27件(jian)(jian)、規(gui)(gui)(gui)范(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)227件(jian)(jian),系統(tong)完備(bei)、科學(xue)(xue)有效的國(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)(guan)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)(zhi)度體系進一(yi)(yi)(yi)步形(xing)成。二是持續(xu)開展規(gui)(gui)(gui)章規(gui)(gui)(gui)范(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)清理工(gong)作(zuo)(zuo)(zuo)。堅持立(li)改(gai)廢釋并(bing)舉,結(jie)合國(guo)(guo)資(zi)(zi)(zi)委(wei)職能(neng)轉變方案、國(guo)(guo)務(wu)院“放管(guan)(guan)(guan)服(fu)”改(gai)革和(he)公(gong)平(ping)競爭審(shen)查工(gong)作(zuo)(zuo)(zuo)要(yao)求,對(dui)我委(wei)現(xian)行有效的規(gui)(gui)(gui)章、規(gui)(gui)(gui)范(fan)(fan)性(xing)文(wen)(wen)件(jian)(jian)進行全面清理,重點清理與(yu)上位法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)不(bu)一(yi)(yi)(yi)致、與(yu)以管(guan)(guan)(guan)資(zi)(zi)(zi)本為主加強國(guo)(guo)有資(zi)(zi)(zi)產監(jian)管(guan)(guan)(guan)要(yao)求不(bu)相符、與(yu)法(fa)(fa)(fa)(fa)治化(hua)監(jian)管(guan)(guan)(guan)不(bu)相適應(ying)的文(wen)(wen)件(jian)(jian),共廢止失效32件(jian)(jian)、計劃修(xiu)改(gai)36件(jian)(jian)。三是積極參(can)與(yu)重點國(guo)(guo)家立(li)法(fa)(fa)(fa)(fa)。配合中(zhong)(zhong)央(yang)紀委(wei)開展國(guo)(guo)家監(jian)察法(fa)(fa)(fa)(fa)實(shi)(shi)施問題研究,參(can)與(yu)預算法(fa)(fa)(fa)(fa)實(shi)(shi)施條例(li)、中(zhong)(zhong)央(yang)儲(chu)備(bei)糧管(guan)(guan)(guan)理條例(li)、上市公(gong)司監(jian)督(du)管(guan)(guan)(guan)理條例(li)等重要(yao)法(fa)(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)(fa)規(gui)(gui)(gui)制(zhi)(zhi)(zhi)訂修(xiu)訂工(gong)作(zuo)(zuo)(zuo),積極反映國(guo)(guo)資(zi)(zi)(zi)監(jian)管(guan)(guan)(guan)實(shi)(shi)際和(he)中(zhong)(zhong)央(yang)企業(ye)合理訴求,為企業(ye)改(gai)革發展營造(zao)(zao)良好政策法(fa)(fa)(fa)(fa)律(lv)環境。四是參(can)與(yu)有關國(guo)(guo)際條約和(he)多雙邊協(xie)定(ding)的談(tan)判(pan)(pan)和(he)制(zhi)(zhi)(zhi)定(ding)。積極參(can)加中(zhong)(zhong)美投(tou)資(zi)(zi)(zi)協(xie)定(ding)談(tan)判(pan)(pan)、中(zhong)(zhong)歐投(tou)資(zi)(zi)(zi)協(xie)定(ding)談(tan)判(pan)(pan)、中(zhong)(zhong)加自貿區談(tan)判(pan)(pan)等政府間(jian)涉外談(tan)判(pan)(pan)對(dui)話,努力為企業(ye)開展國(guo)(guo)際化(hua)經營創造(zao)(zao)良好外部環境。

四、推進決策科學(xue)化(hua)、民(min)主化(hua)、法治(zhi)化(hua)

一(yi)是(shi)完善依法(fa)(fa)(fa)(fa)決(jue)(jue)策(ce)程(cheng)序。研(yan)究(jiu)修訂國(guo)(guo)資(zi)(zi)委(wei)工作(zuo)規(gui)則,進(jin)(jin)(jin)一(yi)步對(dui)決(jue)(jue)策(ce)主(zhu)體、決(jue)(jue)策(ce)事項、決(jue)(jue)策(ce)程(cheng)序等進(jin)(jin)(jin)行規(gui)范,明確重大(da)(da)決(jue)(jue)策(ce)應當經委(wei)黨委(wei)會、委(wei)主(zhu)任辦(ban)公(gong)會議討(tao)論決(jue)(jue)定。二是(shi)加強重大(da)(da)決(jue)(jue)策(ce)合法(fa)(fa)(fa)(fa)性(xing)(xing)審(shen)(shen)查(cha)。建(jian)立健(jian)全國(guo)(guo)資(zi)(zi)委(wei)重大(da)(da)決(jue)(jue)策(ce)合法(fa)(fa)(fa)(fa)性(xing)(xing)審(shen)(shen)查(cha)機制,對(dui)中央企業章(zhang)程(cheng)、改制重組(zu)方(fang)案、國(guo)(guo)有(you)資(zi)(zi)本運營等涉及(ji)國(guo)(guo)資(zi)(zi)國(guo)(guo)企改革發展的重大(da)(da)決(jue)(jue)策(ce)事項進(jin)(jin)(jin)行法(fa)(fa)(fa)(fa)律(lv)(lv)論證(zheng)把關(guan)。建(jian)立國(guo)(guo)資(zi)(zi)委(wei)公(gong)平(ping)競爭(zheng)審(shen)(shen)查(cha)機制,對(dui)涉及(ji)的規(gui)章(zhang)規(gui)范性(xing)(xing)文件和政策(ce)措施進(jin)(jin)(jin)行公(gong)平(ping)競爭(zheng)審(shen)(shen)查(cha),確保監管(guan)行為(wei)(wei)依法(fa)(fa)(fa)(fa)合規(gui)。三(san)是(shi)建(jian)立國(guo)(guo)資(zi)(zi)委(wei)公(gong)職律(lv)(lv)師(shi)(shi)和法(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)(wen)制度(du)。經司法(fa)(fa)(fa)(fa)部批(pi)準(zhun),9名(ming)同志(zhi)成為(wei)(wei)國(guo)(guo)資(zi)(zi)委(wei)第一(yi)批(pi)公(gong)職律(lv)(lv)師(shi)(shi),正式聘(pin)任17名(ming)專家學者、知名(ming)律(lv)(lv)師(shi)(shi)為(wei)(wei)外聘(pin)法(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)(wen),充分發揮其咨詢(xun)論證(zheng)、審(shen)(shen)核把關(guan)作(zuo)用。在(zai)《中央企業違(wei)規(gui)經營投資(zi)(zi)責任追究(jiu)實施辦(ban)法(fa)(fa)(fa)(fa)(試行)》等重要規(gui)章(zhang)規(gui)范性(xing)(xing)文件研(yan)究(jiu)起草過程(cheng)中,主(zhu)動征求外聘(pin)法(fa)(fa)(fa)(fa)律(lv)(lv)顧問(wen)(wen)意見。

五、強化對權力的(de)制約和監督

一是健全(quan)(quan)國(guo)(guo)資(zi)監(jian)(jian)管權力運(yun)行(xing)制(zhi)約和(he)監(jian)(jian)督(du)(du)體系。根據監(jian)(jian)管權力和(he)責(ze)任(ren)清單,修訂《國(guo)(guo)資(zi)委(wei)機(ji)關(guan)職責(ze)分解一覽表》,完善(shan)機(ji)關(guan)工(gong)(gong)作(zuo)指導(dao)書和(he)程(cheng)序文件,進(jin)一步(bu)(bu)細化工(gong)(gong)作(zuo)流程(cheng)和(he)責(ze)任(ren)追究。針對(dui)(dui)機(ji)關(guan)工(gong)(gong)作(zuo)人(ren)員與(yu)中(zhong)央(yang)企(qi)業(ye)往來(lai)行(xing)為、中(zhong)介(jie)機(ji)構(gou)服務委(wei)托制(zhi)度、內幕(mu)信(xin)(xin)(xin)息(xi)(xi)管理(li)等(deng)共性廉(lian)潔風險問(wen)(wen)題,開(kai)(kai)(kai)(kai)展(zhan)(zhan)專(zhuan)題調研(yan),研(yan)究起草相關(guan)制(zhi)度規范。制(zhi)定(ding)貫徹落(luo)實(shi)(shi)中(zhong)央(yang)八項規定(ding)精神(shen)進(jin)一步(bu)(bu)加(jia)強(qiang)(qiang)作(zuo)風建設的實(shi)(shi)施(shi)(shi)意見,持之以恒糾(jiu)正“四風”。二是加(jia)強(qiang)(qiang)風險排查和(he)內部(bu)監(jian)(jian)督(du)(du)。認(ren)真(zhen)開(kai)(kai)(kai)(kai)展(zhan)(zhan)廉(lian)潔風險排查工(gong)(gong)作(zuo),制(zhi)定(ding)防控措施(shi)(shi),有(you)(you)效(xiao)堵塞管理(li)漏(lou)洞。切實(shi)(shi)加(jia)強(qiang)(qiang)對(dui)(dui)委(wei)內廳(ting)局和(he)單位在正風反腐(fu)、選人(ren)用人(ren)、源(yuan)頭治理(li)、巡視整(zheng)(zheng)(zheng)(zheng)改(gai)等(deng)方面落(luo)實(shi)(shi)主(zhu)體責(ze)任(ren)情(qing)況(kuang)的監(jian)(jian)督(du)(du)檢查。三是自(zi)覺接受黨(dang)內監(jian)(jian)督(du)(du)和(he)審(shen)(shen)計監(jian)(jian)督(du)(du)。針對(dui)(dui)2016年(nian)中(zhong)央(yang)巡視組對(dui)(dui)國(guo)(guo)資(zi)委(wei)黨(dang)委(wei)反饋的巡視意見,開(kai)(kai)(kai)(kai)展(zhan)(zhan)自(zi)查自(zi)糾(jiu)深(shen)化整(zheng)(zheng)(zheng)(zheng)改(gai)工(gong)(gong)作(zuo),對(dui)(dui)已(yi)制(zhi)定(ding)的整(zheng)(zheng)(zheng)(zheng)改(gai)措施(shi)(shi)落(luo)實(shi)(shi)情(qing)況(kuang)開(kai)(kai)(kai)(kai)展(zhan)(zhan)“回頭看”。配合(he)審(shen)(shen)計署對(dui)(dui)我委(wei)開(kai)(kai)(kai)(kai)展(zhan)(zhan)2016年(nian)預算(suan)執行(xing)等(deng)情(qing)況(kuang)審(shen)(shen)計、穩(wen)增長等(deng)措施(shi)(shi)落(luo)實(shi)(shi)情(qing)況(kuang)跟蹤審(shen)(shen)計以及(ji)相關(guan)專(zhuan)項審(shen)(shen)計,積(ji)極(ji)提供材(cai)料、主(zhu)動說明情(qing)況(kuang)、全(quan)(quan)力整(zheng)(zheng)(zheng)(zheng)改(gai)問(wen)(wen)題,并將整(zheng)(zheng)(zheng)(zheng)改(gai)情(qing)況(kuang)及(ji)時(shi)報告國(guo)(guo)務院。四是全(quan)(quan)面推進(jin)政(zheng)務公(gong)開(kai)(kai)(kai)(kai)和(he)信(xin)(xin)(xin)息(xi)(xi)公(gong)開(kai)(kai)(kai)(kai)。研(yan)究制(zhi)定(ding)《國(guo)(guo)資(zi)委(wei)2017年(nian)政(zheng)務公(gong)開(kai)(kai)(kai)(kai)工(gong)(gong)作(zuo)要點(dian)》,加(jia)大(da)國(guo)(guo)資(zi)監(jian)(jian)管信(xin)(xin)(xin)息(xi)(xi)主(zhu)動公(gong)開(kai)(kai)(kai)(kai)力度,及(ji)時(shi)向社會(hui)公(gong)布國(guo)(guo)有(you)(you)資(zi)產保值(zhi)增值(zhi)總體情(qing)況(kuang)、中(zhong)央(yang)企(qi)業(ye)業(ye)績考核、中(zhong)央(yang)企(qi)業(ye)負(fu)責(ze)人(ren)薪酬及(ji)重(zhong)大(da)人(ren)事任(ren)免事項等(deng)。2017年(nian),國(guo)(guo)資(zi)委(wei)主(zhu)動公(gong)開(kai)(kai)(kai)(kai)信(xin)(xin)(xin)息(xi)(xi)18000余條,收到的信(xin)(xin)(xin)息(xi)(xi)公(gong)開(kai)(kai)(kai)(kai)申請全(quan)(quan)部(bu)予以答復。積(ji)極(ji)推進(jin)中(zhong)央(yang)企(qi)業(ye)信(xin)(xin)(xin)息(xi)(xi)公(gong)開(kai)(kai)(kai)(kai)試點(dian)工(gong)(gong)作(zuo),舉辦中(zhong)央(yang)企(qi)業(ye)信(xin)(xin)(xin)息(xi)(xi)公(gong)開(kai)(kai)(kai)(kai)培訓班,明確工(gong)(gong)作(zuo)要求(qiu),打造“陽(yang)光(guang)央(yang)企(qi)”。

六、依法(fa)有效(xiao)化解(jie)矛盾糾紛

一(yi)是(shi)妥善應(ying)對機關(guan)涉訴(su)案(an)件(jian)。印(yin)發《國資(zi)委關(guan)于(yu)加強和改進(jin)(jin)行政應(ying)訴(su)工作(zuo)的(de)(de)(de)(de)實施(shi)意見》(國資(zi)廳發法(fa)(fa)規(gui)〔2017〕34號(hao)),進(jin)(jin)一(yi)步規(gui)范(fan)(fan)(fan)機關(guan)行政應(ying)訴(su)工作(zuo),有(you)效防(fang)(fang)范(fan)(fan)(fan)機關(guan)法(fa)(fa)律(lv)(lv)風(feng)(feng)險。二是(shi)依法(fa)(fa)推(tui)進(jin)(jin)信(xin)訪(fang)工作(zuo)。按(an)照《關(guan)于(yu)進(jin)(jin)一(yi)步加強信(xin)訪(fang)法(fa)(fa)治化(hua)建設的(de)(de)(de)(de)意見》(中(zhong)辦發〔2017〕51號(hao))要求,依法(fa)(fa)暢通(tong)信(xin)訪(fang)渠道,堅持以法(fa)(fa)律(lv)(lv)標尺化(hua)解矛盾。全面(mian)引(yin)導(dao)來訪(fang)人(ren)員(yuan)依法(fa)(fa)逐級上(shang)訪(fang),推(tui)動訪(fang)訴(su)分離(li),注重(zhong)加強對來訪(fang)人(ren)員(yuan)的(de)(de)(de)(de)政策解釋和宣傳疏導(dao)。三(san)是(shi)加大(da)對中(zhong)央(yang)企(qi)(qi)業防(fang)(fang)范(fan)(fan)(fan)風(feng)(feng)險指(zhi)(zhi)導(dao)力度。指(zhi)(zhi)導(dao)企(qi)(qi)業加強境外(wai)法(fa)(fa)律(lv)(lv)風(feng)(feng)險防(fang)(fang)范(fan)(fan)(fan),印(yin)發《關(guan)于(yu)進(jin)(jin)一(yi)步加強中(zhong)央(yang)企(qi)(qi)業境外(wai)法(fa)(fa)律(lv)(lv)風(feng)(feng)險排查處(chu)置工作(zuo)的(de)(de)(de)(de)通(tong)知》(國資(zi)廳發法(fa)(fa)規(gui)〔2017〕40號(hao)),召開中(zhong)央(yang)企(qi)(qi)業參與“一(yi)帶一(yi)路(lu)”建設法(fa)(fa)律(lv)(lv)保障研(yan)討會,組織編寫并出(chu)版9個國家(jia)的(de)(de)(de)(de)《一(yi)帶一(yi)路(lu)沿線國家(jia)法(fa)(fa)律(lv)(lv)風(feng)(feng)險防(fang)(fang)范(fan)(fan)(fan)指(zhi)(zhi)引(yin)》。建立法(fa)(fa)律(lv)(lv)風(feng)(feng)險提示(shi)(shi)報告制度,針對國際網絡電信(xin)詐(zha)騙、融(rong)資(zi)性貿(mao)易案(an)件(jian)處(chu)理、國有(you)股權代持等共性法(fa)(fa)律(lv)(lv)風(feng)(feng)險發出(chu)提示(shi)(shi)函7份,督促企(qi)(qi)業及(ji)(ji)早(zao)防(fang)(fang)范(fan)(fan)(fan)、妥善應(ying)對。四是(shi)指(zhi)(zhi)導(dao)協調(diao)中(zhong)央(yang)企(qi)(qi)業重(zhong)大(da)法(fa)(fa)律(lv)(lv)糾紛(fen)案(an)件(jian)。制定印(yin)發《關(guan)于(yu)進(jin)(jin)一(yi)步加強中(zhong)央(yang)企(qi)(qi)業法(fa)(fa)律(lv)(lv)糾紛(fen)案(an)件(jian)管理工作(zuo)的(de)(de)(de)(de)通(tong)知》(國資(zi)發法(fa)(fa)規(gui)〔2017〕210號(hao)),促進(jin)(jin)企(qi)(qi)業依法(fa)(fa)妥善解決(jue)矛盾糾紛(fen),及(ji)(ji)時化(hua)解社會不穩(wen)定因素。

七、加強法治宣傳教育

一是(shi)積極(ji)開展法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)宣傳(chuan)。落實“七五”普法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)劃,通過國(guo)資(zi)(zi)監管(guan)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設(she)網、簡報(bao)、微信群和(he)公眾號等(deng)多種(zhong)途徑,加(jia)(jia)強(qiang)國(guo)資(zi)(zi)監管(guan)法(fa)(fa)(fa)(fa)(fa)規(gui)(gui)制度的宣傳(chuan),及時向(xiang)社(she)會公開國(guo)資(zi)(zi)委(wei)規(gui)(gui)章規(gui)(gui)范(fan)性(xing)文件(jian)、強(qiang)化(hua)政策(ce)(ce)解讀(du)。結合(he)黨的十九大精(jing)神的學(xue)(xue)習(xi)宣傳(chuan),組(zu)織(zhi)開展“12·4”國(guo)家憲(xian)法(fa)(fa)(fa)(fa)(fa)日系(xi)列(lie)宣傳(chuan)活動。組(zu)織(zhi)各廳(ting)局代表到北(bei)京市一中(zhong)(zhong)(zhong)院旁聽行政訴訟案(an)(an)(an)件(jian)庭審(shen),提(ti)升機(ji)關干部(bu)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)素養。開展中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設(she)主(zhu)題宣傳(chuan)活動,專門邀請(qing)(qing)新華社(she)、中(zhong)(zhong)(zhong)央(yang)(yang)電視臺等(deng)媒體對(dui)11家企業(ye)(ye)(ye)進(jin)行采訪并(bing)發表33篇報(bao)道,集(ji)中(zhong)(zhong)(zhong)展示中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設(she)成果。二是(shi)切實加(jia)(jia)強(qiang)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)培(pei)訓。舉(ju)辦(ban)國(guo)資(zi)(zi)委(wei)機(ji)關法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設(she)專題培(pei)訓班(ban),邀請(qing)(qing)學(xue)(xue)者、法(fa)(fa)(fa)(fa)(fa)官(guan)為機(ji)關干部(bu)講授民法(fa)(fa)(fa)(fa)(fa)總則、行政訴訟法(fa)(fa)(fa)(fa)(fa)和(he)典型案(an)(an)(an)例(li)。全年組(zu)織(zhi)6期(qi)“法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)講堂”,邀請(qing)(qing)知名專家學(xue)(xue)者進(jin)行視頻授課,國(guo)資(zi)(zi)委(wei)系(xi)統每(mei)期(qi)參(can)加(jia)(jia)人(ren)員(yuan)1萬多人(ren)。做(zuo)好政策(ce)(ce)宣講解讀(du),派(pai)員(yuan)參(can)加(jia)(jia)各中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)工(gong)作會議、為企業(ye)(ye)(ye)黨委(wei)(黨組(zu))中(zhong)(zhong)(zhong)心組(zu)專題學(xue)(xue)法(fa)(fa)(fa)(fa)(fa)授課80余次。舉(ju)辦(ban)為期(qi)一個月的首屆中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)高級法(fa)(fa)(fa)(fa)(fa)律(lv)管(guan)理(li)人(ren)員(yuan)履職能(neng)力(li)(li)培(pei)訓班(ban),60多名學(xue)(xue)員(yuan)集(ji)中(zhong)(zhong)(zhong)參(can)加(jia)(jia)學(xue)(xue)習(xi),取得(de)良好效果。三是(shi)有力(li)(li)促(cu)進(jin)共(gong)享交流。相繼建立了中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)涉外、金融法(fa)(fa)(fa)(fa)(fa)律(lv)人(ren)才庫(ku)(ku),入庫(ku)(ku)專家193人(ren),更好發揮優(you)秀(xiu)人(ren)才作用。健全完善中(zhong)(zhong)(zhong)央(yang)(yang)企業(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)(zhi)建設(she)優(you)秀(xiu)案(an)(an)(an)例(li)庫(ku)(ku),下(xia)發第三批(pi)優(you)選案(an)(an)(an)例(li)50個。建立法(fa)(fa)(fa)(fa)(fa)律(lv)服務機(ji)構(gou)信息庫(ku)(ku),為企業(ye)(ye)(ye)選聘律(lv)師提(ti)供(gong)參(can)考。組(zu)織(zhi)企業(ye)(ye)(ye)共(gong)同開展合(he)規(gui)(gui)管(guan)理(li)、融資(zi)(zi)性(xing)貿易法(fa)(fa)(fa)(fa)(fa)律(lv)風險防范(fan)等(deng)重點課題研究。

八、促進(jin)中央企業提高依(yi)法治(zhi)企水平

一(yi)(yi)是強(qiang)(qiang)化(hua)組(zu)織推(tui)動(dong)(dong)。召開中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)工(gong)(gong)作(zuo)(zuo)會,對(dui)2017年(nian)法(fa)(fa)(fa)(fa)(fa)治(zhi)央(yang)企(qi)(qi)(qi)(qi)(qi)建(jian)設(she)(she)(she)(she)作(zuo)(zuo)出(chu)部署安排。加強(qiang)(qiang)法(fa)(fa)(fa)(fa)(fa)治(zhi)央(yang)企(qi)(qi)(qi)(qi)(qi)建(jian)設(she)(she)(she)(she)進(jin)(jin)展(zhan)情況的通(tong)報,對(dui)重(zhong)點指(zhi)(zhi)標(biao)進(jin)(jin)行(xing)統計(ji)分(fen)(fen)析,每半(ban)年(nian)通(tong)報一(yi)(yi)次,促進(jin)(jin)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)查找差(cha)距、對(dui)標(biao)提(ti)升(sheng)。指(zhi)(zhi)導各中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)普遍建(jian)立了法(fa)(fa)(fa)(fa)(fa)治(zhi)建(jian)設(she)(she)(she)(she)領(ling)導機(ji)構(gou),并制(zhi)(zhi)(zhi)定(ding)主(zhu)要(yao)負責(ze)人(ren)履行(xing)推(tui)進(jin)(jin)法(fa)(fa)(fa)(fa)(fa)治(zhi)建(jian)設(she)(she)(she)(she)第一(yi)(yi)責(ze)任人(ren)職責(ze)實(shi)施辦法(fa)(fa)(fa)(fa)(fa)。推(tui)動(dong)(dong)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)治(zhi)工(gong)(gong)作(zuo)(zuo)重(zhong)點要(yao)求進(jin)(jin)章程,強(qiang)(qiang)化(hua)法(fa)(fa)(fa)(fa)(fa)治(zhi)建(jian)設(she)(she)(she)(she)的制(zhi)(zhi)(zhi)度(du)保(bao)障。二是強(qiang)(qiang)化(hua)重(zhong)點領(ling)域指(zhi)(zhi)導。通(tong)過分(fen)(fen)行(xing)業(ye)(ye)(ye)(ye)、分(fen)(fen)區域組(zu)織座談(tan)會、研(yan)討會、專題調研(yan)等(deng)活動(dong)(dong),有(you)針對(dui)性的督促指(zhi)(zhi)導企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)依(yi)法(fa)(fa)(fa)(fa)(fa)治(zhi)理、依(yi)法(fa)(fa)(fa)(fa)(fa)開展(zhan)經(jing)營活動(dong)(dong)。探(tan)索(suo)推(tui)進(jin)(jin)合(he)規(gui)管(guan)理,在5家(jia)中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)開展(zhan)試點基礎上,啟動(dong)(dong)《中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)合(he)規(gui)管(guan)理指(zhi)(zhi)引》研(yan)究起草(cao)工(gong)(gong)作(zuo)(zuo),為(wei)全(quan)面(mian)推(tui)進(jin)(jin)合(he)規(gui)管(guan)理奠定(ding)基礎。指(zhi)(zhi)導企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)在法(fa)(fa)(fa)(fa)(fa)治(zhi)軌道上有(you)序推(tui)進(jin)(jin)混合(he)所有(you)制(zhi)(zhi)(zhi)經(jing)濟(ji)、公(gong)(gong)司(si)制(zhi)(zhi)(zhi)改制(zhi)(zhi)(zhi)、完善(shan)現代企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)制(zhi)(zhi)(zhi)度(du)、處僵治(zhi)困等(deng)重(zhong)點改革發(fa)展(zhan)任務(wu),更好服務(wu)和保(bao)障企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)持續(xu)(xu)健(jian)康(kang)發(fa)展(zhan)。三是強(qiang)(qiang)化(hua)法(fa)(fa)(fa)(fa)(fa)治(zhi)隊伍建(jian)設(she)(she)(she)(she)。推(tui)動(dong)(dong)中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)集團公(gong)(gong)司(si)健(jian)全(quan)完善(shan)總法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問制(zhi)(zhi)(zhi)度(du)。持續(xu)(xu)推(tui)進(jin)(jin)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)事務(wu)機(ji)構(gou)建(jian)設(she)(she)(she)(she),優化(hua)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)事務(wu)機(ji)構(gou)職能配置,推(tui)動(dong)(dong)中(zhong)(zhong)央(yang)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)將法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)事務(wu)機(ji)構(gou)由內設(she)(she)(she)(she)處室升(sheng)級為(wei)一(yi)(yi)級部門或(huo)由合(he)署辦公(gong)(gong)調整(zheng)為(wei)獨(du)立設(she)(she)(she)(she)置。積極開展(zhan)企(qi)(qi)(qi)(qi)(qi)業(ye)(ye)(ye)(ye)法(fa)(fa)(fa)(fa)(fa)律(lv)(lv)顧(gu)問職業(ye)(ye)(ye)(ye)崗位等(deng)級資格評審,進(jin)(jin)一(yi)(yi)步夯實(shi)依(yi)法(fa)(fa)(fa)(fa)(fa)治(zhi)企(qi)(qi)(qi)(qi)(qi)的隊伍基礎。

黨的(de)(de)(de)十(shi)九(jiu)大(da)把堅(jian)持全(quan)面(mian)依(yi)法(fa)治國(guo)(guo)確立為新時代堅(jian)持和(he)發展中國(guo)(guo)特色社會(hui)主義(yi)的(de)(de)(de)十(shi)四(si)條基本方略之一,對深化依(yi)法(fa)治國(guo)(guo)實(shi)踐(jian)作出(chu)全(quan)面(mian)部(bu)署(shu)。黨的(de)(de)(de)十(shi)九(jiu)屆二(er)中全(quan)會(hui)提出(chu)了修改憲法(fa)部(bu)分內(nei)容的(de)(de)(de)建(jian)議(yi),第十(shi)三屆全(quan)國(guo)(guo)人大(da)一次(ci)會(hui)議(yi)審議(yi)通過了憲法(fa)修正案,必將(jiang)對法(fa)治政府建(jian)設提出(chu)更高要求。下一步,我們將(jiang)以(yi)習近(jin)平新時代中國(guo)(guo)特色社會(hui)主義(yi)思想(xiang)為指導(dao),深入貫徹黨的(de)(de)(de)十(shi)九(jiu)大(da)和(he)十(shi)九(jiu)屆二(er)中、三中全(quan)會(hui)關于依(yi)法(fa)治國(guo)(guo)的(de)(de)(de)決策部(bu)署(shu),嚴格落實(shi)憲法(fa)法(fa)律規定,按照(zhao)《綱(gang)要》要求,緊緊圍繞國(guo)(guo)資(zi)國(guo)(guo)企(qi)改革發展中心任務,進一步健全(quan)國(guo)(guo)資(zi)監(jian)管制(zhi)度,強(qiang)化任務措施督促檢(jian)查,完(wan)善經(jing)營性(xing)國(guo)(guo)有資(zi)產集中統(tong)一監(jian)管機制(zhi),著(zhu)力(li)(li)打造國(guo)(guo)資(zi)監(jian)管法(fa)治機構和(he)法(fa)治央(yang)企(qi),為實(shi)現國(guo)(guo)有資(zi)產保值增值、國(guo)(guo)有資(zi)本做強(qiang)做優做大(da)、打造具有全(quan)球競爭力(li)(li)的(de)(de)(de)世(shi)界(jie)一流企(qi)業(ye)提供有力(li)(li)法(fa)治保障(zhang)。
